RECORO DRAWfNGS & ENGINEER'S STATEMENT
inspection Requirements
These requiremenis apply to all public and private sewer iines eight inches and larger in
diameter, and to sewer service stubs extended from those lines to the property lines af individual
parcefs. Note ihat all sewer service lines six inches and srnatler in diameter, other than those
service stubs noted above, will be inspected by Spokane County Division of Utilitiea.
On ali sewer conscnuction for development, inspections wilf be pertormed by the Sponsor's
Engineer or his/her designated representative. At !he request of the sponsor, the County may
provide ihe sewer inspectbn services, provided that the sponsor agrees to pay all costs
associated with the County inspections and provided that the County determines that stoff is
available to perform the inspections.
The inspection of sewers shall inciude the items listed belaw. However, the listing provided
below is not intended to be ail inclusive. It will be the responsibility of the Spansor's Engineer to
determine additional inspection activities that may be needed for 8 specific project in order to
report substaniial confarmance of the project with the County's standards.
1. Conformance of a11 construction materials with County standards shall be verified prior to
instaltation.
2. The sewer trench shail be inspected for proper dimensions and pips ione ciearances prior to
placement of pipe.
3. The placement and compaction of the pipe zone materiai and bedding shall be inspected.
4. The pipe joints shall be inspected visually for proper insertion.
5. Horizontal atignment and grade of the pipe shall be checked for conformance to the standards
pnor to backfilling of the trench.
6. Sewer service tees and stubs shall be inspected for correct installation prior to backfilling of
the trench.
7. Accurate measurements shall be made and recorded to facilitate the reestablishment of
sewer service tee locations and stub end locations. The pfacemeni of the requ+red stub
markers shall be verified.
8. Manholes shall be inspected for proper materials, location, assembly, and installation.
9. Trench backfilling operations sha!l be observed and compaction tests shaq be performed.
Minimum requirements for backfilling shall be as set forth in ihe acxepted plans and/or
specifications for the project.
10. Mandrel testing, hydrostatic and/or air pressure testing, and manhole testing shall be
performed following completion of trench backfilling operations. The testing shall be observed
untii passing results are obtained. Manhole testing shall be perfofined on ten percent of the
manho)es in the project, in accordance with Department of Ecology's "Criteria for Sewage
Works Oesign".

11. The Sponsors Engineer shall schedule television inspection of the sewer lines through the
Division of Utilities once the other testing has been satisfactority campleted. The Division of
Utilities wi!l then perform the television inspection and review the tapes for deficienc+es
requiring correction or repair.

12. Daily inspection reports shall be prepared, summarizing construction act+vities, contractos
work force and work period, testing results, problsms encountered, and other pertinent
informaiion.
The project sponsor or the sponsor's Construction Fngineer shall notify the Division of Utilities 48
hours in advance oi the start of construction of the sewer system, and shall provide a generalized
schedule for the progress of the work. County inspection personnel will make occasional site
visits to inspect the work and do materials testing as deemed necessary. County inspection
personnel will address concerns and questions to the Engineer of Record. The cost of these
occasional site visits witl be charged to the Construction Pennjt for the work.
The sponsor will beer the cost of af{ inspections and materiats testing. The Division of Utilibes
shall have accsss to all construction inspectian records and reports. Befare the County accepts
the sewer system, the Sponsor's Engineer shall submit all construction records to the Division of
Utilities. This shall include but not be limited to Daily tnspection Reports, coITespondence,
manufacturers' certificaiions, and material test reports.
When changes to the design are necessary, the sponsor shall be responslble for coordinating the
proposed design changes with the sponsor's Design Engineer. The sponsor's Design Engineer
shall forward two copies af the proposed plan changes, to9eiher with related calculations, to the
Division of Utilities for review and acceptance prior to consiruction.
The Sponsor's Engineer shall schedule a final inspection meeting between the Sponsor's
Engineer, the sponsor, and the Division of Utilities at the completion of construction and testing of
!he sewer system. Deficiencies found shall be conected by the sponsor prior to the County's
acceptance of the sewer.
Record Drawinqs & Engineer's Statement
During construction the sponsar's Surveyar andlor Construction Engineer shall record any
changes to the accepted pians. Ali substantive changes sha!l be indicated and noted on the
eCCepied final sewer plans and the plans shall be annotated as "Record Drawings". !n tttose
cases where ihe County provides the inspection services, the County will produce the Record
Drawings.
Side sewer . stub sketches shall also be prepared on the County's standard form. As-built
elevations, locations, pipe lengths, and pipe slopes must be verified on the Record Drawings. The
foltowing statement shall be lettered on the Record Drawings and stamped and signed by the
sponsor's Construciion Engineer on the Record Drawings: "I have revfewed the constructton of
this sewer system and to my knowledge find it to be ln substantial conformance with the accepted
plans and Spokane County Standards excepi as nated." ,

PROTOCOL FOR TELEVISIC?N INSPECTION OF SEWERS
In the interest of developing a consistent methodology for the caordination ai7d
review of television inspections, the following steps have been estab{ished: 1. PRE-PAVING TELEViS14N 1NSPECTiON
a) At least two weeks prior to the desired pre-paving television inspectlon, the Contrac#or requests
the television inspection through the Sponsor's Engfneer. The Engineer submits the request (on
standard form) to the Division of Utilities Sewer Design Section. (Utility contacts are B. Ur#iausen
and G. Repp).
b) Sewer Design Section schedules tetevision inspection with the Wastewater Operations Sectian.
c) tn order far the inspection to take place, sewer mains wiil. need to be high-pressure cleaned,
mandrel tested, and pressure tested. In addition, menholes will need to be acxessible by the TV
van. Backfill must be in piece eround the cone sections of the manholes. If the contractor has
pleced temporary stest ptates on top of the manholes, then the cvntractar wiil need to provide
manpower and equipment to remove and replace the ptetes to facilltate the television inspection.
d) Detailed television inspectfon is undertaken, nating tee tocatfons/stations, irregularities, defects,
etc.
e) The Contractor shall pay the cost of the pre-paving television inspection.
2. REVtEW OF PRE-PAVlNG TELEVISION tNSPECTION
a) When the Sewer Design Section receives the VtiS tapes and fault log from the Operations
Section, the fauit tog will be reviewed for noted defecis. The tapes and log will tfien be forvvarded
to Engineer for review.
b) Engineer reviews tapes and Ic}g, and makes determination of any repairs that need to be
undertaken.
c) Engineer coordinates with Sewer Design Section Manager for concurnence on repairs that are
needed. In some cases, this may necessitate joint review of tfie tapes.
d) After corrcurrence between the Engineer and the Sewer Design Section Manager, the Engineer
will stipulate !he required repairs to the Contractor.
s. accEPIraNcE sTaNDaROS FoR GRADE DEVIATIONS
a) The Standard Specifications stipulate thet reverse grades are not acceptable. In the review of
television inspection tapes, the Engineer and the Sewer DesiBn Section Manager wiil consider
the combined effects of pipe joints, ailowed variations in pipe diameter, and grade on any
entrapped water appearing on the inspection tapes.
4. POST-PAVING TELEV1StON INSPECTION
a) After the roadway is substantially comptete above the sewer, a post-paving television inspection
will be scheduled, in the same manner as the pre-paving television inspection.
b) This television inspection will be less detailed than the first, and will be undertaken to check for
pipe cleanliness, and to identify any structural detects that may have occurred/presented since
the initial televis+on inspection.
c) The review of the tapes and concurrence on needed repairs will proceed in the same fashion as
identified for the pre-paving television inspection.

dj The cost of the first post-Raving television inspection shall not be charged to the Contractor. The
cast of any subsequent televisian inspections performed to confimn the adequacy of repairs will
be charged to the Contractor.
5. REMEDY PROVISfONS -
a) In the case of a pipeline swafe, or other defect, that is identified during the post-peving television
inspection, the Engineer and the Sewer Design Section Manager shail determine the Reed for
repair work to correct the defect.
b) In certain cases, in lieu of undertaking the repair, the Contractar may be required to pay the
estimated cost of rnaking the repair to the County. Such payment wfll then be deposited in the
County's sewer repair and replecement fund. '
5. MANHOLE INSPECTIONS
a) The Engineer shaii inspect the sewer manhafes for conformance with Spokane County
Standards. Observations regarding the condition of manhvfes made by ihe television inspection
crew are 1o be considered as supplementary information, and are not intended to replace the
Engineer's inspection.
7. MAKING CONNECTtONS TO NEW SEWER LINES
No connections !o the new sewer lines will bre ellowed until the County has ac►cepted the sewer lines for
operation and maintenance. Before acceptance can orcur, the Engineer must provide acceptable record
drawings for the project to the Division of Utilities, together with the required Engineer's Statement.
Adddionatly, the wamanty period security must be provided by the developer as stipulated in the
development agreement.

Thanks for your email. I had a chance to look at it again and it appears that the issue may be caused by the
settlement of the road and curb where it connects to the older phase. It looks like there has been ponding along
the curb and roadway on both the west and east side of the road. I suggest that you to flood that portion of the
roadway to see if positive drainage towards the swales occurs. Please coordinate this test with Rod Pegram when
you have an opportunity.

John,
I recently inspected the manhole on Carnine lane. Please see attached as built survey data showing that the
manhole is approximately 0.10 feet high. We are requesting that the manhole be left as constructed for the
following reasons.
1. This is a private road.
2. The manhole has been in place for approximately four years and has not had any damage to it in that
period from snow plows or anything else.
3. There have never been any complaints nor has it been on any punch list from the iwo previous consulting
engineering firms and has never been mentioned on previous walkthroughs with the City of Spokane
Valley.
4. This street doesn't front any houses and has a very low trafFc volume.
5. With the low traffic volume and low speeds due to the proximity of the street, there is no threat to the public
health, safety and welfare.
6. If the manhole is lowered there is the possibility of future damage to the street due to the patch work that
will need to take place.
7. The bond has been reduced to only drainage items leading us to believe that previous punch list were
accurate and complete with regards to the road.
8. And of course the cost of this adjustment is very high and the benefit is questionable due to the location
and traffic volume. If it were on Sprague or another main Arterial the manhole should be adjusted. Please
note that you and I have seen worse on existing main arterials and are not adjusted.
Please respond as soon as possible as we are trying to close this project out so we can complete the next
addition.

I called John Sav►ryers yesterday, Mon. 8-20-07, to arrange a meeting onsite at this project. He was not available
and I left a message. Mon day PM I receiveci a phone call from Gianna Adams who was returning my call for
John. Later Gianna was at permit services and we discussed a meeting involving the Homeowners Association.
They do not feel that the Homeowners Association should be involved. She also stated that the catch basins had
the 2" depression that was required. The grate apron that is failing will be replaced. They are still saying that the
sewer manhole is okay, that it has been through winter snow removal without damage, and that it was not on the
original punch list. I felt the discussion was not proceeding and decided to wait for your return to discuss farther.

Bob Graham, STI Northwest Inc, requested a bond reduction on 8/28/03 but no action has
been taken on that request. Washington Trust Bank verified the $71,500 construction
Letter of Credit is still valid. We could not find that certification package deficiencies
noted by Kevin Severance on 12/3/04 have been addressed. We reviewed the punch list
developed by John Hohman and Ryan Spidah.l, Metro Engineering, on 7/16/04. The
current condition of deficient items is described below:
1. Catch basin raised and apron replaced - not done
2. Cracks in curb & gutter - large cracks filled with rubberized adhesive and smaller
cracks patched with epoxy.
3. Ponds A& B not finished - Pond A irrigated and seeded. Pond B still has not
been final graded or the weeds removed.
4. Pond A has crack in inlet - Crack has been epoxy patched. Cracking noted in
several aprons on Pond A but do not appear significant enough to replace aprons.
5. Pond C relocated but not noted on as-builts - Pond C has evidently been
constructed opposite Pond D in the undeveloped area. Both ponds have only been
rough-graded. It also appears the size of Pond C will be decreased if Shelley
Lane is extended. John Hohman requested a new drainage plan to be submitted
but no record in files that this has been done.
The developer may be waiting to finish the ponds since housing construction is still
ongoing adjacent to the unfinished ponds.
Recommendation - This construction is all on private roads. Does the City of Spokane
Valley have an interest in roadway construction in addition to the 208 ponds and will a
warranty bond be required? In any case the redesigned plan for Pond C should be
submitted and the punch list items resolved before reducing or releasing the surety bond.
Please let me know if there is more that we can do to speed up the process.
The following files were not found either downstairs or across the street. We even had
Julie check to make sure we didn't overlook them.

and several designs for 208 drainage swales. No bancling infnrmatian, certificatian
gackage, or record drawi.ngs available. A11 work (ACP pavin.g on Valley Way, sidevvalk,
curb & gutter, drywells, swates, etc.) appears to have been cnmpleted except far seeding
#he Tract E drar.inage swale. Construction of a carnmercial bui.Yding and two homes has heen completed and construction of the remaining residence is aimost finxshed,.
This project was recently constructed so there shauld be more informatian available. Is
tlYe main p~-rtion of the file located somewhere that we (and Julie) have not been ab1e to
fmd? Could the inforsnation be found under a different file narne? Is it possible that
Sirnpson Engineers 'has the rnissing information? Was a walk-thraugh conduc#ed by John
or Sandra? Shouldn't this project requi~e a warranty bond?
We will not be able to update the current status af this project aad make a
recammendat.ion without more ixr.formation.
PE 1414B - Riverwaik 3 `d Addition
The construction bond was released on 5127199 by Bill Hemmings, Spakane County
r]evelopment Services Engizxeer, after S-pokane Cou.nty acknowle+dged receiving a
$2, 123.00 warranty bond. This warranty bond was to be limited to vne yeaT expi.ring +on
4l20100. However the actua1 warranty bond, hond num. ber, or name of the honding
company was not found in the f'iles. Afie1d review noted that the maaor part ofthe
praject is now designated prYvate roads. No def ciencies were noted on Lndiana Avenue,
. the offly public road withi.n the project limits.

per#aining tv the deficiencies of each of thern. The Iists are as #ollows:
Shellev Lake 2nd Addition
1.) The engineer is only certifying that the project was, at one Ume, in campiiance with the approved design and
aII applicable standards. He makes no guarantee #ha# the hvme builders andlor new home owners haven't gone
in and subs#antially changed any of the items certified. Even though there was no walk-through made or any
oonfirrnation made at the time of ultimate pertectian and it is ohvious that things are nat in that candition any
langer, if they ever were.
2.} The last correspondenve in the cert. package is frvm 1999. This was fallawing a memo frorn Spakane
Caunt}r Utiiities inforrning them tha# they still had a failing manhole in their systern. Thene is no confirma,tion that
this was addressed further from either side. There is no men#ion of the walk-through that was rnade by us ir,
August, 2003 or the resulting repairs nnted at that time. No# ta mention the incomplete swales that had been
oertsfied as nat passing.
3.) Test resufts, particularly oompaction and density #s, have beerr rounded up in order to reflect passing
percentages. There is alsa no temperature measuremen# shown with #he asphalt density tests to confirm that
passing re-tes#s cauld actually have been achei-ved.

This Easement wilI terminate at such time the described areas are platted. At that time, the
property subject to the Easemcnt described herein shall revert to Grarrtor(s), their successors in

Declaration of Covenant
In consideration of the approval by Spokane County of SHELLEY LAKE FOURTH ADDITION
(hereinafter referred to as the "Development"), the undersigned covenants and agrees that:
1. The subdivider/sponsor will construct the private roads and associated drainage facilities in
conformance with the approved plans on file in the County Engineer's Office.
2. A lot is served by the private road when: (a) the only road frontage for the lot in the Development is
on the private road; or (b) a lot having frontage on more than one road (public or private) constructs an
approach to the private road.
3. The SHELLEY LAKE HOMEOWNERS ASSOCIATION or their successors in interest shall maintain
the private roads and associated drainage facilities in conformance with the approved plans on file in the
County Engineer's Office.
4. The owner(s) of any lot created by the Development or alteration thereof and served by a private road
shall be responsible for maintenance of said private road, including associated drainage facilities.
5. Maintenance financing of the private roads and associated drainage facilities shall be in a manner
determined by the SHELLEY LAKE HOMEOWNERS ASSOCIATION or their successors in interest.
6. Should the SHELLEY LAKE H4MEOWNERS ASSOCIATION be terminated for any reasons, the
successors in interest shall be the individual lot owners, or their successors in interest, who are members
of the SHELLEY LAKE HOMEOWNERS ASSOCIATION at the time of said termination.
7. In the event such private road including associated drainage facilities is improved to Spokane County
standards for public streets, and the County is willing to accept the dedication of such road and drainage
facilities, each lot owner shall execute any documents necessary to accomplish such dedication.
8. Owners of lots within the Development who are served by such road may sue and recover damages
and attorneys' fees from any owner of any lot within the Development which is similarly served who
refuses to participate in the road and drainage facilities construction, financing, and maintenance.

9. WARN1NG: Spokane County has no responsibility to build, improve, or maintain or otherwise
service the private roads and associated drainage facilities contained within or providing service to the
property described in this Development. By accepting this development or subsequently by allowing a
building permit to be issued for property on a private road, Spokane County assumes no obligation for
said private road and the owners hereby acknowledge that the County has no obligation of any kind or
nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain, provide
drainage or snow removal on a private road or its associated drainage facilities.
10. Whenever the SHELLEY LAKE HOMEOWNERS ASSOCIATION or their successors in interest
fail to maintain the drainage facilities in conformance with the approved drainage plan, a notice will be
given to the SHELLEY LAKE HOMEOWNERS ASSOCIATION or their successors in interest by the
County. If not corrected after 10 days, the County has the right to correct the maintenance failure or have
it corrected at the expense of the SHELLEY LAKE HOMEOWNERS ASSOCIATION or their
successors in interest or lots in the development.
11. Spokane County does not accept the responsibility of maintaining the drainage course on private lots
within drainage easements or floodplain areas, nor the responsibility for any drainage whatsoever,
including but not limited to inverse condemnation to any properties due to deficient construction and/or
maintenance of drainage courses in drainage easements on private property.
12. This covenant and agreement shall run with the land and shall be binding upon the owner, their heirs,
successors or assigns, including the obligation to participate in the maintenance of the private road and
drainage facilities as provided herein.

DRAINAGE DECLARATION OF COVENANTS
In consideration of the approval by Spokane County of Shelley Lake PUD, 4 TH
Addition, hereinafter referred to as the "plat", undersigned covenants and agrees that:
Spokane County and its authorized agents are hereby granted the right to ingress and egress to, over and from
all public drainage easements for the purposes of inspection and emergency maintenance of water quality
treatment swales, ponds, ditches, culverts and any other drainage facilities, if not properly maintained by the
property owner(s) or the Shelley Lake Homeowners Association. Spokane County does not accept the
responsibility to inspect or maintain drainage facilities located outside of public rights-of-way. Neither does
Spokane County accept any liability for any failure by the property owner(s) to properly maintain such
facilities. .
The property owner(s) within this plat shall be held responsible for keeping open and maintaining the surface
path of natural or man-made drainage flow over and across their respective properties. If the property owners
fail to maintain the surface path of natural or man-made drainage flow, or drainage facilities on private
properties, a notice of such failure may be given to the property owner(s). If not corrected within the period
indicated on said notice, Spokane County has the right to correct the maintenance failure, or have it corrected,
at the expense of the property owner(s).
Spokane County does not accept the responsibility of maintaining the drainage course on private- lots or
floodplain areas within private lots, nor the responsibility for any damage whatsoever, including, but not
limited to, inverse condemnation to any properties due to deficient construction and/or maintenance of
drainage courses in drainage easements on private property.
Any building that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive
drainage away frorn any drainage entry point to the building (including but not limited to a window well, a
window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum
slope of 3% away from the building for a distance of at least 10 feet from the building. The lots shall be
graded so that either, a) all runoff is routed away from the building and conveyed over the lot to a natural
drainage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in
an approved drainage facility. All drainage facilities for this plat, including any water quality treatment
swales, shall be constructed in accordance with the approved plans on file at the Spokane County Engineer's
Office. Any proposed changes to the approved road and drainage plans must be approved by the Spokane
County Engineer's Office prior to construction of said changes.
There may exist properties located uphill and adjacent to this subdivision that penodically discharge
stormwater runoff onto individual lots within this plat. Stormwater runoff from nearby uphill properties should
be expected, and during snow melt periods or wet seasons the lots may be subjected to higher amounts of

stormwater runoff than what is normally observed or anticipated. Because stormwater runoff from adjacent
properties have discharged onto this plat prior to development, stormwater runoff will likely continue to do so
after development.
The Shelley Lake Homeowners Association, or its successors in interest, shall maintain the water quality
treatment swales and drainage facilities located in Tract A, Tract B, Tract C and Tract D, in conformance with
the approved plans on file at the Spokane County Engineer's Office. Maintenance of water quality swales and
drainage facilities includes, but is not limited to: maintenance of a permanent ground cover (live, native-type
dryland grasses or lawn turf, with optional shrubbery and/or trees which do not obstruct the flow and
percolation of storm drainage water in the drainage swale as indicated by the approved plans) on all water
quality treatment swales and drainage ditches; removing and disposing of the soil and ground cover at such
time Spokane County deems necessary, and replacing the soil and ground cover; keeping open and cleaning
drywells, pipes, catch basins, ditches, drainage ponds and swales; and the replacement of drainage
structures/facilities as needed. No structures, including fences, shall be constructed directly over or within a
water quality treatment swale without the expressed written consent of the Spokane County Engineer.
Spokane County does not accept the responsibility to inspect and/or maintain these drainage facilities nor does
Spokane County accept any liability for any failure by the lot owner(s) to properly maintain such facilities.
If Shelley Lake Homeowners Association, or their successors in interest, fail to maintain the water quality
treatment swales and/or d.rainage facilities in Tract A, Tract B, Tract C and Tract D, in conformance with the
accepted drainage plan on file at the Spokane County Engineer's Office, the County Engineer may give a
notice of such failure to the Shelley Lake Homeowners Association, or their successors in interest. If not
corrected within the period indicated on said notice, Spokane County has the right to correct the maintenance
failure, or have it corrected, at the expense of the Shelley Lake Homeowners Association, or their successors in
interest. The Shelley Lake Homeowners Association shall be responsible for payment of all claims and
other liabilities that may become due for said maintenance responsibilities.
Should the Shelley Lake Homeowners Association be terminated for any reason, the successors in interest
shall be the individual lot owners, or their successors in interest, who are members of Shelley Lake
Homeowners Association at the time of said termination. The successors in interest shall share equally in the
responsibility and cost of maintaining said drainage facilities.
This covenant and agreement shall run with the land in perpetuity, and shall be binding upon the owner, their
heirs, successors and assigns, including the obligation to participate in the maintenance of the drainage

Drainage easements as platted and shown hereon, which are for the purpose of conveying and storing

Thanks for the drainage language. The name of the HOA for this project is
actually Shelley Lake Estates HOA - I am sending a fax of the State
Registration for your records. (The CC&Rs reference the correct UBI# but
refer to it as the Shelley Lake Homeowners Assn.) Would you update the
document and re-email it? Thanks.
Also, the quantities have been done and are being checked this afternoon;

Please note that the following information must be placed on the face of
the final plat.
DRAINAGE LANGUAGE:
Drainage easements as platted and shown hereon, which are for the purpose of conveying and storing
stormwater runoff, and for installing, operating and maintaining drainage ponds and drainage facilities
which dispose of and treat stormwater runoff, are hereby granted to Spokane County and the Shelley Lake
Estates Homeowners' Association. Tracts A, B, C, and D are hereby dedicated to the Shelley Lake Estates
Homeowners' Association for the purpose of conveying and storing stormwater runoff, and for installing,
operating and maintaining drainage ponds and drainage facilities which dispose of and treat stormwater
runoff. A drainage easement is granted to Spokane County over Tracts A, B, C, and D for inspection and
emergency maintenance of stormwater facilities.
Spokane County and its authorized agents are hereby granted the right to ingress and egress to, over and
from all public drainage easements for the purposes of inspection and emergency maintenance of drainage
swales, ponds, ditches, culverts and other drainage facilities, if not properly maintained by the property
owner(s) or the Shelley Lake Estates Homeowners' Association. Spokane County does not accept the
responsibility to inspect or maintain drainage facilities located outside of public rights-of-way, except in
cases where Spokane County specifically assumes that responsibility in wrifiing. Neither does Spokane
County accept any liability for any failure by the property owner(s) to properly maintain such areas.
The property owner(s) within this plat shall be held responsible for keeping open and maintaining the
surface path of natural or man-made drainage flow over and across their respective properties. If the
property owner(s) fail to maintain the surface path of natural or man-made drainage flow, or drainage
facilities on private properties, a notice of such failure may be given to the property owner(s). If not
corrected within the period indicated on said notice, Spokane County has the right to correct the
maintenance failure, or have it corrected, at the expense of the property owner(s).
Spokane County does not accept the responsibility of maintaining the drainage course on private lots nor the
responsibility for any damage whatsoever, including, but not limited to, inverse condemnation to any
properties due to deficient construction and/or maintenance of drainage courses in drainage easements on
private property.
Any building that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive
drainage away from any drainage entry point to the building (including but not ]imited to a window well, a
window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum
slope of 3% away from the building for a distance of at least 10 feet from the building. The lots shall be
graded so that either a) all runoff is routed away from the building, and conveyed over the lot to a natural
drainage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in
an approved drainage facility. All drainage facilities for this plat, including any `208' swales, shall be
constructed in accordance with the approved plans on file at the Spokane County Engineer's Office. Any
proposed changes to the approved road and drainage plans must be approved by the Spokane County
Engineer's Office prior to construction of said changes.
There may exist properties located uphill and adjacent to this subdivision that periodically discharge
stormwater runoff onto individual lots within this plat. Stormwater runoff from nearby uphill properties
should be expected, and during snow melt periods or wet seasons the lots may be subjected to higher
amounts of stormwater runoff than what is normally observed or anticipated. Because stormwater runoff
from adjacent properties have discharged onto this plat prior to development, stormwater runoff will likely
continue to do so after development.
The property owner(s) within this plat shall maintain all natural drainage channels, drainage ditches, and all
water quality swales (`208' swales) situated on their respective properties, and any portion of a`208' swale
situated in a public right-of-way adjacent to their respective properties, with a permanent ground cover as
specified in the currently approved and accepted plans on file at Spokane County Engineer's Office.. No
structures, including fences, shall be constructed directly over or within a natural drainage channel or
drainage ditch without the expressed written consent of the Spokane County Engineer. Spokane County
does not accept the responsibility to inspect and/or maintain the drainage easements, nor does Spokane
County accept any liability for any failure by the lot owner(s) to properly maintain such areas.
The Shelley Lake Estates Homeowners' Association or its successors in interest shall maintain any
drainage facilities, located in Tracts A, B, C, and D, in conformance with the approved plans on file at
the Spokane County Engincer's Office. Maintenance of drainage facilities includes, but is not limited to,
keeping open and cleaning storm pipes, ditches, drainage ponds, swales, etc., replacement of drainage
facilities as needed, and maintaining live native-type dryland grasses or lawn turf in the `208' swales
located in common areas or tracts, with optional shrubbery and/or trees, which do not obstruct the flow and
percolation of storm drainage water in the drainage swale as indicated by the approved plans. The Shelley
Lake Estates Homeowner's Association is also responsible for removing and disposing of the soil and
grass sod located in drainage facilities situated within common areas or tracts at such time Spokane
County deems necessary, and replacing the soil and grass sod. The Shelley Lake Estates Homeowners'
Association shall be responsible for payment of all claims and other liabilities which may become due for
said maintenance responsibilities.
If the Shelley Lake Estates Homeowners' Association, or their successors in interest, fails to maintain the
drainage facilities in conformance with the accepted drainage plan on file at the Spokane County Engineer's
Office, a notice of such failure may be given to the Shelley Lake Estates Homeowners' Association, or their
successors in interest, by the County Engineer. If not corrected within the period indicated on said notice,
Spokane County has the right to correct the maintenance failure, or have it corrected, at the expense of the
Shelley Lake Estates Homeowners' Association, or their successors in interest.
Should the Shelley Lake Estates Homeowners' Association be terminated for any reason, the successors in

The tracts and common areas cannot be sold or transferred and shall be considered subservient estates for
tax purposes to the other lots created herein. The status of the areas designated as subservient estates for tax
purposes cannot be changed without filing a replat.
The developer, property owners, and homeowners' association waive any and all claims for damages against
any governmental authority arising from the construction, ownership or maintenance of public faciliries.
This waiver includes claims of any nature, including but not limited to person and real property damages as
well as any inverse condemnation claims.
