ZE-7-89 Agricultural to UR-3.5
1. The proposal is to divide approximately 38.2 acres into 109 lots for single family
dwellings and to change the zoning from Agricuftural to UR-3.5.
2. Located: On the southeast comer of Progress and 16th Avenue in the Spokane
Vaifey. The property is "L" shaped extending souih from 16th Avenue and Progress
to the vicinity of 22nd Avenue and then east to Suilivan Road. Located in Section
26, Township 25 North, Range 44 E.W.M.; Spokane County, Washington.
3. We find that the item has been properly advertised in accordance with state and
local regulations.
4. We have considered and evaluated the information and conditions contained in the
Planning Report for this proposal.
5. . The Comprehensive Plan designates this area as Urban and is within the Priority
Sewer Service Area (PSSA) boundary.

6. That we believe tfie proposal is compatible with existing uses in the area which
' include single famiiy residential uses on similar size lots.
7. We note that owners of adjacent and nearby property spoke generally about
improvements coRCerning 16th Avenue. No one appeared to oppose tfie proposal.
8. We find the provisions of the State Environmental Policy Act have been complied
with.
9. That we approve the recommended changes in the oonditions of approval presented
at the public hearing.
. 10. That the recommended guideline of 35' ft. setback was excessive along 16th Avenue
and Sullivan Road due to existing development in the area and the remote necessity
of the setback being necessary.

the applicant, owner(s) of the property, heirs, successors or assigns.
2. The preliminary ptat of record approval is for the property legalty described in
the application for this proposal.
3. That the Final Plat be designed substaniially in conformance with the preliminary
plat of reoord as legally described and advertised. No increase of density or lot
number shall occur without a new application submittal and approval.
4. The Spokane Couniy Subdivision Administrator shall review any proposed Final
Plat to insure campliance with the Findings and Conditions of Approval.
5. That the preliminary plat be given conditional approval for three (3) years to
April 1 st, 1992. The applicaM may request an Extension of Time by submitting a
written request forty-five (45) days prior to the above expiration date.
6. Upon fiiing the Fnal Plat the zone change of the Final Plat area shalt be finalized
and the existing Agricultural zone classification shall be changed to UR-3.5.
7. That a Final Pfat name\number be indicated before the final plat is fled; such
namelnumber to be approved by the County Planning Director/Designee.

the WATER PLAN, prior to the filing of the final plat or any phase of the
preliminary plat that the plan is in conformance with their respective needs and
regulations. The WATER PLAN and certifcation will be drafted on a transparency
suitable for reproduciion and be signed by the plat sponsor.

arrangements and schedule of improvements have been made with the plat sponsor
for construction of the water system in accordance with the approved WATER PLAN.
The time schedule for improvements will provide for completion of the water
system and inspection by the appropriate health authorities prior to application
for building permits within the final plat. The arrangements or agreerRents will

sponsor to satisfactorily comptete the approved water system.
15. The final plat dedication will oontain the following siatement: "The pubfic water
system, pursuant the WATER PLAN approved by County and State Heatth
authorities, the local fire district, County Building 8 Safety Department, and
water purveyor, will be installed within this plat, and the subdivideNsponsor will

16. That no building permit will be issued for any lot within the Final Plat until
certified by a Washington State licensed engineer "that the water system has been

stamped by said engineer. The certification may be in the form of a letter bui is
preferred to be certified on a copy of the WATER PLAN as a schematic map showing

17. That a survey is required prior to the filing of a final plat.

facilities be submitted to the County Engineer for approval prior to construction

under the direct supervision of a licensed engineer/surveyor, who shalt furnish

4. No consiruction work is to be performed within the existing or proposed public
right of way until a permit has been issued by the County Engineer. All work is

Collector Arterial Standard for the improvement of St. Charles Road which is to be
construcied within the proposed development. This will require the installation of
40' ft. of asphalt. The oonstruction of curbing and sidewa)k is also required.
The County Engineer has designated Typical Roadway Section Number Two, Access
Street Standard for the improvement of internal streets other than St. Charies
Road, which is to be construcied within the proposed development. This will
require the installation of 36' ft. of asphalt. The construction of curbing is also
required.

The County Engineer has designated Typical Roadway Section Number Two, Access
Street Standard for the improvement of Progress Road which is to be constructed
adjacent to the proposed devebpment. This wili require the insiallation of 10' to
12' ft. of asphalt. The construciion of curbing is also required.
17. The proposed plat shall be improved to the standards set forth in Spokarte County
Board of Commissioners Resolution No. 80-1592, as amended, which establishes
regulations for roads, approaches, drainage, and fees in new construction.
18 Q. This plat or development proposal is located within a drainage basin whcct~ has been
Q identified by the Spokane County Engineer's Office as having stormwater runoff
problems. Since this plat or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the
planning and implementation of a future basinwide stormwater management
system. The following statement shall be placed in the plat dedication: 'That the
owner(s) or successor(s) in interest agree to join in any County approved
Stormwater Management Program and to pay such rates and charges as cf►ay be
fixed through public hearings for service or benefit obtained by the planning,
design, constructing, maintaining or operation of stormwater control facilities".
Note: The proposed road right of way dedication depicted on the prelimmary plat is
consistent with the County Arterial Road Plan. This dedication eliminates the need
for the establishment of a reserve strip along either of the arterials.
19. That Sullivan Road and 16th Avenue be improved per the approved Typical Roadway
Cross Sectans for those roadways. A copy of these Cross Sections is available at
the County Engineer's Office for inspection. These improvements will consist of
1/2 right of way along the froMage of the site.
20. Any change in alignment, removal or relocation of power lines iocated along the
West side of Sullivan Road is the responsibility of the applicant.
21. That the location of the 21 st Avenue intersection at Sullivan Road shall correspond
with the intersection alignment of 21 st within the proposed plat of Ridgemont 3rd
. . Addition. If the alignment of ihe intersections is not possible then the intersection
shall be offset per Spokane County Standards.
22. Construction of the median depicted on the preliminary plat at the 21 st Avenue,
Sullivan Road intersection is subject to the approval of the County Engirreer.
Additional right of way width may be required if approval of construction is given.
22S,JNTY HEALTH DI$TRIrT CQNDITION$
1. A plan for water facilities adequate for domestic use, domestic irrigation use, and
fire protection use shall be approved by the water purveyor. Said water plan must
have been approved by the fire protection district and the appropriate health
authorities. The health authorities, water supplier (purveyor), and the fire
protection district will certify, prior to the filing of the final plat, on the face of
said water plan that the plan is in conformance with their requirements and will
adequately satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.

2. The purveyor will aiso certify prior to filing the final plat on a copy of said water
plan that appropriate oontraciual arrangements have been made with the plat
sponsor for construction of the water system, in accordance with the approved plan
and time schedule. The time schedule will provide, in any case, for completion of
the water system and inspection by the appropriate health authorities prior to
application for buiiding permits within the plat. The contractual arrangements
wiil include a provision holding Spokane County/City of Spokane, Spokane County
Health Districi, and the purveyor harmless from claims by any lot/tract
purchaser refused a building permit due to failure of the plat sponsor to
satisfactorily complete the approved water system.

THIS MATTER, a request for an extension of time from Landreth Construction has been
received and decided upon, pursuant to Spokane County Subdivision regulations (Section
12.100.118) and RCW 58.17.140.
FINDINGS OF FACT
1. The individual signing below has been properly delegated the responsibility for renderincID,
this decision by the Director of the Spokane County Division of Building and Planning.
2. The original preliminary plat proposal was.to divide approximately 38.22 acres into 109
lots for single family residences.
3. The subject preliminary plat was approved by the Hearing Examiner Committee on March
23, 1989.
4. The proposal is generally located at the southeast comer of 16' Avenue and Progress Road
in Section 26, Township 25 North, Range 44 EWM, Spokane County, Washington.
5. The existing zoning of the property described in the application is Urban Residential-3.5
(tJR-3.5) established in 1991 and previously classified as Agricultural (A) (ZE-60-42).
Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing
Urban Residential-3.5 (UR-3.5) zone.
6. The Comprehensive Plan designated this area of the preliminary plat as Urban, and the
location is within the Priority Sewer Service Area (PSSA). The Comprehensive Plan
designation remains the same since the original preliminary plat approval.
7. The subject property is located within the Interim Urban Growth Area (IUGA) adopted by
the Board of County Commissioners (BOCC) Resolution #97-0321.
8. Spokane County has established specific criteria for considering the extension of time for
the expiration of preliminary subdivisions, specifically for regular subdivisions, and
department policy for short subdivisions. These criteria are found in Section12.100.118
(Extensions of Time) of the Spokane County Subdivision Ordinance and have been used as
a basis for this decision.
Section 12.100.118 states that "The Director may administratively approve an extension
provided there are no significant changed conditions which would render filing of the plat
or binding site plan contrary to the public health, safety or general welfare, and further
provided one or more of the following circumstances is found to apply."

1) That some portion of the existing preliminary plat has been frnalized since the last
extension was granted and the remaining lots would form a unified development
consistent with the original approval;
RESPONSE: Of the 109 lots within the original preliminary ~lat, 751ots have been
finalized in four phases, identified as Autumn Crest 15t, Znd, 3rand 40, Additions.
2) That the preliminary subdivision, short subdivision, or binding site plan remains
generally consistent with the original plat or binding site plan that was approved, and
the sponsor has taken substantial steps towards finalizing the plat or binding site plan,
which shall include one, but is not limited to, the following.•
a. surveying the lots within the developmenr,
b. arranging for publ ic services to the site,
c. obtaining necessary financing for all or a portion of the preliminary subdivision,
short subdivision, or binding site plan;
d. the completion of studies or other requirements which were part of preliminary

RESPONSE: The preliminary subdivision remains consistent with the original plat that
was approved. In addition, lots witlun the original preliminary plat have been surveyed
• and public services provided as evidenced by finalization of Autumn Crest ls', 2nd' 3rd,
and 4" Additions.
3) That at the time the preliminary plat approval was granted, development of the
proposal was conditioned upon the extension of public services tivhich are not yet
available. This provision shall not apply to public utility extension which the project
sponsor would normally fund.
RESPONSE: Not applicable.
4) That adrrrinistrative delays have caused the inability of the applicant to finalize the plat
tivithin the five (S) year time period.
REPSONSE: Not applicable.
9. This is the third request for a time extension. The total life of the preliminary plat has been
approximately eight years.
10. The proposal has been circulated to all affected acrencies and departments for comments.
No additional conditions have been recommended by the various reviewing agencies an
departments, including the Spokane County Division of Engineering and Roads, the
Spokane County Division of Utilities, the Spokane Count- Division of Building and
Planning, and the Spokane Regional Health District.
CONCLUSIONS
BASED UPON A REVIEW of (a) the criteria for approving an extension of time of the
expiration date for a preliminary plat and (b) the above FindinQs of Fact, the followincy
conclusion is made:

received and decided upon, pursuant to Spokane Ciounty Subdivision regulaaon (Chapter III,
Sectiori' G) and'RCW'58.17.140. '
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the resgonsibility for
rendering this decision by the Spokane County Director of Planning.
2. The proposal was to subdivide approxunately 38 acres into 109 lots for siiigle family
dwellings. .
3. The subject preliminary plat was approved by the Hearing Examiner Committee on
March 23, 1989. 4. The proposal is generally located at the southeast corner of 16th avenue and Progress
Road in Section 26, Township 25 North, Range 44 EWM, Spokane County,
Washington. -
5. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5), previously established as Agricultural zoning in 1942 and redesignated to
Urban Residential-3.5 (UR-3.5) on January 1, 1991 consistent with the Program to
Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the
proposal does conform to the requirements of the exisdng Urban Residential-3.5
(UR-3.5) zone.
6. The Comprehensive Plan designates this area of the preliminary plat as Urban, and the
location is within the Priority Sewer Service Area. The Comprehensive Plan
designation remains the same since the original preliminary plat approval.
7. Spokane County has established specific criteria for considering the extension of time
.,fqr, the expiration of preliminary subdivisions, specifically for regular subdivisions, and department policy for short subdivisions. These criteria are found in Chapter III,
Section G of the Spokane Counry Subdivision Ordinance and have been used as a basis
for this decision.
Section G states, "Approval of a preliminary subdivision shall automatically expire
three years after preliminary approval is granted unless a time extension is applied for."
and f.ollows with "Upon appIicadon for time extension, the Planning Director or
designee may administratively approve extensions for up to three (3) year petiods
provided at least one of the following circumstances is fount to Apply:" The following
are the relevant sections of Section G and the Planning Department response:
1. That some portion of the existing preliminary plat has been finalized since the last
•extension was-granted and the remaining lots would form a unified development
consistent with the original approval;
RESPONSE; Of the 1091ots within the original preliminary plat, 521ots have
been finalized in tluee phases, identified as Autumn Crest 1 st, 2nd and 3rd
Additions.
2. That the preliminary plat as approved remains consistent with the Generalized
Comprehensive Plan for Spokane County insofar as density AND other

development provisions apply, and the sponsor has taken substantial steps
towands finalizing his plat, which shall include but not be limited to:
a. surveying the lots within the development,
b. arranging for public services to the site,
c. obtaining necessary financing for all or a portion of the preliminary plat,
d. the completion of stud.ies or other requirements which were part of
preliminary plat approval;
RESPONSE: The approved preliminary plat remains consistent with the Urban
category of the Comprehensive Plan, which remains the same since the original
preliminary plat approved. In addition, lots within the original preliminary plat
have been surveyed and public services provided as evidenced by finalization of
Autumn Crest 1 st, 2nd and 3rd Additions.
3. That at the time preliminary approval was granted, development of the proposal
was conditioned upon the extension of public services which- are not yet available.
This provision shall not apply to public utility extension which the project
sponsor would normally fund.

8. No additional condidons have been recommended bythe various reviewing agencies
1nd deparcments, including the County Engineer's Office, County Health District,
County Utilities and the Department of Building & Safety. However, the Central
Valley School District has responded to the extension of time request and has indicated that existing facilities are inadequate to accommodate the impacts generated by the
proposal. The School District has,requested that the applicant be recluired to reach a
voluntary agreement to mitigate the impacts of this proposal on dhe School District.
1'his request is included as a condition of approval for this extension of dme.
9. This is the second request for a time extension. The total life of the preliminary plat has
been approximately 5 years.

of our conversation, the provided `208' volumes in the report submitted to you
previously are based only on bottom area of the pond times 0.5' of depth. I have
recalculated the provided volumes, adding the allowed side slope volumes to the
total volumes provided. The areas, perimeters, and Page 4 of the drainage report
~ are included for your review. I apologize for misinterpreting your original
comment regarding the inclusion of sidewalk areas in the `208' calculations.
Hopefully, this will allow you to accept the plans, as none of the ponds needed to
be changed. Please give me a call when our set of mylars is ready for pick up.

Thank you for your recent comments on our submittal of the above referenced
project. The following items have been addressed in response to your comments:
The street section design for St. Charles Road is a continuation of the approved
section for St. Charles Road for the Springfield at Autunm Crest plat. The
Progress Road section is a continuation of the approved Progress Road section in
the Springfield at Autunm Crest plat. The street section for 17" Court is identical
to the approved section for 18'" Court in Springfield at Autunm Crest. The 16`n
~ Avenue section is a continuation of the 16`'' Avenue section for Whisperwood, the
i ' approved plat to the east of Springfield First Addition at Autunm Crest. Copies of
i ~ the sections from the referenced plats are attached.

~I rechecked all the impervious areas as listed in the drainage report and found
' some of them to be different than the drainage report, as you suggested. The
, revised impervious areas are contained in Table 1, Page 3 of the drainage report.
Please note that I have also weighted the "C" factor, in order to incorporate
sidewalk areas as impervious areas. A separate work sheet has been included for
; verification. Pond A1 has been enlarged slightly to meet the additional "208"
~ requirement for the recalculated impervious area. No lot plan revisions were i ~ necessary, as Pond A1 is not located on a residential lot.

I received the plan submittal for the above referenced project on October 25, 1999.
I have reviewed the submittal and I have the following comments:
1. The submittal is missing the ioformation on how the street section designs were arrived at. Please submit this in you negt subinittal. .
2. I spot checked the impervious area calculation for one for one of the street
basins and I have a considerable difference in area with what you showed.
Please provide your work sheet calculations of irnpervious area for each basin.
Sidewalks must be included since they drain to the treatment facility. (See 5-1 of
th e GSN)
If you find any probtems with your submittal, ptease make any necessary changes
that may be required and resubmit your plans. I did not find any other areas of
concern.

Plat: Springfield Addition at Autumn Crest, PE-1570D Summarv
The applicant is seeking a Design Deviation to construct 308' of Type B curb on Progress
Road at less than 0.5%. The proposed curb grades run from about 0.3% to 0.4%, with
one 25 foot section at 0.08%. Proposed cross-slopes vary from 2.0% to 4.5%
throughout.
Recommendation - I recommend approval of this deviation with the following conditions:
1. A Washington State-licensed Professional Land Surveyor shall verify that the curb
forms are at the grades noted on the approved plans, prior to placement of curb
riaterial.
2. A Washington State-licensed Professional Engineer shall perform a water test on the
completed curb and gutter, to verify that the improvements effectively dra.in runoff
from the surface of the pavement into the roadside swale. Any sections of pavement
or curbing that do not adequately drain the roadway shall be removed and replaced,
prior to acceptance of the improvements by the County.

The County is starting the process to establish the roads constructed in this project. This
Savings Certificate may now be reduced from the original amount of $175,000.00 to
$17,500.00 (Seventeen Thousand Five Hundred and NO/100 USDollazs).
In accordance with the terms of this document, we will provide a statement notarized by
the County Engineer to notify you when this surety may be converted to address warranty
issues, and the amount needed to secure performance of warranty work. This will occur
when the Board of County Commissioners passes a resolution to establish the
improvements required by this project for maintenance by County forces. We expect that
this will occur in the next six to eight weeks.

This being the day set for the hearing on Spokane County Engineer's Report on the proposed
establishment of ST. CHARLES ROAD, 17TH AND 18TH COURTS, proceedings for which were
initiated by PRELIlVIINA1tY RESOLLITION NO. 0-1080, and it appearing to the Board on proof duly
made that Notice of Hearing was published and posted in the manner and for the tune required by law,
and the Board after examining the report and maps of the Spokane County Engineer and alI claims and
papers on file and after hearing all other evidence adduced at the hearing; and

DRAINAGE DECLARATION OF COVENANT
In consideration of the approval by Spokane County of PE1570-89 - SQringfield First Addition at Autumn
Crest, hereinafter refened to as the "plat"), the undersigned covenants and agrees that:
The property owners within this plat shall be held responsible for keeping open and mainta.ining the surface
path of natural or man-made drainage flow over and across their respective properties. Ifthe property owner(s)
fails to maintain the surface path of natural or man-made drainage flow, or the drainage swale, a notice of such
failure may be givcn to the property owner(s). If not conected within the period indicated on said notice,
Spokane County has the right to correct the maintenance failure, or have it corrected, at the expense of the
property owner.
There may eacist properties located uphill and adjacent to tlus subdivision which periodically discharge stormwater
runoff onto individual lots within this plat. Runoff from nea.rby uphill properties should be expected, and during
snowmelt periods or wet seasons the lots may be subjected to higher amounts of storm,"eter runoff that what is
normally observed or anticipated. Because stormwater runofffrom adjacent properties have discharged onto this plat
prior to devclopment, stormwater runoffwill likely continue to do so aftcr development. It is the responsibility of the
individual lot owners to maintain existing surface paths of runoffthrough their respective lots and to grade the lots
in accordance with applicable rules and regulations, so as to prevent property damage.
Any building that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive
drainage away from any drainage entry point to the building (including but not limited to a window well, a
window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum slope
of 3% away from the building for a distance of at least 10 feet from the building. The lots shall be graded so
that either a) all runoff is routed away from the building, and conveyed over the lot to a natural drainage swale
or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved
drainage facility. The approved drainage facility shall be constructed in accordance with any applicable
accepted plans on file at the County Engineer's Office. Any revisions to the accepted drainage plans must be
accepted by the County Engineer's Office prior to construction of said revisions.
Spokane County does not accept the responsibility of maintairiing the drainage course on private lots or floodplain
areas within private lots, nor the responsibility for any damage whatsoever, including, but not limited to, inverse
condemnation to any properties due to deficient constnzction and/or maintenance of drainage courses in drainage
easements on private property. The property owners Nvithin this plat shall maintain all vNrater quality swales ("208" swales) and drainage ditches
situated on their respective properties, and any portion of a`208' sNvale situated in a public right-of-way adjacent to
their respective properties, with a permanent ground cover. as specified in the currently approved and accepted plans
on file at Spokane County's Engineer's Office. No structures, including fences, shall be constructEd directly over
or within a`208' sNvale without the expressed Nvritten consent ofthe Spokane County Engineer. Spokane County does
not accept the responsibility to inspect and/or mainta.in the drainage easements or drainage swales, nor does Spokane
County accept any liability for any failure by the lot owner(s) to properly maintain such areas.
The oNvner(s) or successor(s) in interest agree to join in any County-approved stormwater management program

Plat Dedication and Drainage Language
Drainage easements, as platted and shown hereon, which are for
the purposes of installing, operating and maintaining drainage
ponds and drainage facilities to dispose of runoff, are hereby
granted to Spokane County.
The property owners within this plat shall be held responsible
for keeping open and maintaining the surface path of natural or
man-made drainage flow over and across their respective
properties. If the property owner(s) fails to maintain the
surface path of natural or man-made drainage flow, or the
drainage swale, a notice of such failure may be given to the
property owner(s). If not corrected within the period indicated
on said notice, Spokane County has the right to correct the
maintenance failure, or have it corrected, at the expense of the
property owner.
There may exist properties located uphill and adjacent to this
subdivision which periodically discharge stormwater runoff onto
individual lots within this plat. Runoff from nearby uphill
properties should be expected, and during snowmelt periods or wet
seasons the lots may be subjected to higher amounts of stormwater
runoff that what is normally observed or anticipated. Because
stormwater runoff from adjacent properties have discharged onto
this plat prior to development, stormwater runoff will likely
continue to do so after development. It is the responsibility of
the individual lot owners to maintain existing surface paths of
runoff through their respective lots and to grade the lots in
accordance with applicable rules and regulations, so as to
prevent property damage.
Any building that is constructed on a lot in this plat shall be
set at such an elevation so as to provide positive drainage away
from any drainage entry point to the building (including but not
limited to a window well, a window unprotected by a window well,
or a doorway). Said positive drainage shall consist of a minimum
slope of 301 away from the building for a distance of at least 10
feet from the building. The lots shall be graded so that either
a) all runoff is routed away from the building, and conveyed over
the lot to a natural drainage swale or approved drainage
facility, or b) drainage intercepted on the lot is disposed of on
the lot in an approved drainage facility. The approved drainage
facility shall be constructed in accordance with any applicable
accepted plans on file at the County Engineer's Office. Any
revisions to the accepted drainage plans must be accepted by the
County Engineer's Office prior to construction of said revisions.
Spokane County does not accept the responsibility of maintaining
the drainage course on private lots or floodplain areas within
private lots, nor the responsibility for any damage whatsoever,
including, but not limited to, inverse condemnation to any
properties due to deficient construction and/or maintenance of
drainage courses in drainage easements on private property.
The property owners within this plat shall maintain all water
quality swales 208~ swales) and drainage ditches situated on
their respective properties, and any portion of a'208' swale
situated in a public right-of-way adjacent to their respective
properties, with a permanent ground cover as specified in the
currently approved and accepted plans on file at Spokane County's
Engineer's Office. No structures, including fences, shall be
constructed directly over or within a'208' swale without the
expressed written consent of the Spokane County Engineer.
Spokane County does not accept the responsibility to inspect
and/or maintain the drainage easements or drainage swales, nor
does Spokane County accept any liability for any failure by the
lot owner(s) to properly maintain such areas.
The owner(s) or successor(s) in interest agree to join in any
County-approved stormwater management program and to pay such
rates and charges as may be fixed through public hearings for
service or benefit obtained by the planning, design,
constructing, maintaining or operation of stormwater control
facilities.
