CASE BEFORE THE BOARD: VE -19-90
After consideration of all available information on file, exhibits submitted and testimony
received during the course of the public hearing held on July 16, 1990, the Spokane
County Zoning Adjustor rendered a written decision August 9, 1990 to APPROVE the
application. The decision was amended on September 20, 1990 to include a standard
condition of the Utilities Department which was inadvertently left out of the original
decision. The applicant is also appealing the imposition of that condition. This is an
unusual appeal in the sense that conditions of approval from departments other than the
Planning Department are the subjects of the appeal.
The applicant objects to the recommendation of the Spokane County Engineer to (1)
authorize the County to place the applicant's name on a petition for the formation of a
Road Improvement District (RID), and (2) to dedicate 7.75 feet of land on both South
Riverview and Center Road in order to eventually establish a 50 foot right-of-way street
standard. The applicant states that the present streets are adequate for the area and that
no additional right-of-way for future expansion is needed. The applicant also objects to
the County Utilities Department conditions of approval regarding compliance with the
rules and regulations of the Spokane County Health District and agreement to
participate in the formation of a sewer district (ULID) at such time as one might be
proposed.
Each of the conditions being appealed is an ordinance or has been adopted as part of an
attachment to a resolution adopted by the Board of County Commissioners (BOCC).
In each instance, a specific standard or performance requirement is the object of the
appellant's displeasure. The Zoning Adjustor concluded that the street standards and
the formation of a future Utility Local Improvement District for sewage disposal are
consistent with adopted County ordinances and BOCC resolutions. The various
County agencies involved - Utilities, Health District and Engineers - have forwarded
specific responses for the Board of Adjustment in support of the conditions of approval
for granting this variance.
