SUBJ: Recently Filed Title Notices Which Affect Certain Properties and
letter from Spokane County Fire District No. 3 regarding Otto case.
I mentioned to you the other day that I would try to remember to send you
/copies of filed Title Notices which in effect alter the setbacks on property.
/Attached are two, each involving a separate case (Mr. Wharton's case on Valley Wayand Ms. Davis's case on Harvard Road). Your thought was that you woituld
flag these properties in your computer so that any future building perm
j would at least check into the then present situation regarding setbacks.

49- _ I might suggest that there are probably numerous land use actions taking
place in the Planning Department which are now having similar outcomes,
/ including possibly Title Notices filed regarding revised set-backs associated
with reserve future right-of-way acquisitions. If you are not receiving word ��-K.R*

on a regular basis, I suggest you contact Gary Fergen to see if all of our s�°�o�`
processes need to be altered to somehow try to do this.
Also attached herewith is the short note from Dwayne Paul at Fire District 3/��, �'-
regarding Mr. Otto's property. I am giving Mr. Otto ninety (90) days to attempt
to secure alternative access, capable of being recorded and "running with the
land." He presently has only an access permit from the railroad, which is
revocable on thirty (30) days notice and as near as I can tell, would not
transfer with the railroad's property in the event the railroad ever pulled out
and their right-of-way property was sold.
