Plat: Springfield Addition at Autumn Crest, PE-1570D
Summary,
The applicant is seeking a Design Deviation to construct 308' of Type B curb on Progress
Road at less than 0.5%. The proposed curb grades run from about 0.3% to 0.4%, with
one 25 foot section at 0.08%. Proposed cross -slopes vary from 2.0% to 4.5%
throughout.
Recommendation
I recommend approval of this deviation with the following conditions:
1. A Washington State -licensed Professional Land Surveyor shall verify that the curb
forms are at the grades noted on the approved plans, prior to placement of curb
material.
2. A Washington State -licensed Professional Engineer shall perform a water test on the
completed curb and gutter, to verify that the improvements effectively drain runoff
from the surface of the pavement into the roadside swale. Any sections of pavement
or curbing that do not adequately drain the roadway shall be removed and replaced,
prior to acceptance of the improvements by the County.

ZE-7-89 Agricultural to UR-3.5
1. The proposai is to divide approximately 38.2 acres into 109 lots for single family
dwellings and to change the zoning from Agricultural to UR-3.5.
2. Located: On the southeast comer of Progress and 16th Avenue in the Spokane
Valley. The property is "L" shaped extending south from 16th Avenue and Progress
to the vicinity of 22nd Avenue and then east to Sullivan Road. Located in Section
26, Township 25 North, Range 44 E.W.M., Spokane County, Washington.
3. We find that the rtem has been properly advertised in accordance with state and
local regulations.
4. We have considered and evaluated the information and oonditions contained in the
Planning Report for this proposal.
5. . The Comprehensive Plan designates this area as Urban and is within the Priority
Sewer Service Area (PSSA) boundary.
6. That we believe the proposal is compatible with existmg uses in the area which
. include single family residential uses on similar size lots.
7. We note that ovmers of adjacent and nearby property spoke generally about
improvements concerning 16th Avenue. No one appeared to oppose the proposal.
8. We find the provisions of the State Environmental Policy Act have been complied
with.
9. That we approve the recommended changes in the conditions of approval presented
at the public hearing.
. 10. That the recommended guideline of 35' ft. setback was excessive along 16th Avenue
and Sullivan Road due to existing development in the area and the remote necessity
of the setbadc being necessary.

1. That the below listed oonditions of all Departments and Agencies are binding upon
the applicant, owner(s) of the property, heirs, successors or assigns.
2. The preliminary plat of record approval is for the property legally described in
the application for this proposal.
3. That the Final Plat be deslgned substantially in oonformance with the preliminary
plat of reoord as legally described and advertised. No increase of density or lot
number shall oocur without a new application submittal and approval.
4. The Spokane County Subdivisan Administrator shall review any proposed Final
Plat to insure compliance with the Findings and Conditions of Approval.
5. That the preliminary plat be given conditional approval for three (3) years to
April 1 st, 1992. The applicant may request an Extension of Time by submitting a
written request forty-five (45) days prior to the above expiration date.
6. Upon filing the Final Plat the zone change of the Final Plat area shall be finalized
and the existing Agricultural zone classification shall be changed to UR-3.5.
7. That a Final Plat namelnumber be indicated before the final plat is filed; such
namelnumber to be approved by the County Planning Director/Designee.

8. That appropriate road names be indicated on the plat.
9. That appropriate utility easements be indicated on oopies of the proposed final plat.
Written approval of said utility easements by said utility companies must be
received with the submittal of the final plat.
10. That 3 current certificates of title be fumished the County Planning Department
prior to filing the final plat.
11. That the following statement be placed in the final plat dedication: "No more than
one dwelling structure be placed on any Lot nor shall any lot be further subdivided
for the purpose of creating additional lots, ownerships, or building sites without
first filing a replat."
12. The final plat map shall indicate by a clear dashed line, the required setbacks from
all private, tract x or public roads. the dedication shall contain a statement that:
"Side yard and rear yand setbadcs shall be determined at the time building permits
are requested. The setbadcs indicated on this subdivision may be varied from if
proper zoning approvals are obtained." In addition setbacks for buildings shall be
25' ft. from the Sullivan and 16th Avenue right of way.
13. That a plan for water facilities adequate for domestic service and fire protection be
approved by the water supplier, fire protection district, Spokane County Building
& Safety Department and County health authorities. The agencies will certify on
the WATER PLAN, prior to the flling of the final plat or any phase of the
preliminary plat that the plan is in oonformance with their respective needs and
regulations. The WATER PLAN and certification will be drafted on a transparency
suitable for reproduction and be signed by the plat sponsor.

14. The purveyor will also certify on the Water Plan that appropriate contractual
arrangements and schedule of improvements have been made with the piat sponsor
for construction of the water system in accordance with the approved WATER PLAN.
The time schedule for improvements will provide for completion of the water
system and inspection by the appropriate health authorities prior to application
for building permits within the final plat. The arrangements or agreements will
include a provision holding Spokane County and the purveyor harmless from claims
by any lot purchaser refused a building permit due to the failure of the plat
sponsor to satisfactorily oomplete the approved water system.
15. The final plat dedication will oontain the following statement: "The public water
system, pursuant the WATER PLAN approved by County and State Health
authorities, the local fire district, County Building 8 Safety Department, and
water purveyor, will be installed within this plat, and the subdivider/sponsor will
. provide for individual domestic water service as well as fire protection to each lot
prior to sale of each L,ot and prior to issuance of a building permit for each Lot."
16. That no building permit will be issued for any lot within the Final Plat until
certified by a Washington State licensed engineer "that the water system has been
installed pursuant the approved WATER PLAN for the Final Plat", signed and
stamped by said engineer. The certification may be in the form of a letter but is
preferred to be certified on a copy of the WATER PLAN as a schematic map showing
. the "As Built" water system.
17. That a survey is required prior to the filing of a final plat.
_QQVNTY ENGINEER'S CONDITIQK
1. That plans, profiles, and cross-sections as designed to County standards showing
proposed street centerline and curb grades be submitted to the County Engineer for
approval prior to construction and/or the filing of each final plat; road plans to be °
prepared under the direction of a licensed Professional Civil Engineer.
2. That drainage plans and design calculations showing the alignment of drainage
facilities be submitted to the County Engineer for approval prior to oonstruction
and/or the filing of each final plat. Drainage plans to be prepared under the
. direction of a licensed Professional Civi! Engineer.
3. Construction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed engineer/surveyor, who shall furnish
the County Engineer with "As 6uilt" plans and a certificate in writing that all
improvements were installed to the lines and grades shown on the approved
construction plans and that all cfisiurbed monuments have been replaced.
4. No construction work is to be performed within the existing or proposed public
right of way until a permit has been issued by the County Engineer. All work is
subject to inspection and appraval by the County Engineer.
5. All construction within the existing or proposed public Right-of-Way is to be
completed prior to filing each final plat or a bond in the amount estimated by the
. County Engineer to cover the cvst of construction of improvements, construction

certification. "As Buiit" plans, and monumenting the street centeriines shall be
filed with the County Engineer.
6. No direct aa;ess from bts to Stub Road connections until such roads are constnucted
to County Standards and established as County Roads.
7. Road design, oonstruction, and drainage oontrol for 1/2 Right of Ways and Stub
Road connections are the responsibility of the developer.
8. That appropriate provisions be made that the following descxibed property be held
in trust until the oontinuation of the streets be dedicated or deeded: A I-ft. strip at
the ends or edges of all streets that terminate or border the final plat boundary.
(Temporary cul de sacs are required when streets terminate at the plat
boundaries.)
9. The applicant should be advised that individual driveway access permits are
required prior to issuance of a building permit for driveway approaches to the

2. The purveyor will also certify prior to filing the final plat on a oopy of said water
plan that appropriate contractual arrangements have been made with the plat
sponsor for construction of the water system, in accordance with the approved p(an
and time schedule. The time schedule will provide, in any case, for completion of
the water system and inspeciion by ihe appropriate health authorities prior to
application for building permits within the plat. The contractual arrangements
will include a provision holding Spokane County/City of Spokane. Spokane County
Health District, and the purveyor harmless from claims by any IoVtract
purchaser refused a building permit due to failure of the plat sponsor to
satisfactorily complete the approved water system.
3. A public sewer system will be made available for the plat and individual service
wiN be provided to each lot prior to sale. Use of individual on-site sewage disposal
systems shall not be authorized.

1. The individual signing below has been properly delegated the responsibility for rendering this decision by the Director of the Spokane County Division of Building and Planning.

in Section 26, Township 25 North, Range 44 EWM, Spokane County, Washington.
5. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5) established in 1991 and previously classified as Agricultural (A) (ZE-60-42).
Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing ;
Urban Residential-3.5 (UR-3.5) zone. :
6. The Comprehensive Plan designated this area of the preliminary plat as Urban, and the ~
location is within the Priority Sewer Service Area (PSSA). The Comprehensive Plan
designation remains the same since the original preliminary plat approval. :
7. The subject property is located within the Interim Urban Growth Area (IUGA) adopted by
the Board of County Commissioners (BOCC) Resolution #97-0321.
8. Spokane County has established specific criteria for considering ihe extension of time for .
the expiration of preliminary subdivisions, specifically for regular subdivisions, and "
department policy for short subdivisions. These criteria are found in Section 12.100.118
(Extensions of Time) of the Spokane County Subdivision Ordinance and have been used as
a basis for this decision.
Section 12.100.118 states that "The Director may administratively approve an extension
provided there are no significant changed conditions which would render filing of the plat
or binding site plan contrary to the public health, safety or general welfare, and further
provided one or more of the following circumstances is found to apply."

RESPONSE: Of the 109 lots within the original preliminary plat, 75 lots have been
finalized in four phases, identified as Autumn Crest ls`, Znd, 3' and 4th Additions.
2) That the preliminary subdivision, shor•t subdivision, or binding site plan remains
generally consistent with the original plat or binding site plan that was approved, and
the sponsor has taken substantial steps towards finalizing the plat or binding site plan,
which shall include one, but is not limited to, the following:
a. surveying the lots within the development,
b. arYanging for public services to the site,
c. obtaining necessary financing for all or a portion of the preliminary subdivision,
short subdivision, or binding site plan;
d. the completion of studies or other requirements which were part of preliminary
subdivision, short subdivision, or binding site plan approval;
RESPONSE: The preliminary subdivision remains consistent with the original plat that
was approved. In addition, lots within the original preliminary plat have been surveyed
and public services provided as evidenced by finalization of Autu.mn Crest ls`, 2nd~ 3`d~

This being the day set for the hearing on Spokane County Engineer's Report on the proposed
establishment of ST. CHARLES ROAD, 17m AND 18' COURTS, proceedings for which were
initiated by PRELIlMIINARY RESOLUTION NO. 0-1080, and it appearing to the Board on proof duly
made that Notice of Hearing was published and posted in the manner and for the time required by law,
and the Board after examining the report and maps of the Spokane County Engineer and all claims and
papers on file and after hearing all other evidence adduced at the hearing; and
IT FURTHER APPEARING that the rights of way have been dedicated as public roads, 60 and
50 feet wide, and that said roads are a public necessity and the same should be opened and established as
County road.

in accordance with the drawings and specifications as submitted t~ and
approved by the County of Spokane Engineer's Office on the /s ~ day of
ZU 1998.
No funds will be disbursed from this account without written authorization of
the Spokane County Engineer. This set aside of funds will not be revoked
without the consent of the County Engineer.
In the event that the completion and acceptance of the above-named
improvements for maintenance by the County of Spokane are not accomplished
within a period of one year from the date of this agreement, all funds
remaining in the account will be forfeited to the County of Spokane upon
written request by the Spokane County Engineer's Office to Washington Trust
Bank (Mortgage Company).
It is understood and agreed that upon the forfeiture of the funds to the
County of Spokane, that the County of Spokane will then undertake completion
of the subdivision to be accomplished within twelve (12) months from the date
of forfeiture of funds. It is further understood and agreed that in the event
of any shortage of funds to complete improvements, the County of Spokane may
have recourse against LINDERMAN CONSTRUCTION, INC. (Developer/Borrower) named
above.
It is specifically understood and agreed by the parties, that in holding funds
for this development, Washington Trust Bank (Mortgage company) is not serving
as guarantor for any additional costs incurred by the County of Spokane in the
completion and acceptance of the above-named improvements.

The County Engineers have reviewed the road and drainage plans recently submitted for
this project. The following items must be addressed with the next submittal:
1. The contact at the County is now Jim Radke instead of Ed Pany.
2. Correct the point labels on the cul-de-sac profile.
3. The taper calculations submitted did not employ the correct method. The correct
equation for a shifting taper as proposed is T=WS2/180, or 50', whichever is greater.
4. A Design Deviation must be submitted for curb grades less than 0.5%.
5. Add to Construction Notes 3 and 4 that the utilities must be relocated at least 2'
behind the back of curb.
6. Note what kind of seed or sod will be placed in the Progress swale.
7. It appears that incorrect 10-year peak flow rates were used for determining the curb
inlet dimensions for Sub-Basins T1 and U1. The peak flow rate for T1 is 0.76 cfs,and
the peak flow rate for U1 is 0.99 cfs, according to your time of concentration
calculations.
8. The amount of the financial surety required for the road improvements for this project
is $75,230.00. Please contact me to obtain the paperwork necessary for the filing of
this surety.

as previously submitted. The merging taper formula, WS 2/6 0, has been used at the
request of the Project Engineer, Todd Whipple. An 18' paved width could result in
two unmarked lanes, requiring a merging movement rather than a shifting
movement. The shifting taper formula, WS 2/18 0, has been used for the taper on
the west end, resulting in a 50' taper, as the 40' taper calculated fromW= 8' and

■ Construction Notes 3 and 4 on Sheet 3 of 5 have been modified to indicate a
minimum 2' distance from the back of curb for the relocation of the utilities.
■ Grass turf has been called out for the Progress Road swale, identical to the note in
the Autumn Crest 31 Addition detail for Progress Road swales.
■ The curb inlet calculations for the Sub-Basins T1 and U1 have not been changed.
Both ponds are intermediate ponds, designed to detain and treat a specified `208'
volume, not the peak storm volume flow. If the 10 year flow peak flow rate were
used for the curb inlet calculations in this situation, it would only serve to fill the
pond more quickly to the maximum elevation possible before water would then
flow back out the inlets and into the sump areas in Sub-Basins T2 and U2. The 10
year flow is used in continuous grade curb calculations where flow must be
captured and diverted prior to leaving a plat boundary, but that is not the case
here.
■ The stamped, signed and dated lot plans for Lot 1 of Block 1, Lot 3 of Block 1
and Lot 9 of Block 1 are enclosed.

~Please find enclosed the results of soils classification testing performed by Inland Pacific Engineering
Company, Inc. (IPEC) on the soil sample obtained from the above referenced residential
development.
. Test pit TP-1 was excavated at the approximate location shown on the attached Test Pit Location
Plan. The sa.mple was obtained from between 0.5 feet (approximate bottom of topsoil) and 2.5 feet
below existing grade. The sa.mple location was determined by pacing from existing site features, and
should be considered accurate to the degree implied by the methods used. A portion of the same
sa.mple was delivered to Petroleum Sciences. Inc., who determined the `R' value to be 50 by the
WSDOT 611 test procedure. We certify herein that the sample tested was obtained by a member of
our stafffrom the approximate location stated above, and that based on the data enclosed, the USCS
soil classification of GM is correct for the sample from TP-1.

(hereinafter referred to as the "plat"), undersigned covenants and agrees that:
Spokane County and its authorized agents are hereby granted the right to ingress and egress to, over and
from all public drai.nage easements for the purposes of inspection and emergency maintenance of dra.inage
swales, ponds, ditches, culverts and other drainage facilities, if not properly maintained by the property
owner. Spokane County does not accept the responsibility to inspect or maintain drainage facilities located
outside of public rights-of-way, except in cases where Spokane County specifically assumes that
responsibility in writing , does Spoka.ne County accept any liability for any failure by the property owner(s)
to properly maintain such areas.
The property owners within this plat shall be held responsiple for k6ping open and maintaining the surface
path of natural or man-made drainage flow over and across their respective properties. If the property
owners fail to maintain the surface path of natural or man-made drainage flow, or drainage facilities on
private properties, a notice of such failure may be given to the property owner. If not corrected within the
period indicated on said notice, Spokane County has the right to correct the maintenance failure, or have it
corrected, at the expense of the property owner.

Spokane County does riot accept the responsibility of maintaining the drainage course on private lots or
floodplain areas within private lots, nor the responsibility for any damage whatsoever, including, but not
limited to, inverse condemnation to any properties due to deficient construction and/or maintenance of
drainage courses in drainage easements on private property.
Any building that is constructed on a lot in this plat shall be set at such an elevation so as to provide
positive drainage away from any drainage entry point to the building (including but not limited to a window
well, a window unprotected by a window well, or a doorway). Said positive drainage shall consist of a
minimum slope of 3% away from the building for a distance of at least 10 feet from the building. The lots
shall be graded so that either a) all runoff is routed away from the building, and conveyed over the lot to a
natural drainage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on
the lot in an approved drainage facility. All drainage facilities for this plat, including any `208' swales,
shall be constructed in accordance with the approved plans on file at ihe Spokane County Engineer's
Office. Any proposed changes to the approved road and drainage plans must be approved by the Spokane
County Engineer's Office prior to construction of said changes.
There may exist properties located uphill and adjacent to this subdivision which periodically discharge
stormwater runoff onto individual lots within this plat. Stormwater runoff from nearby uphill properties
should be expected, and during snow melt periods or wet seasons the lots may be subjected to higher
amounts of stormwater runoff that what is normally observed or anticipated. Because stormwater runoff
from adjacent properties have discharged onto this plat prior to development, stormwater runoff will likely
continue to do so after development.

The property owners within this plat shall maintain all water quality swales ("208" swales) and drainage
ditches situated on their respective properties, and any portion of a`208' swale situated in a public right-
of-way adjacent to their respective properties, with a permanent ground cover as specified in the currently
approved and accepted plans on file at Spokane Counfiy's Engineer's Office. No structures, including
fences, shall be constructed directly over or within a`208'swale without the expressed written consent of
the Spokane County Engineer. Spokane County does not accept the responsibility to inspect and/or
maintain the drainage easements or drainage swales, nor does Spokane County accept any liability for any
failure by the lot owner(s) to properly maintain such areas.
This covenant and agreement shall run with the land in perpetuity, and shall be binding upon the owner,
their heirs, successors and assigns, including the obligation to participate in the maintenance of the drainage
facilities as provided herein.

The property owners within this plat shall maintain all water quality swales ("208" swales) and drainage
ditches situated on their respective properties, and any portion of a`208' swale situated in a public right-
of-way adjacent to their respective properties, with a pernianent ground cover as specified in the currently
approved and accepted plans on file at Spokane County's Engineer's Office. No stcuctures, including
fences, shall be constructed directly over or Nvithin a`208'swale without the expressed written consent of
the Spokane County Engineer. Spokane County does not accept the responsibility to inspect and/or
maintain tile drainage easements or drainage swales, nor does Spokane County accept any liability for any
failure by tle lot owner(s) to properly maintain such areas.
This covenant and agreement shall run with the land in perpetuity, and shall be binding upon the owner,
their heirs, successors and assigns, including the obligation to participate in the maintenance of the drainage
