THIS is an agreement entered into by and between the Central Valley School District No.
356 (hereinafter referred to as "District") and WRS & Associates hereinafter referred to as
"Developer".
RECITALS
I. The Developer will submit to Spokane County a residential plat known as PE-
1614-906 (Evergreen Point, 9th Addition), more particularly described in Exhibit "A' attached
e hereto. This proposed plat is located in an area which is served by the District.
2. PE-1614-913will contain sixteen (16) new residential units which, upon
completion, may generate new students which will have an impact on the District's capital
facilities.
3. The District is currently operating over its rapacity and will continue to do so
when PE-1614.904 is fully developed unless additional student housing is provided.
4. The District does not have facilities available to accommodate the additional
students generated by the proposed development.
5. A dispute has arisen between the parties as to the steps which should be taken by
the Developer to offset the impact this development will have on the District. In order to
resolve this dispute, the parties have agreed as follows:
NOW, THEREFORE, for good and valuable consideration, the receipt and
sufficiently of which is hereby acknowledged, the parties agree as follows:
1. Developer and the District agree that this Mitigation Agreement is a voluntary
agreement which is reasonably necessary in order to mitigate the direct impact on the District
of additional students which will be generated by the development and for which there is no
appropriate facilities to house such additional students.
2. In exchange for the promises of the District as contained in this Agreement,
Developer agrees to make payments to the District as specified below.
3. The District hereby agrees that the performance of the conditions in this
Agreement by Developer shall constitute mitigation and offset of adverse impacts of the PE-
1614.906 development to the District. Notification will be given to Spokane County by the
District that impacts to the District from this development have been mitigated as a result of this
Agreement.

4. At the time of issuance of a building permit by Spokane County or such other
municipality asserting jurisdiction over the property for construction of a dwelling, Developer
or his successors shall pay in cash to the District the sum of seven hundred fifty dollars and
001100 (6750) for each single fancily residential unit.
5. The County of Spokane or such other municipality assert ing jurisdiction shag not
issue a building permit for any residential unit within the development without proof of payment
of the sums required under this Agreement. Provided, however, that should Spokane County
refuse to require the payment provided herein as a condition of obtaining a building permit, the
parties agree to negotiate in good faith an altemative collection process.
Mitigation payments shall be used as follows:
A. Payments shall be held in a reserve account and shall be expended to fund
the District's capital needs which are reasonably necessary in order to
mitigate the impact of the increase in student population due to the
development of PE-1614-90.
B. The payments shall be expended in all cases within five years of District
collection, and
C. Any payment not expended within five years of collection shall be
refunded with interest at the rate applied to judgements to the property
owners of record at the time of the refund; however, if the payment is not
expended within Five years due to a delay solely attributable to the
Diveloper or buitder, the payment shall be refunded without interest.
7. The parties acknowledge that the provisions of this Agreement may be affected
by action of Spokane County in connection with the approval of PE•1b14.90, The parties agree
that if Spokane Counly fails to approve Pp-1614-90, this Agreement is null and void.
8. The mitigation fee per unit shall not be increased or reduced for a period of three
years following approval of PE-1614-90 by Spokane Coun(y. The final plat shall provide a
covenant on the face of the plat for the payment of the mitigation For each lot in the final plat
as provided by this Agreement.
9. The terms and conditions hereunder shall be adopted as a condition of final plat
approval of the development. '
10. The District shall execute any documents to release the covenant described in this
Agreement, if required by Developer or his successors and assigns upon satisfaction of payment
under this Agreement.
11. This Agreement is made with reference and is intended to be constructed in

accordance with the laws of the State of Washington. The parttes agree that the venue for any
suit brought under this Agrmment shall be exclusively 1n Spokane County, Washington. Should
any provision of this Agreement be declared invalid or in conflict with any law 40f the State, the
validity of all other provisions shall remain unaffected and in full force and effect.
12, This Agroement shall constitute a covenant running with the property described
in Exhibit 'A' hereto and shall be binding upon and enure to thr: benefit of the heirs, executers,
administrators, successors and assigns of both the parties hereto.
13. This Agreement constitutes the entire agreement between the parties and no
modifications ar revisions shall be binding unless made in writing and signed by the parties
hereto.

PURPOSE
The purpose of this report is to determine the extent of storm drainage facilities
which will be required to dispose of stormwater runoff created by the development of
Evergreen Point Ninth Addition. The storm drainage facilities on this project will be
designed to dispose of runoff from a ten year design storm. This development is within the
Aquifer Sensitive Area and is subject to '208' requirements.
ANALYSIS METHODOLOGY
The Rational Method, which is recommended for basins less than ten acres in size,
will be used to determine the peak discharges and runoff volumes.
PROJECT DESCRIPTION
Evergreen Point Ninth Addition is a 14 lot, 6.3 acre subdivision located in Section
26, T 25 N, R 44 EWM. Sheet 76 of the Soil Survey of Spokane County. Washin on (copy

STORMWATER CALCULATIONS
The stormwater from the on-site basins will be disposed of in '208' grass percolation
areas and drywells as shown on the plans and as calculated on the Bowstring calculations.
'208' Calculations
Within each basin the streets are divided into subbasins by curb drops which capture
upstream stormwater runoff from the impervious street surface and direct the runoff into
grassy '208' ponds. As shown on the '208' calculation worksheet included, the '208' storage
volume provided is adequate to perform '208' treatment for the runoff created by the first
half inch of rainfall. In some cases, the ponds are not quite large enough to provide '208'
storage for all of the upstream runoff. In such cases the excess is carried over to the
downstream ponds which provide adequate capacity for the carry-over flows.
Curb Drop Calculations
It is necessary to check the adequacy of the curb drops provided to divert the runoff
from the gutter into the '208' ponds. The curb drop calculation sheet included shows the
required lengths of curb openings. The calculations show that some '208' ponds require
multiple curb drops.

FINDINGS OF FACT
CONCLUSIONS AND
DECISION
THIS MATTER, a request for an extension of time from Inland Pacific Engineering has been
received and decided upon, pursuant to Spokane County Subdivision regulation (Chapter III,
Section G) and RCW 58.17.140.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been delegated the responsibility for rendering this
decision by the Spokane County Director of Planning.
2. The proposal is a revised preliminary plat of EVERGREEN POINT, PE-1614-90, (see
previous file PE-1469-84), with a preliminary Planned Unit Development overlay zone,
PURE-6-90, of VALLEY VISTA at EVERGREEN POINT (now Parkside at Evergreen
Point), and Zone Change, ZE-43-90, from Agricultural (A) to Urban Residential-3.5
(UR-3.5) and Urban Residential-7 (UR-7) with PUD Overlay Zone for the purpose of
developing 114 single family dwellings on approximately 38.6 acres with one 2.2 acre
lot for a private community park.
3. The subject preliminary plat revision was approved by the Hearing Examiner Committee
November 30, 1990.
4. The property is generally located north of and adjacent to 32nd Avenue, and west of and
adjacent to Best Road in the SW 1/4 of Section 26, Township 25 North, Range 44
EWM, Spokane County, Washington.
5. The existing zoning of the property described in the application is Urban Residential-
3.5, (UR-3.5) previously established as Agricultural (A) zoning in 1942 and
redesignated to Urban Residential-3.5 (UR-3.5) on January 1, 1991 consistent with the
Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195
the proposal does conform to the requirements of the proposed Urban Residential-3.5
(UR-3.5) and Urban Residential-7 (UR-7) zones with PUD overlay.
6. The Comprehensive Plan designates this area of the preliminary plat as Urban, and the
location is within the Priority Sewer Service Area. The Comprehensive Plan
designation remains the same since the original preliminary plat approval.
7. Spokane County has established specific criteria for considering the extension of time
for the expiration of preliminary subdivisions, specifically for regular subdivisions, and
department policy for short subdivisions. These criteria are found in Chapter III,
Section G of the Spokane County Subdivision Ordinance and have been used as a basis
for this decision.
Section G states, "Approval of a preliminary subdivision shall automatically expire three
years after preliminary approval is granted unless a time extension is applied for. " and
follows with "Upon application for time extension, the Planning Director or designee
may administratively approve extensions for up to three (3) year periods provided at
least one of the following circumstances is found to apply:" The following are the
relevant sections of Section G and the Planning Department response: .
1. That some portion of the existing preliminary plat has been finalized since the last
extension was granted and the remaining lots would form a unified development
consistent with the original approval;
RESPONSE: Numerous phases of the original plat have been finalized and the
applicant has submitted additional final plats for review.
2. That the preliminary plat as approved remains consistent with the Generalized
Comprehensive Plan for Spokane County insofar as density and other
development provisions apply, AND the sponsor has taken substantial steps
towards finalizing his plat, which shall include but not be limited to:

a. surveying the lots within the development,
b. arranging for public services to the site,
c. obtaining necessary financing for all or a portion of the preliminary plat,
d . the completion of studies or other requirements which were part of
preliminary plat approval;
RESPONSE: Evergreen Point 8th Addition has been submitted for review and
finalization.
3. That at the time preliminary approval was granted, development of the proposal
was conditioned upon the extension of public services which are not yet available.
This provision shall not apply to public utility extension which the project sponsor
would normally fund.
RESPONSE: Does not apply
8. No written comments were received from any adjoining property owners.
9. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited. No
additional conditions have been recommended by the various reviewing agencies and
departments, including the County Engineer's Office, County Health District County
Utilities and the Department of Building & Safety. However, the Central Valley School
District (#356) has responded which resulted in updated conditions.
10. The Central Valley School District (No. 356 ) has commented on the proposed time
extension . The District has indicated that existing school facilities are inadequate to
serve the proposed plat and has requested the applicant negotiate with the District to
provide appropriate capital facilities as required by the Revised Code of Washington
(RCW) 58.17.110. Approval of this plat should include conditions requiring that
provisions for appropriate facilities be in place prior to recording the final plat(s) in the
form of a written agreement between the property owner and the school district.
11. The Spokane County Parks Department has commented on the proposed time extension.
The Parks Department has requested a voluntary agreement be completed between the
Parks Department and the property owner to mitigate impacts to the County Park
system. The Spokane County Planning Department recommends the property owner
negotiate with the Spokane County Parks Department to provide for appropriate capital
facilities as required by the Revised Code of Washington (RCW) 58.17.110. Approval
of this time extension should include conditions requiring that provisions for appropriate
facilities be in place prior to recording the final plat(s) in the form of a written agreement
between the owner and the Spokane County Parks Department.
12. The site is located within the Public Transit Benefit Area (PTBA). Route #22,
Valley/32nd Avenue Feeder, provides connecting service to the Valley Transit Center.
13. The Spokane County Arterial Road Plan identifies 32nd Avenue and Evergreen Road as
Principle arterials. The existing rights of way are inadequate and the County Engineer
has requested additional dedication and a reserve strip to be designated as a Future
Acquisition Area (FAA). Sidewalks are required improvements on 32nd Avenue,
Evergreen Road, and Best Avenue.
14. The proposed plat will be served by a public water and sewer system.
15. This is the first request for a time extension. The total life of the revised preliminary plat
has been approximately three years.
16. The applicant/owner has changed the name of the planned unit development from Valley
Vista at Evergreen Point to Parkside at Evergreen Point. There are two(2) phases

17. The applicant/owner should show continued progress toward complying with Chapter
1111, Section G, of the Subdivision Ordinance before requesting an additional extension
of time.
18. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the

SPOKANE COUNTY PLANNING DEPARTMENT
1. Additional Extensions of Time shall not be granted unless substantial compliance
with Chapter III, Section G, of the Subdivision Ordinance is demonstrated by the
applicant; otherwise the preliminary subdivision approval will become null and void.
2. The final plat shall be designed substantially in conformance with the preliminary plat of
record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
3. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
4. The preliminary plat is given conditional approval for three (3) years, specifically to

11. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County Building &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
12. ,*The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building permit due to the failure of
the subdivision sponsor to satisfactorily complete the approved water system.
13. / The final plat dedication shall contain the following statement: "The public water -
system, pursuant to the Water Plan approved by county and state health authorities, the
local fire protection district, County Building & Safety Department and water purveyor,
shall be installed within this subdivision or binding site plan, and the applicant shall
provide for individual domestic water service as well as fire protection to each lot prior
-6 sale of each lot and prior to issuance of a building permit for each lot."
14. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant to
the approved Water Plan for the final plat," including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
15. A survey is required prior to the filing of a final plat.
16. The final plat shall indicate yard setback arc lengths on cul-de-sac lots which meet or
exceed the minimum frontage of the underlying zone of the final plat.
17. The PUD final plat shall indicate all exterior boundary setbacks, as well as setbacks
from roadways and individual lot lines. Final Planned Unit Development shall illustrate
setbacks from site perimeter, front yard, rear yard, flanking street, and side yards
consistent with preliminary Planned Unit Development approval.
18. A copy of the homeowners/property owners' association articles of incorporation and/or
bylaws and/or covenants and restrictions, together with any other provisions for
maintenance of common areas and facilities, shall be submitted for review and approval
to the Planning Department prior to finalizing.
19. A specific landscape plan, planting schedule and provisions for maintenance acceptable
to the Planning Director/designee shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall be installed and
maintained so that sight distance at access points is not obscured or impaired.
20. Upon filing the final plat, or a portion thereof, the zone reclassification of the final plat
area shall be finalized, and the existing zone classification shall be changed to Urban
Residential-3.5 (UR-3.5) and Urban Residential-7 (UR-7) with Planned Unit
Development (PUD) overlay, consistent with the proposed zoning approved with the
preliminary plat of record.
21. The Spokane County Planning Department shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way and
utilities. The reserved future acquisition area Title Notice shall be released, in full or in
part, by the Planning Department. The notice should be recorded within the same time
frame as an appeal and shall provide the following:
a. At least 16 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
32nd Avenue. NOTE: The County Engineer has required 14 feet of new
dedication.

C. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above improvements are made within this area, they shall be relocated at
the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
22. The Planning Department shall prepare and record with the Spokane County Auditor a
Title Notice noting that the property in question is subject to a variety of special
conditions imposed as a result of approval of a land use action. This Title Notice shall
serve as public notice of the conditions of approval affecting the property in question.
The Title Notice should be recorded within the same time frame as allowed for an appeal
and shall only be released, in full or in part, by the Planning Department. The Title
Notice shall generally provide as follows: The parcel of property legally
described as (legal description) is the subject of a land use action by a
Spokane County Hearing Body or Administrative Official on November
29, 1990, imposing a variety of special development conditions. File
No. PE-1614-90 is available for inspection and copying in the Spokane
County Planning Department.
23. The owner shall negotiate with the Central Valley School District and the Spokane
County Parks Department and submit a recorded copy of the agreement(s) making
appropriate provisions for public schools and parks prior to finalization and recording of
the final plat. The agreement(s) shall provide a written description of the subject
property to which the agreement(s) apply(ies) and also state the dollar amount per lot
and any other agreed to mitigating measure(s).
The Owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington
(58.17.205), that adequate provisions for school facilities and parks must be made
conditioned on a future agreement(s) between the plattor, school district, and County
Parks.
Voluntary agreements between the Owner, School District and County Parks shall
conform to the requirements of the Revised Code of Washington Chapter 82.02.
24. The final plat(s) shall be addressed in accordance with RCW 58.17.280 and local
ordinance.
SPOKANE COUNTY ENGINEER'S OFFICE

feet of asphalt. The construction of curbing is also required.
21. The County Engineer has designated Typical Roadway Section Number Two, Major
Arterial standard for the improvement of Evergreen Road, which is adjacent to the
proposed development. This will require the addition of approximately 13-15 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.

Arterial standard for the improvement of 32nd Avenue, which is adjacent to the

Section 10.207 of the Spokane County Fire Code.
26. All vested owners shall sign and record private road documents as prescribed by the .
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokane County Engineer prior to recording with the Spokane County Auditor.
Recording numbers shall be referenced in the dedicatory language of the plat.
27. ✓That the following statement be placed in the plat dedication for Parkside P.U.D.:
"WARNING: Spokane County has no responsibility to build, improve, maintain or
otherwise service the private roads contained within or provide service to the property
described in this plat. By accepting this plat or subsequently by allowing a building

obligation for said private road, and the owners hereby acknowledge that the County

28. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
29. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the dedication
of additional right-of-way and the roadway improvements herein specified.

2. The applicant is advised that the private road shall be named and signed in accordance
with the provisions of Spokane County Road Standards. This condition may be waived
in the event that the Department of Building and Safety determines addressing on the
private road is not acceptable. However, at such time as the Department of Building and
Safety feels the need for the road to become a private, named road, the applicant/owner
shall participate and cooperate in this process.
3. The required fire flow for any building or subdivision is determined by building size,
type of construction and proximity of exposures. Based on information presented to
this office regarding this subdivision, the minimum fire flow established by code of 500
gallons per minute for 30 minutes is being required.
4.. The applicant shall contact the Department of Buildings at the.earliest possible stage of
design/development in order to be informed of code requirements administered/enforced
as authorized by the State Building Code Act. Design/development concerns include:

SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during demolition, construction and
excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces
onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be
taken immediately to clean these surfaces.
3. Debris generated as a result of this project must be disposed of by means other than
burning.
4. Solid fuel heating device(s) shall meet provisions of SCAPCA Regulation I, Article
VIII.
5. Demolition and renovation projects must comply with the requirements of CFR 40, Part 61,
Subpart M. Intent to Demolish and Renovate forms are available at the SCAPCA office.

DECLARATION OF COVENANT SPOKANE COUNTY, quip,.
In consideration of the approval by Spokane County of Plat # PE-1616-
90, EVERGREEN POINT 9TH ADDITION (hereinafter referred to as the
"plat"), undersigned covenants and agrees that:
1. Spokane County and its authorized agents are hereby granted the
right of ingress and egress to, over, and from said easements for
the purpose of inspection and emergency maintenance of water
quality treatment swales (11208 swales") and other drainage
facilities, if not properly maintained by the property owner.
Spokane County does not accept the responsibility to inspect or
maintain the drainage easements or drainage swales, nor does the
County accept any liability for any failure by the lots owners(s)
to properly maintain such areas.
2. The property owners within this Plat shall be held responsible
for keeping open and maintaining the surface path of natural or
man-made drainage flow over and across their respective
properties.
3. The property owners within this Plat shall maintain all water
quality treatment swales (11208 swales") and,drainage ditches
situated on their respective properties, and any portion of a 208
swale situated in the public right of way adjacent to their
respective properties, with a permanent ground cover as specified
on the current approved plans on file at the County Engineer's
Office. The property owners may install approved shrubbery
and/or trees which do not obstruct the flow or percolation of
storm drainage water in the 208 swale and drainage ditches, as
indicated by the current approved plans on file with the County
Engineer's Office.
4. The property owner or his representative shall inform each
succeeding purchaser of all drainage easements on the property
and of his responsibility for maintaining surface drainage paths
and swales within said easements.
5. Spokane County does not accept the responsibility of maintaining
the drainage course on private lots within drainage easements or
floodplain areas, nor the responsibility for any damage
whatsoever, including, but not limited to, inverse condemnation
to any properties due to deficient construction and or
maintenance of drainage courses in drainage easements on private
property.
6. If the property owners fails to maintain the surface path of
natural or man-made drainage flow, or the drainage swale, a
notice of such failure may be given to the property owner. If
not corrected within the period indicated on said notice, Spokane
County has the right to correct the maintenance failure, or have
it corrected, at the expense of the property owner.
7. Any building that is constructed on a lot in this Plat shall be
set at such an elevation so as to provide positive drainage away
from any drainage entry point to the building (including but not
limited to a window well, a window unprotected by a window well,
or a doorway). Said positive drainage shall consist of a minimum
slope of 3% away from the building for a distance of at least 10
feet from the building. The lots shall be graded so that either
a) all runoff is routed away from the building, and conveyed over
the lot to a natural drainage swales or approved drainage
facility, or b) drainage intercepted on the lots is disposes of
on the lot in an approved drainage facility. The approved
drainage facility shall be constructed in accordance with the
approved plans on file at the County Engineer's Office. Any
revisions to the approved drainage plans must be approved by the

County Engineer's Office prior to construction of said revisions.

ESTABLISHMENT
This being the day set for the hearing on Spokane County Engineer's Report on the proposed
establishment of 31ST AVENUE, BOLIVAR ROAD, BOLIVAR AND BANNEN COURTS,
proceedings for which were initiated by PRELIMINARY RESOLUTION NO. 98-0548, and it
appearing to the Board on proof duly made that Notice of Hearing was published and posted in the
manner and for the time required by law, and the Board after examining the report and maps of the
Spokane County Engineer and all claims and papers on file and after hearing all other evidence adduced
at the hearing; and
IT FURTHER APPEARING that the rights of way have been dedicated as public roads, 50 feet
wide, and that said roads are a public necessity and the same should be opened and established as County
roads.
THEREFORE BE IT RESOLVED by the Board of County Commissioners of Spokane County,
Washington, that the hereinafter described roads as reported by the Spokane County Engineer on the 4th
day of August, 1998, being more particularly described as follows:

Post-pavement TV inspection.
Dear Bill,
Please be advised the Construction Division accepts the quality of construction of the
following system components:
• All mainline sewer pipe, manholes, and side service stub-outs located beneath paved
roadways and within the platted boundaries of Evergreen Point 9" Addition.
The above acceptance will allow the County Utilities Department to establish a one year
warranty period. Utilities will begin this period when all as-built drawings, O & M
manuals, easements, and other related system components have been satisfactorily
provided. Any additional defects observed in the system during the warranty period will
be brought to your attention by the Spokane County Utilities Department.

Addition sewer collection system. Prior to Construction Division acceptance of the

• Flow restriction at manhole 140.3/31 causing back flow up the line starting 141.4
feet downstream of manhole number 139.9/31.
• "Manhole # 140.3/31 - Channel needs work for proper flow. High spot in channel
need grinned down, 1-2 inch dip in channel at outlet and adjacent inverts needs
shaping for proper flow.
The available information indicates excessive maintenance cleaning and attention. The
Construction Division cannot accept the quality of work until items are addressed.
Contact me at 456-3606 when repairs are to take place. Also, send a request in writing
after work is complete for re-TV and/or manhole inspection of problem areas.

• Manhole # 140.6/31 - Channel needs work for proper flow. Back flow in south channel.

(developer), as "Principal," and Contractors Bonding and Insurance Company
(bonding company), a corporation organized and existing under the laws of the
State of Washington and authorized to transact a surety
business in the State of Washington, as "Surety," are held and firmly bound
unto Spokane County, a political subdivision of the State of Washington, as
"Obligee," in the penal sum of
one hundred & twenty thousand, four hundred Dollars 0120,400.00

WHEREAS, said Principal is the owner of a tract of land in Spokane County
divided and platted into lots and known as Evergreen Point 9th Addition ,
and being located in Section 26 , Township 25 North, Range 44 E.W.M.,
in Spokane County, Washington, and said County has required that a bond be
furnished in an amount sufficient to pay the construction costs of grading and
surfacing to the approved grades and typical section of the roadways of said
plat and the installation of drainage structures and such other work as is
incidental and necessary thereto, all in accordance with those Plat Roadway
Improvement Specifications dated June 01 , 1995 , and to the
satisfaction of the Spokane County Engineer; such improvements to be completed
not later than October 04 , 1997 unless said date be
extended at the option of the Spokane County Engineer.
Upon failure of the Principal to comply with the requirements stated here-
in within the time authorized, and upon delivery of a written notice thereof by
Obligee to Surety, the Surety shall make satisfaction to Obligee to the extent
of this Bond.
The obligation of this Bond shall be kept in full force and effect until,
in the opinion of the Obligee, the requirements herein stated have been satis-
fied, in which event written release will be given by the Obligee, the Obligee
having sole right to grant such release. The Surety hereby waives all rights
to release from the obligation except as herein stated.

In consideration of
90, EVERG ereinatter referred to as the
"plat")~ undersigned covenants ahd agrees that:
1. Spokane County and its authorized agents are hereby granted the
right of ingress and egress to, over, and from said easements for
the purpose of inspection and emergency maintenance of water
quality treatment swales ("208 swales") and other drainage
facilities, if not properly maintained by the property owner.
Spokane County does not accept the responsibility to inspect or
maintain the drainage easements or drainage swales, nor does the
County accept any liability for any failure by the lots owners(s)
to properly maintain such areas.
2. The property owners within this Plat shall be held responsible
for keeping open and maintaining the surface path of natural or
man-made drainage flow over and across their respective
properties. IF
3. The property owners within this Plat shall maintain all water
quality treatment swalee (0208 swales") and drainage ditches
situated on their respective properties, and any portion of a 208
swale situated in the public right of way adjacent to their
respective properties, with a permanent ground cover as specified
on the current approved plans on file at the County Engineer's
Office. The property owners may install approved shrubbery
and/or trees which do not obstruct the flow or percolation of
storm drainage water in the 108 swale and drainage ditches, as
indicated by the current approved plans on file with the County
Engineer's office.
4. The property owner or hie representative shall inform each
succeeding purchaser of all drainage easements on the property
and of his responsibility for maintaining surface drainage paths
and swales within said easements.
S. Spokane County does not accept the responsibility of maintaining
the drainage course on private lots within drainage easements or
floodplain areas, nor the responsibility for any damage
whatsoever, including, but not limited to, inverse condemnation
to any properties due to deficient construction and or
maintenance of drainage courses in drainage easements on private
property.
6. If the property owners fails to maintain the surface path of
natural or man-made drainage flow, or the drainage swale, a
notice of such failure may be given to the property owner. If
not corrected within the period indicated on said notice, Spokane
County has the right to correct the maintenance failure, or have
it corrected, at the expense of the property owner.
7. Any building that is constructed on a lot in this Plat shall be
set at such an elevation so as to provide positive drainage away
from any drainage entry point to the building (including but not
limited to a window well, a window unprotected by a window well,
or a doorway). Said positive drainage shall consist of a minimum
slope of 31 away from the building for a distance of at least 10
feet from the building. The lots shall be graded so that either
a) all runoff is routed away from the building, and conveyed over
the lot to a natural drainage swales or approved drainage
facility, or b) drainage intercepted on the lots is disposes of
on the lot in an approved drainage facility. The approved
drainage facility shall be constructed in accordance with the
approved plans on file at the County Engineer's Office. Any
revisions to the approved drainage plans must be approved by the

In accordance with your request, we have performed an "R"-value test of the subgrade
soils at the Evergreen Point 8th Addition Subdivision. Attached is a copy of the lab form
graphical plot. Our testing was performed in accordance with AASHTO T-190 guidelines.
