PARAS Mr. Chairman: This evening is the date which the Board of County Commissioners has set to render its decision on ZE-8-92, a rezone request from UR-3 .5 and UR-22 to UR-22 with sewer bonus density. The applicant is John Paras. The proposal would allow development of 24 multi-family residential units on a 42, 006 square foot lot, located generally at the northeast corner of Valleyway Avenue and McDonald Road, for a density of 24 . 7 units per acre. The file indicates that the Spokane County Hearing Examiner Committee previously denied the applicant' s request for sewer bonus density of 2 .7 units per acre over and above the 22 units per acre allowed by the UR-22 zone. The Hearing Examiner Committee' s denial of the bonus density request was appealed to the Board of County Commissioners on behalf of Mr. Paras. After considering the file and all public testimony submitted at the public hearing held on May 26, 1992, I hereby move that the appeal filed on behalf of John Paras, and his request for sewer bonus density of 2 .7 units per acre to allow the proposed development of 24 multi-family residential units on a 42, 006 site at the northeast corner of Valleyway and McDonald be approved. I observe that the applicant offered ample testimony at the hearing on the justification for bonus density pursuant to chapter 14 . 820 of the Spokane County Zoning Code, and that no testimony was submitted in opposition to the appeal . I further find that several findings (i.e. 5, 6, 11, 12 and 14) made by the Hearing Examiner Committee in its written decision actually support the request for sewer bonus density. While the applicant could request up to an additional 5 units per acre for the proposal, the rezone request is limited to the 2 . 7 units needed to make the project viable, in the applicant' s view. The proposal is compatible with surrounding land uses, is consistent with the intent and purpose of bonus density for sewer hookup, and will not otherwise harm the public health, safety and welfare. PAGE - 1 92 0'707 I would request that Planning Department staff prepare Findings of Fact and Decision reflecting this motion and other issues raised at the public hearing for execution by the Board at a subsequent public meeting.
