As you know, I represent Jim and Gerdette Hensley. They live
at East 8911 Sinto, immediately adjacent to the Safeway,
Pay -n -Save Project, proposed by WAM Enterprise, located at
Mission and Argonne.
It is my understanding that pursuant to the above -referenced
zoning -approvals for this site, the developer must construct a
project substantially in conformance with the site plan
submitted for the rezone. (See Finding #D.1,ZE-84-85 and
Finding #D(a)5, ZE-28-88)
As you know, I do not believe the site plan submitted by WAM
Enterprises substantially complies with the site plan
originally approved by the county. I note that a change in
this site plan requires further hearing by the Hearing Examiner
Committee. (See Finding #D.1, ZE-84-85) The relocation of the
loading dock for the Safeway store is so that it immediately
abuts my clients' property is a significant change in the
design of this project which obviously impacts my clients to a
much greater degree than the project originally submitted.
By this letter I am requesting notice of any decision made by
you or any member of the Planning Department or Building.
Department staff which determines whether the site plan

submitted by WAM for the Safeway Store Project is in
substantial conformance with the original site plan approved by
the County. In addition, I request notice of any decisions by
Spokane County to not require an additional environmental
checklist for the revised project.
Further, I request this notice be given in a timely fashion so
that my clients may exhaust any administrative or judicial
appeals within the time periods established by law for such
appeals.
Very truly yours,
