I discovered today that this plat is under the IOC for the South Hill so the proposed concept will not be acceptable
without an amendment to the present proposal, so I must recind my acceptance of the concept plan and return the

INTRODUCTION
This is a concept drainage plan for the 29 lot plat alteration of a portion of the Woodland
Terrace subdivision in Spokane County, Washington. This plat alteration will outlet iLs runoff
at its historical outlet via the existing drainage channel located South of 14" Avenue and West
of Carnahan Street.
The historic Qlo for the 6.81 acre plat alteration is 5.52 cfs and the developed Qlo is 9.34 cfs,
for a difference of 3.82 cfs. This developed runoff will be routed via the street network into
a series of catch basins, and will then be piped to the existing drainage channel.
Runoff will be intercepted from the existing 24" corrugated metal pipe down drain whicb
collects runoff from Carnahan Street and 16' Avenue. This down dra.in is located north of
16' Avenue. The runoff will be then routed around the proposed plat alteration through a
series of swales and ultimately rejoin the existing drainage channel as it historically does.
From there the runoff will pass under 14'' Avenue via the existing 60" bottom width arched
culvert.
From that point, the developed and historic runoff will be routed via the existing drainage
channel to the existing retention/evaporation pond South of 12' Avenue and West of
Carnahan Street.
Biofiltering of the developed runoff will occur through the existing vegetation within the
existing channel as well as at the existing retention/evaporation pond.
Improvements will be made to the existing drainage channel, retention/evaporation pond,
existing channel North of 12h Avenue and the sand infiltration depression South of 8' Avenue
where future improvements are planned for the Glenrose/Moran Prairie Regional Drainage.

County has conducted a very cursory review of the submittal. The submittal generally did not conform to the
requirements of the Spokane County Guidelines for Stormwater Management. Unfortunately, we are unable
to accept the Drainage Concept at this time.
Our review comments are listed below. Tbese comments are not to be construed as a comprehensive list.

I recommend the following plat conditions for the above referenced plat:
1. A Professional Engineer, licensed in the State of Washington, shall submit
final road and drainage plans, a drainage report and road and drainage
calculations that conform to the 1995 Spokane County Standards for Road
and Sewer Construction and the current edition of the Spokane County
Guidelines for Stormwater Management. Final road and drainage plans shall
also comply with all applicable state and federal laws that may be applicable
to this project. Final road and drainage plans, related calculations and a
drainage report shall receive the County Engineer's acceptance prior to
release of a construction or building permit or approval of the final plat.
Following plan acceptance by the kane County Engineer, drainage
language will be drafted by Spok np, Coun and provided to the Sponsor's
Engineer or Surve~ r for inclusion , the fin I plat document.
2. The draina4 facili i s pro os by a licant's engineer for this land

infiltration pond in s ch wa that de eloped volumes of stormwater are
disposed of in an ppr ved a ner that does not adversely affect flood plain
elevations. All pr os d st water improvements shall comply with the
most current edition t',e Guidelines for Stormwater Management and any
applicable floodplain re tions.
3. Adequate drainage easements, granted to Spokane County and/or an
acceptable maintenance entity, must be provided for all elements of the
drainage plan, in order that proper maintenance may be performed. A
homeowners association or acceptable alternative maintenance entity has
been proposed for this development. Easements for drainage ditches and
natural drainage channels shall be wide enough to contain within the
easement the runoff from a 50 year, 24 hour storm event for the contributing
basin, plus a 30% freeboard. The easement shall also include an adequate
width for maintenance access to be able to conduct proper maintenance of
natural drainages and an adequate width access road for rnan made
drainage facilities. Any easements and agreements for acceptance,
conveyance, treatment, and disposal of stormwater that lie outside of the
proposed plat being submitted, must be submitted with the project plans
before Spokane County will review the plans for acceptance. Natural
~
drainages and natural depressions may not be filled or disturbed unless
approval is obtained from the Spokane County Engineer.
4. Maintenance access roads of sufficient width shall be provided to all man
made ditches, ponds, drainage control structures, and any element of the
system that may require replacement or maintenance in the future.
Easements for drainage ditches shall be a minimum of 20 ft. in width. All
maintenance access roads shall have a minimum of six inches of gravel, or
other type of all-weather driveable surface acceptable to the County
Engineer. The maintenance access road shall be designed to accommodate
the turning movements of a Bus as defined by AASHTO. If the maintenance
road is greater than 300 feet in length, measured from the connecting public
roadway or paved private road, then a turn-around shall be provided at its
terminus.
5. If the drainage disposal system includes infiltration of stormwater as an
element in design, there shall be a site investigation and study conducted by
a qualified Geotechnical Engineer prior to final submittal of road and
drainage plans. The study shall evaluate the potential impacts on
surrounding properties, foundations, basements and structures, due to
injecting and infiltrating stormwater. The geotechnical report shall cover all
sites where drywells or surface infiltration is proposed. The report shall draw
conclusions about the ability of the proposed drywells to function according
to the Spokane County Guidelines for Stormwater Management.
6. If the project is developed in phases, a phased road and drainage plan shall
be prepared by a licensed Professional Engineer, which clearly shows the
phasing of the development. The plan must demonstrate that each phase of
the development is in conformance with the applicable Spokane County road
and drainage standards, and the Conditions of Approval for the plat as well
as any applicable regulations that may apply to this project from other
governmental authority. The plan shall be submitted to Spokane County at
the pre-design meeting, for final design plan preparation. The stormwater
management systems and roads for this plat shall be constructed and
certified to be constructed in accordance with the accepted road and
drainage plans, or all the required improvements must be bonded for in
accordance with Spokane County regulations, prior to the recording of the
final plat. Record drawings and all construction documentation shall be
submitted with the proper certification statement.
7. A concept drainage plan for this project has been submitted by the Sponsor's
Engineer. While the County Engineer has accepted this concept for
drainage design, and the concept appears to be adequate for the proposed
_ land use action, the County Engineer has conducted no detailed review of
the concept plan and drainage calculations for the proposed land-use action.
Therefore, approval of the concept drainage plan does not constitute final
.
approval of the drainage facilities for construction. When construction plans
and calculations for road and drainage facilities are submitted, the County
Engineer may have additional comments that will need to be addressed to
the satisfaction of the County Engineer prior to construction.
8. Erosion Control: A Temporary Erosion and Sedimentation Control (TESC)
plan is to be prepared by a WA State licensed Professional Engineer or
Landscape Architect, and implemented throughout the duration of
construction. The TESC plan is to be prepared using best management
practices (BMP's) currently accepted within the Civil Engineering profession,
and shall address limits on amount and duration of disturbed areas which
have not been stabilized. The TESC plan is to include, as a minimum, a
grading plan, location and details of silt control structures, and street
cleaning program. Runoff from exposed areas must be filtered prior to
discharging into a detention pond, 208 swale, or infiltration facility. The
TESC plan is to be included in the road and drainage plans. The Sponsor's
Engineer is to submit the TESC plan and supporting calculations to Spokane
County for review, and shall receive acceptance as part of the plan review
process prior to site disturbance. The TESC major structures (such as silt
ponds, silt traps) are to be installed prior to other site work and the TESC
measures are to be implemented and maintained throughout the duration of
construction, including house construction.
9. If the project is phased and one phase depends on another phase for access
and/or drainage treatment and disposal, the prior phase shall be completed
and certified prior to the submittal of plans for the dependent phase of the
development. One foot no access strips on public roads will not be released
until the subject phase is completed, certified and accepted by Spokane
County for maintenance. No access through a non certified and non-
accepted phase of the development may be allowed and no plans will be
accepted by Spokane County for construction unless the prior phase is
completed and certified by the Sponsor's Engineer.
10. Any portion of the drainage system that lies outside of the public right-of-way
will neither be maintained nor operated by Spokane County forces. Prior to
plan acceptance by the County Engineer, the Sponsor shall provide a
mechanism, acceptable to the County Engineer, for the perpetual
maintenance of the stormwater drainage system.
11. As per Section 9.14.080 of the Spokane County Code, no person shall
construct a road or other facilities within the existing proposed, or future
public right-of-way, or the private road easement in connection with the
actions enumerated in Section 9.14.020 without out first having received a
permit as specified in Section 9.14.070(1) for such facilities from the County
Engineer. Said permit will not be granted until the plans for the development
have been accepted by the County Engineer. If this provision is violated, the

County Engineer may decide to not accept a bond for the improvements and
may require the project sponsor to build and certify the facilities priar to final
plat.
12. This proposed subdivision or development proposal is located within a
drainage basin which has been identified by the Spokane County Engineer's
and Utilities offices as having stormwater runoff problems. Since this
proposed subdivision or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the
planning and implementation of a future basinwide stormwater management
system. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be
fixed through public hearings for service or benefit obtained by the planning,
design, constructing, maintaining or operation of stormwater control facilities."

The purpose of this project is to evaluate the encroachment of an existing sewer
~ manhole and its proposed stability fill. The project is located on 15th Avenue
between Havana and Camahan within and existing natural drainage way and
consists of placement of structural fill with scour protection. Our proposed
~ solution to the ProPosed encroachnlent is to enlarge the channel to comPensate
for the uifill. We feel the shaping and removal of existing fill on the east ban.k
will provide better flow characteristics to the channel and thus eliminate any rise
in the 100 yr. flood flow elevation.

Dear Gary,
Thank you for your letter of response to our letter dated April 3, 2000. This letter will act as our
response to the above referenced letter. For clarity, we will respond to each item in the order of
appearance in your letter.
1. We acknowledge that historical upstream drainage is crossing Mr. Shuler's property and that
portions of his property lie within a 100-year flood zone. We also acknowledge Mr. Shuler's
responsibility to consider the 100-year historic runoff in any proposed design. We also
acknowledge his responsibility to obtain a floodplain development permit for any work
required to transmit and dispose of his additional runoff generated by the development of his
property. However, as a point of clarification, the enhancements to the existing drainage
channel, the enhancements to the existing pond, and the construction of the disposal facility
to be located south or west of the Alcott School all lie within the 100-year floodplain and
those improvements will obviously encroach into said floodplain. However, we also
acknowledge Mr. Shuler's responsibility to not interfere with the safe conveyance of said
upstream historic runoff and agree that he must process all improvement plans through
Spokane County for proper permits and approvals. .
2. The intent of Item #2 of our Apri13, 20001etter was to clarify how to meet the ordinance, not
to avoid meeting the ordinance. What we had tried to accomplish in said letter was to outline
the methodology to meet the ordinance as discussed in our meeting of March 30, and as
stated in our April 37 2000 letter, then this groundwater (or potential groundwater)
needs to be acddressed in accordance with adopted Spokacne County ordinances." Grant

7. SERVIENT ESTATE, BINDING EFFECT AND RUNNIlVG WITH THE LAND: Tfiis
easement created and granted herein shall be binding upon the owner, successors and
assigaees of Grantor and said eassment shali run with the land.
8. MAINTENANCE OBLIGATION: Following construction by Grantor ROCKY TOP
LLC., Grantee SOUTH TERR.ACE HOMEOWNERS ASSOCIATION shall have the
obligation of replacing, grading, maintaining and repairing as may be necessary. The
drain pipe and structures to be installed on, over a.nd under the easement property.
Such maintenance shall be in a manner as to not disturb the Qondition of Grantor's
property, provided Grantor shall not be entitled to impede the easement property or
conshuct any improvements or obstructions which will inierfere with Grantee's ability to
gain aocess for maintenance and repair of the drain pipe.
South Terrace Homeowners' Association agrees to provide all maintenance of the
drainpige in the easement which drain pipe shall be maintained in good condition with all
breaks or failures repaired immediately. Maintenance and repair of such drainage
facilities shall be pursuant to that certain maintenance manual prepared for purpose of
such maintenance, which is currendy on file at Spokane County Engineer's office under
file number F-0045.

South Terrace Homeowners' Associadon agrees to notify the one call system (Inland
Empire Utility Co-coordinating Council) of the earistence of any drainage pipe installed in
the drainage easement and the name and person to oontact for location and emergencies.
The Association shall also provide Spokane County with a name, address and phone
number of a person responsible for maintenance on an annual basis.
No additional storm drainage may be directed to this drainage facility other than what has
been shown on the approved 16hstreet improvement plans without written permission
from the Spokane County Engineer.
The Drainage Easement described hereinabove is to and shall run with the land. No
modification of the boundaries of said Easement can be made without the proper
approval of Spokane County.
Spokane County does not accept the responsibility of maintaining any dminage
whatsoever, including but not limited to inverse condemnation to any properties due to
deficient oonstruction and/or maintenance of drainage oowses in Drainage easements on
private property.
A 15t' avenue Private road portion of access shall be constructed in accordance with
plans submitted and approved by Spokane Couaty providing drainage pond and outlet
facilities access.
Following construction of the private road by MDS SHLTLER, INC., county credit letter
number LC048, Grantee SOUTH TERRACE HOMEWONERS' ASSOCIATION shall
have the exclusive obligation of mainiaining and repairing the 15th Avenue private road.
Whenever the South Terrace Homeowner's Association and/or the individual lot owners
or their successors interest fail to maintain the drainage and/or the private road, a notice
will be given to the individual lot owners or their successors interest by the County. If
not conected after ten (10) days, the County has the right to correct the maintenance
failure or to have it corrected at the expenses of the individual lot owners or their
successors in interest.
9. INDEIVIlVII'Y: Grantee shall indemnify and hold Grantor harmless from and against

reference incorporated herein.
6. BENEFICIAL INTEREST: The easement herein created is for the benefit of Grantee to be
used for storm water drainage and for access thereto for purposes of maintenance and'repair,
as necessary. The easement may be utilized by the HOMEOWNERS' ASSOCIATION for
the various property owners as necessary. But no such use shall interfere with the ability of
the drainage channel to convey storm water across the property which is legally described on
the attached Exhibit "A" legal description and Exlu'bit "B" legal map.
7. SERVIENT ESTATE, BINDING EFFECT AND Ri:WUNG WITH THE LAND: This
easement created and granted herein shall be binding upon the owners, successors and assigns

South Terrace Homeowner's Association agrees to provide all maintenance of the storm water
channel system in the easement, which shall be maintained in good condition with all breaks
or failures to be repaired immediately. Maintenance and repair of such drainage facilities
shall be pursuant to the approved plans and to that certain mai.ntenance manual prepared for

I talked to Mike Shular about the IOC. He talked to his attomey and Boyd Rood and I went through the IOC
ordinance, and we are all (I think) of the same opinion that it does not apply to a plat map recorded in 1908. Let
ma outline the reasons I am aware of: 1) Under section 4. DEFiNITIONS which defines a develoment or development proposal nowhere does it
mention a plat alteration (which is a reconfiguration of existing lot lines isn't it?) hypothetically speaking if it
were found in a court of law that it does apply to a plat aiteration, then wouldn't it also have to apply to lot line
adjustments?
2) Under section D. HIGH RISK DRAINAGE PROBLEM AREA Subsection 1. we are meeting the criteria
that the historic runoff shall be maintained by use of the infiltration ponds. No developed runoff is going to leave
this site that was the whole premise of the concept drainage plan, that not only are we handling Shular
developed properties on Shular's downstream property, but we are also reducing or holding the historic upstream
Q100 on-site or delivering o the outlet at 8th and Havana in it's historic Q100 outlet rate via the 42" box culvert
(even though this was a secondardy outlet).
3) Also Section D Subsection 1-- We (Mike Shular, Lynn Sampson, Boyd and myselfl thought the resolution
from the meeting we had with Gary Oberg, Bruce Rawls, Bill Johns, Brenda Simms, yourself etc. etc. on March
30 met the last sentence of this subsection in that the County Director of Utilities and the County Engineer were
booth in agreement that the infiltration of the developed and undeveloped Q100 on Shular's property was
acceptable as long as the developed Q was not permitted to be transported downstream. Do we need another
meeting with everyone to clarify this point? Please advise
