INTRODUCTION
This matter has come before the Hearing Examiner Committee on July 23, 1992. The
members of the Committee present are Jane Myers, Chairperson, Frank Yuse and
Harry Gibbons.
PROPOSAL
The sponsor, Jim McGuffin, requests approval of a Preliminary Plat of-Golden
Acres, PE-1661-92, with existing Urban Residential-3.5 (UR-3.5) zoning within the
Aquifer Sensitive Area Overlay Zone
FINDINGS OF FACT AND CONCLUSIONS
1. The sponsor has withdrawn his application for the preliminary subdivision approval
in a letter dated July 14, 1992.
2. The Hearing Examiner Committee received no public objection to the withdrawal of
this item.
ORDER
The Hearing Examiner Committee, pursuant to the above Findings of Fact and
Conclusion, ACCEPTS the withdrawal of Golden Acres, PE-1661-92, from the July
23, 1992 Hearing Examiner Committee Agenda.

SHORT PLAT NO. SP-89-577) CONCLUSIONS AND DECISION
THIS MATTER, an application for subdivision of land, from Virginia Farman
has been received and d cided upon, pursuant to Spokane County Subdivision
.regulations, on the ay of, 19 rte.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility
for rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide into lots for the development of Single Family Residential.
3. The proposal is located at the North East corner of Montgomery and Long Roads.
4. The current zoning of the property is Agricultural. The proposed lot sizes, frontage
and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this
category/designation.
6. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited
7. No one in the area commented on the proposal.
8. The County Engineer has examined this development proposal and has determined
that the impact of this proposal upon the existing County Road System warrants the
dedication of additional Right of Way and the roadway improvements herein
specified.
9. Recognizing the recommended conditions and Spokane County development
standards, the proposed subdivision makes appropriate provisions for the public
health, safety and general welfare and that the public use and interest will be served
by platting the subdivision.
10. The project is exempt from environmental review under the State Environmental
Policy Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat
Application SP-89-577 is hereby APPROVED, subject to conditions noted below.
Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision.

These Conditions of Approval apply to applicant(s), owners(s) of the
property, heirs, assigns or any successors in interest to property
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The final plat shall be designed substantially in conformance with the preliminary
plat of record as legally described and advertised. No increase of density or lot
number shall occur without a new application submittal and approval.
3. The Spokane County Planning Director/designee shall review any proposed final plat
to ensure compliance with these Findings and Conditions of Approval.
4. The preliminary plat is given conditional approval for three (3) years, specifically to
July 1. 199_The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
5. Appropriate road names shall be indicated on the plat.
6. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies must be
received with the submittal of the final plat.
7. Three (3) current certificates of title shall be furnished the County Planning
Department prior to filing the final plat.
8. The following statement shall be placed in the final plat dedication: 'No more than
one (1) dwelling structure shall be placed on any lot, nor shall any lot be further
subdivided for the purpose of creating additional lots, ownerships or building sites
without first filing and receiving approval of a replat."
9. The final plat map shall indicate by a clear dashed line the required yard setbacks
from all private, "Tract X" or public roads. The dedication shall contain the
following statement that: "Side yard and rear yard setbacks shall be detemuned at
the time building permits are requested. The setbacks indicated'on this plat may be
varied from if proper zoning approvals are obtained."
10. No water plan is required and a simple tap is needed at time of Building Permit
release.
11. A survey is required prior to the filing of a final plat.
12. The Spokane County Planning Department shall prepare and record with the
Spokane County Auditor a "Title Notice" noting that the property in question is
subject to a variety of special conditions. imposed as a result of approval of a land use
action. This "Title Notice " shall serve as official public notice regarding conditions
of approval affecting the property in question. The "Title Notice" shall be recorded
within fifteen (15) days of final disposition of the approved land use action and shall
only be extinguished by the Spokane County Planning Department. The Title
Notice" shall generally provide as follows:
The parcel of property legall y described in the Title Notice is the subject of a land use
action, imposing a variety of special development conditions, by a Spokane County
Hearing Body or Administrative Official on (date) . File No. SP-89-577 is
available for inspection and copying in the Spokane County Planning Department.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. Access permits are required prior to issuance of a building permit for driveway
approaches to the County road system."
2. Dedication of a 20 ft. radius at Long Rd. and Montgomery Ave.
3. Existing county roads providing direct access to the plat shall be paved and/or curbed
to Spokane County standards.
4. To construct the road improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be a willing participant in any petition
or resolution which purpose is the formation of a Road Improvement District (RID)
for said improvements, pursuant to RCW 36.88, as amended. At such time as an
RID is created or any Road Improvement Project is sanctioned by Spokane County,
the improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs,
grantees and assigns.
5. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in.a County Road Project
(CRP) to the extent of the required road improvements. At such time as a RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs,
grantees and assigns.
5. The following statement shall appear within the dedicatory language of the final plat:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s)' property, and further not to object, by the signing of a ballot, to the
formation of an RID by the resolution method pursuant to Chapter 36.88 RCW
which resolution includes the owner(s) property. If a RID is formed by either the
petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed RID
is feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation, exceed
the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of
the improvements called for in conjunction with the formation of an RID by either
petition or resolution method under Chapter 36.88 RCW, and to appeal to the
Superior Court the decision of the Board of County Commissioners- affirming the
final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving) will be at the sole expense of the undersigned
owner(s), their heirs, grantees and assigns without participation by Spokane
County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said
RID waiver expires without construction of the required improvements, the owner(s)
or successor(s) agree to construct the required improvements at their own expense,
pay to Spokane County the then estimated cost of the required improvements to
enable the County to complete the same, or furnish a bond or other secure method
suitable to the County (which may include the execution of another RID waiver
agreement) providing for or securing to the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s).
7. The County Engineer has designated Typical Roadway Section Number Two,
Access Street Standard for the, improvement of Long Road and Montgomery Avenue
which are adjacent to the proposed development. This will require the addition of
approximately 9 to 14 ft. of asphalt along the frontage of the development. The
construction of curbing is also required.
8. The proposed plat shall be unproved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 80-1592, as amended, which establishes
regulations for roads, approaches, drainage and fees in new construction.
COUNTY HEALTH DISTRICT CONDITIONS
1. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Services.
2. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that a suitable site for on-site sewage disposal
system is available on tract B.
3. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that the existing on-site sewage disposal system
serving the residence located on Tract A is wholly located within the boundaries of
the tract.
4. Subject to specific application approval and issuance of permits by the Health
Officer, the use of individual on-site sewage disposal systems may be authorized.
5. The dedicatory language of the plat will state: "Subject to specific application
approval and issuance of permits by the Health Offcer, the use of individual on-site
sewage disposal systems may be authorized."
6. The dedicatory language of the plat shall state: "Use of private wells and water
systems is prohibited.
7. The plat dedication will contain a statement to the effect that: "The public water
system, as approved by County and State health authorities and the local fire district
and purveyor, will be installed within thi plat, and the subdivider will provide for
individual domestic water service, as well as fire protection, to each tract prior to sale
of each tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use
of on-site sewer disposal systems is hereby authorized This authorization is
conditioned on compliance with all rules and regulations of the Spokane County
Health District and is further conditioned and subject to specific application approval
and issuance of permits by the Health District.
2. The dedication shall state: "The owner(s) or successor(s) in interest agree to
authorize the County to place their name(s) on a petition for the formation of ULID
by petition method pursuant to RCW 36.94, which the petition includes the
owner(s)' property; and further not to object by the signing of a protest petition
against the formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the owner(s)' property. PROVIDED this condition shall not
prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the
property as a result of improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.

BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. The shed located nearer than 3 feet to the north property line shall be demolished or
modified to include a north wall with one hour fire resistant construction in accord
with the Uniform Building Code.

vaxious land uses. Intensive residential, public facilities and public service
are typical of this category. The residential density ranges from 1 unit per
acre to 17 units per acre. .
When reviewing new developments, the Comprehensive Plan states:
Goal .l .1 "Encourage a variety of housing types and densities."
Objective: l.la "Promote.s fill-in within esuiblished development areas
having adequate power supplies, water, sanitary sewers,
streets .
The proposed plat does conform to the Urban Comprehensive Plan Goals
and Objectives for fill-in development . The overall gross density of 1.2
units per acre is within the Comprehensive plan guidelines.
2. Arterial Road Plan: The proposal fronts on Montgomery Avenue and
Long Road. Both streets are designated Local Access Streets on the
County's Arterial Road Plan with a 60 foot existing right-of-way width.
Additional dedication has not been requested by the County Engineer
3. County Parks Plan: The site is located within 1.5 miles of Sullivan
Park.which is located north of the Spokane River and adjacent to Sullivan
Road, west of the site. The park offers picnic facilities, playground
equipment, and a radio controlled car racetrack. Liberty Lake Regional Park
is located approximately six miles to the southeast and offers camping,
swimming, and hiking. The Centennial Trail, which is owned and
maintained by the Washington State Parks Department, is located to the
north along the south bank of the Spokane River. The nearest trailhead is
located 1/2 mile west at Flora Road.
C . Site Characteristics: The site is relatively flat and covered with native
grasses. There is an existing single family home with accessory structures
located at the southwest corner of the parcel.
D . Neighborhood Characteristics: The surrounding terrain is relatively flat and
consists of small acreage lots with some nonconforming large animal keeping and
agricultural use still present. The Spokane River is located north of the site with
the Centennial Trail located along it's south bank.
E. Zoning Analysis:
Proposal: Subdivide land presently zoned Urban Residential-3.5 (UR-3.5),
established on January 1, 1991
North: Urban Residential-3.5 (UR-3.5), established on January 1, 1991.
South: Urban Residential-3.5 (UR-3.5), established on January' 1, 1991.
East: Urban Residential-3.5 (UR-3.5), established on January 1, 1991.

West: Urban Residential-3.5 (UR-3.5), established on January 1, 1991.
Prior to'the county wide zoning redesignation on January 1, 1991, the site and
surrounding area was zoned Agricultural (A) (ZE-286-57, ZE-480-58). Light
Industrial 1-2) and Heavy Industrial (I-3) zoning (ZE-480-58) is located north and
northwest of the site across the Spokane River. Urban Residential-3.5 (UR-3.5)
and Urban Residential-7 (UR-7) zones are located to the northeast and east (ZE-
,180-58, ZE-40-68, ZE-11-70) and are also across the Spok~ine River to the east
;ind northeast. 'T'here has not been any recent zoning activity within 1/4 mile of
the. site.
F . Land Use Analysis:
Site: The existing land use is and existing single family residence and
accessory structures.
The proposed land uses are single family residences on seven
additional lots
North: Single family with accessory structures.
South: Single family with accessory structures.
East: Single family with accessory structures.
West: Single family with accessory structures.
The site contains an existing single family residence with numerous accessory
structures, some of, which may have been used in agricultural production or large
animal keeping. The surrounding land uses are single family homes on small
acreage lots. Some nonconforming large animal keeping and agricultural
activities are present. Lots fronting the Spokane River average less than one acre
in size.
The Centennial Trail is located north of the site running east and west along the
south bank of the Spokane River. Industrial uses are located north of the River
and include some gravel/mining operations.
G . Circulation: Access to all proposed lots is via existing, improved, county
maintained roads. Additional public or private roads are not proposed with this
subdivision.
H . Design: The preliminary plat design takes advantage of existing roads and
provides access to all lots without new roadway construction and dedication.
Lots 1 through 5 are slightly larger than 1/2 acre with the existing home and
accessory structures located on lot 3. Lots 6 through 8 are 1.2 acres in size. The
Urban Residential-3.5 (UR-3.5) zone allows duplexes on lots that are twice the
required minimum 10,000 square are for single family homes. All lots have the
potential for duplex development except for lot 3. Existing storage buildings
located on the northerly portion of lot 3 are to be removed as indicated on the site
plan. Retention of these buildings may require adjustment of lot line location to

allow for proper side and rear yard areas. Any nonconforming rights for large
animal keeping that may exist for this parcel expire upon finalization of this plat.
The owner applicant had decided to develop'this parcel into suburban sized lots
which is consistent with surrounding lot sizes but limits future redevelopment of
the site into additional urban sized lots.

Proposed Buffering/Landscaping Techniques: None indicated on
the site plan. The Zoning Code does not require landscaping or buffering
for plats with identical adjacent zoning and uses.
Oth& Site Plan Considerations: The-site plan submitted for review by
the Hearing Examiner Committee is general in nature. Detailed review to
determine compliance with all Code regulations and conditions of approval
is recommended to be administrative and to occur at the Building Permit
stage for each residence and accessory structures.
I . Density: The net density is 1.2 units per acre which complies with the existing
zone density requirements and the Urban Category density guidelines.
J . Drainage: A drainage plan is required. This plan must be reviewed and
approved by the County Engineer's Department prior to development.
K . Water Supply: The proposal is within the corporate limits of Consolidated
Irrigation District #19. The District has indicated that a water plan will not be
required for this plat.
L . Sewage Disposal: Individual on-site septic systems will be utilized for sewage
disposal. The County Utilities Department has recommended conditions for
double plumbing for connection to the future county wide sanitary sewer system.
M . School: The proposal is in the Central Valley School District No. 356. No
comments were received from the District.
N . Fire Protection: The proposal is within Fire District No. 1. The Fire District
and the Division of Buildings Department (Fire Marshall) are required to approve
fire protection provisions prior to finalizing the preliminary plat. The Fire District
has indicated that one additional fire hydrant may be required prior to finalization
of this plat.

P. Wetlands: Spokane County Wetland Inventory Maps do not indicate the
presence of permanent or seasonal wetlands on site.
Q. Special Information: There' is an existing plat with the name "Golden Acres".
The owner/applicant will need to rename this plat prior to finalization.
11f. ENVIRONMENTAL REVIEW:
An Environmental Checklist was submitted by the sponsor and was reviewed by the
C(:Aunt)! Planning Departnlcin. The. rcvlew considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has determined that "No
probable significant adverse impacts" would result from the proposal being developed
and has issued a Determination of Nonsignificance ("DNS").
The "DNS" was circulated to 10 other agencies of jurisdiction and other
agencies/departments affected by the future development for review and comment.
The "DNS" comment period ends July 21, 1992 and was advertised 15 calendar days
before said date in the newspaper, by letter to adjacent property owners within 400
feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing
Examiner may consider additional environmental related testimony at the public
hewing.
IV. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposed plat conforms to County Subdivision and Zoning Codes. The proposal
also complies with Comprehensive Plan density guidelines and provides for fill-in
development in an area with existing urban services. Conditions are attached which
have been recommended by other county agencies and departments. The Planning
Department recommends approval of the plat as conditioned.
V . CONDITIONS OF APPROVAL
i . All conditions imposed by the Hearing Examiner Committee shall
be binding on the "Applicant", which terms shall include the
owner or owners of the property, heirs, assigns and successors.
i i . The conditions of approval apply to the preliminary subdivision
of record.
SPOKANE COUNTY PLANNING DEPARTMENT
1 . The proposal shall comply with the Urban Residential-3.5 zone(s) as
amended.
2. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.

3. A final plat/ name/number shall be indicated before the final plat is filed, such
name;/number to be approved by the Planning Director/designee. The proposed
name of "Golden Acres" shall not be used and the owner/applicant shall submit a
new name prior to finalization.
4. Appropriate road name(s) shall be indicated.
5. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be perniitied, including, but not limited to building
location and general allowable uses of the permitted zone. All variations must
c:onfonii to regulations set forth in the Spokane County Zoning Code.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
August 1, 1995 The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiration
d ate.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be
received with the submittal of the final plat.
The final plat map shall indicate: by a clear, dashed line the required yard setbacks
from all private, "Tract V or public roads. Existing buildings shall meet current
Code requirements for setbacks. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building permits
are requested unless these setbacks are specifically drafted on this final plat. The
setbacks indicated on this plat may be varied from if proper zoning approvals are
obtained."
9. Three (3) current certificates of title shall be furnished to the Planning Department
prior to filing the final plat.
10. Prior to filing of all or a portion of the final plat the applicant's surveyor shall
submit one or more maps outlined in red of the area being finalized. The scale shall
match the appropriate assessors map scale.
11. A plan for water facilities adequate for domestic service and Fire protection shall be
approved by the water purveyor, appropriate fire protection district, County
Building & Safety Department and County Health District. The agencies will
certify on the Water Plan, prior to the filing of a final plat, that the plan is in
conformance with their respective needs and regulations. The Water Plan and
certification* shall be drafted on a transparency suitable for reproduction and be
signed by the plat sponsor.
12. The water purveyor shall certify that appropriate contractual arrangements and
schedule of improvements have been made with the plat sponsor for construction of
the water system in accordance with the approved Water Plan. The time schedule
shall provide for completion of the water system and inspection by the appropriate
health authorities prior to application for building permits within the final plat. The
arrangements or agreements shall include a provision holding Spokane County and

the purveyor harmless from claims by any lot purchaser refused a building perrniit
due to the failure of the subdivision sponsor to satisfactorily complete the approved
water system.
13. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safety
Department and w,iter purveyor, shall be installed within this subdivision and the
applicant shall provide for individual domestic water service as well as fire
protection to each lot prior io sale of each lot and prior to issuance of a building
permit for each lot."
14. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed
pursuant to the approved Water Plan for the final plat " including a signed license
stamp. The certification may be in the form of a letter, but is preferred to be
certified on a copy of the Water Plan as a schematic map showing the "as-built"
water system.
15. The Water Plan and the above four (4) conditions of approval regarding the Water
Plan may be waived by the Planning Director/designee upon receipt of letters from
the appropriate water purveyor and. fire protection district stating that simple
connections to an existing, approved water system will provide adequate domestic
and fire protection water to ensure the public health, safety and general welfare.
16.- A survey is required prior to the filing of a final plat.
17. Prior to approval of road and drainage plans, you are required to coordinate with
the United States Postal Service to determine type and location of central mail
delivery facilities which may include applicable easements for developments of
three or more homes.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior To Issuance Of A Building Permit Or Use Of The Property As Proms
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing
proposed street centerline and curb grades shall be submitted to the County
Engineer for approval prior to construction and/or the filing of each final plat; road
plans to be prepared under the direction of a licensed Professional Civil Engineer.
3. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval prior to construction and/or
the filing of the final plat. Drainage plans to be prepared under the direction of a
licensed Professional Civil Engineer.

4. Construction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed engineer/surveyor, who shall furnish the
County Engineer with "as-built" plans and a certificate in writing that all
improvements were installed to the lines and grades shown on the approved
construction plans and that all disturbed monuments have been replaced.
5. No construction work is to be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work is
subject to inspection and approval by the County Engineer.
6. All construction within the existing or proposed public right-of-way is to be
coniplered poor to filing each final plat, or a bond in the amount estimated by the
County Engineer to cover the cost of construction of improvements, construction
cert ification, "as-built" plans and monumenting the street centerlines shall be Filed
with the County Engineer.
7. Individual driveway access permits are required prior to issuance of a building
permit for driveway approaches to the county road system.
8. Existing county roads providing direct access to the plat shall be paved and/or
curbed to Spokane County standards.
9. All public roads within the plat shall be designed and constructed to Spokane
County standards.
10. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
11. The County Engineer has designated Typical Roadway Section Number Two,
Local Access standard for the improvement of Long Road, which is adjacent to the
proposed development. This will require the addition of approximately 9-11 feet of
asphalt along the frontage of the development. The construction of curbing is also
required.
12. The County Engineer has designated Typical Roadway Section Number Two,
Local Access standard for the improvement of Montgomery. Avenue, which is
adjacent to the proposed development. This will require the addition of
approximately 9-11 feet of asphalt along the frontage of the development. The
construction of curbing also required.
13. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
14. The County Engineer has examined this development proposal and has determined
that the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein
specified.
15. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation

regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to determine whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
16. The applicant shall dedicate the applicable radius on Long Road and Montgomery
Avenue.
SPOKANE COUNTY DIVISCON OF UTILITIES
Pursuant to the Board of County Commissioncrs Resolution No. 80-04J 8, the use
of on-site sewer disposal systems is hereby authorized. This authorization is
conditioned on compliance with all rules and regulations of the Spokane County
Health District and is further conditioned and subject to specific application
approval and issuance of permits by the Health District.
2. The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of MD by petition method pursuant to
RCW 36.94, which petition includes the owner(s)' property; and further not to
object by the signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this condition shall not prohibit the owner(s) or
successor(s) frorn objecting to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a ULID by either
petition or resolution method under RCW Chapter 36.94.
3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
4. Each new dwelling unit shall be double-plumbed for connection to future areawide
collection systems.
SPOKANE COUNTY HEALTH DISTRICT
1. The final plat shall be designed as indicated on the preliminary plat of record and/or
any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies,
Spokane County Engineer and the Spokane County Health District. Written
approval of the easements by the utility companies must be received prior to the -
siubmittal of the final plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane.
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane
County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.

6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each lot of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies
within the recorded service area of the water system proposed to serve the plat.
K. Prior to Filing the final plat, the sponsor shill demonstrate to the satisfaction of the
Spokane County Health District that a suitable sites for on-site sewage disposal
systems are available on all lots except Lot 3.
9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that the existing on-site sewage disposal system
serving the residence on lot is wholly located within the boundaries of the lot.
10. Subject to specific application approval and issuance of permits by the health
officer, the use of individual on-site sewage disposal systems may be authorized.
1 1. The dedicatory language of the plat will state: "Subject to specific application
approval and issuance of permits by the Health Officer, the use of on-site sewage
systems may be authorized."
12. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
13. The plat dedication will contain a statement to the effect that: "The public water
system, as approved by county and state health authorities, the local fire district and
purveyor, will be installed within this plat, and the subdivider will provide for
individual domestic water service as well as fire protection to each lot prior to sale
of each lot."
SPOKANE COUNTY DIVISION OF BUILDINGS
1. Requirements of Fire District No. 1 need to be satisfied during the building permit
process.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.

4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (ie. construction waste, etc.).
6. Demolition and renovation projects must comply with the requirements of 'CFR 40,
Part 61, Subpart M. Intent to Demolish and Renovate forms are available at'the
SCAPCA office.
7. Solid fuel heating device(s) shall meet provisions of SCAPCA Regulation 1, Article
V111.
SPOKANE C(.)UN"CY FIRE DISTRICT NO. 1
1. This plat requires the installation of one new fire hydrant. The hydrant shall be
installed on Montgomery Avenue at approximately the Eastern boundary of Lot 8. If
the existing water main is on the South side of Montgomery we will allow the hydrant
to be located on the South side of Montgomery.
