BEFORE THE SPOKANE COUNTY DIVISION OF PLANNING
IN THE MATTER OF PRELIMINARY) FINDINGS OF FACT,
BINDING SITE PLAN, BSP-78-01 ) CONCLUSIONS AND '
DECISION
THIS MATfER, an application to divide industrial and commercial land from Lumber Yard Investments has
been received and was decided upon, pursuant to the Spokane County Subdivision Ordinance, Section 12.500,
on the 18T" day of September, 2001.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering the decision by the Director of the Spokane County Division of Planning. .
2. The site is generally located south of and adjacent to Mirabeau Parkway approximately 1000 feet east of
the intersection of Mirabeau Parkway and Pines Road in the NE %4 of Section 10, Township 25 North,
Range 44 E.W.M.. The subject property is identified as Assessor's Tax Parcel No. 45105.9095, created
by Certificate of Exemption CE-435-00.
3. The proposal is to divide approximately 12 acres into seven (7) parcels for those uses allowed in the Light
Industrial Zone (I-2) as amended. The subject property is currently zoned Light Industrial (I-2) pursuant
to Zone Reclassification ZE-37-96. Pursuant to the requirements of RCW 58.17.195 the proposal does
conform to the requirements of the existing I-2 Zone.
4. The Binding Site Plan Chapter of the SQokane County Subdivision Ordinance allows any number of
parcels to be recorded over time, individually or in groups; provided each parcel and the proposed use
• can meet the minimum development standards of Spokane County. Specific parcels can be recorded at
different times, but prior to sale, lease or transfer of the particular parcel. "
5. The subject property is located within the Public Transportation Benefit Area (PTBA) of Spokane County.
Spokane Transit Authority (STA) Route 95 (Central Spokane Valley) provides connecting services to the
vicinity of the proposal.
6. The Spokane CountY Arterial Road Plan identifies Mirabeau Parkway (Euclid Road) as a Local Access
Road with a future right-of-way width of 60 feet. The existing right-of-way width is 60 feet.
7. The required public notice was provided for this proposal and agencies having a potential interest in the
project were notified and recommendations solicited. No written comments were received from any
adjoining property owner(s).
8. An Environmental Checklist was submitted by the sponsor and was reviewed by the Spokane County
Division of Planning. The review considered the specifics of the proposal, other available information,
County ordinances, other regulations and laws, possible standard Conditions of Approval, the
Generalized Comprehensive Plan, and other County policies and guidelines. The Division of Planning
has determined that "no probable significant adverse impacts" would result from the proposal being
developed and issued a Determination of Nonsignificance (DNS) on August 31, 2001.
9. The DNS was circulated for review and comments to agencies of jurisdiction affected by this proposal.
The DNS was also advertised in the newspaper to the public 15 calendar da~rs before the comment
period ended on September 15, 2001. In response to the environmental review, written comments were
received from the Washington State Department of Ecology.
10. The proposal as conditioned is in furtherance of the public health, safety and general welfare and is
consistent with the Spokane County Zoning Code.
14. This proposal is located within the Aquifer Sensitive Area Overiay Zone (ASA) and within the Priority •Sewer Service area (PSSA).
15. Water service will be provided by Irvin Water District #6. Sewer Service will be provided by Spokane
County.
16. The subject property is designated as Urban Natural Open Space by Spokane County Critical Area
maps and is subject to the requirements of the Spokane County Critical Areas Ordinance (CAO). The
CAO, Section 11.20.060(D), requires consultations with the Washington Department of Fish and Wildlife

to determine if a wildlife habitat maintenance plan is required. The Department stated that a habitat
maintenance plan is not necessary for this proposal.
17. The prolect is located within the 30,000-foot Conical Area Overlay Zone applicable to Felts Field Airport.
The project proponent will need to secure and record an avigation easement from the Manager of Felts
Field as required by Section 14.702.060 of the Spokane County Zoning Code, or in lieu of the easement,
submit a letter signed by said Manager stating that an avigation easement is not required.
18. The proposal is subject to all applicable Conditions of Approval of Zone Reclassification ZE-37-96,
approved by the Spokane County Hearing Examiner on August 17 and as modified by him on August 18,
1999. .
19. The proposal is generally consistent with Washington State Subdivision Statute RCW 58.17 and the
Spokane County Subdivision Ordinance, promoting the public health, safety and general welfare in
accordance with standards established by Washington State and Spokane County. The County Division
of Planning has considered the provision of adequate public facilities as cited in RCW 58.17.110(2).
More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and school grounds
e. potable water j. sidewalks
DECISION
Based upon the above Findings of Fact and Conclusions, Binding Site Plan Application BSP-78-01 is hereby APPROVED for five (5) years, specifically until SepWmber.20, 200 d-subject to the conditions noted below.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include the developer of
the project, the owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposal shall comply with all requirements of the Light Industrial (I-2) Zone and all other applicable
Spokane County Zoning Code sections, as amended. Development of the lots shall comply with all
applicable conditions of reclassification ZE-37-96, approved by the County Hearing Examiner on August
17, 1999 and as revised by him on August 18, 1999.
2. The Preliminary Binding Site Plan is given conditional approvaf for fve (5) years, specifcally to September
2,0,,,2006. Tfie applicant may submit an extension of time application at least thirty (30) days prior to the
above expiration date. Application(s) for extension of time shall be processed under the provisions of
Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant
complies with the criteria of Chapter 12.100.118, the preliminary approval extension will be granted with
conditions attached that reflect the adopted policy and development regulations in effect at e time of the
• extension application. Submission of a time extension request following August 20, 2006 will not be
accepted and the preliminary binding site plan will be null and void on September 20, 2006 if the
final Binding Site Plan is not recorded in the County Auditor's Office.
3. Prior to recording the final binding site plan, the applicant shall submit to the Division of Planning for
review any proposed finat binding site plan to ensure compliance with these Conditions of Approval.
4. The final binding site plan shall be designed substantially in conformance with the "Preliminary Binding Site
Plan of Record." If the Binding Site Plan is finalized in phases, each phase shall be consistent with the
Preliminary Binding Site Plan as approved herein. The initial recording of the Final Binding Site Plan shall
show, at a minimum, the perimeter boundary of the total site and any specific internal parcels that can
comply with the development standards at that time.

5. Any subsequent divisions of land within the recorded original final binding site plan shall be reviewed by
the Division of Planning. The number of parcels proposed will be determined by the development
standards, such as the Zoning Code and shall be consistent with the terms of the final binding site plan's
conditions of approval. After the Division of Planning has reviewed the specific parcel(s) and determined
their compliance with all applicable regulations and provisions of the final binding site plan, an
"Amendment to the Final Bindmg Site Plan by Survey" may be recorded with the Spokane County Auditor
consistent with the Spokane County Subdivision Ordinance, Section 12.500.140.
6. A survey is required of the subject property prior to recording the final binding site plan.
7. Appropriate road name and street address for each parcel shall be indicated on the final binding site plan
map.
8. Appropriate utility easements shall be indicated on the final binding site plan map. Written approval of
utility easements by utility companies must be received prior to recording the final binding site plan.
9. The final binding site plan map shall indicate by a dashed line the required setbacks from all private and
public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks
shall be determined at the time building permits are requested unless these setbacks are specifically .
drafted on this final binding site plan.°
10. Four (4' current certificates of title shall be furnished to the County Division of Planning prior to recording
the fina binding site plan.
11. A specific and detailed lot development plan will be submitted to the Division of Planning for review and
approval prior to issuance of a building permit. -
12. The Division of Planning shall prepare and record with the Spokane County Auditor a 7itle Notice noting
that the property in question is subject to a variety of special conditions imposed as a result of approval of
• this proposal. This Titie Notice shall serve as public noUce of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same time frame as allowed for an
appeal and shall only be released, in full or in part, by the Division of Planning. The Title Notice shall
clearly communicate to owners, potential buyer(s) and lessee(s) that County enforceable
restrictions/conditions exist and run with the property and such restrictions shall be set forth therein.
13. The applicant shall secure an avigation easement from the Manager of Felts Field Airport or a letter signed
by the Manager that an avigation easement is not required. This condition must be satisfied prior to
recording the final binding site plan.
14. The Division of Planning shall prepare and record with the Spokane County Auditor a Title Notice, which
shall generally provide as follow:
4Prior to the issuance of any building permit for any building or any use on the property
described herein, the applicant shall be responsible for complying with the provisions of the
Zoning Code for Spokane County, Section 14.706 (Aquifer Sensitive Area Overlay Zone). The
property which is the subject of this notice is more particularfy described as follows: (insert
legal description of property in File # BSP-78-01 located in the Division of Planning)." 15. Approval is required from the Director of the Division of Planning/designee of a specific lighting and signing
plan for each lot prior to the release of any building permit.
16. A specific landscape plan, planting schedule and provisions for the maintenance acceptable to the Director
of the Division of Planning/designee shall be submitted with a suitable guarantee prior to release of a
building permit for each lot. Landscaping shall be installed and maintained so that sight distance at
access points is not obscured or impaired.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. The applicant shall compfy with all Spokane County Division of Engineering conditions of approval for ZE -
37-96.

2. In addition to the base financial contribution toward the Evergreen Interchange Spokane County
purchased reserve capacity above the public participation requirement on Evergreen Interchange.
Spokane County invested 2.1 million dollars. This capital investment will require the applicant to execute a
Developer Agreement for transportation fees, to be approved by the Spokane County Board of County
Commissioners, prior to the issuance of any building permits. This development agreement is pursuant to
RCW 43.21 C.060. RCW 82.02.020, and Article XI of the Washington State Constitution which provides the
County with the authority to impose mitigation fees for the costs of certain road Qrojects made necessary
by development, provided the County has identified future road projects necessitated by planned
development in certain areas of Spokane County and is enacted through conditions of approval of a land
use action including a State Environmental Policy Act review, where a reasonable relationship between
impacts to the transportation system from the proposed development and the financial contribution are
roughly proportional. Trips generated by this proposal as detailed in the Mirabeau Point Environmental
Impact Statement warrant financial participation in the Evergreen Interchange.
Note: The pro-rata share for the Evergreen Interchange has been calculated for this proposal to be
$64,050.
The Washington State Department of Transportation has other transportation infrastructure improvements
also required based on impacts as discussed in the Mirabeau Point Environmental Impact Statement
affecting State facilities, all could be addressed through the formation of a area wide SEPA Mitigation Area
for transportation.
3. Conditional approval of the Binding Site Plan by the County Engineer is given subject ta approval of the
road system as indicated in the Preliminary Binding Site Plan of record.
4. A Professional Engineer, licensed in the State of Washington, shall submit final drainage plans, a
drainage report and calculations that conform to the April 3, 2001 Edition of the Spokane County
Standards for Road and Sewer construction, the current edifion of the Guidelines for Stormwater
Management and all standards and laws that are applicable to this project if drainage improvements are
required. Any final drainage plans and a drainage report shall recewe the County Engineer's acceptance
prior to release of a construction or building permit or approval of the final plat CSrainage language will be
drafted by Spokane County and provided to the Sponsor's Engineer or Surveyor for inclusion in the final
plat document following plan acceptance by the Spokane County Engineer.
5. No construction work is to be performed within the existing or proposed public right-of-way until a permit
has been issued by the County Engineer. All work is subject to inspection and approval by the County
Engineer.
6. All construction within the existing or proposed public right of way is to be completed prior to filing the
final Binding Site Plan or a bond in the amount estimated by the County Engineer to cover the cost of
construction of improvements. Construction certification. "As BuilY' plans and monumenting the street
centerlines shall be filed with the County Engineer.
7. Road improvements for Mirabeau Parkway were pertormed under Road Improvement District #513. The
applicant shall be responsible for the construction of a sidewalk per Spokane County Standards for Road
and Sewer Construction sidewalk at the time of each building permit. The applicant shall also grant
applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards.
8. The applicant is requested to submit a signal warrant analysis for the Mirabeau Parkway and Pines Road
(SR 27) intersection, which was identified in the Final Environmental Impact Statement for the Mirabeau
Point Development (ZE-37-96) as a failing intersection. This analysis must be reviewed and accepted by
the Spokane County Engineer and the Washington State Department of Transportation. If signal warrants
are met, the sponsors shall design, fund and construct the signal.
9. Approach permits are required for any access to the Spokane County road system.
10. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 1-0298, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction.

11. The applicant is advised that there may exist utilities either underground or overhead affecting the
applicant's property, including property to be dedicated or set aside for future acquisition. Spokane
County will assume no financial obligation for adjustments or relocation regarding these utilities. The
applicant should contact the applicable utilities regarding responsibility for adjustment or relocation costs and to make arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Side sewer easement with a width acceptable to the Division of Utilities shall be shown on the
face of the final binding site plan as "Sewer and Utilities Easement."
2. An easement for a sewer service line will be required on the northwest portion of Lot 5, to
accommodate a sewer connection for Lot 4 to the existing stub on Lot 5. The easement should
consist of the west 60 feet of the north 25 feet of Lot 5. A"joint use and hold harmless
agreement" will be req uired for the common service line before a sewer connection permit will
be issued for Lot 4 or Lot 5.
3. An easement for a sewer service line will be required on the northern portion of Lot 7, to
accommodate a sewer connection for the property east of Lot 7 to the existing stub on Lot 7.
The easement should consist of the east 220 feet of the north 25 feet of Lot 7. A"joint use and
hold harmless agreement' will be required for the common service line before a sewer
connection permit will be issued for Lot 7.
4. A wet (live) sewer connection to the area-wide Public Sewer System is to be constructed.
Sewer connection permit is required. Commercial developments shall submit historical and or
estimated water usage prior to the issuance of the connection permit in order to establish
sewer fees.
5. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover,p
only those plan sheets showing sewer plans and specifications for the public sewer
connections and facilities for review and approval. Commercial developments shall submit
historical and or estimated water usage as part of the sewer plan submittal.
6. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of
the project.
7. Any water service for this project shall be provided in accordance with the Coordinated Water System
Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County.
2. Water service shall be coordinated through the Director of Utilities, Spokane County.
3. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Heatth.
4. Prior to filing the final binding site plan, the sponsor shall demonstrate to the satisfaction of the Spokane
Regional Health District that an adequate and potable water supply is available to each lot of the BSP.
5. Prior to filing the final BSP, the sponsor shall present evidence that the plat lies within the recorded
service area of the water system proposed to serve the BSP.
6. A plan for water facilities adequate for domestic use, domestic irrigation use, and fire protection use shall
be approved by the water purveyor. Said water plan must have been approved by the fire protection
district and the appropriate health authorities. The health authorities, water supplier (purveyor), and the
fire protection district will certify, prior tb the filing of the final binding site plan, on the face of said water
plan that the plan is in conformance with their requirements and will adequately satisfy their respective
needs. Said water plan and certification will be drafted on a transparency suitable for reproduction.
7. The purveyor will also certify prior to filing the final BSP on a copy of said water plan that appropriate

contractual arrangements have been made with the plat sponsor for construction of the water system, in
accordance with the approved plan and time schedule. The time schedule will provide, in any case, for
completion of the water system and inspection by the appropriate health authorities prior to application for
building permits within the BSP. The contractual arrangement will include a provision holding Spokane
County, Spokane Regional Health District, and the purveyor harmless from claims by any lot purchaser
refused a building permit due to failure of the BSP sponsor to satisfactorily complete the approved water
system.
8. A public sewer system will be made available for the binding site plan and individual service will be
provided to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be
auth, orized.
9. VsStatement shall be placed in the dedication to the effect that: °A public sewer system will be made
a%Nlable for the BSP and individual service will be provided to each lot prior to sale. Use of individual on-
te sewage disposal systems shall not be authorized.°
10. 4TThe dedicatory language on the BSP shall state: "Use of private wells and water systems is prohibited."
11. T~ final BSP dedication shall contain the following statement: "The public water system, pursuant to the
Water Plan approved by county and state health authorities, the local fire protection district, County
Division of Building and Code Enforcement and water purveyor,. shall be installed within this subdivision
1 and the applicant shall provide for individual domestic water service as well as frre protection to each lot
prior to sale of each lot and prior to issuance of a building permit for each lot."
WASHINGTON STATE DEPARTMENT OF TRANSPORTATION
1. This BSP is part of the property that the rezone and Environmental Impact Statement for the Mirabeau
Point (ZE-37-96) project covered. The conditions of reclassification approval that were imposed on that
action through the Hearing Examiner applicable to the subject proposal shall be as specifed in conditions

guarantee financial surety of the following improvements (Phase II of the project is defined on page 33 of

cumulative peak hour trips.~ Revise the existing signal and channelization at the Pines Road/Mission
Avenue intersection to allow eastbound and westbound protected plus permitted left turn movements.

Avenue and install a new traffic signal and illumination system at the Indiana/westbound off ramp
intersection. At the Pines Road/lndiana Avenue intersection provide an eastbound right turn lane.
Reconfigure the east approach to provide one left turn lane, one through and left lane, and one right turn
lane. Revise the signal phasing for the eastbound and westbound approaches to split. Provide a traffic
signal and illumination system at the Pines Road/Euclid Avenue intersection.
. 3. Prior to release of building permits or construction occurring in Phase III, the applicant shall enter into a
WSDOT developer's agreement to either design and construct or participate to the extent needed to
guarantee financial surety of the following improvements (Phase III) of the project is defined on page 33
of the Final Environmental Impact Statement Appendix B; not to exceed 2,025 cumulative peak hour
trips.). Provide an improvement for the Pines Road/Mansfield Avenue intersection that will ensure that
the level of service based on delay time at this intersection will not be further degraded by this project.
4. While the threshold air quality analysis submitted by the applicant suggests these projects will meet the
air quality standards for Carbon Monoxide (CO), a pro'ect level air quality analysis will need to be
conducted by the applicant. This analysis will need to ~e accepted by WSDOT and the Spokane
Regional Transportation Council prior to the needed improvements being constructed. This analysis shall
document that the allowable limits of CO will not be exceeded and that an existing CO hot spot will not be
further impacted by the proposed project. Should this occur the proposed project will need to be modified
accordingly to ensure the allowable levels of CO will not be exceeded. The traffic analysis conducted for
this development shall be updated by the applicant for the portion of this development for which building
permits have not been obtained by the end of the year 2006. This traffic study shall also be updated by
the applicant if the cumulative traffic generation of this development exceeds 881 entering and 1,144

exiting peak hour trips. This updated analysis shall be reviewed and accepted by both WSDOT and
Spokane County. All improvements to WSDOT facilities shall be approved by WSDOT prior to
construction (i.e. design, drainage, illumination, electrical, surfacing, etc.).
5. Spokane County is now developing a traffic mitigation plan in conjunction with WSDOT for the Pines and
Sullivan Corridors. Should this plan be adopted by the Board of Spokane County Commissioners the
applicant may choose to participate in the plan in lieu of the improvements called out in items 1 through 4
above.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Prior to the issuance of a building permit for each lot the applicant shall demonstrate compliance with
requirements of the Spokane County Air Pollution Control Authority.
DIVISION OF BUILDING AND CODE ENFORCEMENT
1. The applicant shall contact the Division of Building and Code Enforcement at the eariiest possible stage in
order to be informed of code requirements administered/enforced as authorized by the State Building
Code Act. Development concerns include: addressing, fire apparatus access roads, fire hydrant/flow,
approved water systems, building accessibility, construction type, occupancy classification, exiting,
exterior wall protection, and energy code regulations.
2. Prior to the issuance of the initial building permit(s), the applicant shall submit to the Division of
Building and Code Enforcement documentation signed by the water purveyor and the applicable fire
district stating that the public water system has been installed, tested and accepted as operational
pursuant to the approved water plan.

The Spokane County Engineering Department has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for
inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be approved.
Prior to release of a building permit or use of property as proposed:
1. The applicant shall comply with all Spokane County Division of Engineering conditions of
approval for ZE - 37-96.
2. In addition to the base financial contribution toward the Evergreen Interchange Spokane County
purchased reserve capacity above the public participation requirement on Evergreen
Interchange. Spokane County invested 2.1 million dollars. This capital investment will require
the applicant to execute a Developer Agreement for transportation fees, to be approved by the
Spokane County Board of County Commissioners, prior to the issuance of any building permits.
This development agreement is pursuant to RCW 43.21 C.060, RCW 82.02.020, and Article XI
of the Washington State Constitution which provides the County with the authority to impose
mitigation fees for the costs of certain road projects made necessary by development, provided
the County has identified future road projects necessitated by planned development in certain
areas of Spokane County and is enacted through conditions of approval of a land use action
including a State Environmental Policy Act review, where a reasonable relationship between
impacts to the transportation system from the proposed development and the financial
contribution are roughly proportional. Trips generated by this proposal as detailed in the
Mirabeau Point Environmental Impact Statement warrant financial participation in the Evergreen
Interchange. .
Note: The pro-rata share for the Evergreen Interchange has been calculated for this proposal to
be $64,050.

The Washington State Department of Transportation has other transportation infrastructure
improvements also required based on impacts as discussed in the Mirabeau Point
Environmental Impact Statement affecting State facilities, all could be addressed through the
formation of a area wide SEPA Mitigation Area for transportation.
3. Conditional approval of the Binding Site Plan by the County Engineer is given subject to
approval of the road system as indicated in the Preliminary Binding Site Plan of record.
4. A Professional Engineer, licensed in the State of Washington, shall submit final drainage plans,
a drainage report and calculations that conform to the April 3, 2001 Edition of the Spokane
County Standards for Road and Sewer construction, the current edition of the Guidelines for
Stormwater Management and all standards and laws that are applicable to this project if
drainage improvements are required. Any final drainage plans and a drainage report shall
receive the County Engineer's acceptance prior to release of a construction or building permit or
approval of the final plat. Drainage language will be drafted by Spokane County and provided to
the Sponsor's Engineer or Surveyor for inclusion in the final plat document following plan
acceptance by the Spokane County Engineer.
5. No construction work is to be performed within the existing or proposed public right-of-way until
a permit has been issued by the County Engineer. All work is subject to inspection and
approval by the County Engineer.
6. All construction within the existing or proposed public right of way is to be completed prior to
filing the final Binding Site Plan or a bond in the amount estimated by the County Engineer to
cover the cost of construction of improvements. Construction certification, "As Built" plans and
monumenting the street centerlines shall be filed with the County Engineer.
7. Road improvements for Mirabeau Parkway were performed under Road Improvement District
#513. The applicant shall be responsible for the construction of a sidewalk per Spokane County
Standards for Road and Sewer Construction at the time of each building permit. The applicant
shall also grant applicable border easements adjacent to Spokane County Right of Way per
Spokane County Standards.
8. The applicant is requested to submit a signal warrant analysis for the Mirabeau Parkway and
Pines Road (SR 27) intersection, which was identified in the Final Environmental Impact
Statement for the Mirabeau Point Development (ZE-37-96) as a failing intersection. This
analysis must be reviewed and accepted by the Spokane County Engineer and the Washington
State Department of Transportation. If signal warrants are met, the sponsors shall design, fund
and construct the signal.
9. Approach permits are required for any access to the Spokane County road system.
. 10. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 1-0298, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.

The State Environmental Act (SEPA) Chapter 43.21 C RCW, requires all
governmental agencies to consider the environmental impacts of a proposal before
making decisions. An Environmental Impact Statement (EIS) must be prepared
for all proposals with probable significant adverse impacts on the quality of the
environment. The pwpose of this checklist is to provide inforniation to help you
and the agency identify impacts from your proposal (and to reduce or avoid
impacts from the proposal, if it can be done) and to help the agency decide
whether an EIS is required.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information about
your proposal. Governmental agencies use this checklist to determine whether tlie
environmental impacts of your proposal are significant, requiring preparation of an
EIS. Answer the questions briefly, with the most precise information known, or
give the best description you can.
You must answer each question accurately and carefully, to the best of your
knowledge. In most cases, you should be able to answer the questions from your
own observations or project plans without the need to hire experts. If you really

During the conshuction phase, water spraying of the soils will
occur during periods of dryness and winds to control dust.

vegetation for site development will be landsGaped as soon as
the construction phase is complete to avoid potential dust
emission resulting from exposed soils.

from Mirabeau Parkway.

site. The County of Spokane has a sewer line fliat extends along

garbage collection service.

I've discussed the surety issues that were brought,up at our December 18th meeting with John Hohman. All
punchlist items still need to be completed, with the following requirements:
1. The unfinished swales need to be finish graded, and can be seeded with dryland grass (as shown on the
approved plans).
2. The sidewalk along Mirabeau Drive needs to be completed as approved by the City (with separated
sidewalk).
3. The remaining sidewalk needs to be complete enough to provide adequate pedestrian access.
With those items finished, we would consider initiating the warranty period with an appropriate warranty surety.
We would still hold surety for any incomplete sidewalk.

I have talked to John Miller yesterday and Homer Tollinare today and re-informed them of Engineer's Condition of
Approval #2 for BSP-78 they have 6een seeking a building permit on. It requires a development agreement to arrange
for payment of their pro-rata share of the Evergreen Interchange. We did release the first building on the east side
because, at the time, we were. very close on reaching an agreement. However, until I called John and Homer, I had
heard nothing from them sirice Christmas and we have not reached closure on the agreement. We will not sign any
permits until the agreement is sigiied by the developer and approved by the BoCC.

TEMPORARY DRAINAGE EASEMENTS(bv separate document if to be replaced)General Terms
Drainage easements are hereby dedicated over the natural depression areas as defined and
enclosed by the native topography and the easement areas reserved for the purposes of
temporary storage and infiltration of storm water runoff from the tributary uphill
properties. Filling or removal of the depressions within the easement areas is prohibited.
These easements are extinguished and become of no further effect nor encumbrance to

1. The preliminary Binding Site Pian of Record indicated natural depressions were present
within the BSP property centered at the south property line for Lot 5 and just off-site to the
BSP property south of Lots 2& 3. The following actions need to occur prior to signature
of the Final BSP by the County Engineer:
. The closed volumes of these natural depressions need to be estimated and their
contributing basins delineated. Natural drainage easements need to be dedicated and
reserved within the BSP property adequate to enclose the runoff ponding elevations from
the applicable design storm event and antecedent drainage conditions, or

Ross Kelley has ask me to provide you with the information needed to write a development
agreement with Lumberyard Investments (John Miller) for the repayment of a portion of the
Evergreen I/C. Lumberyard Investments has purchased approximately 12.01 acres from Inland
Empire Paper along Mirabeau Pkwy. The property was a part of the Mirabeau Point
development and subject to the condition of approval to repay $2,100,000 toward the Evergreen
Interchange.
Lumberyard Investments has submitted a binding site plan for the property and we want to
condition the BSP in a manner similar to IEP for the repayment of their portion of the $2.1
million.
Accompanying this memo is the following:
1. Parcel map showing the division of the Mirabeau Point project properties through
Certificate of Exemption. 2. Copy of Certificate of Exemption for parcel A(purchased by Lumberyard Investments)
with legal description. .
3. Breakdown of 787 Evergreen Interchange trips with proportionate shares of the
$2,100,000.
4. BSP location map -

knowledge to the Company, or if the Coinpany othervvise acquires actuallmowledge of any such defect, lien,

The required temporary natural drainage easement was record by separate document and Taylor Engineering this
morning.(AF# 4673162). The final BSP drainage language is acceptable and the final BSP OK to forward to the County
Engineer for signature.
