HEARING EXAMINER COMMITTEE
FINDINGS OF FACT, CONCLUSIDNS AND ORDER
INTRODUCTION - This matter has come before the Hearing Examiner Committee on November 17,
1995, having been continued from the November 16, 1995 regularly scheduled
meeting. The members of the Committee present are: Brenda Bodenstein, Chair,
Toni Nersesian and Michael Schrader.
PROPOSAL
The sponsor, Dean V4-94,*as sts approval of a Change of Conditions to a portion
of the approved of Celtic Addition (PE-1754-94) and a new revised
preliminary pl r, divide approximately 12.5 acres into 381ots for
single family r sid~'.sting Urban Residential-3.5 (UR-3.5) zoning. Celtic Addition approved on October 24, 1994 to subdivide
approximately 7.64 acres into 221ots for single family residences with existing
Urban Residential-3.5 (UR-3.5) zoning
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located west of and adjacent to Sullivan Road,
approximately 650 feet north of 32nd Avenue, in Section 26, Township 25 North,
Range 44 EWM, Spokane County, Washington.
2. The Committee adopts the Planning Department Report as a part of this record.
3. The existing land uses in the area include single family residences and fanning
activities.
4. The proposed use is compatible with existing uses in the area.
5. The proposal is located within the Urban category of the Comprehensive Plan and
within the Priority Sewer Service Area (PSSA). The Urban category is intended to
provide the opportunity for development of a"citylike" environment which includes
various land uses and intensive residential development. Urban areas will have
public water systems, sanitary sewer systems, storm sewer systems and other
public services available. The Goals, Objectives and Decision Guidelines of the
Urban category promote "fill-in" development within an area where utilities;
arterials, and community facilities have already been established. The proposal is
located in an area where public services including roads, water and sewer are
available to the site and the project is also located in an area with existing residential
development and promotes 1fill-in development which is encouraged by the Urban
ComPrehensive Plan categorY. Residential net densities in the Urban category
should range between 1 and 17 units per acres. The proposed density of 3.04 units
per acre is in accord with the density range suggested by the Urban category.

6. The existing zoning does implement and conform to the Comprehensive Plan.
7. The site is adjacent to Sullivan Road which is designated on the Spokane County
Arcerial Road Plan as a Principal Arterial with a future right-of-way width of 100 feet.
In order to implement the Plan, the Spokane County Engineer has requested twenty
(20) feet of dedication as a recommended condition of approval on the southern plat
boundary. In order to implement the Arterial Road Plan, a future acquisition area
(FAA) equaling 50 feet from the centerline shall be shown along the taper of SQllivan
Road.
8. The existing zoning of the property described in the application is Urban
Residential-3.5 (UR-3.5) established in 1991, previously classified as Agricultural
(A) (ZE-60-42) and redesignated to Urban Residential-3.5 (UR-3.5) on January 1,
1991 pursuant to the Program to Implement the Spokane County Zoning Code.
Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the
existing zone.
9. The provisions of RCW 43.21 C(The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance (DNS) was issued. The
Committee, after independent review, hereby adopts the DNS.
10. The legal requirements for public notice have been fulfilled. a
11. No public testimony was provided either in favor or opposition to the proposal.
Letters were received in opposition and concerns expressed were increased traff'ic
and stormwater runoff.
12. The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the cond.itions recommended by the reviewing
agencies.
14. The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The
proposal as conditioned does provide adequate public facilities as cited in RCW 58.17.110 (2). More specifically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d. transit
e. potable water
f. sanitary waste disposal
g. parks and recreation facilities
h. playgrounds i. schools and schoolgrounds
j . sidewalks
The above improvements are either existing facilities or will be provided by the
applicant upon finalization of this subdivision as conditioned by the Conunittee and
implemented by the various County agencies.

` 15. The Committee additionally finds/concludes: a. The applicant agrees with and accepts all the recommended conditians of
approval.
b. The previous approved preliminary plat of Celtic Addition (PE-1754-94) is
null and void.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Cominittee shall be binding on
the "Applicant," which term shall include the owner or owners of the property,
heirs, assigns, and successors-in-interest.
2. The conditions of approval apply to the preliminary subdivision of record.
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) and Aqutfer r
Sensitive Area (ASA) Overlay zones, as amended.
2. The final plat shall be designed substantially in conformance with the preliminary
plat of record. No increase of density or number of lots shall occur without a
change of condition application submittal and approval.
3. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
4. A final plat name/number shall be indicated before the final plat is filed, such
name/number to be approved by the Planning Director/designee.
5. Appropriate road name(s) shall be indicated. .
6. The preliminary plat is given conditional approval for five (5) years, specifically to
December 1, 2000. The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiration
date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be
received with the submittal of the final plat.
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks
from all public roads. The dedication shall contain the following statement:
"Side yard and rear yard setbacks shall be determined at the time building permits
are requested unless these setbacks are specifically drafted on this final plat. The
setbacks indicated on tlus plat may be varied from if proper zoning approvals are
obtained."

9. A titirty-five (35) feet structure setback sha11be impased frorn Sullivan Rvad,. and
shall be measured from the Future Acquisition Area.
10. A thirty faot (30) #larxking yard setback shall be imposed from the west propeny
- Iine of Lot 1, Block 2, which is adjacent to the dedicated 112 right-of-way.
11. T'hree (3) curre,nt certiicates of title shall be furnished to the Planning Department
priar to filing the final plat.
12. Prior to filing of all ar a partion of the final plat, the applican#'s surveyor shall
submit one ar more maps outlined in red of the area being finalized. The scale shall
match the appropriate assessor's map scale.
13. "The plat dedication shall cantain the following staternent.
"Lot 31 , BIock 1 a.nd Lot i, Black 2 are located on a ternparary cul;de-
saclroadway. This temporary cul-de-sacfroadway may be extended to provide
access to adjacent property and/or conneet ta existing roads or new roads as
developrnent antUor circulation needs dicCate."
14. The ~'~naT plat shall indicate yard setback arc lengths on cul-de-sac lots which rneet ~
or exceed the minimurn frontage of the underlying zone of the ~inal plat,
15. A plan for water facilities adequaCe for domestic service and fire protection shall be
approved by t.he water purveyor, appropriate fire protection district, County
Building & Safety Uepartment and County Health District, The agencies wi.il

conformance with their respective needs and regulations. 'i'he Water Plan and

16. The water purveyor shall certify t-iat appropriate contractualarrangements and

17. The fma1 plat dedication shall contain the folTawing statement:

Depart.rnent and water purveyor, shall be installed, wifihin this subdivisi~n and the
applicant shall provide for individual domestic vtrater servtce as well as fim
prvtection to each lot prior to sale of each lot and grior tv issuan.ce of a building
permit for each lat."
18. Na building permit will be issued far any lot within the inal plat until certified by a
Washu°igton state-licertsed engineer that "the water system has been installed

pursuant to the approved Water Plan for the final plat" includinQ a signed license
stamp. The certification may be in the form of a letter. but is prefenedto be
certified on a copy of the Water Plan as a schematic map showinQ the ,as-built,
water system.
19. The Water Plan and the above four (4) conditions of approval regarding the Water
Plan may be waived by the Planning Director/designee upon receipt of letters frQm
the appropriate water purveyor and fire protection district stating that simple '
connections to an existing, approved water system will provide adequate domestic
and fire protection water to ensure the public health, safety and general welfare.
20. A survey is required prior to the filing of a final plat.
21. Prior to approval of road and drainage plans, you are required to coordinate with
the United States Postal Service to determine type and location of central mail
delivery facilities which may include applicable easements for developments of
three or more homes.
22. The Owner shall negotiate with the Central Valley School District and submit a
recorded copy of a voluntary agreement making provisions for public schools prior
to finalization and recording of this plat. The agreement shall provide a written ~
description of the subject property to which the agreement applies and also state the
dollar amount and any other agreed to mitigatin~ measures.
The Owner shall also notify any potential purchasers who have made an agreement
to purchase property within said plat pursuant to the Revised Code of Washington
(58.17.205), that adequate provisions for school facilities must be made
conditioned on a future agreement between the plattor and school district.
Voluntary agreements between the Owner and School District shall conform to the
requirements of the Revised Code of Washington Chapter 82.02.
23. The Spokane County Planning Department shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Department. The notice should be
recorcied within the same time frame as an appeal and shall provide the following:
a. A future acquisition area equaling 50 feet from centerline shall be shown
along the taper of Sullivan Road, in addition to the existing and/or newly
dedicated right of way.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
.

landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements
after acquiring said future acquisition area.
24. The applicant shall contact the Division of Buildings at the earliest possible stage in
order to be informed of code requirements administered/enforced as authorized by
the State Building Code Act. Design/development concerns include: addressing;
fire apparatus access roads; fire hydrant/flow; approved water systems; building
accessibility; construction type; occupancy classification; exiting; exterior wall
protection; and energy code regulations. (Note: The Division of Buildings reserves
the right to confirm the actual address at the time of building permit.)
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record. ~
2. Plans, profiles, and cross-sections as designed to County standards showing
proposed street centerline and curb grades shall be submitted to the County
Engineer for acceptance prior to construction and/or the filing of each final plat;
road plans to be prepared under the direction of a licensed Professional Civil
Engineer.
3. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engineer for acceptance prior to construction
and/or the filing of the final plat. Drainage plans to be prepared under the direction
of a licensed Professional Civil Engineer.
4. Construction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed engineer/surveyor, who shall furnish the
County Engineer with "as-built" plans and a certificate in writing that all
improvements were installed to the lines and grades shown on the approved
construction plans and that all disturbed monuments have been replaced.
5. No construction work is to be performed within the existing or proposed public
right-of-way until a pernut has been issued by the County Engineer. All work is
subject to inspection and approval by the County Engineer.

improvement of Saltese Road which is to be constructed within the proposed
development. This will require the installation of 37 feet of asphalt. The
construction of curbing and sidewalk is also required. -22. The County Engineer has designated Local Access Roadway Section for the
improvement of the two unnamed Local Access Roads which are to be constructed
within the proposed development This will require the installation of 20 feet of
asphalt. The construction of curbing and sidewalk is also required.
23. The County Engineer has designated a Principal Arterial Special Roadway Section
for the improvement of Sullivan Road which is adjacent to the proposed
development. This will require the addition of varying amounts of asphalt along the
frontage of the development. The construction of curbing and sidewalk is also
required.
24. The proposed subdivision shall be improved to the standards set forth in Spokane ~
County Board of Commissioners Resolution No. 95-0498, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
25. The County Engineer has examined this development proposal and has deternuned
that the impact of this proposal upon the existin~ county road system warrants the
dedication of additional right-of-way and the roadway improvements herein
specified.
26. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane Counry assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to deternune whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
27. The applicant shall improve Sullivan Road to equa136 feet of aspnalt along the frontage
of the development prior to finalization of any portion of this plat. Construction of the
ultimate Special Roadway Section for Sullivan Road shall be done through an RID.
28. The applicant shall grant applicable border easements adjacent to Spokane County right
of way per Spokane County Standards.
29. The Sullivan Road and 24th Avenue intersection continues to experience the impacts
from several new and existing developments. The developer shall financially
participate in the signalization of this intersection for costs not to exceed a pro-rata share
based on proposed traffic from this development. This agreement shall be reached and
executed by the developer and Spokane Counry prior to any final plat. This provision
is applicable to the 16 new lots on the extension of Century and Newer Roads.

30. The applicant has proposed tapering the required 20 foot dedication along Sullivan
Road to match the right of way dedication from a previously approved project on the
southern plat boundary. In order to implement the Spokane County Arterial Road Plan,
a future acquisition area equaling 50 feet from centerline shall be shown along the taper.
This area may be acquired by Spokane County when arterial improvements are made to
Sullivan Road.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Any water service for this project shall be provided in accordance with the
Coordinated Water Systenn Plan for Spokane County, as amended.
2. "The owner(s) or successor(s) in interest agree to authorize the Counry to place
their name(s) on a petition for the formation of ULID by petition method pursuant
to RCW 36.94, which petition includes the owner(s)' property; and further not to
object by the signing of a protest petifion against the fonnation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a ULID by either -
petition or resolution method under RCW Chapter 36.94."
3. A wet (live) sewer conriection to the area-wide Public Sewer System is to be
constructed. Sewer connection permit is required.
4. Applicant shall submit expressly to Spokane County Utilities Department under
separate cover, only those plan sheets showing sewer lines and specifications for
public sewer connections for review and approval by the Utilities Department prior
to issuance of permit to connect.
5. Security shall be deposited with the Utilities Department for construction of public
facilities connection.
6. Arrangements for payments of additional sewer charges must be made for prior to
issuance to sewer connection permit.
SPOKANE COUNTY FIEALTH DISTRICT
1. The final plat shall be designed as indicated on the preliminary plat of record and/or
any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies,
Spokane County Engineer and the Spokane County Health District. Written
approval of the easements by the utility companies must be received prior to the
submittal of the final plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.

4. Water service shall be coordinated ttu-ough the Director of Utilities, Spokane County.
5• Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is
available to each lot of the plat. -7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies
within the recorded service area of the water system proposed to serve the plat.
8. A plan for water facilities adequate for domestic use, domestic irrigation use and
fire protection use shall be approved by the water purveyor. Said water plan must
have been approved by the fire protection district and the appropriate health
authorities. The health authorities, water supplier (purveyor) and the fire protection
district will certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in conformance with their requirements and will adequately satisfy
their respective needs. Said water plan and certification will be drafted on a
transparency suitable for reproduction.

9. The purveyor will also certify prior to filing the final plat on a copy of said water
plan that appropriate contractual arrangements have been made with the plat sponsor
for construction of the water system, in accordance with the approved plan and time
schedule. The time schedule will provide, in any case, for completion of the water
system and inspection by the appropriate health authorities prior to application for
building permits within the plat. The contractual arrangements will include a
provision holding Spokane County, Spokane County Health District and the
purveyor harmless from claims by any lot/tract purchaser refused a building permit
due to failure of the plat sponsor to satisfactorily complete the approved water
system.
10. A public sewer system will be made available for the plat, and individual service
will be provided to each lot prior to sale. Use of individual on-site sewage disposal
systems shall not be authorized.
11. A statement shall be placed in the dedication to the effect that: "A public sewer
system will be made available for the plat, and individual service will be provided to
each lot prior to sale. Use of individual on-site sewage disposal systems shall not
be authorized."
12. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
13. The final plat dedication shall contain the following statement: "The public water
system, pursuant to the water plan approved by county and state health authorities,
the local fire protection district, County Building and Safety Department, and water
purveyor, shall be installed within this subdivision and the applicant shall provide
for individual domestic water service as well as fire protection to each lot prior to
sale of each lot and prior to issuance of a building permit for each lot."

SPOKANE COUNTI' AIR POLLUTION CONTR4L AUTHORITY
1. A11 air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be-
controlled, as well as emissions from all other construction-related activities.
3. SCAPCA strongly recommends that all traveled surfaces (ingress, egress, parking
areas, access roads) be paved and kept clean to minimize dust emissions.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e., construction waste, etc.)

6. Demolition and renovation projects must comply with the requirements of CFR 401
Part 61, Subpart M and SCAPCA Regulation I, Article IX. Intent to Demolish
forms are available at the SCAPCA office.
7. All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with
local, state, and federal rules and regulations.
8. Some objectionable odors will likely result from this project. SCAPCA's regulations
state that effective control apparatus and measures must be used to reduce odors to a
minimum.

INTRODUCTION Caupty ~nnineerir~
This matter has come before the Hearing Examiner Committee on October 20,
1994. The members of the Committee present are: Brenda Bodenstein, Chair, Jan
Reuter and Frank Yuse.
PROPOSAL
The sponsor, Dean Greer requests approval of the Preliminary Plat of Celtic
Addition, PE-1754-94, to subdivide approximately 7.64 acres into 221ots for single
family dwellings and those uses allowed in the existi.ng Urban Residential-3.5
(UR-3.5) zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located west of and adjacent to Sullivan Road,
approximately 1,000 feet north of 32nd Avenue, within the SE 1/4 of Section 26,
Township 25 North, Range 44 EWM, Spokane County, Washington.
2. The Committee adopts the Planning Department Report as a part of this record.
3. The existing land uses in the area include single family residences, large animal
keeping and undeveloped land.
4. The proposed use is compatible with existing uses in the area. 5. The proposal is located within the Urban category of the Comprehensive Plan and
within the Priority Sewer Service Area (PSSA). The Urban category is intended to
provide the opportunity for development of a"cirylike" environment which includes
various land uses and intensive residenrial development. Residential net densities in
the Urban category should range between 1 and 17 units per acres. The proposed
density of 2.87 units per acre is in -accord with the density range suggested by the
Urban category.
. 6. The existing zoning does implement and conform to the Comprehensive Plan.
7. The Arterial Road Plan designates Sullivan Road as a Frincipal Arterial, with a
recommended right of way width of 100 feet. In order to unplement the Arterial
Road Plan, the County Engineer has requested 20 feet of dedication along Sullivan
Road.
8. The existing zoning of the property described in the application is Urban
Residential-3.5 (UR-3.5) previously established as Agricultural (A) zoning in 1942
and redesignated to Urban Residential-3.5 (UR-3.5) on January 1, 1991 pursuant
to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW
58.17.195 .the-proposal does conform to the requirements of the exisring zone.
9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been
complieti with and a Determination of Nonsignificance (DNS) was issued. The
Committee,-after independent review, hereby adopts the DNS.
10. The legal requirements for public notice have been fulfilled.
11. The owners of adjacent lands expressed neither approval nor d.isapproval of the
proposed use.
12. The agent for the project testified at the public hearing that all recommended
conditions of approval were accepted by the applicant, including the conditions for
parks and school mitigation agreements.
13. The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing
agencies.
14. The sabdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regularions, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The
proposal as conditioned does provide adequate public faciliries as cited in RCW
58.17.110 (2). More specifically:
a. open spaces
b. drainage ways
c. public andlor private rights-of-way
d. transit
e. potable water
f. sanitary waste disposal
g, parks and recreation facilities
h . playgrounds . i. schools and schoolgrounds
j . sidewalks
The above improvements are either existing facilities or will be provided by the
applicant upon finalizarion of this subdivision as conditioned by the Committee and
implemented by the various County agencies.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on
the "Applicant," which term shall include the owner or owners of the property,
heirs, assigns, and successors-in-interest.
2. The condirions of approval apply to the preliminary subdivision of record.

SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) and Aquifer
Sensitive Area (ASA) Overlay zones, as amended.
2. The final plat shall be designed substantially in conformance with the preliminary
plat of record. No increase of density or number of lots shall occur without a
change of condition application submittal and approval.
3. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval. ,
4. A final plat name/number shall be indicated before the final plat is filed, such
name/number to be approved by the Planning Director/designee.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
November 1, 1997. The applicant may request an extension of rime by submitting
a written request approximately forty-five (45) days prior to the above expirarion
date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat
Written approval of utility easements by appropriate utility companies shall be
received with the submittal of the final plat.
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks
from all private, "Tract X" or public roads. The dedication shall contain the
following statement:
"Side yard and rear yard setbacks shall be determined at the time building pernuts
are requested unless these setbacks are specifically drafted on this final plat. The
setbacks indicated on this plat may be varied from if proper zoning approvals are
obtained."
9. A thirty-five (35) feet structure setback shall be imposed from Sullivan Road, and
shall be measured from the Future Acquisition Area.
10. A twenty-five (25) feet flanking yard setback shall be imposed from the west
property line of Lot 1, Block 2, which is adjacent to the dedicated 1/2 right-of-way.
11. Three (3) current certificates of title shall be furnished to the Planning Department
prior to filing the final plat.
12. Prior to filing of all or a portion of the final plat, the applicant's surveyor shall
submit one or more maps outlined in red of the area being finalized. The scale shall
match the appropriate assessor's map scale.
13. The plat dedication shall contain the following statement:
"Lot 15 , Block 1 and Lots 1-7, Block 2 are located on a temporary cul-de-
sac/roadway. This temporary cul-de-sac%adway may be extended to provide HEC 4rder for PE-1754-94 Page 3
access to adjacent property and/or connect to existing roads or new roads as
development and/or circulation needs dictate." -
14. The final plat shall indicate yard setback arc lengths on cul-de-sac lots which meet
or exceed the minimum frontage of the underlying zone of the final plat. 15. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection d.istrict, County
Building & Safety Department and County Health I?istrict. The agencies will
certify on the Water Plan, prior to the fiung of a final plat, that the plan is in
conformance with their respective needs and regulations. The Water Plan and
certification shall be drafted on a transparency suitable for reproduction and be
signed by the plat sponsor.
16. The water purveyor shall certify that appropriate contractual arrangements and
schedule of improvements have been made with the plat sponsor for construcrion of
the water system in accordance with the approved Water Plan. The time schedule
shall provide for completion of the water system and inspection by the appropriate
health authoriries prior to application for building permits within the final plat. The
arrangements or agreements shall include a provision holding Spokane County and
the purveyor harmless from claims by any lot purchaser refused a building permit
due to the failure of the subdivision sponsor to satisfactorily complete the approved
water system.
17. The final plat dedicarion shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safery
Department and water purveyor, shall be instal.led within this subdivision and the
applicant shall provide for individual domesric water service as well as fire
protection to each lot prior to sale of each lot and prior to issuance of a building
pernut for each lot." ,
18. No building permit will be issued for any lot within the final- plat until certified by a
Washington state-licensed engineer that "the water system has been installed
pursuant to the approved Water Plan for the final plat" includ.ing a signed license
stamp. The cerd.fication may be in the form of a letter, but is preferred to be
certified on a copy of the Water Plan as a schematic map showing the "as-built"
water system.
19. The Water Plan and the above four (4) conditions of approval regarding the Water
Plan may be waived by the Pla.nning Director/designee upon receipt of letters from
the appropriate water purveyor and fire protection district stating that simple
connections to an existing, approved water system will provide adequate domestic
and fire protection water to ensure the public health, safety and general welfare.
20. A survey is required prior to the filing of a final plat.
21. Prior to approval of road and drainage plans, you are required to coordinate with
the United States Postal Service to determine type and location of central mail
delivery facilities which may include applicable easements for developments of
_ three or more homes.

22. The Owner shall negotiate with the Central Valley School District and submit a
recorded copy of a voluntary agreement making provisions for public schools prior
to finalization and recording of this plat. The agreement shall provide a written
descriprion of the subject property to which the agreement applies and also state the
dollar amount and any other agreed to mitigating measures.
The Owner sha11 also notify any potential purchasers who have made an agreement
to purchase property within said plat pursuant to the Revised Code of Washington
(58.17.205), that adequate provisions for school facilities must be made
conditioned on a future agreement between the plattor and school district.
Voluntary agreements between the Owner and School District shall conform to the
requirements of the Revised Code of Washington Chapter 82.02.
23. To satisfy the requirements of RCW 58.17.110 that a subdivision make appropriate
provisions for public parks, recreation and playgmunds, the owner, at his option,
shall either ded.icate land within the subdivision or enter into a voluntary agreement
with Spokane County to mitigate the direct impacts that the subdivision has on
public parks, open spaces and recreational faciliries within the unincorporated areas
of Spokane County.
If the owner opts to enter into a voluntary agreement, the agxeement shall be
executed prior to the finalization and recording of the final plat and recorded in
conjunction therewith. The agreement shall be consistent with RCW 82.02.020
and be substantially the same as the standardized agreement prepared by the
Spokane County Parks, Recreation and Fair Department. Prior to finalization of the
plat, the owner shall advise any purchaser of property, as authorized under RCW
58.17.205, of the obligation within the voluntary agreement.
24. Short plat-915-93 (SP-915-93) shall be deemed null and void upon approval of this
preliminary plat.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS 1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing
proposed street centerline and curb grades shall be submitted to the County
Engineer for approval prior to construction and/or the filing of each final plat; road
plans to be prepared under the direcrion of a licensed Professional Civil Engineer.
3. Dra.inage plans and design calculations showing the alignment of drainage facilities
shall be subtnitted to the County Engineer for approval prior to construction and/or
the filing of the final plat Drainage plans to be prepared under the direction of a
licensed Professional Civil Engineer.
4. Construction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed engineer/surveyor, who shall fumish the ,
County Engineer with "as=built" plans and a certificate in writing that+all

improvements were installed to the lines and grades shown on the approved
constructi.ory plans and that all disturbed monuments have been replaced.
5. No construction work is to be performed within the existing or proposed public
right-of-way until a pernut has been issued by the County Engineer. All work is
subject to inspection and approval by the Counry Engineer.
6. All construcrion within the existing or proposed public right-of-way is to be
completed prior to filing each final plat, or a bond in the amount estimated by the
County Engineer to cover the cost of construction of improvements, construcrion
certification, "as-built" plans and monumenting the street centerlines shall be filed
with the County Engineer.
7. No d.irect access from lots to one-half (1/2) rights-of-way until such roads are
constructed to County standards and-established as County roa.ds.
8. Appropriate provision shall be made that the following-described property be held
in trust until the continuation of the streets be dedicated or deeded: a one (1)-foot
strip at the ends or edges of all streets that ternunate or border the subdivision
boundary. (Temporary cul-de-sacs are required when streets terminate at the
subdivision boundaries.)
9. Individual driveway access permits are required prior to issuance of a building
permit for driveway approaches to the counry road system.
10. Dedication of 20 feet of additional right-of-way along Sullivan Road.
. 11. Ded.ication of 20 feet of additional right-of-way along the future Murbach Road.
12. A statement shall be placed in plat dedication that no direct access be allowed from
lots to Sullivan Road.
13. A statement shall be placed in the plat dedication providing for future slope
easements as required by Spokane County along Sullivan Road. 14. Existing county roads providing direct access to the plat shall be paved and/or
curbed to Spokane County standards.
15. All public roads within the plat shall be designed and constructed to Spokane
County standards.
16. Sidewalks are required along the arterial(s) on Sullivan Road.
17. The word "applicant" shall include the owner or owners of the property, his heirs,
- assigns and successors.
18. To construct the road improvements stated 'herein, the applicant may, with the
approval of the County Engineer, join in and be a willing participant in any petition
or resolution which purpose is the forniation of a Road Impmvement District (RID)
for said improvements, pursuant to RCW 36.88, as amended. At such rime as an
RID is created or any Road Improvement Project is sanctioned by Spokane County,
the improvements required (curb, sidewalk, drainage control and paving to existing

pavement) will be at the sole expense of the undersigned owner(s), their heirs,
grantees and assigns. This provision is.applicable to the ultimate Special Roadway
Section for Sullivan Road. -
19. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, tile
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs,
grantees and assigns. This provision is applicable to the ultimate Special Roadway
Section for Sullivan Road.
20. - The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petirion for the formation of a Road Improvement District (RID)
by the petirion method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s)' property, and filrther not to object, by the signing of a ballot, to the
formation of an RID by the resolution method pursuant to Chapter 36.88 RCW,
- which resolution includes the owner(s)' property. If an RID is formed by either the
petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree:
(a) that the improvement(s) or construcrion contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and
, (c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the property
as a result of the improvements called for in conjuncrion with the fonnarion of an
RID by either petition or resolution method under Chapter 36.88 RCW, and to
appeal to the Superior Court the decision of the Board of County Commissioners
affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving) wi.ll be at the sole expense of the
undersigned owner(s), their heirs, grantees and assigns without participation by
Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from
the date of execution below. However, the owner(s) or successor(s) agree that if
. said RID waiver expires without construction of the required improvements, the
owner(s) or successor(s) agree to construct the required unprovements at their own
. expense, pay to Spokane County the then estimated cost of the required :

improvements to enable the County to complete the same, or furnish a bond or
other secure method suitable to the County (which may include the execution of
another RID waiver agreement) providing for or securing to the County the actual
construction of the improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision is
applicable to ulrimate roadway section of Sullivan Road.
21. The County Engineer has designated Typical Roadway Section Number Two,
Local Access standard for the unprovement of all internal roads, which is to be
constcucted within the proposed development. This will require the installarion of
36 feet of asphalt. The construction of curbing is also required.
22. The County Engineer has designated Special Roadway Section standard for the .
improvement of Sullivan Road, which is-adjacent to the proposed development.
This will require the addirion of varying amounts of asphalt to equal a total width of
36 feet along the frontage of the development. The constniction of curbing and
sidewalk is also required.
23. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction,
24, The County Engineer has examined this development proposal and has deternuned
that the impact of this proposal upon the existing county road system warrants the
dedicarion of additional right-of-way and the roadway improvements herein
specified.
25. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane Counry assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to deternune whether applicant(s) or
the utility is responsible for adjustment or relocarion costs and to make
arrangements for any necessary work.
26. The applicant shall improve Sullivan Road to equal 36 feet of asphalt along the frontage
of the development prior to finalization of any portion of this plat. Construction of the
ultimate Special Roadway Section for Sullivan Road sha11 be done through an RID.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
2. "The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of ULID by petition method pursuant
_ to RCW 36.94, which perition includes the owner(s)' property; and further not to
object by the signing of a protest petition against the formation of a tTLID by

resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this condition shall not prohibit the owner(s) or-
successor(s) from objecting to any assessment(s) on the property as a result of
improvements calleii for in conjunction with the formation of a ULID by either
petition or resolution method under RCW Chapter 36.94." 3. Applicant shall make connection to public sewer system. Sewer connection pennit
is required.
4. Public Sanitary Sewer easement shall be shown on the face of the plat and the
dedication shall state:
"The perpetual [exclusive] easement granted to Spokane County, its successors and
assigns is for the sole purpose of constructing, installing, operating, maintaining,
repairing, altering, replacing, removing, and all other uses or purposes which are or
may be related to a sewer system. Spokane County, its successors and assigns at
all times hereinafter, at their own cost-and expense, may remove all crops, brush,
grass or trees that my interfere with the constructing, installing, operaring,
maintaining, repairing, altering, replacing, removing and all other uses or purposes
which are may be related to a sewer system.
The grantor(s) reserves the right to use and enjoy that property which is the subject
of this easement for purposes which will not interfere with the County's full
enjoyment of the rights hereby granted; provided, the Grantor(s) shall not erect or
construct any buildings or other structure or drill on the easement, or diminish or
substantially add to the ground cover over the easement. The easement described
hereinabove is to and shall run with the land."
5. Plans and specifications for the public faciliries connection are to be reviewed and
approved by the Utilities Department. Spokane County plan submittal requ.irements
apply.
6. Security shall be deposited with the Utilities Department for construction of public
facilities connecrion. SPOKANE COUNTY HEALTH DISTRICT
1. The final plat shall be designed as indicated on the preliminary plat of record and/or
any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies,
Spokane County Engineer and the Spokane County Health District. Written
approval of the easements by the utility companies must be received prior to the
submittal of the final plat.
3. Sewage disposal method shall be as authorized by the I?irector of Utiliries, Spokane
County. •
4. Water service shall be coordinated through the Director of Utiliries, Spokane County.

5. Water service shail be by an exisring public water supply when approved by the
Regional Engineer (Spokane), State Department. of Health. -
6. Prior to filing the final plat, the sponsor shall demonstrate to the sarisfaction of the
Spokane County Health District that an adequate and potable water supply is
avai.lable to each lot of the plat.
7. Prior to filing the final plat, the sponsor sha11 present evidence that the plat lies
within the recorded service area of the water system proposed to serve the plat.
8. A plan for water facilities adequate for domestic use, domestic irrigation use and
fire pmtecdon use shall be approved by the water purveyor. Said water plan must
have been approved by the ~'ire protection d.istrict and the appropriate health
authorities. The health authorities, water supplier (purveyor) and the fire protection
district will certify, prior to the filing of the final p1at, on the face of said water pian
that the plan is in conformance with their requirements and will adequately sarisfy
their respective needs. Said water plan and certificarion will be drafted on a
transparency suitable for reproduction.
9. The purveyor will also certify prior to filing the final plat on a copy of said water
plan that appropriate contractual arrangements have been made with the plat sponsor
for construction of the water system, in accordance with the approved plan and time
schedule. The rime schedule will provide, in any case, for completion of the water
system and inspecaon by the appropriate health authoriries prior to application for
buiiding permits within the plat The contractual arrangements will include a
provision hold.ing Spokane County, Spokane County Health District and the
purveyor hannless from claims by any lot/tract purchaser refused a building permit
due to failure of the plat sponsor to satisfactorily complete the approved water
system.
10. A public sewer system will be made available for the plat, and individual service
will be provided to each lot prior to sale. Use of individual on-site sewage disposal
systems shall not be authorized.
11. A statement shall be placed in the dedication io the effect that: "A public sewer
system will be made available for the plat, and individual service will be provided to
each lot prior to sale. Use of individual on-site sewage disposal systems shall not
be authorized."
12. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
13. The final plat dedication shall contain the following statement: "The public water
system, pursuant to the water plan approved by county and state health authorities,
the local fire protection district, County Building and Safety Department, and water .
purveyor, shall be installed within this subd.ivision and the applicant shall provide
for individual domestic water service as well as fire protection to each lot prior to
sale of each lot and prior to issuance of a building permit for each lot."

SPOKANE COUNTY DIVISION OF BUILDINGS
1. The applicant shall contact the Division of Buildings at the earliest possible stage in
order to be informed of code requirements administered/enforced as authorized by
the State Build.ing Code Act. Design/development concerns include: addressing; fire apparatus access roads; fire hydrantJflow; approved water systems; building
accessibility; construction type; occupancy classificarion; exiting; exterior wall
protection; and energy code regularions. (Note: The Division of Buildings reserves
the right to confirm the actual address at the rime of building pernut.)
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolirion, constiuction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as errussions from all other construction-related activities.
3. SCAPCA strongly recommends that all traveled surfaces (ingress, egress, parking
areas, access roads) be paved and kept clean to minimize dust emissions.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e., construction waste, etc.)
6. Demolition and renovation projects must comply with the requirements of CFR 40,
Part 61, Subpart M and SCAPCA Regulation I, Article IX. Intent to Demolish
forms are available at the SCA,PCA office. 7. All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with
local, state, and federal rules and regularions.

ORDER
The Hearing Examiner Committee, pursuant to the above Findings of Fact and
Conclusion, APPROVES the application of Dean Greer for the subdivision of
approximately 7.64 acres into 221ots for single family dwellings and those uses
allowed in the existing Urban Residential-3.5 (UR-3.5) zone as described in the
application PE-1754-94 known as Celtic Addition.

B. Cornprehensive Plan 1. Land Use Pfsn: The proposal is located within the Urban category of the
Cvaprehensive Plan and within the Priority Sewer Service Area (PSSA).
The Urban categvey is intended to provide the opportunity for developrrent
of a"citylike" enviromnent which includes various land uses and intensive
residential development. TiJrban areas will have public water systems,
sanitary sevver systems, stoma sewer systems and nther public s+ervices
available. The Gvals, Objectives and Dacisian Guidelines of the Urban
categclry promate !'fill-in" development within an area wheTe utilities,
arteria1s, and comnxunity facilities have already been established. The
proprasal is Iacated in an area where public serviees including roads, water
and sewer are available ta the site and the project is also located in an area
with existing residential develvpment anti prornotes development
which is encvurageri by the Urban Comprehensive Plan category.
Residential net densities in the Urban category should range between and
17 units per acres. The propased density of 2.87 units per acre is in accord
with t.he density range suggested by the Urban categary.
2. A,rterial Road Pian: The site is ad}acent to 5u11ivan Road which is
designated vn the Spolcane County Axterial Road Plan as a Principal Arterial ,
with a futu.m night-of-way width of 100 feet, In vrder to implement the
Plari, the Spokane County Engineer has requested tvventy (20) feet of
dedication a,~ a recomnnended eandition of approval. A thirty five (35) foat
structure setback along arterials is recommended by the Camprehensive
Plan and ia to be neasured from the prvperty li.ne after dedication of right-
vf-way. A tecommerided conditivn of apgraval has been included to
provide far, this setback. Saitese Avenue wiU be extended westerly tv
provide interna1 access to the subdi►rision. Saltese Roa.d is rtot designate.d as
an arterial on the we.st side of Sulliuan Road, but is designated as a Minor
Arterial with a future right-of-way widthof 80 feet on. the east side of
SuRivan Road.
3, County Parks Plan: The Spok,ane County Parks and Recreation Plan
identifies Browns Park and Termce View Park as the -nearest county park
facilities. Brawns Park is designated as a Neighborhaad Park and is
located approxiuYately 2 nniles west of the proposal at the intersection of
Pines Road and 32nd Avenue. Terrace View gark is also designated as a
Neighborhood Park and is lacated appmximately 2 niles northwest of the
propoW at the ititffswtion of B1ake Raad and 24th Avenue. (5ee Item T

C. Site Characteristics: An existing manufactured home arid accessary structures
are presently lacated on t.he site and will renain as part of the plat The rerrainder
of the site xs generally flat and has been used for the production of a1fa1€a in the
gast. The site is a.tijacent tv Sullivan Road which is apaved public raad without
cu.rb or sidewalk.
D. Neighbarhond Characteristics. The surrounding area consists of single
family residences on both planed and unplatted lots. Large anitnal keeping rnay
also be fvund in the area.

G. Circulation: Saltese Road will be extended westerly from Sullivan Road to
provide access to the subdivision. Two (2) cul-de-sacs will also extend southerly
from Saltese Road extended to provide addirional access to those lots along the
cul-de-sacs. The Spokane County Engineer is requesting twenty (20) feet of
dedication for a 1%2 right-of-way along the northwestem portion of the
preliminary plat for the fucure establishment of Murbach Road. Murbach Road
may be established to provide future access to the preliminary plat and
developments in the area as development occurs.
H . Design/Preliminary Plat Data:
The preliminary plat consists of 221ots on approximately 7.64 acres. Lot sizes
range between 10,000 and 20,000 square feet. All access within the subd.ivision
will be provided by a fifty (50) foot public rights-of-way. All of the lots, as
designed, meet or exceed the minimum development standards of the exisdng
Urban Residential-3.5 (UR-3.5) zone for lot size, frontage, and setbacks.
I. Density: The net density (excluding roads) is approximately 3.4 dwelling units
per acre which is consistent with the Urban Residential-3.5 (UR-3.5) zone and
the density range suggested by the Urban category of the Comprehensive Plan.
J. Drainage: A drainage plan is required. This plan must be reviewed and
approved by the County Engineer"s Department prior to development.
K. Power Transmission LineslOther Known Easements: None illustrated.
Any recorded or required easements will be disclosed during the final plat
process.
L. Water Supply: The progosal is within the Vera Irrigation Water District. A
water plan and provisions for water service are required prior to finalization of the
final, plat.
M. S'ewage Disposal: A public sewer system will serve the proposal. Plans and
specifications shall be reviewed and approved by the Spokane County Udlities .
Department prior to finalization of the final plat.
N. School: The proposal is in the Central Valley School District No. 356. The
Central Valley School District has responded to the proposal and has indicated
that existing facilities are inadequate to accommodate additional students generated
by new residential developments and requests the applicant be required to reach a
voluntary agreement to mitigate the impact of the project on the school district as
per Revised Caie of Washington ('<<W,). 58,.17.110. This request is included as
a recommended condition, of approval.
0. Fire Protection: The proposal~ is within Fire District No. 1.. The Fire District
and the Division of Buildings Department (Fire Marshall) are required to approve
fire protection provisions prior to finalizing the preliminary plat.

I V. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposed preliminary plat conforms to the Spokane County Subdivision and
Zoning Code regulations and is consistent with, and implements the Goals, Objectives,
and Decision Guidelines of the Comprehensive Plan. The proposal is consistent with
existing land uses in the area, and also provides "fill-in" development as encouraged by
the Urban Comprehensive Plan category. As conditioned, the preliminary plat makes
appropriate provisions for public facilities as required by RCW 58.17.110. The
Planning Department recommends approval as conditioned.
V . CONDITIONS OF APPROVAL
i. All conditions imposed by the Hearing Examiner Committee shall
be binding on the "Applicant", which terms shall include the
owner or owners of the property, heirs, assigns and successors.
i i. The conditions of approval apply to the preliminary subdivision
of record.
SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) and Aquifer
Sensitive Area (ASA) Overlay zones, as amended.
2. The final plat shall be designed substantially in conformance with the preliminary
plat of record. No increase of density or number of lots shall occur without a
change of condition application submittal and approval.
3. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
4. A final plat name/number shall be indicated before the final plat is filed, such name/number to be approved by the Planning Director/designee.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
November 1, 1997. The applicant may request an extension of time by subnutting
a written request approximately forty-five (45) days prior to the above expiration
date.
. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be
received with the submittal of the final plat.
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks
from all private, "Tract X" or public roads. The ded.ication shall contain the
following statement:
"Side yard and rear yard setbacks shall be determined at the time building pernuts

18. No building germit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed
pursuant to the approved Water Plan for the final plat" includ.ing a signed license
stamp. The certification may be in the form of a letter, but is preferred to be
certified on a copy of the Water Plan as a schematic map showuig the "as-built"
water system.
19. The Water Plan and the above four (4) conditions of approval regarding the Water
Plan may be waived by the Planning Director/designee upon receipt of letters from
the appropriate water puiveyor and fire protection district staring that simple
connections to an existing, approved water system will provide adequate domestic
and fire protection water to ensure the public health, safery and general welfare.
20. A survey is required prior to the filing of a final plat.
21. Prior to approval of road and dra.inage plans, you are required to coordinate with
the United States Postal Setvice to determine type and location of central mail
delivery facilities which may include applicable easements for developments of
three or more homes.
22. The Owner shall negotiate with the Central Valley School District and submit a
recorded copy of a voluntary agreement making provisions for public schools prior
to finalization and recording of this plat. The agreement shall provide a written
description of the subject property to which the agreement applies and also state the
dollar amount and any other agreed to mitigating measures.
The Owner shall also notify any potential purchasers who have made an agreement
to purchase property within said plat pursuant to the Revised Code of Washington
(58.17.205), that adequate provisions for school facilities must be made
conditioned on a future agreement between the plattor and school d.istrict.
Voluntary agreements between the Owner and School I?istrict shall conform to the
requirements of the Revised Code of Washington Chapter 82.02. _
23. To satisfy the requirements of RCW 58.17.110 that a subdivision make appropriate
provisions for public parks, recneation and playgrounds, the owner, at his opnon,
shall either dedicate land within the subdivision or enter into a voluntary agreement
with Spokane County to mitigate the direct impacts that the subdivision has on
public parks, open spaces and recreational facilities within the unincorporated areas
of Spokane County.
If the owner opts to enter into a voluntary agreement, the agreement shall be
executed prior to the finalization and recording of the final plat and recorded in
conjunction therewith. The agreement shall be consistent with RCW 82.02.020 .
and be substantially the same as the standardized agreement prepared by the
Spokane County Parks, Recreation and Fair Department. Prior to finalization of the
plat, the owner shall advise any purchaser of properry, as authorized under RCW
58.17.205, of the obligation within the voluntary agreement.
24. Short plat-915-93 (SP-915-93) shall be deemed null and void upon approval of this
preliminary plat.

13. A statement shall be placed in the plat dedication providing for future slope
easements as required by Spokane County along Sullivan Road.
14. Existing county roads providing direct access to the plat shall be paved andlor
curbed to Spokane County standards.
15. All public roads within the plat shall be designed and constructed to Spokane
County standards.
16. Sidewalks are required along the arterial(s) on Sullivan Road,

18. To construct the road improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be a willing participant in any petition
or resolution which purpose is the forniation of a Road Improvement District (RID)
for said improvements, pursuant to RCW 36.88, as amended. At such time as an
RID is created or any Road Improvement Project is sanctioned by Spokane County,
the improvements required (curb, sidewalk, drainage control and pavulg to elcisting
pavement) will be at the sole expense of the undersigned owner(s), their heirs,
grantees and assigns. This provision is applicable to the ultimate Special Roadway
Section for Sullivan Road.
19. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CR.P) to the extent of the required road 'unprovements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs,
grantees and assigns. This provision is applicable to the ultimate Special Roadway
Section for Sullivan Road.
20. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of a Road Improvement District (RID)
by the petition method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s)' property, and further not to object, by the signing of a ballot, to the
formation of an RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s)' property. If an RID is formed by either the
petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formarion of the RID; and
(c) that the property within the proposed RID is sufficiendy developed.

2. "The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of ULID by petition method pursuant
- to RCW 36.94, which petition includes the owner(s)' property; and further not to
object by the signi.ng of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a ULID by either
petition or resolution method under RCW Chapter 36.94."
3. Applicant shall make connection to public sewer system. Sewer connection permit
is required.
4. Public Sanitary Sewer easement shall be shown on the face of the plat and the
dedication shall state:
"The perpetual [exclusive] easement granted to Spokane County, its successors and
assigns is for the sole purpose of construction, installing, operating, maintaining,
repairing, altering, replacing, removing, and all other uses or purposes which are or
may be related to a sewer system. Spokane County, its successors and assigns at .
all rimes hereinafter, at their own cost and expense, may remove all crops, brush,
grass or trees that my interfere with the constructing, installing, operating,
maintaining, repairing, altering, replacing, removing and all other uses or purposes
which are may be related to a sewer system.
The grantor(s) reserves the right to use and enjoy that property which is the subject
of this easement for purposes which will not interfere with the County's full
enjoyment of the rights hereby granted; provided, the Grantor(s) shall not erect or
construct any build.ings or other structure or drill on the easement, or diminish or
substantially a.dd to the ground cover over the easement. The easement described
hereinabove is to and shall run with the land."
5. Plans and specifications for the public facilities connection are to be reviewed and
approved by the Uriliries Department. Spokane County plan submittal requirements
apply.
6. Security shall be deposited with the Utilities Department for construcrion of public

SPOKANE COUNTY HEALTH DISTRICT
1. The final plat shall be designed as indicated on the preliminary plat of record andlor
any attached sheets as noted.
2. Appropriate urility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the urility companies,
Spokane County Engineer and the Spokane County Health District. Written
approval of the easements by the utility companies must be received prior to the
submittal of the final plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utiliries, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is
available to each lot of the plat,
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies
within the recorded service area of the water system proposed to serve the plat.
8. A plan for water facilities adequate for domestic use, domestic irrigation use and
fire protection use shall be approved by the water purveyor. Said water plan must
have been appmved by the fue protection district and the appropriate health
authorities. The health authorities, water supplier (purveyor) and the fire protection
district will certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in confarmance with their requirements and will adequately sadsfy
their respective needs. Said water plan and certification will be drafted on a
transparency suitable for reproduction. 9. The purveyor will also certify prior to filing the final plat on a copy of said water
plan that appropriate contractual arrangements have been made with the plat sponsor
for construction of the water system, in accordance with the approved plan and time
schedule. The time schedule will provide, in any case, for completion of the water
system and inspection by the appropriate health authorities prior to application for
building permits within the plat The contractual arrangements will include a
provision holding Sgokane County, Spokane County Health District and the
purveyor harmless from claims by any lot/tract purchaser refused a building pennit
due to failure of the plat sponsor to satisfactorily complete the approved water
system. -
10. A public sewer system will be made available for the plat, and individual service
will be provided to each lot prior to sale. Use of individual on-site sewage disposal
systems shall not be authorized.
11. A statement shall be placed in the dedication to the effect that: "A public sewer
