UR-3.5 TO UR-7 AND UR-22 )
THIS MATTER, a request for an extension of time from Glen Nachbar and Dale Wilcox has
been received and decided upon, pursuant to Spokane County Subdivision regulations (Section
12.100.118) and RCW 58.17.140.
FINDINGS OF FACT
1. The individual signing below has been properly delegated the responsibility for rendering
this decision by the Director of the Spokane County Division of Building and Planning.
2. The original preliminary plat proposal was to divide approximately 2.04 acres into four (4)
lots for single family residences, one (1) lot for multiple-family dwellings and a Zone
Reclassification, ZE-43-94, from Urban Residential-3.5 (UR-3.5) to Urban Residential-7
(UR-7) and Urban Residential-22 (UR-22).
3. The subject preliminary plat was approved by the Hearing Examiner Committee on
November 18, 1994.
4. The proposal is generally located north of and adjacent to Fourth Avenue, approximately
850 feet east of Pines Road- in the NW '/4 of Section 22, Township 25 North, Range 44
E. W.M., Spokane County, Washington.
5. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5), established in 1991 pursuant to the Program to Implement the Spokane County
Zoning Code. The zoning of the subject property will be reclassified to Urban
' Residential-7 (tJR-7) and Urban Residential-22 (UR-22) upon the filing of the plat.
6. The Comprehensive Plan designated this area of the preliminary plat as Urban (U) and the
location is inside the Priority Sewer Service Area (PSSA). The Comprehensive Plan
designation remains the same since the original preliminary plat approval.
7. The subject property is located inside of the Interim Urban Growth Area (IUGA) adopted
by the Board of County Commissioners (BOCC) Resolution #97-0321.
8. Spokane County has established specific criteria for considering the extension of time for
the expiration of preliminary subdivisions, specifically for regular subdivisions, and
department policy for short subdivisions. These criteria are found in Section 12.100.118
(Extensions of Time) of the Spokane County Subdivision Ordinance and have been used
as a basis for this decision.
Section 12.100.118 states that "The Director may administratively approve an extension
provided there aze no significant changed conditions which would render filing of the plat

or binding site plan contrary to the public health, safety or general welfare, and further
provided one or more of the following circumstances is found to apply."
1) That some portion of the existing preliminary plat has been finalized since the last
extension was granted and the remaining lots would form a unified development
consistent with the original approval;
RESPONSE: No portion of the preliminary plat has been finalized to date.
2) That the preliminary subdivision, short subdivision, or binding site plan remains
generally consistent with the original plat or binding site plan that was approved, and
the sponsor has taken substantial steps towards finalizing the plat or binding site plan,
which shall include one, but is not limited to, the following:
a. surveying the lots within the development;
b. arranging for public services to the site;
c. obtaining necessary f nancing for all or a portion of the preliminary subdivision,
short subdivision, or binding site plan;
d. the completion of studies or other requirements which were part ofpreliminary
subdivision, short subdivision, or binding site plan approval.
RESPONSE: The preliminary subdivision remains consistent with the original plat
that was approved. In addition, lots within the original preliminary plat have been
surveyed, and road and sewer plans have been submitted for County review.
• 3) That at the time the preliminary plat approval was granted, development of the
proposal was conditioned upon the extension of public services which are not yet
available. This provision shall not apply to public utility extension which the project
sponsor would normally fund.
RESPONSE: Not applicable.
4) That administrative delays have caused the inability of the applicant to finalize the
plat within the five (5) year time period.
REPSONSE: Not applicable.
9. This is the first request for a time extension. The total life of the preliminary plat has been
approYimately three years.
10. The proposal has been circulated to all affected agencies and departments for comment.
No additional conditions have been recommended by the various reviewing agencies and
departments, including the Spokane County Division of Engineering and Roads, the
Spokane County Division of Utilities, and the Spokane County Division of Building and
Planning.

CONCLUSIONS
BASED UPON A REVIEW of (a) the criteria for approving an extension of time of the
expiration date for a preliminary plat and (b) the above Findings of Fact, the following
conclusion is made:
The proponent has demonstrated progress toward completing the preliminary plat as
evidenced in the above Findings of Fact and there are no significant changed conditions
which would render filing of the plat contrary to the public health, safety or general
welfare. Therefore, a tbree (3) year extension of time is warranted.
DECISION
BASED UPON THE ABOVE Findings of Fact and Conclusions, an extension of time request
for application PE-1759-94, Nachbar Wilcox Addition, is hereby APPROVED until November
1, 2000.
CONDITIONS OF APPROVAL
Those previous Conditions of Approval specified in the Hearing Examiner Committee Findings
of Fact, Conclusions and Order, dated November 18, 1994, together with the following updated
conditions:
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING (UPDATED)
1. The preliminary plat is given conditional approval for three (3) years, specifically to
November 1, 2000. The applicant may request an extension of time by submitting a
written request thirty (30) days prior to the above expiration date.
2. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be informed of code requirements administered/enforced as authorized by
the State Building Code Act. Design/development concerns include: addressing; fire
apparatus access roads; fire hydrant/flow; approved water systems; building accessibility;
construction type; occupancy classification; exiting; exterior wall protection; and energy
code regulations.

INTRODUCTION ai eT",
This matter has come before the Hearing Examiner Committee on November 17,
1994. 1'he members' of the Committee present are: Jane Myers, Chair, Brenda
Bodenstein and Toni Nersesian.
° PROPOSAI.
The sponsors, Glen Nachbar and Dale Wilcox, requests approval of a Preliminary
plat of Nachbar-Wilcox Addition, PE-1759-94, to subdivide approximately 2.04
acres into four (4) lots for single family residences, one lot for multiple-fa.mily
dwellings, and a Zone Reclassification, ZE-43-94, from Urban Residential-3.5
(UR-3.5) to Urban Residential-7 (UR-7) and Urban Residential-22 (UR-22).
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located north of and adjacent to Fourth Avenue,
approximately 850 feet east of Pines Road in the NW 1/4 of Section 22, Township
25 North, Range 44 E.W.M., Spokane County, Washington.
2. The Committee adopts the Planning Department Repart as a part of this record.
3. The exisring land uses in the area include single family residences, duplexes, muld-
family dwellings and commercial uses.
4. The proposed use is compatible with existing uses in the azea.
5. The Comprehensive Plan designates this site as Urban. The Urban category is
intended to provide the opporninity for development of a"citylike" environment
which includes various land uses and a variety of housing types and densities. The
Urban category is primarily a residential category with single faznily, two-family, _
and multi-family developments. The Urban category promotes "fill-in"
development within established development areas having adequate power supplies,
water, sanitary sewers and streets. The proposal is located in an area that is
developed and established with a variety of uses, with public services and facilities
in place.
6. The proposed zoning does implement and conform to the Comprehensive Plan.
7. The Arterial Road Plan designates Fourth Avenue as a Collector Arterial, with a
recommended right of way width of 70 feet In order to implement the Arterial
Road Plan, the County Engineer has requested 10 feet of dedicarion along 4th
Avenue.

8. The Spokane County Arterial Road Plan designates the South Valley Arterial as a
Principal Arterial with a recommended right of way width of 130 feeL In order to
implement the Arterial Road Plan, the County Engineer is requesting that a 30 foot
wide strip of property along the Spokane Valley Arterial be set aside for a future
acquisition area.
9. The existing zoning of the property described in the application is Urban
Residential-3.5 (UR-3.5) previously established as Agricultural Suburban (AS)
(ZE-171-55) zoning in 1955 and redesignated to Urban Residential-3.5 (UR-3.5)
on January 1, 1991 pursuant to the Program to Implement the Spokane County
Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the
requirements of the proposed zone classifications.
10, - n-P -provasions of RCW 43.121C (The Sta*e Fnvironmi:ntal Policy Act) have-been
complied with and a Determination of Nonsignificance (DNS) was issued. The
Committee, after indegendent review, hereby adopts the DNS.
11. The legal requirements for public notice have been fulfilled.
12. An adjacent property owner expressed disapproval of the proposed use via written
correspondence presented at the public hearing and entered into the record by the
Hearing Examiner Committee. Concerns regarding compatibility with the
neighborhood, density, and noise associated with construction were expressed in
the correspondence.
13. The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified. Specifically, changed conditions include the adoption of the
Comprehensive Land Use Plan, Zoning Code, and the designation of Fourth
Avenue as a Collector Arterial and the South Valley Arterial as a Principal Arterial.
14. The proposed use will not be detrimental to the public health, safery, morals or
welfare especially in light of the cond.itions recommended by the reviewing
agencies.
15. The subd.ivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The
proposal as conditioned dces provide adequate public facilities as cited in RCW
58.17.110 (2). More specifically:
a. open spaces '
b. drainage ways
c. public andlor private rights-of-way
d . transit
e. potable water
f. sanitary waste disposal
g, parks and recreation facilities
h . playgrounds
i. schools and schoolgrounds
j . sidewalks

The above improvements are either existing facilities or will be provided by the
applicant upon finalization of this subdivision as conditioned by the Committee and
implemented by the various County agencies.
16. The Committae additionally findslconcludes:
a. That the applicant, by public testimony, does agree with the conditions of
approval as required by reviewing agencies.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on

heirs, assigns, and successors-in-interest.
2. The conditions of approval apply to the preliminary subdivision of record.
SPOKANE COUNTY PLAN1vING DEPARTMENT
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5), Urban
Residential-7 (UR-7), Urban Residential-22 (UR-22), and Aquifer Sensitive Area
(ASA) Overlay zones, as a.mended.
2. Upon filing the final plat, or a portion thereof, the zone reclassification of the final
plat area shall be finalized, and the existing zone classification shall be changed to
Urban Residential-7 (UR-7) and Urban Residential-22 (UR-22), consistent with the
proposed zoning approved with the preliminary plat of record.
3. The final plat shall be designed substantially in confomzance with the preliminary
plat of record. No increase of density or number of lots shall occur without a
change of condition application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. A final plat name/number shall be indicated before the final plat is filed, such
namelnumber to be approved by the Planning Director/designee.
6. Appropriate road name(s) shall be indicated.
7. The preliminary plat is given conditional approval for three (3) years, specifically to
December 1, 1997. The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiration
date.
8. Appropriate utility easements shall be ind.icated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be
received with the submittal of the final plat.

9. The final plat map shall indicate by a clear, dashed line the required yard setbacks
from all private, "Tract X" or public roads. The dedication shall contain the
following statement:
"Side yard and rear y.ard setbacks shall be determined at the rime building pernuts
are requested unless these setbacks are specifically drafted on this final plat. The
setbacks ind.icated on this plat may be varied from if proper zoning approvals are
obtained."
10. Three (3) current certificates of tide shall be furnished to the Planning Department
prior to filing the final plat
11. Prior to filing of all or a portion of the final plat, the applicant's surveyor shall

match the appropriate assessor's map scale.
12. The plat dedication shall contain the following statement: _
"Lots 2 and 3, Block 1, and Lot 1 Block 2, are located on a temporary cul-de-
sac/roadway. This temporary cul-de-sac/roadway may be extended to provide
access to adjacent property andlor connect to existing roads or new roads as
development and/or circularion needs dictate."
13. The final plat shall indicate yard setback arc lengrths on cul-de-sac lots which meet
. or exceed the minimum frontage of the underlying zone of the final plat.
14. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County
Building & Safety Department and County Health District. The agencies will
certify on the Water Plan, prior to the filing of a final plat, that the plan is in
conformance with their respective needs and regulations. The Water Plan and
certi.fication shall be drafted on a transparency suitable for reproduction and be
signed by the plat sponsor.
15. The water purveyor shall certify that appropriate contractual arrangements and
schedule of improvements have been made with the plat sponsor for construction of
the water system in accord.ance with the approved Water Plan. The time schedule
shall provide for completion of the water system and inspection by the appropriate
health authorities prior to application for building permits within the final plat. The
arrangements or agreements shall include a provision holding Spokane County and -
the purveyor harmless from claims by any lot purchaser refused a building permit
due to the failure of the subdivision sponsor to satisfactorily complete the approved
water system. 11
16. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safety
Department and water purveyor, shall be installed within this subdivision and the
applicant shall provide for individual domestic water service as well as fire
protecdon to each lot prior to sale of each lot and prior to issuance of a building
permit for each lot."

17. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed
pursuant to the approved Water Plan for the final plat" including a signed license
stamp. The certification may be in the form of a letter, but is prefetred to be
certified on a copy of the Water Plan as a schematic map showing the "as-built"
water system,
18. The Water Plan and the above four (4) conditions of approval regard.ing the Water
Plan may be waived by the Planning Dimctor/designee upon receipt of letters from
the appropriate water purveyor and fire protecdon district stating that simple
connections to an existing, approved water system will provide adequate domestic
and fire protection water to ensure the public health, safety and general welfare.
19. A survey is required prior to the filing of a final plat.
20. Prior to approval of road and drainage plans, you are required to coordinate with
the United States Postal Service to determine type and location of central mail
delivery facilities which may include applicable easements for developments of
three or more homes.
21. The Spokane County Planning Department shall prepare and record with the
Counry Auditor a Title Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved fvture acquisition area Tide Notice shall be
. released, in full or in part, by the Planning Department. The notice should be
recorded within the same time frme as an appeal and shall provide the following:
a. At least 30 feet of reserved future acquisition area for road right-of-way and
urilities, in addition to the existing and/or newly dedicated right-of-way along
South Valley Arterial,
b. Fuaue building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, pazking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
22. Prior to finalization of the plat, the applicant shall submit legal descriptions prepared
by a licensed surveyor in the State of Washington for the Urban Residential-3.5
(UR-3.5), Urban Residential-7 (UR-7), and Urban Residential-22 (UR-22) z,ones.
A zoning map stamped by a licensed surveyor shall also be submitted with each
zone boundary oudined and labeled in red,

23. The Owner, shall negotiate with the Central Valley School District and submit a
recorderi copy of a voluntary agreement making provisions for public schools prior
to finalization and record.ing of this plat The agreement shall prnvide a written
description of the subject property to which tlie agreement applies and also state the
dollar amount and any other agreed to mitigating measures.
The Owner shall also notify any potential purchasers who have made an agneement
to pur+chase property within said plat pursuant to the Revised Code of Washington
(58.17.205), that adequate provision& for school facilities must be made
conditioned on a future agree m, ent between the plattor and~ school district
Voluntary agreements between the Owner and School I}istrict shall conform to the
requirements of the Revised Code of Washington Chapter 82.02.
24. To satisfy the requirements of RCW 58.17.110 that a subdivision make appropriate
provisions for public pazks, recreation and playgrounds, the owner, at his option,
shall either dedicate land within the subdivision or enter into a voluntary agreement
with Spokane County to mitigate the direct impacts that the subdivision has on
public parks, open spaces and recreational facilities within the unincorparated areas
of Spokane County.
If the owner opts to enter into a voluntary agreement, the agreement shall be
executed prior to the finalization and record.ing of the final plat and recorded in
conjunction therewith. The agreement shall be consistent with RCW 82.02.020
. and be substantially the same as the stand ''z d agreement prepared by the
Spokane County Parks, Recreation and Fair Department Prior to finalization of the
plat, the owner shall advise any purchaser of property, as authorized under RCW
58.17.205, of the obligation within the voluntary agreemenL
25. Prior to finalization of the plat, the applicant shall demonstrate to the satisfaction of
the Planning Department that the two sheds located on proposed Lot 2 and the small
barn and shed located on proposed Lot 3 have been removed from the site.
Additional Condirions annlicable to Urban Residential-22 (UR-22) nortion onlv
26. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be permitted, including, but not limited to building
location, landscage plans and general all'owable uses of the permitted zone. All
variations must conform to regulations set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained.
27. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.

28. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning I?irector/designee shall be submitted with a perfarmance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired.
29. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.

SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing
proposed street centerline and curb grades shall be submitted to the County
EngineeT for approval prior to construction andlor the filing of each final plat; road
plans to be prepared under the direction of a licensed Professional Civil Engineer.

shall be submitted to the County Engineer for approval prior to construction and/or
the filing of the final plat Drainage plans to be prepared under the direction of a
licensed Professional Civil Engineer.
4. Construction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed engineer/surveyor, who shall furnish the
County Engineer with "as-built" plans and a certificate in writing that all
improvements were i,nstalled to the lines and grades shown on the approved
construction plans and that all disturbed monuments have been replaced.
. 5. No construction work is to be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work is
subject to inspection and approval by the County Engineer.
6. All construction within the existing or proposed public right-of-way is to be
completed prior to filing each final plat, or a bond in the amount esrimated by the
County Engineer to cover the cost of construction of improvements, construction
certification, "as-built" plans and monumenting the street centerlines shall be filed
with the County Engineer.
7. No d.irect access from lots to stub road connecrions until such roads are constructed
to County standards and established as county roads.
8. Road design, construction, and drainage control for one-half (1/2) rights-of-way
and stub road connections are the responsibility of the owner, developer or
applicant
9. Appropriate provision shall be made that the following-described property be held
in trust untal the continuation of the streets be dedicated or deeded: a one (1)-foot
strip at the ends or edges of all smeets that ternunate or border the subdivision
boundary. (Temporary cul-de-sacs are required when streets terminate at the
subdivision boundaries.)
10. Individual driveway access permits are required prior to issuance of a building
permit for driveway approaches to the county road system.
11. Dedication of 60 feet of additional right-of-way along Third Avenue Extension is
required.

13. A statement shall be placed in plat dedication that no direct access be allowed from
lots to the South Valley Arterial.
14. Existing county roads providing direct access to the plat shall be paved and/or
curbed to Spokane County standards.
15. All public roads within the plat shall be designed and constructed to Spokane
County standards.
16. Sidewalks are required along the arterial(s) on Fourth Avenue.
17. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
18. To construct the road improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be a willing participant in any petition
or resolution which purpose is the formation of a Road Improvement District (RID)
for said improvements, pursuant to RCW 36.88, as amended. At such time as an
RID is created or any Road Improvement Project is sanctioned by Spokane County,
the improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs,
grantees and assigns. This provision is applicable to Fourth Avenue.
19. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participaring in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs,
grantees and assigns. This provision is applicable to Fourth Avenue.
20. The following statement shall be placed in the plat dedication:

The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of a Road Improvement District (RID)
by the petition method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s)' property, and further not to object, by the signing of a ballot, to the
formation of an RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s)' property. If an RID is formed by either the
petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formarion of the RID; and

(c) that the property within the proposed RID is sufficiendy developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the property
as a result of the improvements called for in conjuncrion with the formation of an
RID by either petition or resolution method under Chapter 36.88 RCW, and to
appeal to the Superior Court the decision of the Board of County Commissioners
affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Sgokane County, the improvements required (curb,
sidewallc, drainage control and paving) will be at the sole expense of the

The RID waiver contained in this agreement shall expire after ten (10) years from
the date of execution below. However, the owner(s) or successor(s) agree that if
said RID waiver expires without construction of the required improvements, the
owner(s) or successor(s) agree to construct the required improvements at their own
expense, pay to Spokane County the then esrimated cost of the required
improvements to enable the County to complete the same, or furnish a bond ar
other secure method suitable to the County (which may include the execution of
another RID waiver agreement) providing for or securing to the Counry the actual
. construction of the improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision is
applicable to Fourth Avenue.
21. The Counry Engineer has designated Typical Roadway Section Number One, Local
Access standard for the improvement of Third Avenue, which is to be constructed
within the proposed development. This will require the installation of 40 feet of
asphalt. The construction of curbing and sidewalk is also required.
22. The County Engineer has designated Typical Roadway Section Number Two,
Collector Arterial standard for the improvement of Fourth Avenue, which is
adjacent to the proposed development. This will require the addition of
approximately 10-12 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
23. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolurion No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
24. The County Engineer has examined this development proposal and has detemuned
that the impact of this proposal upon the existing county road system wan-ants the
dedication of addirional right-af-way and the roadway improvements herein
specified.

25. The County Arterial Road Plan identifies South Valley Arterial as a Principal
Arterial. The existing right-of way width of 100 feet is not consistent with that
specif'ied in the Plan.• In order, to implement the Arterial Road Plan, in addition to
the required right-of-way dedication, a strip of property 30 feet in width along the
South Valley Arterial frontage shall be set aside in reserve. This property may be
acq,uired by, Spokane-Coun,ty, at the t' m, e when rtenal~ improvements are made to

26. There may exist utilities, either, und'erground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to deternune whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
2. A wet (live) sewer connection to the existing area wide public sewer system is to be
constructed, Sewer connection permit is required.
3. Applicant shall submit expressly to Spokane County Utilities Department "under
separate cover" only those plan sheets showing sewer plans and specifications for
public sewer for review and approval by the Utilities Department prior to issuance of
permit to connect.
4. Security shall be deposited with the Utilities Department for construction of public
facilides.
5. Arrangements for payments of additional sewer charges must be made for prior to the
finalizarion of the project.
SPOKANE COUNTY HEALTH DISTRICT
1. The final plat shall be designed as indicated on the preliminary plat of record and/or
any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning I?epartment to the utility companies,
Spokane County Engineer and the Spokane County Health District. Written
approval of the easements by the utility companies must be received prior to the
submittal of the final' plat.
3. Sewage disposal method sha11 be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utiliries, Spokane County.

5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is
available to each lot of the plat
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies
within the recorded service area of the water system proposed to serve the plat.
8. A plan for water facilities adequate for domestic use, domestic urigation use and
fire protection use shall be approved by the water purveyor. Said water plan must
ha_ve~bxen_ appmved by the_fire .protec:tion-clistrict and xhe-aPProPriate health -
authorities. The health authorities, water supplier (ptuveyor) and the fire protection
district will certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in confomiance with their requirements and will adequately satisfy
their respective needs. Said water plan and certificarion will be drafted on a
transparency suitable for reproduction.
9. The purveyor will also certify prior to filing the final plat on a copy of said water
plan that appropriate contractual amangements have been made with the plat sponsor
for construction of the water system, in accordance with the approved plan and time
schedule. The time schedule will provide, in any case, for compl'etion of the water
. system and inspection by the appropriate health authorities prior to application for
building penmits within the plaL The contractual arrangements will include a
provision holding Spokane County, Spokane County Health District and the
purveyor harmless from claims by any lot/tract purchaser refused a building permit
due to failure of the plat sponsor to satisfactorily complete the approved water
system.

10. A public sewer system will be made available for the plat/project, and individual
service will be provided to each lot prior to sale. Use of individual on-site sewage
disposal systems shall not be authorized.
11. A statement shall be placed in the dedication to the effect that: "A public sewer
system will be made available for the plat, and individual service will be provided to
- each lot prior to sale. Use of individual on-site sewage disposal systems shall not
be authorized."
12. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
13. The final plat dedication shall contain the following statement: "The public water
system, pursuant to the water plan approved by county and state health authorities,
the local fire protection district, County Building and Safety Department, and water
purveyor, shall be installed within this subdivision and the applicant shall provide
for individual domestic water service as well as fire protecrion to each lot prior to
sale of each lot and prior to issuance of a building pernut for each lot."

SPOKANE COUNTY DIVISION OF BUILDINGS
1. The applicant shall contact the Division of Buildings at the earliest possible stage in
order to be informed;of caie requirements administered/enforced as authorized by
the State Building Code Act Design/development concerns include: addressing;
fire apparatus accessroads; fire hydrant/flow; approved water systems; build:ing
accessibility; construction type; occupancy classif'ication; exiting, exterior wall
protection; and energy code regulations. (Note: The I?ivision of Buildings reserves
the right to confirln the actual address at the time of building permit.)
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORTTY
1. All air pollution regulatio~~must.he-metP.
2. Air pollution regulations require that dust emissions during demolition, constcuction
and excavation projects be controll'ed. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from a11 other construction-related activiries.
3. SCAPCA strongly recommends that all traveled surfaces (ingress, egress, parking
areas, access roads) be paved and kept clean to minimize dust emissions.

. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. SCAPCA Regulation I, Article V requires that a Notice of Construction and
Applicarion for Approval be submitted to and approved by our agency prior to the
construction, installation or establishment of an air pollution source. This includes
any fuel fired equipment rated at greater than 400,000 BTU/hour.
6. Debris generated as a result of this project must be disposed of by means other than
burning (i.e., construction waste, etc.)
7. Demolition and renovation projects must comply with the requirements of CFR 40,
Part 61, Subpart M and SCAPCA Regulation I, Article IX which deal with asbestos
removal. Intent to Demolish forms are available at the SCAPCA office.
8. All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with
local, state, and federal rules and regulations.

residential category with single family, two-family, and multi-fannily
developments. The Urban category promotes "fill-in" development within
established development areas having adequate power supplies, water,
sanitary sewers and streets. The proposal is located in an area that is
developed and established with a variety of uses, with public services and
facilities in place.
The Goals, Objectives, and Decision Guidelines of the Urban category also
recommend that high-density developments such as multi-family be located
with direct or near direct access to major arterials, rather than on local access
neighborhood streets. The proposed Urban Residential-22 (UR-22) zone is
located adjacent to the proposed South Valley Arterial, but does not have
direct access to this arterial. The site has d.irect access to Third Avenue
which is a local access street connecting to Fines Road which is located
approxinaately 800 feet west of the site. Pines Roa.d is a secondary state
highway controlled by the Washington State Department of Transportation.
2. Arterial Road Plan: The site is adjacent to Fourth Avenue and the
proposed South Valley Arterial. Thud Avenue will also be extended
easterly to provide access to the site. The Spokane County Arterial Road
Plan designates Fourth Avenue as a Collector Arterial with a recommended
right-of-way width of 70 feet To implement the plan, the Spokane County
Engineer is requesting 10 feet of ded.ication along Fourth Avenue and that a
five foot wide strip of property be set aside as Future Acquisition Area
(FAA) along the Fourth Avenue frontage. The proposed South Valley
Arterial alignment is located adjacent to the north boundary of the proposed
plat. The South Valley Arterial is designated a Controlled Access Principal
Arterial with a recommended right-of-way width of 130 feeL The County
Engineer has requested that a strip of property thirty feet in width be set
aside as Future Acquisition Area (FAA) for the South Valley Arterial. Third
Avenue, ~vhich will be extended easterly, is a Local Access Street and is not
designated as an arterial. The Comprehensive Plan reconamends a thirty-
five (35) feet setback from arterials. The proposed preliminary plat
illustrates;a thirty-five (35) feet setback from the South Valley ArteTial
Future Acquisition Area (FAA), as recommended by the Comprehensive
Plan. The existing single family residences located along Fourth Avenue
will have 'non-confomung front yard setbacks when dedication and future
aoquisition area are implemented, therefore a thirty-five (35) feet setback
along Fourth Avenue is not illustrated.
3. County Parks Plan: The Spokane County Parks and Recreation Plan

identifies :Terrace View Park as the nearest existing park facility. Temace
View Park is located approximately 2 mile southeast of the proposal at Blake
Street and 24th Avenue. The Plan also identifies a proposed park acquisition
in the area approximately 1,000 feet west of the site. (See Item Q)
C. Site Characteristics: Two single family residences and accessory structures
are presendy located on the southern portion of the site. The remainder of the site
is flat, undeveloped, vacant land.
D. Neighborhood Characteristics: The surrounding area is developed with
single family residences, duplexes, multi-family dwellings and commercial uses.
Some non-conforming large anunal keeping may also be found in the area.

G. Circulation: Third Avenue will be extended easterly to provide direct access to
the proposed single family residences and the multi-family development. The two
existing single family residences adjacent to Fourth Avenue will maintain direct
access from Fourth Avenue. No direct access to the proposed South Valley
Arterial is pennitted.
H . Design:
The preliminary plat consists of S lots on approximately 2.04 acres. Four of the
lots are for single family residences and one lot is for multi-fa.mily dwellings. The
two existing single family residences will remain in the Urban Residential-3. S
(UR-3.5) zone and the two new single family residential lots will be reclassified
from Urban Residential-3.5 (UR-3.5) to Urban Residential-7 (LJR-7) upon
finalization of the plat The portion of the property located north of and adjacent to
Third Avenue extended will be rezoned to Urban Residential-22 (UR-22). Each
lot meets or exceeds the development standards for parking, lot size, and frontage
in each respective zone classification which will be implemented upon finalization
of the plat, The Urban Residential-7 (UR-7) and Urban Residential-22 (UR-22)
lots also meet minimum setbacks, however, the existing single family residences
along Fourth Avenue will have non-conforming front yard setbacks at the time
dedication and future acquisition area requirements are implemented.

parks, recreation and playgrounds, the owner, at his option, shall either dedicate
land within the 'subdivision or enter into a voluntary agreement with Spokane
County to mitigate the d.irect impacts that the subdivision has on public parks,
open spaces and recreation facilities within the unincorporaxed areas of Spokane
County. This request is included as a recommended condition of approval. If the
owner opts to enter into a voluntary agreement, the agreement shall be executed
prior to the finalization and recording of the plat and recorded in conjunction
therewith. The'agreement shall be consistent with RCW 82.02.020 and be
substantially the same as the standardiz,ed agreement prepared by the Spokane
County Parks, Recreation and Fair Department Prior to finalization of the plat,
the owner shall advise any purchaser of property, as authorized under RCW
58.17.205, of the obligation within the voluntary agreement.
III. ENVIRONMENTAL REVIEW:
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Department The review considered the specif'ics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has determined that "No
probable significant adverse impacts would result from the proposal being developed
and has issued a Determination of Nonsignificance ("DNS
The "DNS" was circulated to 13 other agencies of jurisdiction and other
agencies/departments affected by the future development for review and comment, The
"DNS" comment period ends November 15,1994 and was advertised 15 calendar days
before said date in the newspaper, by letter to adjacent property owners within 400 feet
of the proposal, and by notice on a sign posted on the proposal site. The Hearing
Exanuner may consider additional environmental related testimony at the public
hearing.
I V. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposed preliminary plat and zone reclassification request is generally consistent
with the Spokane County Subdivision Ordinance, Zoning Code and the Urban category
of the Comprehensive Plan. The variety of housing types and densities as proposed,
are generally compatible with the residential uses established in the area. The proposal
also provides for "fill-in" development within an area with exisring public services and
facilities available. The Planning Department recommends approval of the preliminary
plat and zone reclassifications as proposed, subject to conditions recommended by
reviewing agencies.
V. CONDITIONS OF APPROVAL
i. All conditions imposed by the Hearing Examiner Committee shall
be binding on the "Applicant", which terms shall include the
owner or owners of the property, heirs, assigns and successors.

13. The final plat shall indicate yard setback arc lengths on cul-de-sac lots which meet
or exceed the minimum frontage of the underlying zone of the final plaL
14. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County
Building & Safety Department and Counry Health I?istrict The agencies will
certify on the Water Plan, prior to the filing of a final plat, that the plan is in
conformanoe with their respective needs and regulations. The Water Plan and
certification shall be drafted on a transparency suitable for reproduction and be
signed by the plat sponsor.
15. The water purveyor shall certify that appropriate contractual a,mangements and
schedule of improvements have been made with the plat sponsor for construcdon of
the water system in accordance with the approved Water Plan. The time schedule
shall provide for completion of the water system and inspecaon by the appropriate
health authorities prior to application for building permits within the final plat. The
arrangements ar agreements shall include a provision holding Spokane County aad
the purveyor harmless from claims by any lot pu.rchaser refused a building permit
due to the failure of the subdivision sponsor to satisfactorily complete the approved
water system.
16. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safety
Department and water purveyor, shall be installed within this subdivision and the
applicant shall provide for individual domestic water service as well as fire
protection to each lot, prior to sale of each lot and prior to issuance of a building
permit for each lot" ,
17. No building pemut will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed
pursuant to the approved Water Plan for the final plat" including a signed license
stamp. The certificadon may be in the form of a letter, but is prefened to be
certified on a copy of the Water Plan as a schematic map showing the "as-built"
water system.
18. The Water Plan and the above four (4) conditions of approval regarding the Water
Plan may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protection district stating that sunple
connections to an eacisting, approved water system will provide adequate domestic
and fire protection water to ensure the public health, safety and general welfare.
19. A survey is required prior to the filing of a final plat.
20. Prior to approval of road and drainage plans, you are required to coordinate with
the United States Postal Service to detemiine type and location of central mail
delivery facilities which may include applicable easements for developments of
three or more homes.

24. The Owner shall negotiate with the Central Valley School District and submit a
recorded copy of a voluntary agreement making provisions for public schools prior
Lo finalization and recording of this plaL The agreement shall provide a written
description of the subject property to which the agneement applies and also state the
dollar amount and any other agreed to mitigating measures.
The Owner shall also notify any potential purchasers who have made an agreement
to purchase property within said plat pursuant to the Revised Code of Washington
(58.17.205), that ade4uate provisions for school facilities must be made
conditioned on a future agre.ement between the plattor and school districL
Voluntary agreements between the Owner and School District shall conform to the
requirements of the Revised Code of Washington Chapter 82.02.
25. To sarisfy the requirements of RCW 58.17.110 that a subdivision make appropriate
provisions for public, parks, recreation and playgrounds, the owner, at his opdon,
shall either dedicate land within the subdivision or enter into a voluntary agreement
with Spokane County to mitigate the direct unpacts that the subdivision has on
public parks, open spaces and recrearional facilities within the unincorporated areas
of Spokane County.
If the owner opts to enter into a voluntary agreement, the agreement shall be
executed prior to the finalization and record.ing of the final plat and recorded in
conjunction therewith. The agrecement shall be consistent with RCW 82.02.020
and be substantiaUy the same as the standardized agreement prepared by the
Spokane County Pazks, Recreation and Fair DepartmenL Prior to finalization of the
plat, the owner shall advise any purchaser of property, as authorized under RCW
58.17.205, of the oblYgation within the voluntary agreemenL

26. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be pernutted, including, but not limited to building
location, landscape plans and general allowable uses of the permitted zone. All
variations must conform to regulations set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained.
27. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building pernuts.
28. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Ilirector/designee shall be submitted with a perforcnance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
unpaired. 29. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.

or resolution which purpose is the farm,ation of a Road Improvement District (RID)
for said improvements, pursuant to RCW 36.88, as amended. At such time as an
RID is created or any. Road Improvement Project is sanctioned by Spokane County,
the improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs,
grantees and assigns. This provision is applicable to Fourth Avenue.
19. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs,
grantees and assigns., This provision is applicable to Fourth Avenue.
20. The following statement shall be placed in the plat dedicarion:

their name(s) on a petition for the formation of a Road Improvement District (RID)
by the petition method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s)' property, and further not to object, by the signing of a ballot, to the
formation of an RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s)' property. If an RID is formed by either the
petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree:
(a) that the improvement(s) or construcrion contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the a.mount of any County participation,
exceed the cost- and expense of formation of the RID; and
- (c) that the property within the proposed RID is sufficiently developed.

purveyor and the Spokane County Engineer to determine whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amenderi.
2. Applicant will make connection to Public Sewer System. Sewer Connection Permit is
required.
3. Plans and specifications for the public facilities are to be reviewed and approved by the
Utilities Department. Spokane County plan submittal requirements apply. ~
4. Security shall be deposited with the Utilities Department for construction of public
facilities.
5. Applicant must make arrangements for payment of additional charges prior to
finalization of the project.
SPOKANE COUNTY HEALTH DISTRICT
1. The final plat shall be designed as indicated on the preliminary plat of record andlor
any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies,
Spokane County Engineer and the Spokane County Health District. Written
approval of the easements by the utility companies must be received prior to the
submittal of the final plat.
3. Sewage d.isposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall Ue coordinated through the Director of Utilities, Spokane County. ~

5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is
available to each lot of the plat.

SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air polludon regulations must be met.
2. Air pollution regulations require that dust emissions during demolidon, construction
and excavation projects be conmolled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as' emissions from all other construction-related activities.
3. SCAPCA strongly re,commends that all traveled surfaces (ingress, egress, parking
areas, access roads) be paved and kept clean to minimize dust emissions.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. SCAPCA Regulation I, Article V requires that a Notice of Construction and
Application for Approval be submitted to and approved by our agency prior to the
construction, installation or establishment of an air pollution source. This includes
any fuel fired equipment rated at greater than 400,000 BTU/hour.

6. Debris generated as a result of this pmject must be disposed of by means other than
burning (i.e., construction waste, etc.) ,
7. Demolition and renovation projects must comply with the requirements of CFR 40,
Part 61, Subpart M and SCAPCA Regulation I, Article IX which deal with asbestos
removal. Intent to Demolish forms are available at the SCAPCA office.
8. All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with
local, state, and federal rules and regulations.

A. Background
No. 11: The project consists of two existing parcels of 82.75' x 538' (1.02
acres each) with a single-family re$idence on each parcel. The owners wish to
divide the two lots into 5 lots. The existing two lots are zoned UR-3.5. The
project proposes to change the zones as follows: i

3.5 lots are 10,013 S.F., include the existing single-family residences, and front
Forth Avenue. The UR-7 lots are 7,940 and 5,982 S. . and front Third Avenue.

to this lot and the two UR 7 lots. The fifth lot is proposed to be zoned to UR- ~
22 and is 38,271 S.F. in size. This lot is bounded by Third Avenue to the south
and the proposed valley arterial to the north. 1 ''o

The zone change to UR-7 from UR-3.5 for the two sin9le-family residences is N-1
required to comply with the Zoning Code's minimum !ot area. UR-31.a~ ne
requires 10,000 S.F. minimums while the UR-7 zone allows W~
minimums. The proponents will loose 12,703 S.F. of property for right-of-way
dedications along Fou-rth and for Third Avenue (1,655 S.F. and 11,048 S.F.
respectively). The roadway dedications eliminates the sponsors' ability to
provide four single-family residences meeting the 10,000 S.F. minimum of the
UR-3.5 zone. Therefore, the reason for the proposed zone change to UR-7. The parcel of land between Third Avenue and the proposed valley arterial is
proposed to be zoned to UR-22. Recent zone changes have occurred changing
the zone to UR-22 for other properties between Third Avenue and the proposed
arterial. Most recent change was in 1990 and adjacent to the site. The
proposed zone change is the best use of this land as the high density zoning

acts as a buffer between the industrial zoned land and proposed arterial to the
north and the lower density UR-3.5 zoning to the south. ,
No. 12: The project is located in the east '/z of the west '/2 of tract 182 of
Opportunity in the northwest quarter of Section- 22, T. 25 N., R. 44 E.W.M.
in Spokane County. More specifically, the project is located approximately 800
feet east of Pines on Fourth and Third Avenues. The address of the existing
residences on Fourth Avenue are E. 12507 and E. 12513. The project site is
. bounded by the abandoned railroad right-of-way/proposed valley arterial to the
north, undeveJoped and single-family residence to the east, Fourth Avenue to
the south and a single-family residence, the Scroggin Apartments, the
Washington Apartments and Third Avenue to the west. Both the Scroggin and
Washington Apartments are under construction.
B. Environmental Elements
1.c: The soils found on the site, according to the Soil Survey for Spokane
County, 1-969, is designated as GgA, Garrison gravelly loam, 0 to 5
percent slopes.
8.a: Current use of the s;te is two single-family residences fronting Fourth
Avenue. The north 300 feet of each parcel is vacant grass land.
Adjacent land uses follows:
North - Abandoned railroad right-of-way and site of proposed
valley arterial. North of right-of-way is industria(ly
zoned land, some of which is vacant.
East - Vacant grass land and single family residences.
South - Fourth Avenue and single family residences.
West - Single-family residence, the Scroggin Apartments
(under construction), the Washington Apartments
(under construction), and Third Avenue.

12513 parcel has a home, a garage, a small barn and a shed.

WHAT ARE THE CHANGED CONDITIONS OF THE AREA WHICH YOU FEEL MAKE THIS PROPOSAL
WARRANTED?
The project site was zoned to Agricultural Suburban (AS) or R-1 in 1955. On
January 1, 1991, the existing zone crossed over to UR-3.5. Since there has been a
change in zone titles over the years, discussion of the changed conditions will use
today's zone designation as if they were in effect prior to January 1, 1991.

Since the site was zoned UR-3.5 in , ~acent or nearby lands have requested
and been granted zone changes. The following identifies zone change, dates, and
proximity to the proposed project.

The abandoned C.M. & St. P. & P. Railroad right-of-way has been purchased by
Spokane County. They have designated this old rail bed to be the new valley arterial.
This arterial will relieve traffic congestion on both Sprague Avenue and I-90. The land
adjacent and north of this proposed arterial is zoned I-2. The best use of land south
of the arterial and industrially zoned land is high density/multi-family zoning. The UR-
22 zone will buffer the less dense residential zones from the valley arterial and
industrial zone. This was also the case when the land west of the site was zoned to
UR-22. These developments would buffer the less dense residential areas from the
railroad and industrial lands.
The UR-7 zone is being requested due to the fact that it is impossible to create lots
fronting the extended Third Avenue and existing Fourth'Avenue that comply with the
requirements of the UR-3.5 zone. The County will require the extension of Third
. ~
Avenue east across the project. That will create two double fronted lots (if the
existing parcels are maintained), with frontage on Third and Fourth Avenue. This will
leave 19,860 S.F. per parcel. Also, the County will require 10 feet of additional right-
of-way dedication for Fourth Avenue. This will reduce the land area available down
to 19,032 S.F. per parcel. Add a required cul de sac to Third Avenue and a 5-foot
right-of-way reservation for Fourth Avenue and the parcels are reduced to 18,995 S.F.
and 17,952 S.f.
The UR-3.5 zone requires that each lot have a minimum of 10,000 S.F. As previously
identified only two lots could exist between Third and Fourth Avenues if the zone
remained at UR-3.5. Changing the zone to UR-7 will allow the creation of two lots
fronting Third Avenue. Each lot will be above the minimum lot area of 7,000 S.F. ~
(8,568 S.F. and 7,526 S.F.) and can only be developed with single family residences.
Even though the zone would support a greater use; lot area restrictions allow only the
development of single family residences.
The land adjacent to Fourth Avenue now zoned UR-3.5 will remain zoned UR-3.5. The
existing residences on these two parcels will remain.
WHAT IMPACT WILLTHE PROPOSED ZONE RECLASSIFICATION HAVE ON THE ADJACENT PROPERTIES?
Existing land use surrounding the proposed project includes:
North - Abandoned railroad - proposed valley arterial & industrially zoned land
East - Vacant land and single family residences, apartments 300' east
South- Single family residences
West- Single family and apartments adjacent
There will be no impact to the adjacent properties along Fourth Avenue as there will
be no change in land use. The impacts will occur to properties along Third Avenue.
Impacts west of the proposed project on Third Avenue include noise, light and glare,
and additional traffic associated with single and multi-family dweltings.
Property to the east of the project site may be impacted very little from the proposal.
If Third Avenue was extended east, the property north of Third and adjacent to the
site is vacant. Impacts include noise, light and glare associated with multi-family
dwellings. Property south of Third and adjacent to the site is developed with a barn
and out buildings along Third and a single family residence along Fourth. Impacts to
the adjacent land would be impacts associated with single family residences.

WHAT FACTORS SUPPORT THE ZONE RECLASSIFICATION?

The area has changed since the UR-3.5 zone was established in W5. Since 1968,
the lands between Pines and the project site have been rezonerto B-1 and UR-22.
With each new rezone, Third Avenue has been extended east, bisecting long narrow
land segregations. The splitting of the land has provided for a land use buffer
between the industrially zoned lands north and single family residences south.
The railroad has abandoned their lines riorth of the site. The County has purchased
the right-of-way and propose a limited access, high speed arterial. The arterial will
impact the adjacent lands. The UR-22 zone north of Third and south of this proposed
arterial provides a buffer to the lower density land uses and is a use identified by the
comprehensive plan for this purpose.
The UR-7 zone classification is not requested to increase the density of the area, but
requested for the construction of two single family homes. The extension of Third
Avenue reduces the land available for single family residences in the UR-3.5 zone. To
comply with the zoning code, the remaining available land area for two additional lots
require the zone change to UR-7. The land use west of the proposed UR-7 zone is
apartments with a zoning of UR-22.
WHAT MEASURES DO YOU PROPOSE TO MITIGATE YOUR PROPOSAL'S IMPACT ON SURROUNDING
LAND USE?
Measures to mitigate the proposal's impacts are:
