Relocated structures within or into the County must conform to the requirements of the Uniform Building Code and Chapter 3 of the Spokane County Code. In addition, the moving contractor must be licensed and insured to operate within the county right-of-way. WHAT INFORMATION WILL BE NECESSARY TO COMPLETE THE APPLICATION? In order to submit an application for your building permit the following information should be provided: * Parcel number of the proposed site. * Legal description of the proposed site. * Site plan, on 8-1/2 x 11 paper. (See residential building permits brochure) . NOTE: This information can be found on your property tax statement or may be obtained from the County Assessor's Office. * Present location, legal description, and use of the building. HOW LONG WILL IT TAKE TO RECEIVE THE PROCESSED PERMIT? When a septic system is not involved, your application and plans are complete, and the proposal clearly conforms to the codes and ordinances adopted by Spokane County, the permit may be issued within 2 to 3 days, if not the same day, after review by county staff. In the case of installation of a septic system or alterations to a septic system, a time frame of 7 to 10 days is necessary to allow review of the sewage disposal system by the Spokane County Environmental Health District. - 1 - How Much Will My Permit Cost? Fees for relocation permits are based on a flat rate. Fees for any construction work are established by the Uniform Building Code and are based on the size and use of the structure, and the scope of the work to be performed. Contact a technician for current fees. Will I Need Other Permits In Conjunction With My Application? Approvals or permits from other county and state agencies may be required prior to the release of your building permit: * Many projects require plumbing and mechanical permits in conjunction with the building permit. Both are issued by this department. All three may be issued as a single combination permit or obtained separately. * If you are installing or altering a septic system, or if your project is such that your septic system may need to be enlarged or relocated, permits are required from the Spokane County Health District. (324-1560) * If sewer is available to your site, a side sewer permit will need to be obtained from the Spokane County Utilities Department. (456-3604) * Oversized loads, curbcuts, driveway approaches and the construction of curbs and sidewalks need to be reviewed by the Spokane County Engineer's Office. Permits may be required. (456-3600) * For oversized loads on State highways, contact the State Department of Transportation. * Electrical permits for work in unincorporated areas of the county can be obtained from the Washington State Department of Labor and Industries, (324-2640) . For connection to the power distribution lines, contact the serving utility. * You will need to contact the appropriate utility for connections to a public water system. WHAT INSPECTIONS WILL BE REQUIRED? A pre-relocation inspection is required prior to permit issuance to verify the condition of the structure and to advise you as to what work will need to be done to the structure at its new location to bring it into conformance with current regulations. All footings and foundations on the site which the building or structure is to be relocated shall be inspected, approved and installed prior to removal of the building or structure from its original site. All repairs including remodeling, plumbing, and mechanical systems, must be inspected prior to concealing. WILL THE PERMIT EXPIRE? All relocated structures shall be permanently affixed to the new foundation within 45 days of approval of the foundation. Prior to the release of the permit, you may request, in writing, an extension of the 45 day time, subjedt 'to approval by the building official who may attach such conditions as he deems necessary to any such request. The intent of this zone is to promote areas of primarily single-family residential use in an urbanized neighborhood setting, having a high level of public services. Lots shall be served by a public water system and shall require connection to a public central sewer system when available. Roadways shall be paved and curbed and may have sidewalks. 14.61 6.210 Permitted Uses Hereafter in the UR-3.5 zone no building, structure or improvements or portion thereof shall be erected, constructed, converted, established, altered or enlarged, nor shall any lot or premises be used, except for those uses specifically permitted in this zone pursuant to Chapter 14.605, the Residential Zones Matrix, and the requirements of Chapter 14.416. In addition the following specific standards are required for the following permitted uses. A. Residential Uses 1. Clustered housing - only with an approved PUD overlay as provided in Chapter 14.704. 2. Manufactured home park- pursuant to the density standards of this zone and the standards of Chapter 14.808. B. Public and Semipublic Uses 1. Community hall, club or lodge, provided that it is related to local community social activities and its principal activity includes a service customarily carried on as a business. The utility company shall secure the necessary property or right-of-way to assure for the proper construction, continued maintenance, and general safety to the properties adjoining the public utility transmission facility; b. All support structures for electrical transmission lines shall have their means of access located a minimum of ten (10) feet above the ground; c. The facilities shall be compatible with the surrounding uses either by distance, landscaping, buffering, or design, as determined by the Zoning Administrator; and d The height of the structure above ground does not exceed one hundred twenty- five (125) feet. 3. Day care center (in a church or public or private school), provided that: a. There are no more than fifty (50) children; b. Any outside play area shall not be closer than fifty (50) feet to a property line; or c. Any outside play area must be completely enclosed with a minimum four (4)-foot fence. 4. Community transit center, provided that: a. The site is not currently farmed or designated as "prime" or "unique" farmland per the USDA Soil Conservation Service; b. The site has adequate paved parking to handle anticipated riders; and c. Ingress and egress is adequate based upon the County Engineer's review and approval. 5. Park-and-ride facility, provided that: a. The site is not currently farmed or designated as "prime" or "unique" farmland per the USDA Soil Conservation Service; b. The site has adequate paved parking to handle maximum anticipated daily riders; and c. Ingress and egress is adequate for buses and autos based upon the County Engineer's review and approval. 14.61 6.2 2 0 Accessory Uses All accessory uses, buildings and structures ordinarily appurtenant to any of the uses allowed in this zone under Chapter 14.605, the Residential Zones Matrix, are permitted including: Printed: Zoning Code 1992 Page 150 of Spokane County 1. Community recreation facility when approved and identified within a site development plan or building plan; 2. Home profession provided that a home profession permit is obtained; 3. Solar collector and associated systems; 4. Pigeons, performing and show, provided that: a. All pigeon lofts shall be located in the rear half (1/2) of the lot and setback a minimum of fifteen (15) feet to any property line; b. All pigeon lofts shall be constructed and maintained in a clean and sanitary condition so as not to create offensive odors, fly or insect breeding or other nuisances; c. Only one (1) loft shall be permitted per residential dwelling unit and each loft shall contain not more than fifty (50) pigeons over one (1) year of age and twenty-five (25) pigeons under one (1) year of age; and d Performing pigeons requiring freedom of flight for purposes of training, maintaining physical conditioning or competitive performance may be released for said purpose(s); provided, however, that in no instance shall such pigeons be allowed to continually perch or linger on buildings, structures or property of the owners or others in the vicinity of said loft. 5. Tower, private, provided: a. That a building permit for the private tower is obtained, reviewed and signed off by the Planning Department; b. The applicant shall furnish a site plan showing height and location of the private tower; c. The applicant shall furnish a copy of the tower manufacturer's construction/erection specifications; d The private tower shall be erected in accordance with the manufacturer's specifications; e. The applicant shall show that the impact area (that area in all directions equal to the private tower's height above grade) is completely on his/her property. Up to one-half (1/2) of the tower's impact area in distance may be administratively approved if off of the applicant's property pursuant to Section 14.506.020(8); or The applicant has secured an easement(s) for all property in the towers impact area if not entirely on his/her ownership. Such easement(s) shall be recorded with the County Auditor with a statement that only the Planning Department can remove the recordation; f. That generally a residence has to be on the same site as the private tower, except for a private repeater facility or remote base operations; Printed: Zoning Code 1992 Page 151 of Spokane County r + g. That the height limitation of the zone is not exceeded without approval of a variance or administrative exception as respectively pertains; and h. That the setbacks for the private tower shall be the accessory use setbacks of the zone where it is located, if detached, and shall be the primary use setbacks of the zone where it is located, if attached to the primary use/building of the property. 6. Beekeeping, hobby, provided that: a. The activity shall be accessory to a residential use only; b. The number of beehives shall be limited to one (1) beehive per four thousand three hundred fifty-six (4,356) square feet of lot area up to a maximum of twenty-five (25) beehives; and c. The beehives shall maintain at least the accessory use setbacks and be completely enclosed with a six (6)-foot barrier (solid fence, hedge, landscaping, etc.) that necessitates the bees flying over; or The beehives shall maintain at least a fifty (50)-foot, or twenty-five (25)-foot in SR 1/2, UR-3.5 and RS zones, setback from all property lines and be isolated from public access by a security fence; or The beehives shall maintain at least the accessory use setbacks, be not less than ten (10) feet in height above grade, and be isolated from public access by a security fence or located on a restricted access platform. 7. Storage structure, detached, private a. One storage structure, detached, private, is permitted outside the Urban Impact Area (UIA) boundary, provided setback and maximum building coverage standards are met; b. One storage structure, detached, private, is permitted inside the Urban Impact Area (UIA) boundary, limited in area to 1,500 square feet gross, and provided setback and maximum building coverage standards are met. 14.616.230 Prohibited Uses All uses not specifically authorized in the UR-3.5 zone are prohibited, including, but not limited to, the following: 1. General agriculture use, except as specifically permitted in this section; 2. General industrial use; 3. General commercial use; and 4. Mining. Printed: Zoning Code 1992 Page 152 of Spokane County 14.616.240 Conditional Uses Those uses designated as conditional uses within the UR-3.5 zone on the Residential Zones Matrix, Chapter 14.605, may be permitted, provided that a conditional use permit authorizing such use has been granted, as set forth in Section 14.404.100, and provided further that at a minimum the development standards of this section and the following special standards are met. 1. Community treatment facility (8 or fewer residents). 2. Tower, provided that: a. The tower shall be enclosed by a fence not less than six (6) feet in height with a locking gate; b. The tower shall have a locking trap door or the climbing apparatus shall stop twelve (12) feet short of the ground; c. The tower collapse or blade impact area shall lie completely within the applicant's property or within adjacent property for which the applicant has secured and filed an easement as designed and certified by a registered engineer and shall be determined by relating "blade diameter" to a "throw trajectory" based on the following scale: Blade Diameter (ft.) 5 10 15 20 30 35 40+ Radius of Impact Area (ft.) 100 165 220 270 340 365 385 d Before the issuance of a conditional use permit, the applicant shall have demonstrated that all applicable requirements of the Federal Communications Commission, Federal Aviation Administration and any required avigation easements can be satisfied. 3. Transitional community facility (8 or fewer residents). 4. Home industry, provided that: a. The property shall retain its residential appearance and character; b. The use shall be carried on in a primary residence or may be allowed in accessory, detached structures which are not, in total, larger than two (2) times the gross floor area of the primary residence; c. Only members of the family residing on the premises, and no more than two (2) employees outside of the family, may be engaged in the home industry; d. Signs identifying the home industry shall be unlighted and may be attached or detached per the following standards: i. In the EA, GA, RR-10, SRR-5 and SRR-2 zones, signs totaling a maximum of sixteen (16) square feet on a face; Printed: Zoning Code 1992 Page 153 of Spokane County t S ii. In the SR-1, SR-1/2, UR-3.5, and RS zones, signs totaling a maximum of four,(4) square feet on a face; e. Window or outside displays may be allowed as approved by the Hearing Body; f. There shall be no stock stored nor commodity kept for sale on the premises which is not necessary to the occupation, profession, or craft; g. All material or mechanical equipment shall be used in such a manner as to be in compliance with WAC-173-60 regarding noise; h. Parking, traffic, and storage requirements shall be as approved by the Hearing Body; and i. All storage areas shall be enclosed or completely screened from view by a maximum six (6)-foot-high sight-obscuring fence meeting accessory use setback requirements. 5. Private kennel, provided that: a. Minimum lot area is one-half (1/2) acre. b. No more than ten (10) dogs and/or ten (10) cats over six (6) months of age are permitted on the subject site. c. Outside runs or areas shall be not less than fifty (50) feet from any dwelling other than the dwelling of the owner and the run or yard area shall be enclosed with a six (6)-foot sight-obscuring fence, board-on-board or cyclone with slats. d The structure(s) housing the animals shall be large enough to accomodate all animals and shall be adequately soundproofed to meet WAC 173-60 as determined by the noise levels for the number of animals to be kept during a period of normal operation. e. All animals are to be housed within a structure and no outside animals are permitted between the hours of 10:00 p.m. and 6:00 a.m. f. Landscaping for screening and noise abatement may be required by the Hearing Body in addition to sight-obscuring fencing. g. One off-street parking space shall be provided for each ten (10) animals kept on the premises. h. A kennel license and inspections shall be made by the Spokane County Small Animal Control. i. Advertising, signs, lighting and parking plans shall be approved by the Hearing Body. j . The permit shall be granted for a period not to exceed two (2) years. At the end of such period an inspection shall be made of the premises to determine: i. compliance with all the conditions of approval; and Printed: Zoning Code 1992 Page 154 of Spokane County ii. the advisability of renewing such permit. k. The applicant shall submit adequate information to aid the Hearing Body in determining that the above standards are satisfied prior to the public hearing. I. Those conditions or safeguards as deemed necessary by the Hearing Body for the protection and assurance of the health, safety and welfare of the nearby residences. 14.616.300 Development Standards Prior to the issuance of a building permit, evidence of compliance with provisions of Sections 14.616.305 thru 14.616.355 shall be provided to the Department. 14.616.305 Density The maximum density of dwelling units in the UR-3.5 zone shall be three and one-half (3-1/2) dwelling units per acre. 14.616.310 Minimum Lot Area The minimum lot area for residential units in the UR-3.5 zone shall be ten thousand (10,000) square feet per unit unless otherwise specified or unless units are clustered in a PUD overlay zone, in which case the minimum lot area shall be six thousand (6,000) square feet per residential unit provided that the overall density for the site shall not exceed three and one-half (3-1/2) residential units per acre or unless the residential units are solar structures as defined in which case the minimum lot area, if approved, shall be seven thousand (7,000) square feet and the overall density for development shall not exceed four and one-half (4-1/2) residential units per acre. 14.616.315 Minimum Frontage The minimum frontage for residential units in the UR-3.5 zone shall be eighty (80) feet on a public road or street unless units are clustered in a P.U.D. overlay zone in which case the minimum frontage shall be fifty (50) feet on a public road or street or unless the residential units are solar structures as defined in which case the minimum frontage, if approved, may be as low as forty (40) feet on a public road or street. The minimum frontage for all other permitted uses that have a principal structure on site shall be eighty (80) feet on a public road or street. There is no minimum frontage for permitted uses that do not have a structure on site. 14.616.325 Minimum Yards The minimum yards and setbacks for permitted and accessory uses in the UR-3.5 zone shall be as follows: A. All Uses Except Accessory Uses and Solar Structures 1. Front Yard: A minimum fifty-five (55)-foot setback the centerline of all roadway rights-of-way or twenty-five (25)-foot setback from the lot front line, whichever provides the greater setback from the centerline of the roadway right-of-way. Flanking Street Yard: A minimum fifty-five (55)-foot setback from the centerline of all roadway rights-of-way or twenty-five (25)-foot setback from the existing property line, whichever provides the greater setback from the centerline of the roadway right-of-way. 4. Rear Yard: The minimum rear yard shall be twenty (20) feet. B. Accessory Uses and Solar Structures 1. Front Yard: A minimum fifty-five (55)-foot setback from the centerline of all roadway rights-of-way or twenty-five (25)-foot setback from the lot front line, whichever provides the greatest setback from the centerline of the roadway right-of-way. 2. Side Yard: Five (5) feet for each story of building. 3. Flanking Street Yard: A minimum fifty-five (55)-foot setback from the centerline of all roadway rights-of-way or a twenty-five (25)-foot setback from the existing property line, whichever provides the greater setback from the centerline of the roadway right-of-way. 4. Rear Yard: Five (5) feet for each story of building. 5. Solar Lot Yards a. Front Yard: Lesser front yards may be administratively approved according to Chapter 14.812 within this Code. b. Other Yards: No other yards are required beyond those required for "clear view triangle" as noted in Section 14.810.020 (2) or for other safety and health standards as determined by the Department. 14.616.330 Maximum Building Coverage The maximum building coverage in the UR-3.5 zone shall be fifty percent (50%) of the lot area. 14.616.335 Maximum Building Height The maximum height of buildings or structures in the UR-3.5 zone shall be thirty-five (35) feet. 14.616.340 Parking Standards Parking standards for uses in the UR-3.5 zone shall be as provided in Chapter 14.802. 14.616.345 Signage Standards Signage standards for uses in the UR-3.5 zone shall be as provided in Chapter 14.804. Printed: Zoning Code 1992 Page 156 of Spokane County 14.616.350 Landscaping Standards Landscaping standards for uses in the UR-3.5 zone shall be as provided in Chapter 14.806. 14.616.355 Storage Standards All storage (including storage of recyclable materials) shall be wholly within a building or shall be screened from view from the surrounding properties and shall be accessory to the permitted use on the site. There shall be no storage in any required front yard or flanking street yard. The private, noncommercial storage of up to two (2) inoperable or not currently licensed vehicles or remnants thereof shall be completely sight-screened year-round from uses allowed in this zone with a fence, maintained Type I or II landscaped area or maintained landscaped berm. There is no number limit within a permitted, completely enclosed building, including doors. Vehicle remnants or parts must be stored inside a vehicle or a permitted, completely enclosed building, including doors. Fences over six (6) feet in height require a building permit and/or a zoning variance. Type I and II landscaping are described in Section 14.806.060. Nonconforming rights for outdoor storage of more than two (2) inoperable or not currently licensed vehicles inside the UR-3.5 zone will end on the first day of the month after adoption, plus one year (September 1, 1993).
