FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Planning. 2. The proposal is to create a legal lot of record on approximately .66 acre for the development of those uses allowed in the existing Light Industrial (I-2) zone. 3. The Binding Site Plan Chapter of the Spokane County Subdivision Ordinance allows any number of parcels to be recorded over time, individually or in groups; provided each parcel and the proposed use can meet the minimum development standards of Spokane County. Specific parcels can be recorded at different times, but prior to sale, lease or transfer of the , particular parcel. 4. The proposal is located at the southwest corner of the intersection of Bowdish Road and Jackson Avenue in the S'/z of the NW'/4 of Section 9, Township 25 N., Range 44 EWM., Spokane County, WA. Tax Parcel No. 45092.9054. 5. The existing zoning of the property described in the application is Light Industrial (I-2), which was established in 1991, previously classified as Restricted Industrial (RI) in 1983 (ZE-104- 83). Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing Light Industrial (I-2) zone. 6. The Spokane County Comprehensive Plan designates this area as Industryal (I). The development and uses, as proposed and conditioned, are in accord with the Industrial (I) Category. This proposal is not yet compatible with the surrounding uses. Properties to the north and east of the site are zoned Urban Residential-3.5 (UR-3.5), Urban Residential-7 (UR- 7) and Urban Residential-22 (UR-22), and are fully developed residential lots. Property to the west and south of the site is zoned Light Industrial (I-2). 7. The proposed site is located within the Public Transportation Benefit Area (PTBA), Interim Urban Growth Area (IUGA), Aquifer Sensitive Area (ASA), and the Conical Area for Felts Field. 8. The Spokane County Arterial Road Plan identifies Bowdish Road as a County Local Access Road with a future right-of-way width of 60 feet. The existing right of way width along the Bowdish Road frontage is 60 feet. The Arterial Road Plan identifies Jackson Avenue as a County Local Access Road with a future right-of-way width of 60 feet. Therefore, as conditioned, the proposal conforms to the Arterial Road Plan. 9. The required public notice was provided for this proposal on April 25, 2001. Agencies having a potential interest in the project were notified on April 18, 2001 and recommendations solicited. No written comments were received from any adjoining property owners regarding this proposal. 10. An Environmental Checklist was submitted by the sponsor and was reviewed by the Spokane County Division Planning. The revjew considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Division of Planning has determined that "No probable significant adverse impacts" would result from the proposal being developed and issued a Determination of Non-Significance (DNS) on May 15, 2001. - . . ' ~ • »F ! The DNS -was circulated for review and comments to those agencies of jurisdiction affected by this proposal. The DNS was also advertised in the newspaper to the public 15 calendar days before the comment period ended on May 30, 2001. 11. In conjunction with the conditions of approval and Spokane County development standards, the proposed binding site plan is not detrimental to the public health, safety and general welfare. Moreover, this proposal implements the underlying zoning and complies with the provisions of Chapter 12.500 (Binding Site Plans) of the Spokane County Subdivision Ordinance. DECISION Based upon the above Findings of Fact and Conclusio 2 Binding Site Plan Application BSP-77-01 is hereby APPROVED for fve (5) years, specifcally until I~a~ 2Qnd subject to the conditions noted below. This decision is final unless appealed in writing, consistent with adopted appeal procedures. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DIVISION OF PLANNING 1. The proposal shall comply with the Light Industrial (I-2) zone and other applicable Zoning Code chapters, as amended. 2. The preliminary Bindings Site Plan is given conditional approval for five (5) years, specifically to May 30, 2006. The applicant may submit an extension of time application at least thirty (30) days prior to the above expiration date, but no later than April 30, 2006. Application(s) for extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary approval and conditions will be changed to reflect the adopted policy and development regulations at the time of the extension application. 3. Prior to recording the final binding site plan, the applicant shall submit to the Planning _ Director/designee for review any proposed final binding site plan to ensure compliance with these Findings and Conditions of Approval. -4. The initial overall final binding site plan shall be designed substantially in conformance with the "Preliminary Binding Site Plan of Record." The initial recording of this final binding site plan shall show, at a minimum, the perimeter boundary of the total site and any specific internal parcels that can comply with the development standards at that time. 5. Any subsequent divisions of land within the recorded original final binding site plan shall be reviewed by the Planning Director/designee. The number of parcels proposed will be determined by the development standards, such as the Zoning Code and shall be flexible within the terrns of the original final binding site plan's conditions of approval. After the Division of Planning has reviewed the specific parcel(s) and determined their compliance with all applicable regulations and provisions of the original final binding site plan, an "Amendment to the Final Binding Site Plan by Sunrey" may be recorded with the Spokane County Auditor. 6. A survey is required of the subject property prior to recording the final binding site plan. 7. Appropriate road name(s) and street address for each parcel shall be indicated on the final binding site plan map. 8. Appropriate utility easements shall be indicated on the final binding site plan map. Development Engineering Services RE: Drainage Language for BSP-77-01 There may exist properties located uphill and adjacent to this subdivision which periodically discharge stormwater runoff onto individual tracts within this plat. Runoff from nearby uphill properties should be expected, and during snowmelt periods or wet seasons the tracts may be subjected to higher amounts of stormwater runoff that what is normally observed or anticipated. Because stormwater runoff from adjacent properties has discharged onto this plat prior to development, stormwater runoff will likely continue to do so after development. It is tbe responsibility of the individual lot owners to maintain eacisting surface paths of runoff of natural or man-made drainage flow over and across their respective properties and to grade the lots in accordance with applicable rules and regulations, so as to prevent property damage. Any building that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive drainage away from any drainage eotry point to the building (including but not limited to a window well, a window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from the building for a distance of at least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed away from the building, and conveyed over the lot to a natural drainage swale or approved drainage facility, or b) drainage iotercepted on the lot is disposed of on the lot in an approved drainage facility. The approved drainage facility shall be constructed in accordance with any applicable accepted plans on file at the County Engineer's Office. Any revisions to tbe accepted drainage plans must be accepted by the County Engineer's Office prior to construction of said revisions. Spokaoe County does not accept the responsibility of maintaining the drainage course on private lots or floodplain areas within private lots, nor the responsibility for any damage whatsoever, including, but not limited to, inverse condemnation to any properties due to deficient construction and/or maintenance of drainage courses in drainage easements on private property. The owner(s) or successor(s) in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining i~ \ i ~ , or operation of stormwater control facilities. BSP-0064 Bonuccelli Marieta @ Sullivan I visited this site on 4/5/06 and observed that this project appears to be still under construction. The Marieta. Avenue portion of the project has been completed as far as curbing and paving is concerned. Sidewalk and swales were constructed only on portion along commercial development on the south side of Marieta. There were two areas of concern on this portion and they were: 1. Cracked sidewalk panel at approach to business development. 2. Curb inlets do not drain into swales due to the thickness of the sod. The file conta.ined a Roadway Improvement Bond for $35,100.00 issued by Lumbermens Mutual Casualty Company, dated 3/26/01. I tried calling the bonding company, but they are no longer at the number given on the bond, in fact it appears that the bonding company no longer exists. I was able to determine that Kemper Insurance was contact for bond and was told by them that bond had been released on 4/9/04. I e-mailed them and asked for a copy of the release letter. This project was constructed in 2002 and is an ongoing development. It appears that a11 lots within this project limits are commercially zoned and that construction of swales and sidewalks is tied to each lot, as developed. At the time I visited the site, material was being hauled off from the west end of the Marieta Cul-de-Sac. Recommendation: Since t11e bond has been released, consider this project closed. However, any further commercial developments should be monitored to insure swales and sidewalks are constructed as per plan. , . . , I visited this site on 4/5/06 and found the following areas of concern, along Bowdish Road: 1. There were 2 panels in the sidewalk which were cracked. 2. There were 2 panels in the sidewalk which had settled as much as 1-1 /4". 3. There was 1 panel in sidewalk which had a broken comer at south-end of sidewalk. 4/7/2006 Page 2 of 2 This project was constructed in 2001 and the file contained a bond in the amount of $22,000.00 and was issued by Washington Trust Bank. It was dated 6/7/01. There was a letter in the file releasing the performance portion of the bond, but retaining $4400.00 as a warraniy bond. The letter states that the warranty portion will expire two years from 11/28/01, and was signed by John Hohman, P.E., for Spokane County. No release was found in the .file. I called the bank and was told that the Savings Certificate for this bond had been closed on 11/29/01 with zero balance. The bank stated that they would have no file due to it being done in 2001. Recommendation: Due to the length of time that has passed, and the bond being closed out, I would doubt that any correcrions to items listed above could be done. Therefore, consider this project closed with no further action required. SP-1324-03, SP-1321-03 and SP-1320-03 I visited the sites of these three projects on 4/5/06 and observed that no public works concern exists. These projects were for new plats and did not require bonds. They probably should not have been listed on the surety spreadsheet. Recommendation: Remove from surety sprea.dsheet and consider them closed. Please let me know if you need more information and if you agree with the recommendations.
