The Site Development Plan for Howe Road Manufactured Home Park, MHP-1-99 (attached),
has been reviewed and approved by the Division of Building and Planning (review authority)
pursuant to the requirements of Chapter 14.808 (Manufactured and Mobile Home Standards) of
the Spokane County Zoning Code. Prior to any development of the site, acceptance of an Erosion Sediment Control Plan, issuance
of a grading permit, building permits or other required permit(s), the applicant shall complete the
following:
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant,° which term shall include
the owner or owners of the property, heirs, assigns and successors. Any failure to comply with
the conditions of approval herein will be enforced, pursuant to Chapter 14.406 of the Spokane
County Zoning Code.
Spokane Countv Division of BuildinQ and Plannina
1. The proposal shall comply with the Urban Residential-7 (UR-7) zone, Chapter 14.808 of
the Spokane County Zoning Code and the Spokane County Subdivision Ordinance, as
amended.

2. The applicant shail develop the subject property in accord with the approved site
development plan. Any variations must be reviewed by those agencies of jurisdiction and
approved by the Director of Building and Planning or designee.
3. Prior to recording the final manufactured home park binding site plan, the applicant shall
submit to the Building and Planning Director/designee for review a proposed final
manufactured home park binding site plan to ensure compliance with these Conditions of
Approval.
4. Prior to the leasing of any home space or any site development, a final manufactured
home park binding site plan shall be recorded with the County Auditor, which shall include
a survey of the subject property's perimeter boundary.
5. Four (4) current certificates of title shall be furnished to the County Division of Building
and Planning prior to recording the final manufactured home park binding site plan.
6. Appropriate road name and street address for each parcel shall be indicated on the final
manufactured home park binding site plan.
7. Appropriate utility easements shall be indicated on the final manufacture home park
binding site plan map. Written approval of utility easements by utility companies must be
received prior to recording the binding site plan.
The final manufactured home park binding site plan dedication shall contain the following
statement: "Side yard and rear yard setbacks shall be determined at the time building
permits are requested unless these setbacks are specifically drafted on this binding site
plan. The setbacks indicated on this binding site plan may be varied from if proper zoning
- or variance approvals are obtained."

The final manufactured home park binding site plan dedication shall contain the following
statement: "This final binding site plan shall be developed in accord with the approved
site development plan. Any variations must be reviewed and approved by the Director of
Building and Planning or designee."
Spokane Countv Division of Enaineerin4 and Roads
1. Access permits for approaches to the County Road System shall be obtained from the
County Engineer.
2. Applicant shall submit for approval by the Spokane County Engineer drainage and access
plans.
3. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls shall
be in accordance with standard engineering practices. Paving or surfacing as approved by
the County Engineer will be required for any portion of the project which is to be occupied
or traveled by vehicles.

4. The applicant shall construct a paved and delineated approach to meet the existing
pavement on Howe Road.
5. Fancher Road is not constructed to Spokane County Public Road Standards. Access to
Fancher Road shall be prohibited until such time as specifically authorized by the
Spokane County Engineer.
6. Roadway standards, typical roadway sections and drainage plan requirements are found
in Spokane Board of County Commissioners resolution 95-0498 as amended and are
applicable to this proposal.
7. No construction work is to be performed within the existing or proposed right of way until a
permit has been issued by the County Engineer. All work within the public road right of
way is subject to inspection and approval by the County Engineer.
8. The applicant is advised that the Division of Building and Planning may request that
certain required improvements for manufactured home parks be reviewed for compliance
by the Division of Engineering and Roads. Design Standards for Manufactured Home
Parks are found in the Spokane County Zoning Code.
9. Applicant shall sign "Spokane County Notice to the Public Number 6" which specifies the
following:
The owner(s) or successor(s) in interest agree that in consideration of Mutual Benefits
now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest hereby request and authorize Spokane County to include the
above described property in a Road Improvement District, (RID) and to support the
formation of a Road Improvement District for improvement of the road(s) described below
by requesting and authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting
and authorizing Spokane County to cast their ballot in favor of an RID being formed under
the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against
the formation of an RID being formed under the alternative resolution method provided for
in RCW 36.88.065 and Chapter 35.43 RCW.
If an RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within
the proposed RID are feasible and (2) that the benefits to be derived from the formation
of the RID by the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID, and (3) that the
property within the proposed RID is sufficiently developed; provided, themselves, their
heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result of the improvements
called for in conjunction with the formation of an RID by either the petition or resolution
method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the
Board of County Commissioners confirming the final assessment roll; provided further, it is
recognized that actual assessments may vary from assessment estimate so long as they
do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to
the property.

It is further acknowledged and agreed that at such time as an RID is created or any
County Road Improvement project is authorized by Spokane County, the improvements
required shall be at the sole expense of the owner(s) of property within the RID or served
by the improvements without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. This provision is applicable to Howe Road and Fancher Road.
10. The County Engineer has designated a Local Access Roadway Section for the
improvement of Howe Road which is adjacent to the proposed development. This will
require the addition of approximately 3-5 feet of asphalt along the frontage of the
development. Curbing and sidewalk must also be constructed.
` 11. The County Engineer has designated a Local Access Roadway Section for the
improvement of Fancher Road which is adjacent to the proposed development. This will
require the addition of approximately 30 feet of asphalt along the frontage of the
development. Curbing and sidewalk must also be constructed.
12. The applicant shall grant applicable border easements adjacent to Spokane County right-
of-way per Spokane County Standards.
Spokane Countv Division of Utilities
1. The final manufactured home park binding site plan dedication shall contain the following
statement: "Public sewers shall be constructed to provide for the connection of each
parcel to the County's system of sewerage. Uses on properties within the project shall be
required to connect to the sewer and pay applicable charges per the County Sewer
Ordinance. Sewer connection permits shall be required."
2. Applicant shall submit expressly to Spokane County Division of Utilities "under separate
cover," only those plan sheets showing sewer plans and specifications for the public
sewer connections and facilities for review and approval. Commercial developments shall
submit historical and or estimated water usage as part of the sewer plan submittal.
3. Sewer plans acceptable to the Division of Utilities shall be submitted prior to recording the
final manufactured home park binding site plan.
4. Any water service for this project shal) be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
Spokane Countv Fire District No. 1
1. Prior to issuance of a building permit, the installation of a new fire hydrant at the entrance
to the subject property at Howe Road shall be required.
2. A detail plan of any gates used on the subject property shall be required.

1. Any development of the proposed site shall comply with all air pollution control
regulations. The applicant shall contact SCAPCA, prior to construction and issuance of a
building permit.

and Planning, First Floor, Spokane County Public Works Building, 1026 West Broadway
Avenue, Spokane, Washington 99260-0245. The file may be inspected during normal working
hours, listed as Monday-Friday of each week, except holidays, between the hours of 8:00 a.m.
and 4:00 p.m. Copies of the documents in the record will be made available at a cost set by
Spokane County.
Pursuant to ESHB-1724 and the Board of County Commissioners Resolution No. 96-0293, this
document is also considered the Notice of Right to Appeal. This administrative decision and
SEPA determination is final and conclusive unless within fourteen (14) calendar days after the
decision is issued, a party aggrieved by such decision files an appeal with the Spokane County
Hearing Examiner. The appropriate appeal application and fee information can be obtained
from the Division of Building and Planning. Upon receipt of a complete appeal application, a
public hearing will be scheduled.
This decision was mailed to the applicant and parties of record and other interested parties on
July 28, 1999. The appeal closing date is August 11, 1999.
