Declaration of Covenant In consideration of the approval by Spokane County of RIDGEMONT ESTATES NORTH 6TH ADDITION (hereinafter referred to as the "plat"), undersigned covenants and agrees that: The property owners within this plat shall maintain all water duality swales (1208' swales) and drainage ditches situated on their respective properties, and any portion of a '208' Swale situated in the public right-of-way adjacent to their respective properties, with a permanent live grass cover as specified on the current approved plans on file at the County Engineer's office. The property owners may install approved shrubbery and/or trees which do not obstruct the flow and percolation of storm drainage water in the 1208' Swale and drainage ditches, as indicated by the current approved plans on file with the County Engineer's Office. The property owners within this plat Shall be held responsible for keeping open and maintaining the surface path of natural or man-made drainage flow over and across their respective properties. The property owner or authorized representative shall inform each succeeding purchaser of all drainage easements on the property and their responsibility for maintaining surface drainage paths and swales within said easements. Spokane County and its authorized agents are hereby granted the right to ingress and egress to, over and from all public drainage easements for the purposes of inspection and emergency maintenance of drainage swales, pondB and other maintenance facilities, if not properly maintained by the property owner. CONCLUSIONS AND ORDER INTRODUCTION Y V! .-ray This matter has come before the Hearing Examiner Committee on January 21, 1993'. The members of the Committee present are Phil Harris, Chairperson, Bud Skadan and Prank Yuse. PROPOSAL The sponsor, lien Tupper, requests approval of a Preliminary Plat of Ridgemont Estates North, PE-1684-92, with existing Urban Residential-3.5 (UR-3.5) zoning within the Aquifer Sensitive Area (ASA) Overlay zone. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located south of and adjacent to 16th Avenue and approximately 900 feet east of Sullivan Road in Section 25, Township 25 North, Range 44 EWM, Spokane County, Washington. 2. The committee adopts the Planning Department Report as a part of this record. The Planning Department has recommended that the proposed plat be approved as conditioned. 3. The existing land use(s) in the area are residential and agricultural. 4. The proposed use is compatible with existing uses in the area. 5. The Comprehensive Plan designates this site as Urban. The Urban category is for the purpose of residential uses, including residential densities of 1 to 17 units per acre, or 3.2 units for this proposal. 6. The proposed plat does implement and conform to the Comprehensive Plan. 7. The Arterial Road Plan designates 16th Avenue as an arterial, with a recommended right of way width of 80 feet. 8. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5), previously established as Agricultural zoning in 1942 and reclassified to Urban Residential-3.5 (UR-3.5) on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing Urban Residential-3.5 (UR-3.5) zone. 9. The provisions of RCW 43.210 (The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance was issued. The owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 12. The proposed use will not be detrimental to the public health, safety, morals or welfare especially in light of the conditions recommended by the reviewing agencies. 13. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. The proposal as conditioned does provide adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces b . drainage ways C. public and/or private rights-of-way d. transit e. potable water f. sanitary waste disposal g. parks and recreation facilities h. playgrounds i. schools and schoolgrounds j. sidewalks The above improvements are either existing facilities or will be provided by the applicant upon finalization of this subdivision as conditioned by the Committee and implemented by the various County agencies. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. SPOKANE COUNTY PLANNING DEPARTMENT 1. The proposal shall comply with the Urban Residential-3.5 (C]R-3.5) zone as amended. Note: A copy of the homeowner/property owners association covenants and restrictions shall be submitted for review and approval to the Planning Department prior to finalizing. Covenants shall state that duplexes are not allowed on lots containing 20,000 square feet or more. Appropriate provisions shall be made for maintenance of the lift station lot and drainage lot with the sponsor and the County Engineer and Utilities Department, 2. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. Note: Timberlane Road shall be contained wholly within the boundary of the final plat. 3. Appropriate utility easements shall be indicated on copies of the proposed final plat. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. However, this HQA is not adjacent to the pored, it is not part of the Ridgemont Estates North 6th Add., and according to the basin trap submitted by your engineer, the pond will not overflow onto the HQA property In short, this HQA will received little to no benefit to the formation of this easement, and the pond is in no way associated with their property. Therefore, it is not appronate to make this HQA the responsible party. Drainage Calculations D1) Whenever off-site runoff contributes to the drainage facilities, then the facilities are to be designed for the 50-yr storm event, per the County "Guidelines of Stormwater Management." The design approach is to perform the Bowstring]SCS analysis for the 10-yr storm considering the on-site area only, along with the shorter time of concentration (Tc). Then perform the 50-yr analysis considering both the on-site and off-site areas combined, using the longer Tc (as appropriate for the larger drainage basin. Draw a comparison of the two, the larger volume requirements will be the controlling amount. Normally the contributing off-site area is analyzed using existing conditions. However, for Subbasin 'C', which is intended to be design for future conditions, the 10--yr storm for the entire subbasin will need to be considered as well. If you have any questions feel free to call me. D2) Subbasin A: Whenever using QTR-55, multiply the basin area x 10 for data entry. This is because the flowrates generated are to the nearest integer. It is important to provided flowrates to at least + 0.1 cfs. Then by hydrograph multiplication, reduce the hydrograph to the correct amount. Please revise. D3) Provide level pool routing calculations for the pond in Subbasin 'A', which lists the max. water level achieved during the routing of the storm. D4) Subbasin C: The drainage basin for future conditions change, per the calculations. Clearly show in the basin map what the limits of the basin will be under future conditions. D5) Provide calculations demonstrating that the storm flow along the concrete curbs will not exceed 12' in width.
