AFter 1 months r es ideni_y in our Prestigious Larrzce Douglass
Ridge'rnont Estates home we hae 10 creaks in the floor. We have
now been here a1.rnosi N months, there are 15 creaks in the floor,
t:tv'o of which are groans originating from heating ducts. Walking
on the floor causes items on dressers, tables, in pantry, etc., to
shale and vibrate. Neither of us is obese, nor do we walk with a
heavy step. The joisLs do not appear to be either nailed or glued
to the flooring. We've spoken to a contractor regarding what is
required by you to cor.•ect these conditions.
The deck off the dining area was unstable, we found the stairs for
the most part without nails on the right side. The support 4x4's
were not bolted to the metal base, only nailed with two nails.
After sending you FOUR .letters, and phoning you FIVE times
regarding the hydroseeding of the swale you sent two young men to
hand seed. We were told it was to be hydroseeded. The bottom of
the swale was filled to levee with the drain with topsoil which had
blown there from the yard. The sides of the swale were exposed
rocks. We faithfully watered your seed for three weeks, our
efforts resulted in a strip of grass in the swale about 15" by 3'.
An evaluation of the slope of the sides makes it obvious that
hydroseeding is the only way the seed will adhere to the sides. After
contacting you NINE times, we corresponded with Spokane County, to get
the correct dimensions for our swale. We spent 5 hours raking and
shaping the swale, pulling up the topsoil and covering the rocks. We
lowered the swale floor to below the level of the drain. We
hydroseeded the swale. You failed to meet your contractual agreement
with us regarding this matter.
We have also contacted you regarding the fact that there .is riot/'
texture over the entry way door, baseboards were damaged`"by
carpet: installer, there is a hole in the wall behind the toilet
in master bath, both baths need painting completed, paint on woodwork
gloss paint over flat wail paint in all rooms, fireplace screen not
attached, etc., a Long list... Your implication these items ;`are
related to cleaning is absurd.

I received your letter dated July 2, on July 13th. Squeaks are not uncommon and I do not guarantee against
them. We not only nail and glue the floor down, but also screw it down. My office will be contacting you
to set up an appointment to reduce your squeaks and look at your deck railing. For your information, your
home and deck was inspected by Spokane County and no code violations were noted.
I have received 3 letters from you and 1 from the Better Business Bureau. The letter of March 30, you sent
me on 2 different occasions and all where replied to in a timely manner. You first letter dated March 15, I
received on March 20th and replied in my letter dated March 24th. You then sent a letter Dated March 30th
which I received on April 3 and replied to in my letter of April 6th. On April 17th I received the March
30th letter again to which I had already responded to in my letter of April 6th. Then on June 19th I received
a copy of a letter dated May 10th, which I had not previously received, from the Better Business Bureau.
The letter was requesting completion of the swale which had already been seeded May 26th. A letter was
then sent to the Better Business Bureau stating the work had already been completed.
I doubt that you have called 14 times and not gotten a response. I suggest all future correspondence to my
office be in writing. If you would read your earnest money agreement you will notice that I was only to
seed the 208 area which I did. After the seed was placed, my men noted on several occasions that the
seeded area was dry as a bone. It appeared to us that contrary to your statement the seed was not watered
properly. On none of you letters was it mentioned that the swale was improperly graded. How would I fix
something I know nothing about?
In regards to texture over entry door, damaged baseboards, hole behind toilet, paint on woodwork,
incomplete painting and gloss paint over flat, why was not one of these mentioned on your walk thru which
was signed by your husband? Apparently these items were not present at that time and occurred after move
in. As stated in all my previous letters no action will be taken in regards to paint, texture or cleanliness of
your home.

The earnest money agreement to which you refer to in paragraph 3 clearly states on line 15 "swale only to
be seeded in spring". The word hydroseed is one which you will not find in the earnest money agreement. I
suggest you read what you signed before making these misrepresentations. Prior to your July 2 letter
nothing was mentioned in regards to your swale grading.
As stated in my letters of March 24, April 5 and July 18, I will not come out and fix any cosmetic item that
were not on the walk through list. No where on the walk through list, a copy

On March 31st my repairman visited you home and repaired your fireplace screen and your husband signed
off on this repair. Your husband also told him not to repair the crack on the fireplace unless the mortar
would be a perfect match. This is impossible to do so nothing was done or will be done with the cracks.
As stated in my July 18th letter squeaks are not uncommon and I do not guarantee against them. We have
repaired many squeaks already and will not be returning to repair any more.
I have attached a page from the RWC and HOW warranty programs concerning concrete cracks. If any of
your concrete cracks exceeds those allowed please let me know in writing before 1-31-96. If I do not hear
from you in regards to these cracks by that time, I will assume the cracks are within the allowable tolerance
and no action will be taken.
