The easement that BPA acquired allows BPA to restrict the use of the right-of-way by the underlying fee-owner for various reasons. Current BPA policy does not allow buildings in the right-of-way larger than 1000 cubic feet. Safety concerns,to both the landowner and to BPA facilities,with having a large building in close proximity to a high-voltage power line have required BPA to restrict the construction of buildings within the easement area. I have relayed this information to Mr. Colburn and he informed me that he would go ahead and build it anyway. BPA understands that it is not the place of the City of Spokane Valley to get in the middle of this dispute, but I would appreciate it if you would note in your file that the BPA is not in agreement that a building can be placed within the easement area on Mr. Colburn's parcel.
