Developer hereby agrees that should such drainage facilities and sod not be constructed in accordance with the approved drawings within six months of occupancy, Spokane County may then use the securiry to bring these facilities and sod into conformance therewith. Developer shall be responsible for any costs incurred by the counry in excess of the amount of securiry. Spokane County agrees to retum to Developer any unused funds upon satisfactory completion of these facilities and sod.
