The Hearing Examiner has reviewed the appiication for alteration of the final plat of
Jacob,s Addition and the evidence of record, and hereby adopts the follawing findings of fact
and conclusians:

A. GENERA.L INFORMATION:
Applicant: Don Henrichs, 2918 North Argonne Road, Spokane, WA 99212
Location: Generally located north of and adjacent to 40 Avenue, approximately 651 feet east
of the intersection of Bowdish Road and 4`' Avenue in Section 21, Township 25 North, Range 44
' EWM, Spokane County, Washington.
Zoning: Urban Residential-22 (tJR-22) and Urban Residential-3.5 UR-3.5)

Compreheasive Plan Category: Urban
Environmental Review: Exempt from SEPA review under WAC 197-11-800.

I Site Description: The site is relatively flat, and consists of three lots that comprise the final
plat of Jacob's Addition, recorded on Ja.nuaxy 14, 1987 in Book 18 of plat, page 29. Lots 1 and 2
are improved with single-family residences along with appurtenant accessory buildings and
~ structures. Lot 3 includes drainage easements approved with the final plat. Site improvements
are under construction on Lot 3 for multi-family development. Overhead transmission lines
border the site along the north and south property lines.
Surroundiag Conditions: The site fronts along 4" Avenue, a Collector Arterial, which is
paved but has no curb or sidewalks. The site is surrounded by UR-3.5 zoning, with a Light
Industrial (I-2) zone located about 60 feet north of the site. The land located immediately west of
Lot 3 of Jacob's Addition is undeveloped. The site fronts along the south side of an old railroad

interest of lots, tracts, sites or divisions in the subdivision or portion thereof to be altered;
provided that the application must contain 100% of such signatures if the praposed alteration
would result in the violation of a covenant. While only the signature of the owner of Lot 3
appears ta be required to authorize the alteration requested, the applicant has secured the
signatures of all the owners of lots in the final plat of Jacob's Addition.
2. The public use and interest will be served bv approval of the proposed plat alteration.
RCW 58.17.215 requires that the decision-maker determine the public use and interest in
the proposed alteration and deny or approve the application. The record indicates that road and
drainage plans have been submitted by the applicant for the site and appraved by County
Engineering, which do not rely on the drainage easements in Lot 3 of the final plat. The Division
of Building and Placwing indicated that the proposed alteration is not relevant to compliance or
consistency with the County Zoning Code or Comprehensive Plan. The proposed alteration is
clearly in the public interest.
III. DECISION
Based on the Findings of Fact and Conclusions above, the above plat alteration
application is approved, subject to the following conditions:
1. Pursuant to RCW 58.17.215, the applicant shall submit a revised drawing showing
deletion of the above-referenced drainage easements in Lot 3 of the final plat of Jacob's
Addition, and revision to any necessary language in the dedication for such final plat language
with regard ta such easernents. The revised drawing and alteration shall be submitted to the
Division of Building and Planning, in a form acceptable to the Division. The Division shall
submit the same to the Board of County Cammissioners at a public meeting for signature, and
' provide the Board with a copy of this decision. Following signature of the $oard of County
Commissioners, the revised drawing and alteration shall be recorded with the Spokane County
Auditor as part of the lawful plat of the property.

~ 2. The fmal plat shall remain subject to the conditions of approval for such final plat as
~ previously imposed, except as modified by this alteration.
