4. The applicant shall construct a paved and de,line.gted approach to meet the existing
pavement on Howe Road.
5. Fancher Road is not constructed to Spokane County Public' Road Standards. Access to
Fancher Road shall be prohibited until such time as specifically authorized by the
Spokane County Engineer. 6. Roadway standards, typical roadway sections and drainage plan requirements are found
in Spokane Board of County Commissioners resolution 95-0498 as amended and are
applicable to this proposal. , .
7. No construction work is to be performed within the existing or proposed right of way until a
permit has been issued by the County Engineer. All work within the public road right of
way is subject to inspection and approval by the County Engineer.
8. The applicant is advised that the Division of Building and Planning may request that
certain required improvements for manufactured home parks be reviewed for compliance
by the Division of Engineering and Roads. Design Standards for Manufactured Home
Parks are found in the Spokane County Zoning Code.
9. Applicant shall sign "Spokane County Notice to the Public Number 6" which specifies the

If an RID is proposed for improvement of the road(s) ciescribed below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within
fihe Nroposed RID are feasible and (2) that the benefts to be derived firom the formatidn
of the RID by the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID, and (3) that the
property within the proposed RID is sufficiently developed; provided, themselves, their
heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result of the improvements
called for in conjunction with the formation of an RID by either the petition or resolution
method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the
Board of County Commissioners confirming the final assessment roll; provided further, it is
recognized that actual assessments may vary from assessment estimate.so long as they
do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to

It is further acknowledged and agreed that at such time as an RID is created or any
County Road Improvement project is authorized by Spokane County, the improvements
required shall be at the sole expense of the owner(s) of property within the RID or served
by the improvements without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. This provision is applicable to Howe Road and Fancher Road.
10. The County Engineer has designated a Local Access Roadway Section for the
improvement of Howe Road which is adjacent to the proposed development. This will
require the addition of approximately 3-5 feet of asphalt along the frontage of the
development. Curbing and sidewalk must also be constructed.
11. The County Engineer has designated a Local Access Roadway Section for the
improvement of Fancher Road which is adjacent to the proposed development. This will
require the addition of approximately 30 feet of asphalt along the frontage of the
development. Curbing and sidewalk must also be constructed.
12. The applicant shall grant applicable border easements adjacent to Spokane County right-
of-way per Spokane County Standards.

The Spokane County Engineering Department has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for
inclusion in the Site Plan review. Prior to release of a building permit or use of property as proposed:
1. Access permits for approaches to the County Road System shall be obtained from the County
Engineer.
2. Applicant shall submit for approval by the Spokane County Engineer drainage and access
plans.
3. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane
County Engineer. The design, location and arrangement of parking stalls shall be in
accordance with standard engineering practices. Paving or surfacing as approved by the County
Engineer will be required for any portion of the project which is to be occupied or traveled by
vehicles.
4. The applicant shall construct a paved and delineated approach to meet the existing pavement
on Howe Road.
5. Fancher Road is not constructed to Spokane County Public Road Standards. Access to
Fancher Road shall be prohibited until such time as specifically authorized by the Spokane
County Engineer.
6. Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane Board of County Commissioners resolution 95-0498 as amended and are applicable to
this proposal.

7. No construction work is to be performed within the existing or proposed right of way until a
permit has been issued by the County Engineer. All work within the public road right of way is
subject to inspection and approval by the County Engineer.
8. The applicant is advised that the Division of Building and Planning may request that certain
required improvements for manufactured home parks be reviewed for compliance by the
Division of Engineering and Roads. Design Standards for Manufactured Home Parks are found
in the Spokane County Zoning Code.
9. Applicant shall sign "Spokane County Notice to the Public Number 6" which specifies the
following:
The owner(s) or successor(s) in interest agree that in consideration of Mutual Benefits now or to
be hereafter derived, do for themselves, their heirs, grantees, assigns and successor(s) in
interest hereby request and authorize Spokane County to include the above described property
in a Road Improvement District (RID) and to support the formation of a Road Improvement
District for improvement of the road(s) described below by requesting and authorizing Spokane
County to place their name(s) on a petition for the formation of a Road Improvement District
pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their
ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030,
and/or by not filing a protest against the formation of a RID being formed under the alternative
resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within the
proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID
by the property included therein, together with the amount of any County participation, exceeds
the cost and expense of formation of the RID, and (3) that the property within the proposed RID
is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s)
shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on
the property as a result of the improvements called for in conjunction with the formation of a RID
by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment roll; provided further, it is recognized that actual assessments may vary from
assessment estimate so long as they do not exceed a figure equal to the increased true and fair
value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is created or any County Road
Improvement project is authorized by Spokane County, the improvements required shall be at
the sole expense of the owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. This provision is applicable to Howe Road and Fancher Road..

10. The County Engineer has designated a Local Access Roadway Section for the improvement of
Howe Road which is adjacent to the proposed development. This will require the addition of
approximately 3-5 feet of asphalt along the frontage of the development. Curbing and sidewalk
must also be constructed.
11. The County Engineer has designated a Local Access Roadway Section for the improvement of
Fancher Road which is adjacent to the proposed development. This will require the addition of
approximately 30 feet of asphalt along the frontage of the development. Curbing and sidewalk
must also be constructed.
12. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.

Your submitted private driveway and drainage plan is in general compliance with the
applicable portions of the Spokane County GSM, SRSC, & Zoning Code Chapter 14.808.
The plan will be acceptable for construction upon making the following revisions:
1. See enclosed Mark-Ups.
2. Connection of the private drive to unimproved Fancher will be allowed for emergency
service vehicles only. A perimeter fence and gate with knox box or other entry
approved by Fire District No. 1 will be required to preclude normal vehicular travel.
Approach Permits will be required for the new access points on Howe and Fancher.
Here is my idea of a reasonable way of sequencing the requirements for the MBP, but I
will need to verify that it is satisfactory with Bill Hemmings and the Planning Department.
Completion of the following action is required prior to the County Engineers release
of any Approach or Grading Permit for the infrastructure improvements:
1. Plan acceptance for construction.
Completion of the following actions are required prior to the County Engineers
release of any building permit: I. Recording of a Binding Site Plan.
2. Signature of RID Agreements for Howe and Fancher.
Completion of the following actions are required prior to the County Engineers

I am writing in response to your comment letter dated February 23, 1999 on the above referenced
project. The site plan has finally been approved by Spokane County Planning and conditions
have been published. I found no comments that would change the scope of the plans submitted
previously. Please let me know if you see anything that would require changes. I have included
two copies of the previously submitted plan, a copy of your comments, and a copy of the
conditions for your convenience.
In response to your conceptual level comments, I offer the following. The lots north of the road
are indeed lower than the road. However, the existing grades would act to direct the drainage
south to the road and then toward the low point in the road. At the low point, the road is only a
few inches above the existing ground. In the unlikely event that runoff would travel overland it
would overflow the road at the low point and enter the pond. It is however our opinion that
overland flow is very unlikely due to the dense landscaping common to mobile home park lots,
the free-draining nature of the soils, and the extremely shallow (less than one percent slopes).
In regard to the two low points along the south property it is our opinion that in the predeveloped
condition water from the entire site ran off this property at these two locations. About three
quarters of the site and all of the off-site to the north is being intercepted and diverted into the
proposed pond. Only the five lots south of the road, and not even all of those, will continue to
flow off-site to the south. The runoff from these lots, even with the addition of the mobile home
and the driveway, will be less than what flowed off-site in the predeveloped condition. As stated
previously, it is very unlikely that any runoff would in actuality flow off-site.
Finally, the pond was previously in a separate tract, but John Todd in Planning demanded that
the pond tract be eliminated. We agree with you in prefemng to have the pond in a separate
tract.

DRAINAGE LANGUAGE:
Spokane County does not accept the responsibility to inspect or maintain drainage facilities located outside
of public rights-of-way, except in cases where Spokane County specifically assumes that responsibility in
writing. Neither does Spokane County accept any liability for any failure by the property owner or their .
successor to properly maintain such areas.
The property owner or their successor shall be held responsible for keeping open and maintaining the
surface path of natural or man-made drainage flow over and across their respective properties. If the
property owner or successor should fail to maintain the surface path of natural or man-made drainage flow,
or drainage facilities on this private property, a notice of such failure may be given to the property owner
or their successor. If not corrected within the period indicated on said notice, Spokane County has the right
to correct the maintenance failure, or have it corrected, at the expense of the property owner or their
successor. Spokane County does not accept the responsibility of maintaining the drainage course on private property
or Aoodplain areas within private property, nor the responsibility for a.ny damage whatsoever, including,
but not limited to, inverse condemnation to any properties due to deficient construction and/or maintenance
of drainage courses in drainage easements on private property.
The properl}, owner or their successor shall mainta.in a11 water quality swales (`208' swales) and drainage ditches situated on this property, and any portion of a`208' swale situated in a public right-of-way adjacent to this property, with a permanent ground cover as specified in the currently approved and
accepted plans on file at Spokane County Engineer's Office. No structures, including fences, shall be '
constructed directly over or within a`208' swale without the expressed written consent of the Spokane
County Engineer. Spokane County does not accept the responsibility to inspect and/or maintain the

drainage swales, nor does Spokane County accept any liability for any failure by the lot owner or their
successor to properly maintain such areas.
, Any building that is constructed on this property shall be set at such an elevation so as to provide positive
drainage away from any drainage entry point to the building (including but not limited to a window well, a
window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum '
slope of 3% away from the building for a distance of at least 10 feet from the building. 1'he site shall be
graded so that either a) all runoff is routed away from the building, and conveyed over the site to a natural
drainage swale or approved drainage facility, or b) drainage intercepted on this property is disposed of on
this property in an approved drainage facility. All drainage facilities for this property, including any `208'
swales, shall be constructed in accordance with the approved pla.ns on file at the Spokane County
Engineer's Office. Any proposed changes to the approved road and drainage plans must be approved by
the Spokane County Engineer's Office prior to construction of said changes. '
There may exist properties located uphill and adjacent to this subdivision that periodically discharge
stormwater runoff onto this property. Stormwater runoff from nearby uphill properties should be expected,
and during snow melt periods or wet seasons the lots may be subjected to higher amounts of stormwater
runoff that what is normally observed or anticipated. Because stormwater runoff from adjacent properties
, have discharged onto this properiy prior to development, stormwater runoff will likely continue to do so
, after development.
