SITE PLAN, BSP-75-00 ) CONCLUSIONS AND
) DECISION
THIS MAT'TER, an application to divide industrial land from Hanson Industries has been received and
was decided upon, pursuant to Spokane County Subdivision regulations, on the lst Day of November,
2000.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering the
decision by the Director of Spokane County Division of Planning.
2. The proposal is to divide approximately 8.44 acres into 4 lots for commercial uses.
3. The Binding Site Plan Chapter of the Spokane County Subdivision Ordinance allows any number
of parcels to be recorded over time, individually or in groups; provided each parcel and the
proposed, use can meet the minimum development standards of Spokane County Zoning Code.
Specific parcels can be recorded at different times, but must be recorded prior to sale, lease or
transfer of the particular parcel.
4. The proposal is generally located at the northwest corner of the intersection of Sull ivan Road and
Indiana Avenue in the SE '/a of Section 11, Township 25 N., Range 44 EWM, Spokane County,
Washington. The subject property is identified by Spokane County Ta1c Assessors parcel numbers
45116.0207 and 45116.0208.
5. The existing zoning of the property described in the application is Regional Business (B-3)
established in 1991, previously classified as Commercial (C) in 1978 (ZE-180-78), and General
Agricultural (A) established in 1991, previously classified as Agricultural (A) in 1957 (ZE-225-
57). The area of the site that is currently zoned as General Agricultural (GA) consists of a strip of
property located along the northeasterly boundary of the site. Commercial uses are not allowed in
the General Agricultural (GA) zone. The Division of Planning will require the property located
within the General Agricultural (GA) zone to be maintained in its natural state as a nonbuildable
area. Pursuant to 58.17.195 the proposal does conform to the requirements of the existing
Regional Business (B-3) and General Agricultural (GA) zones, as conditioned.
6. Section 14.628.315 of the Spokane County Zoning Code requires that that any building site within
the Regional Business (B-3) zone shall have frontage on a public street or road of Principal
Arterial or higher classification sufficient for proper ingress or egress as determined by the County
Engineer. The subject property does have existing frontage on Sullivan Road, which is designated
as a Principal Arterial by the Spokane County Arterial Road Plan. However, access to the site
from Sullivan Road is prohibited by the Spokane County Division of Roads and the Washington
State Department of Transportation. The Spokane County Planning Director, in a letter dated
October 31, 2000, has recognized that Indiana Avenue, a Minor Arterial located south of and
adjacent to the site, is developed to Principal Arterial standards as outlined within Section 20 of the
Spokane County Comprehensive Plan and can serve to satisfy the requirements of Section
14.628.315.
7. The Spokane County Comprehensive Plan designates the subject property as Industrial (I). The
development and uses, as proposed, are compatible with the Industrial category. The subject
property is also located within the Interim Urban Growth Area-(IUGA) as adopted by
.

8. The proposed site is located within the Public Transportation Benefit Area (PTBA) of Spokane
County. The nearest connecting services are available along Indiana Avenue, located south of and
- adjacent to the site.
9. The Spokane County Arterial Road Plan identifies Sullivan Road as a Principal Arterial with a
, planned right of way width of 100 feet. The existing right of way width of 80 feet is not consistent
with that specified in the plan. The Spokane County Division of Engineering and Roads
recommend that a strip of property 10 feet in width along Sullivan Road be set aside as Future
Acquisition Area (FAA). No direct access will be allowed from the proposed lots to Sullivan
Road. As conditioned, the proposal conforms to the Arterial Road Plan.
10. A portion of the subject property is located within 200 feet of the shoreline of the Spokane River
which is identified as a Shoreline of Statewide Significance. The Spokane County Shoreline
Program designates the adjacent shoreline management area as Pastoral (P) The Pastoral (P)
designation prohibits any commercial development within 200 feet of the Ordinary High Water
Mark (OHWM) of the Spokane River. 11. The subject property is located near the Spokane River which is recognized as a Type I stream by
the Spokane County Critical Areas Ordinance. Section 11.20.060(C.2.e.) of the Spokane County
. Critical Areas Ordinance reyuires a riparian buffer area of 250 feet from the Ordinary High Water
Mark (OHW1V) along Type I streams. A 25% reduction of the required riparian buffer for the
proposed lots was previously requested through the use of `buffer averaging' and granted by the
Division of Planning (see file #'s CAR-14-99 and CAR-16-99).
12. The Washington State Department of Transportation has commented on the approach for parcel #4
as illustrated on the binding site plan of record, and will not allow the proposed approach at this
location since it is within the Department's limited access area for the Sullivan Road / I-90
Interchange.
13. The required public notice was provided for this proposal and agencies having a potential interest
in the project were notified and recommendations solicited. No written comments were received
from any adjoining property owners regarding this proposal.
14. An Environmental Checklist was submitted by the sponsor and was reviewed by the Spokane
County Division of Planning. The review considered specifics of the proposal, other available
information, County Ordinances, other regulations and laws, possible standard Conditions of
Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The
Planning Division has determined that "No probable significant adverse impacts" would result
from the proposal being developed and issued a Determination of Nonsignificance ("DNS") on
September 7, 2000. .
The "DNS" was circulated to ten (10) agencies of jurisdiction affected by this proposal for review
and comments. The "DNS" was advertised in the newspaper to the public 15 calendar days before
the comment period ended on September 21, 2000. No written comments were received regarding
this determination.
15. In conjunction with the conditions of approval and Spokane County development standards, the
proposed binding site plan is not detrimental to the public health, safety and general welfare.
Moreover, this proposal implements the underlying zoning and complies with the provisions of
Chapter 12.500 (Binding Site Plans) of the Spokane County Subdivision Ordinance.
DECISION Based upon the above Findings of Fact and Conclusions, BindingLt-P1an;Applfcation BSP-75-00 is
hereby APPROVED for five (5) years, specifically until and subject to the
conditions noted below. This decision is final unless appealed in writing, consistent with adopted appeal
procedures.

CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include the
owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposal shall comply with the Regional Business (B-3) and General Agricultural (GA) zones,
and other applicable Zoning Code chapters, as amended.
2. The relimina Binding Site Plan was given conditional approval for five (5) years, specifically to
Mapplicant may submit an extension of time application no later than thirty
(3U) days prior to the above expiration date. Application(s) for extension of time shall be
processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County
. Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the
preliminary approval and conditions will be changed to reflect the adopted policy and development
regulations at the time of the extension application.
3. Prior to recording the final binding site plan, the applicant shall submit to the Planning
Director/designee for review any proposed final binding site plan to ensure compliance with these
Findings and Conditions of Approval.
4. The initial overall fmal binding site plan shall be designed substantially in conformance with the
"Preliminary Binding Site Plan of Record." The initial recording of this final binding site plan
shall show, at a minimum, the perimeter boundary of the total site and any specific intemal parcels
that can comply with the development standards at that time.
5. Any subsequent divisions of land within the recorded original final binding site plan shall be
reviewed by the Planning Director/designee. The number of parcels proposed will be determined
by the development standards, such as the Zoning Code and shall be flexible within the terms of
the original fmal binding site plan's conditions of approval. After the Division of Planning has
reviewed the specifc parcel(s) and determined their compliance with all applicable regulations and
provisions of the origmal final binding site plan, an "Amendment to the Final Binding Site Plan by
Survey" may be recorded with the Spokane County Auditor. .
6. A survey is required of the subject property prior to recording the final binding site plan.
7. Appropriate road name(s) and street address for each parcel shall be indicated on the-final binding
site plan map.
8. Appropriate utility easements shall be indicated on the final binding site plan map. Approval of
utility easements by utility companies must be received prior to recording the final binding site
plan.
9. The final binding site plan dedication shall contain the following statement: "'Mj and rear
• yard setbacks shall be determined at the time building permits are requested".
10. Four (4) current certificates of title shall be furnished to the County Division of Planning prior to
recording the final binding site plan.
11. The portion of the subject site currently zoned as General Agricultural (GA) will be set aside as a
nonbuildable area to be maintained in its natural state.

12. A specific and detailed Site Development Plan will be submitted to the Division of Planning for
review and approval prior to issuance of a building permit, Change of Use Permit or Certificate of
Occupancy. 13. The Spokane County Division of Planning shall prepare and record with the County Auditor a Title
Notice stating that the subject property is subject to a variety of special conditions imposed as a
result of approval of a land use action. This Title Notice shall contain the following statement:
"All applicable Conditions of Approval for Spokane County Zone Change ZE-180-78, Conditions
of Approval for PE-1504-85, and all mitigating measures associated with ZE-180-78 and PE-1504-
85 shall apply to this Final Binding Site Plan."
14. The Spokane County Division of Planning shall prepare and record with the County Auditor a Title
Notice specifying a future land use acquisition area for road right-of-way and utilities. The Title
Notice shall state the following:
a. A strip of property 10 feet in width from the existing right-of-way is reserved for future
acquisition area for additional road right-of-way width along Sullivan Road.
b. Future building and other setbacks required by the Spokane County Zoning Code shall be
measured from the reserved future acquisition area.
c. No required landscaping, parking, `208' areas, drainfield or allowed signs should be located
within the future acquisition area for road right-of-way and utilities. If any of the above
improvements are within the area, they shall be relocated at the applicant's expense when
roadway improvements are made.
d. The future acquisition area, unit acquired, shall be private property and may be used as
allowed in the zone, except that any improvements (such as landscaping, parking, surface
drainage, drainfield, signs or others) shall be considered interim uses.
e. The property owner shall be responsible for relocating such "interim" improvements at the
time Spokane County makes roadway improvements after acquiring said future acquisition.
15. The Ordinary High Water Mark (OWHM), the 200 foot Shoreline Management Act jurisdiction
boun ,ary line, and the 100 and 50 foot horizontal shoreline setback lines from the OHWM shall be
illu ated on the final binding site plan, if applicable.
16. T final binding site plan dedication shall contain the following statement: "At the time of final
a roval of the binding site plan, this property fell under the jurisdiction of the Washington State
reline Management Act (RCW 90.58) and the Spokane County Shoreline Program (WAC 173-

0). Any development of this property shall only proceed in strict compliance with the
horeline regulations in effect at the time of permit issuance.
17. 1'he final binding site plan shall illustrate the required Riparian Buffer Area as is exists due to the
approval of buffer averaging. The final binding site plan shall comply with the Spokane County
Critical Areas Ordinance, as amended.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS •
1. The Applicant/Developer shall comply with the Engineering Conditions of Approval for Spokane
. County Zone Changer ZE-180-78 and the Engineering Conditions of Approval of PE-1504-85.
Additionally, all environmental documents included with the aforementioned Zone Change ZE-
180-78 and PE-1504-85 shall be applicable to this Binding Site Plan.
2. Drainage language will be drafted by Spokane County and provided to the Sponsor's Engineer or
Surveyor for inclusion in the dedication language of the final binding site plan.
3. Prior to the release of a building permit, a Professional Engineer, licensed in the State of '
Washington, shall submit drainage plans and a drainage report and calculations that conform to
Stormwater design/management in Spokane County. Drainage plans and a drainage report shall
receive the County Engineer's acceptance prior to release of the building permit.

4. tatement shall be placed in language of the Binding Site Plan that no direct access shall be
#1Cwed from lots to Sullivan Road.
5. This proposed Binding Site Plan or development proposal is located within a drainage basin which
, has been identified by the Spokane County Engineer's and Utitities offices as having stormwater
runoff problems. Since this proposed Binding Site Plan or development proposal is affected by or
is a contributor to stormwater flows, properly owners should participate in the planning and
implementation of a future basinwide stormwater management system. Tl1e following statement
shall be placed in the dedicatory language of the final Binding Site Plan:
` e owner(s) or successor(s) in interest agree to join in any County-approved stormwater
nagement program and to pay such rates and charges as may be fixed through public hearings
service or benefit obtained by the planning, design, constructing, maintaining or operation of

6. Approach permits are required for any access to the Spokane County road system.
7. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way
,per Spokane County Standards.

construction work is to be performed within the existing or proposed Public Right-of-way until
plans have been accepted by the County Engineer and a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County Engineer.
10. 'I`he proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads,
V, roaches, drainage and fees in new construcrion.
1. e County Arterial Road Plan identifies Sullivan Road as a 100 foot Principal Arterial. The ! xisting right of way width of 80 feet is not consistent with that specified in the Plan. In order to
implement the Arterial Road Plan it is recommended that, a strip of property 10 feet in width along
the Sullivan Road frontage be set aside in reserve. This properly may be acquired by Spokane
County at the time when Arterial improvements are made to Sullivan Road.
12. The applicant should be advised that there may exist utilities either underground or overhead
affecting the applicants property, including property to be dedicated or set aside for future
acquisition. Spokane County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the applicable utilities and Spokane
County Engineer to determine whether the applicant or utility is responsible for adjustment or
~ relocation costs and to make arrangements for any necessary work.
13. Before finalization of the binding site plan, the existing easement agreement for the handling and
maintenance of stormwater swales and stormwater collection systems for stormwater will need to
'be revised to handle the proposed tracts and any additional easements that may be required must be
dedicated on the plat or handled though the revised easement agreement. If stormwater
improvements and/or easements will be required for the proper stormwater servicing of the new
parcels, a stormwater plan shall be submitted for review and acceptance prior to finalization of the
Binding Site Plan. The Binding Site Plan shall meet the requirements of the most recent version of
the Spokane County Guidelines for Stormwater Management and Spokane Count)► Standards for
Road and Sewer Construction.
SPOX:ANE COUNTY DIVISION OF UTILITIES
1. 000rdedication shall state: Public sewers shall be constructed to provide for the connection of each

3. he dedication shall state: Individual tracts shall be subject to payment of current applicable sewer
connection charges and/or general facilities charges prior to the issuance of a sewer connection
permit.
4. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover",
only those plan sheets showing sewer plans and specifications for,the public sewer connections and
facilities for review and approval. Commercial developments shall submit historical and or
estimated water usage as part of the sewer plan submittal.
5. Sewer plans acceptable to the Division Utilities shall be submitted prior to the finalization of the
project. .
6. Any water service for this project shall be provided in accordance with the Coordinated Water
System Plan for Spokane County, as amended. SPOKANE REGIONAL HEALTH DISTRICT
1. The final binding site plan (BSP) shall be designed as indicated on the preliminary plat of record
and/or any attached sheets as noted.
2. Sewage disposal method shall be as authorized by the Director of the Spokane County Division of
Utilities.
3. Water service shall be coordinated through the Spokane County Division of Utilities.
4. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
5. Prior to recording the final binding site plan, the applicant shall demonstrate to the satisfaction of
the Spokane Regional Health District that an adequate and potable water supply is available to
each tract of the plat.
6. Prior to recording the final binding site plan, the applicant shall present evidence that the plat lies
within the recorded service area of the water system proposed to serve the plat.
7. A plan for water facilities adequate for domestic use, domestic irrigation' use and fire protection
use shall be approved by the water purveyor. Said water plan must have been approved by the fire
protection distxict and the appropriate health authorities. The health authorities, water supplier
(purveyor) and the fire protection district will certify, prior to recording the final binding site plan,
on the face of said water plan that the plan is in conformance with their requirements and will
adequately satisfy their respective needs. Said water plan and certification will be drafted on a
transparency suitable for reproduction.
8. The purveyor will also certify prior to recording the final binding site plan on a copy of said water
plan that appropriate contractual arrangements have been made with the plat applicant for
construction of the water system, in accordance with the approved plan and time schedule. The
time schedule will provide, in any case, for completion of the water system and inspection by the
appropriate health authorities pnor to application for building permits within the plat. The
contractual arrangements will include a provision holding Spokane County, Spokane Regional
Health District and the purveyor harmless from claims by any tract purchaser refused a building
permit due to failure of the plat applicant to satisfactorily complete the approved water system.

9. A public sewer system will be made available for the BSP, and individual service will be provided
to each tract prior to sale. Use of individual on-site sewage disposal systems shall not be
authorized.
10. The final binding site plan shall contain the following statement: "A public sewer system will be
made avai ble~for the plat, and individual service will be provided to each tract prior to sale. Use

this 'ding site plan, and the applicant shall provide for individual domestic water service as well

The Spokane County Engineering Department has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for
inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be approved.
Prior to release of a building permit or use of property as proposed:
1. The ApplicanUDeveloper shall comply with the Engineering Conditions of Approval for Spokane
County Zone Change ZE 180-78 and the Engineering Conditions of Approval of PE 1504-85.
Additionally, all environmental documents included with the aforementioned Zone Change ZE
180-78 and PE 1504-85 shall be applicable to this Binding Site Plan.
2. Drainage language will be drafted by Spokane County and provided to the Sponsor's Engineer
or Surveyor for inclusion in the dedication language of the final binding site plan.
3. Prior to the release of a building permit, a Professional Engineer, licensed in the State of
Washington, shall submit drainage plans and a drainage report and calculations that conform
stormwater design/management in Spokane County. Drainage plans and a drainage report
shall receive the County Engineer's acceptance prior to release of the building permit.
4. A statement shall be placed in language of the Binding Site Plan that no direct access shall be
allowed from lots to Sullivan Road.
5. This proposed Binding Site Plan or development proposal is located within a drainage basin
which has been identified by the Spokane County Engineer's and Utilities offices as having
stormwater runoff problems. Since this proposed Binding Site Plan or development proposal is
affected by or is a contributor to stormwater flows, property owners should participate in the
planning and implementation of a future basinwide stormwater management system. The
following statement shall be placed in the dedicatory language of the final Binding Site Plan:

6. Approach Permits are required for any access to the Spokane County road system.
7. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
8. The applicant shall execute reciprocal access agreements to provide for ingress and egress.
9. No construction work is to be performed within the existing or proposed Public Right-of-way until
plans have been accepted by the County Engineer and a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County Engineer.
10. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction.
11. The County Arterial Road plan identifies Sullivan Road as a 100 foot Principal Arterial. The
existing right of way width of 80 feet is not consistent with that specified in the plan. In order to
implement the Arterial Road Plan it is recommended that, a strip of property 10 feet in width
along the Sullivan Road frontage be set aside in reserve. This property may be acquired by
Spokane County at the time when Arterial Improvements are made to Sullivan Road.
12. The applicant should be advised that there may exist utilities either underground or overhead
affecting the applicants property, including property to be dedicated or set aside future
acquisition. Spokane County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the applicable utilities and Spokane
County Engineer to determine whether the applicant or utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.

Thank you for the opportunity to comment on the above mentioned preliminary binding
site plan (BSP). The plans submitted to us for this development show an access point to
Indiana Ave. from Parcel 4. This access as shown on the developers plans is not a valid
access point to Indiana at this time, as it is within our limited access area for the Sullivan
Road/I-90 Interchange.
In regard to this issue the Washington State Department of Transportation (WSDOT) and
Hanson Industries have engaged in a process which would allow them to purchase a right
turn in approach at the general location the driveway is shown on the plans. However, at
this time resolution to this matter has not been reached. Consequently, we ask that as
- stated in the conditions of approval for Short Plat SP-1218-99 that underlies this property
also be applied to this BSP. These conditions are as follows:
