Plat Dedication
The property owners within this plat shall be held responsible for keeping open
and maintaining the surface path of natural or man-made drainage flow over and
across their respective properties. If the property owner(s) fails to maintain the
surface path of natural or man-made drainage flow, or the drainage swale, a
notice of such failure may be given to the property owner(s). If not corrected
within the period indicated on said notice, Spokane County has the right to
correct the maintenance failure, or have it corrected, at the expense of the
property owner.
Any building that is constructed on a lot in this plat shall be set at such an
elevation so as to provide positive drainage away from any drainage entry point
to the building (including but not limited to a window well, a window unprotected
by a window well, or a doorway). Said positive drainage shall consist of a
minimum slope of 3% away from the building for a distance of at least 10 feet
from the building. The lots shall be graded so that either a) all runoff is routed
away from the building, and conveyed over the lot to a natural drainage swale or
approved drainage facility, or b) drainage intercepted on the lot is disposed of on
the lot in an approved drainage facility. The approved drainage facility shall be
constructed in accordance with any applicable accepted plans on file at the
County Engineer's Office. Any revisions to the accepted drainage plans must be
accepted by the County Engineer's Office prior to construction of said revisions.
Spokane County does not accept the responsibility of maintaining the drainage
course on private lots or floodplain areas within private lots, nor the responsibility
for any damage whatsoever, including, but not limited to, inverse condemnation to
any properties due to deficient construction and/or maintenance of drainage
courses in drainage easements on private property.
The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be
fixed through public hearings for service or benefit obtained by the planning,
design, constructing, maintaining or operation of stormwater control facilities.
The property owners within this plat shall maintain all grassed percolation areas
("208" swales) and drainage facilities situated on their respective properties with a
permanent ground cover that they are legally required to maintain. No structures,
including fences, shall be constructed directly over or within the grassed
percolation areas without the expressed written consent of the Spokane County
Engineer. Spokane County does not accept the responsibility to inspect and/or
maintain the drainage easements or drainage swales, nor does Spokane County
accept any liability for any failure by the lot owner(s) to properly maintain such
areas.

IN THE MATTER OF SPRAGUE AVENUE, RF NO. 2312"D", KNOW ALL MEN BY
THESE PRESENTS, for and in consideration of Mutual Benefits, Randy Mitchell as the property
owner, and Spokane County, a political subdivision of the State of Washington, do hereby agree
to the following: .
Spokane County will construct the drainage facilities and install grass sod, or dryland grasses as
applicable, in the "208" drainage area located between the property boundary and the back of the
proposed sidewalk, and install irrigation systems, as required for sod areas, to adequately water
alI landscaping within the "208" drainage collection area, described as follows:

The North 20.00 feet of the South 45.00 feet of the East 64.00 feet of the East
Half of Tract 16 of VERA, as per plat thereof recorded in Volume "O" of Plats,
Page 30, Spokane County, Washington; -
EXCEPT ROADS.
Located in the Southeast Quarter (SE '/4) of Section 13, Township 25 North,
Range 44 East, W.M., Spokane County, Washington cpq~ , .
This instrument is given as a Correction Drainage Maintenance Agreement to correct an
erroneous description contained in that certain Drainage Maintenance Agreement executed by the
Grantor herein which was filed for record as Document No. 4196271, thereof and shall hereby
render same null and void.

IN THE MATTER OF SPRAGUE AVENUE, ROAD FILE NO. 2312"D", KNOW ALL MEN BY
THESE PRESENTS, that the Grantor, Randy Mitcliell of the County of Spokane, State of Wasliington,
for and in consideration of Mutual Benefits, the receipt of which is hereby acknowledged, grant(s) to
Spokane County, a potitical subdivision of the State of Washington, a Drainage Easement over, under,
upon and across the following described real property situated in the County of Spokane, State of
Washington:
AFFECTS ASSESSORS PARCEL NO.: 45134.1773
The North 20.00 feet of the South 45.40 feet of the East 64.00 feet of the East Half of
, Tract 16 of VERA, as per plat thereof recorded in Volume "O" of Plats, Page 30,
Spokane County, Washington;
EXCEPT ROADS.
Located in the Southeast Quarter (SE of Section 13, Township 25 North, Range 44
East, W.M., Spokane County, Washington
This instrument is given as a Correction Drainage Easement to correct an erroneous description
contained in that certain Urainage Easement executed by the Grantor herein which was filed for record as
Document No. 4197656, thereof and shall hereby render same null and void.
The Drainage Easement- granted to Spokane County and its authorized agents is for the sole purpose of
allowing the flow of natural drainage andlor runoff from manmade facilities across and over the lands
described above, and for the disposal of natural drainage and/or runoff from manmade facilities in public
rights of way upon the lands described above.
Spokane County and its authorized agents are hereby granted the right of ingress and egress to, over and
from said Easement for the purpose of inspection and emergency maintenance of water quality treatment
swales ("208" swales) and other drainage facilities, if not properly maintained by the Grantor(s), or their
successors in interest. Spokane County does not accept the responsibility to inspect or maintain the
Drainage Easements or drainage swales, except for the drywell located as described above, nor does
Spokane County accept any liability for any failure by the Grantor(s), or their successors in interest, to
properly maintain such areas. Spokane County accepts complete and total responsibility for the
construction and perpetuai maintenance of the drywell located as described above.
