FINDINGS OF FACT 1. The individual signing below has been properly delegated the responsibility for rendering this decision by the Director of the Spokane County Division of Building and Planning. 2. The original preliminary plat approval was to divide approYimately 1.87 acres into 41ots for single family residences and one common lot with a Planned Unit Development (PUD) Overlay Zone in the existing Urban Residential-3.5 (UR-3.5) zone. 3. The subject preliminary plat and planned unit development was approved by the Hearing Examiner Committee on November 18, 1994. 4. The proposal is generally located approximately 300 feet east of Carnahan Road and east of 17"' Lane (extended) in the NE '/4 of Section 26, Township 25 North, Range 43 EW1VI, Spokane County, Washington. 5. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5), established in 1991 pursuant to the Program to Implement the Spokane County Zoninb Code, previously established as Agricultural Suburban (AS) (ZE-48-66). Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing Urban Residential-3.5 (UR-3.5) zone. 6. The Comprehensive Plan designated this area of the preliminary plat as Urban (U) and the location is inside the Priority Sewer Service Area (PSSA). The Comprehensive Plan . designation remains the same since the original preliminary plat approval. 7. The subject property is located inside of the Interim Urban Growth Area (IUGA) adopted by the Board of County Commissioners (BOCC) Resolution #97-0321. 8. Spokane County has established specific criteria for considering the extension of time for the expiration of preliminary subdivisions, specifically for regular subdivisions, and department policy for short subdivisions. These criteria are found in Section 12.100.118 (Extensions of Time) of the Spokane County Subdivision Ordinance and have been used as a basis for this decision. Section 12.100.118 states that "The Director may administratively approve an extension provided there are no significant changed conditions which would render filing of the plat / / ✓ ~ Extension of Time Findings File No. PE-1758-94/PUDE-6-94 Page 2 or binding site plan contrary to the public health, safety or general welfare, and further provided one or more of the following circumstances is found to apply." 1) That some portion of the exi.sting preliminary plat has been finalized since the last extension was granted and the remaining lots would form a unified development consistent tivith the original approvul; RESPONSE: No portion of the preliminary plat has been finalized to date. 2) That the preliminary subdivision, short subdivision, or binding site plan remains generally consistent with the original plat or binding site plan that was approved, and the sponsor has taken substantial steps towards finalizing the plat or binding site plan, which shall include one, but is not limited to, the following: a. surveying the lots within the development; b. arranging for public services to the site; c. obtaining necessary financing for all or a portion of the preliminary subdivision, short subdivision, or binding site plan; d. the completion of studies or other requirements which were part of preliminary saibdivision, short subdivision, or binding site plan approval. 0 RESPONSE: The preliminary subdivision remains consistent with the original plat that was approved. In addition, lots within the original preliminary plat have been surveyed and the applicant is making arrangements to extend public services to the site. 3) That at the time the preliminary plat approval was granted, development of the proposal was conditioned zepon the extension of ptcblic services which are not yet available. This provision shall not apply to public utiliry extension which the project sponsor would normally fund. RESPONSE: Not applicable. 4) That administrative delays have caused the inability of the applicant to finalize the plat within the five (5) year time period. REPSONSE: Not applicable. 9. This is the first request for a time extension. The total life of the preliminary plat has been approximately three years. 10. The proposal has been circulated to all affected agencies and departments for comment. The members of the Committee present are: Jane Myers, Chair, Brenda Bodeastein and Toni Nersesian. PROPOSAL The sponsor, Ted Clark, requests approval of a Preliminary Plat of Carnahan Crest Phase II, PE-1758-94/PUDE-6-94, to subdivide approximately 1.87 acres into four lots for single family residences, one common open space lot, and those uses allowed in the existing Urban Residential-3.5 (UR-3.5) zone with a Planned Unit Development (PUD) overlay zone. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located approximately 300 feet east of Carnahan Road and . east of 17th Lane extended, in the NE 1/4 of Section 26, Township 25 North, Range 43 E.W.M., Spokane County, Washington. 2. The Committee adopts the Planning Department Report as a part of this record. 3. The existing land uses in the area include single family residences and undeveloped land. 4. The proposed use is compatible with existing uses in the area. 5. The Comprehensive Plan designates this site as Urban. The Urban category is intended to provide the opportunity for development of a"citylike" environment which includes various land uses and intensive residential development. Residential net densities in the Urban category should range between 1 and 17 units per acres. The proposed density of 2.1 units per acre is in accord with the densiry range suggested by the Urban category. 6. The existing Urban Residendal-3.5 (UR-3.5) zoning does implement and conform to the Comprehensive Plan. 7. The existing zoning of the properry described in the application is Urban Residential-3.5 (UR-3.5) previously established as Agricultural Suburban (AS) (ZE-48-66) zoning in 1966 and redesignated to Urban Residential-3.5 (UR-3.5) on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing Urban Residenrial-3.5 (UR-3.5) zone. 1 ~ , 8. The provisions of RCW 43.21C ('The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance (DNS) was issued.. The Committee, after independent review, hereby adopts the DNS. 9. The legal requirements for public notice have been fulfilled. 10. Written correspondence was received by the Planning Deparnnent regard.ing the proposal. Concerns regarding safe ingress/egress to the proposal, maintaining the neighborhood and compatibility with the surrounding azea were expressed. 11. The proposed use will not be detrimental to the public health, safety, morals or welfare especially in light of the conditions recommended by the reviewing agencies. 12. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, -safety and general welfare in accordance wnth standards established by the state and Spokane County. The proposal as conditioned dces provide adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces b. drainage ways c. public andlor private rights-of-way d. transit e. potable water f , sanitary waste disposal g. parks and recreation facilities h. playgrounds i. schools and schoolgrounds j . sidewalks ; The above improvements are either existing facilities or will be provided by the applicant upon finalization of this subdivision as conditioned by the Committee and irnplemented by the various County agencies. 13. The Committee additionally finds/concludes: a. That the applicant, by public testimony, accepts the conditions of approval as recommended by reviewing agencies. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which tenn shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The conditions of approval apply to the preliminary subdivision of record. HEC Order for PE-1758-94 Page 2 . SPOKANE COUNTY PLANr1ING DEPARTMENT 1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5), Aquifer Sensitive Area (ASA) and Planned Unit Development (PUD) Overlay Zones, as amended. . 2. The fulal plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 3. The Planning Director/designee shal review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 4. A final plat name/nutnber shall be ind:icated before the final plat is filed, such name,/number to be approved by the Planning I?irector/designee. 5. Appropriate road name(s) shall be indicated 6. The preliminary plat and planned unit development is given condirional approval for three (3) years, specifically, to December 1,1997. The applicant may r+equest an extension of rime by submitting a written request approximately forty-five (45) days prior to the above expiration date. 7. Appropriate utility e,asements shall be indicated on copies of the proposed final plaL Written approval of utility easements by appropriate utiliry companies shall be received with the submittal of the final plat. 8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the foll wing statement: " e yard and rear yard setbacks shall be detennined at the time building permits requested unless these setbacks are specifically drafted on this final plat. 'The tbacks indicated on this plat may be varied from if proper zoning approvals are ~ ,btained." 9. Three (3) current certifficates of tide shall be furnished to the Planning Department prior to filing the final plat. 10. Prior to filing of all or a portion of the final plat, the applicant's surveyor shall submit one or more maps outlined in red of the area being finalized. The scale shall match the appropriate assessor's map scale. 11. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Bluild:ing & Safety Deparanent and County Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat that the plan is in confbrmance with their r+espective needs and regulations. The Water Plan and certification, shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. , 12. The water purveyor shall certify that appropriate contractual amangements and schedule of improveinents have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule HEC Order for PE-1758-94 Page 3 shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building perrnits within the final plat. The anangements or agreements shall include a provision holding Spokane County and the purveyor harniless from claims by any lot purchaser refused a building permit due to the failure of the subd.ivision sponsor to satisfactorily complete the approved water system 13. The final plat dedication shall contain the following statement: f~erniit public water system, pursuant to the Water Plan approved by county and state authorities, the local fire protection district, County Building & Safety tment and water purveyor, shall be installed within this subdivision, and the ant shall provide for individual domestic water service as well as fre tion to each lot prior to sale of each lot and prior to issuance of a building for each lot," 14. No building permit will be issued for any lot within the final plat until certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat" including a signed license stamp. The certification may be in the form of a letter, but is prefenred to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system 15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protection district stating that simple connections to an existing, approved water system will provide adequate domesdc and fire protection water to ensure the public health, safety and general welfare. 16. A survey is required prior to the filing of a final plat. 17. The final plat dedication shall contain the following statement "The private roads and/or common areas shown on this plat are hereby dedicated to the homeowners association created by document recorded under State document no. 18. The dedicatory language of the final plat shall state "The private roads and/or common areas cannot be sold or transferred, regardless of any provision in the covenants to the contrary, and shall be considered subservient estates for tax purposes to the other lots created herein." 19. The PUD final plat shall ind.icate all exterior boundary setbacks, as well as setbacks from roadways and individual lot lines. 20. A copy of the homeowners/property owners' association articles of incorporation andlor bylaws andJor covenants and restrictions, together with any other provisions for maintenance of cominon areas and facilities, shall be submitted for review and approval to the Planning Department prior to finalizing. 21. Prior to finalization of the plat, the applicant shall complete a plat alteration for Carnahan Crest Phase I Planned Unit Development (PE-1571-89). Said plat alteration shall illustrate the private driveway easements which provide access to Carnahan Crest Planned Unit Development (PUD) Phase II. Additional alterations, madifications andlor deledons may be required in the dedicatory language of Carnahan Crest Planned Unit Development (PUD) Phase I to reflect the above alterations. 27. To satisfy the requirements of RCW 58.17.110 that a subdivision make appropriate provisions for public parks, recreation and playgrounds, the owner, at his option, shall either dedicate land within the subdivision or enter into a voluntary agreement with Spokane Counry to mitigate the direct impacts that the subdivision has on public parks, open spaces and recreational facilities within the unincorporated areas of Spokane County. If the owner opts to enter into a voluntary agreement, the agreement shall be executed prior to the finalization and recording of the final plat and recorded in conjunction therewith. The agreement shall be consistent with RCW 82.02.020 and be substantially the same as the standardized agreement prepared by the Spokane County Pazks, Recreation and Fair Department Prior to finalization of the plat, the owner shall advise any purchaser of property, as authorized under RCW 58.17.205, of the obligation within the voluntary agreemenL HEC Order for PE-1758-94 Page 5 SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. Pthe Drainage plans and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for approval prior to construction andlor filing of the final plat Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. Construction within the proposed public streets and easements shall be performed under the direct supervision of a licensed engineer/surveyor, who shall furnish the County Engineer with "as-built" plans and a certificate in writing that all improvements were installed to the lines and grades shown on the approved -construction plans and that all disturbed monuments have ib-een replaced. ` - ~ 4. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 5. To construct the road improvements stated herein, the applicant may, with the appnoval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Carnahan Road. 6. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a Counry Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the unprovements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Carnahan Road. 7. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition methai pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolurion includes the owner(s)' property. If an RID is formed by either the petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; HEC Order for PE-1758-94 Page 6 (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiendy developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the imprnvements called for in conjunction with the formation of an RID by either petidon or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirnung the final assessment roll. It is further agreed that at such time as an RID is created or any Roa,d Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the - undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agre.e to construct the required improvements at their own expense, pay to Spokane County the then estimated cost of the required improvements to enable the County to complete the same, or furnish a bond or other secure methai suitable to the County (which may include the execution of - another RID waiver agreement) provid.ing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Carnahan Road. 8. The County Engineer has designated Typical Roadway Section Number Two, Minor Arterial standard far the improvement of Carnahan Road, which is adjacent to the proposed development. This will require the addition of approximately 12-14 feet of asphalt along the frontage of the development. The construction of curbing and sidewallc is also required. 9. All vested owners shall sign and record private road documents as prescribed by the Spokane County Engineer. These documents shall be reviewed and approved by the Spokane County Engine.er prior to recording with the Spokane County Auditor. Recording numbers shall be referenced in the dedicatory language of the plat 10. The following statement shall be placed in the plat dedication: t0uRNING: Spokane Counry has no responsibility to build, unprove, maintain therwise service the private roads contained within or provide service to the perty described in this plat. By accepting this plat or subsequendy by allowing a lding pemut to be issued on property on a private road, Spokane County mes no obligation for said private road, and the owners hereby acknowledge t the County has no obligation of any kind or nature whatsoever to establish, mine, survey, construct, alter, repair, improve, maintain or provide drainage or w removal on a private roa.d. The area appears to be steeply sloped, and soils in the area do not always allow disposal of stormwater flows by percolation via grassy swales and drywells. Before preliminary plat approval the applicant needs to show either that on-site soil borings prove the soil is adequate for constructing stormwater facilities to treat and dispose of flows from the proposed development or that other means of disposing of the flows are available. The applicant will need to address mitigation of any possible impacts to public drainage facilities, such as roadside ditches, from the project. The property owners within this plat shall be held responsible for keeping open and maintaining the surface path of natural or man-made drainage flow over and across their respective properties. If tlie property owners fail to maintain the surface path of natural or man-made drainage flow, or drainage facilities on private properties, a notice of such failure may be given to the property owner. If not corrected within the period indicated on said notice, Spokane County has the right to correct the maintenance failure, or have it corrected, at the expense of tlle property owner. Said positive drainage shall consist of a nunimum slope of 3% away from the building for a d.istance of at least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed away from the building, and conveyed over the lot to a natural drainage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved drainage facility. All dra.inage facilities for this plat, including any `208' swales, shaU be constructed in accordance with the approved plans on file at the Spokane County Engineer's Office. Any proposed changes to the approved road and drainage plans must be approved by the Spokane County Engineer°s Office prior to construction of said changes. T'here may exist properties located uphill and adjacent to this subdivision which periodically ' discharge stormwater runoff onto individual lots within this plat. Stonnvvater runoff from nearby . uphill properties should be expected, and during snow melt periods or wet seasons the lots may be subjected to higher amounts of stormwater runoff that what is nornlally observed or anticipated. Because storrnwater runoff from adjacent properties have discharged onto this plat prior to development, stormwater runoff will likely continue to do so after development.
