RELEASE OF CLAIMS
THIS RELEASECLAIMS document, made and entered
into this // day of �Jigpid/12 y , 198 . by Wolfland,
Inc. , a Washington corporation , having offices at South 717
Pines Road, Spokane , Washington 99206 , hereinafter referred
to as the "Developer . "
WITNESSETH :
WHEREAS, pursuant to the provisions of RCW Section
36 . 32.120 (6) , the Board of County Commissioners of Spokane
County has the care of County property and the management of
County funds and business; and
WHEREAS, pursuant to the provisions of RCW Section
36 . 32.120 (8) , the Board of County Commissioners of Spokane
County has the power to compound and release in whole or in
part any debt due the County when in their opinion the
interests of the County will not be prejudiced thereby; and
WHEREAS, pursuant to the provisions of RCW Chapter
19. 27, the Board of County Commissioners of Spokane County
has created a Building & Safety Department, which department
is in part responsible for the administration and enforce-
- ment of the-Uniform Building Code; and
WHEREAS, pursuant to the provisions of RCW Chapter
36 . 70, the Board of County Commissioners of Spokane County ,
has adopted a zoning ordinance, which ordinance among other
items , regulates set backs in conjunction with the issuance
of building permits ; and
WHEREAS, Wolfland, Inc. is the owner of two parcels
of property located within Spokane County, at North 1208-10
and North 1204-06 Van Marter , which parcels of property have
structures located thereon , not in conformance with the pro-
visions of the Spokane County Zoning Ordinance regulating
front , side and rear yards , namely Section 4. 05 . 110 ; and
WHEREAS, Wolfland , Inc. has indicated that building
permits , in their opinion , were issued by the Spokane
County Building & Safety Department for structures located
at North 1204-06 Van Marter and North 1208-10 Van Marter
inconsistent with the provisions of the Spokane County
Zoning Ordinance regulating front and side yard setbacks;
and
WHEREAS , for and in consideration of Spokane County
not requiring Wolffland , Inc . to process "Waiver of
Violations , " for the structures located at North 1204-06 Van
Marter and North 1208-10 Van Marter for not meeting the side
and front as well as front yard setbacks respectively as
required by the Spokane County Zoning Ordinance, Wolf land,
Inc. agrees to release Spokane County from any and all
claims which they may have against the same for allegedly
improper issuing building permits for such structures in-
consistent with provisions of the Spokane County Zoning
Ordinance;
NOW, THEREFORE, for and in consideration of Spokane
County through the Spokane County Planning Department not
requiring Wolf land, Inc. , to process "Waiver of Violations"
pursuant to Spokane County Code Section 4. 25.030 (f ) for the
structures located at North 1204-06 Van Marter and North
1208-10 Van Marter inasmuch as the structures located
thereon do not meet the front and side yard as well as front
yard setbacks respectively as required under Spokane County
Zoning Ordinance, Wolfland, Inc. , its successors, heirs and
assigns, hereby release and forever discharge Spokane
County, a political subdivision, their officers , agents and
employees, their successors and assigns, and any and all
other persons, firms or corporations, whether herein named
or referred to, and their respective heirs , legal repre-
sentatives , successors and assigns of and from any and all
claims , demands , and causes of action, damages , costs ,
expenses, compensation, attorneys ' fees , personal injuries ,
property damage, loss and use of inconvenience of said pro-
perty, diminished property value, mental and emotional dis-
tress , and all other claims or damages of any kind
whatsoever arising out of or connected with directly or
indirectly any alleged damages arising out of Spokane County
issuing building permits for those structures located at
North 1204-06 Van Marter , and 1208-10 Van Marter incon-
sistent with the setback requirements set forth in the
Spokane County Zoning Ordinance.
This release covers properties owned by the Devel-
oper at North 1204-06 Van Marter and North 1208-10 Van
Marter, which shall constitute a sufficient legal descrip-
tion of said property.
It is expressly agreed and understood that this
release is not to be construed as an admission on the part
of Spokane County of any liability whatsoever in connection
with the construction on the above referenced properties of
any structures inconsistent with the provisions of Spokane
County Zoning Ordinance, but is in compromise and settlement
of a claim which is disputed by the County.
This release shall forever settle, adjust and dis-
charge all claims of Wolf land , Inc. , its officers, agents
and employees as well as future owners of the parcels of
property referred to herein and no further causes of action
or claims shall be asserted in any form whatsoever as a
result of the negligence of Spokane County issuing building
permits for structures located on the above described pro-
perties inconsistent with the setback requirements within
the Spokane County Zoning Ordinance.
The undersigned declares that he has read the
above, had the opportunity to obtain the advice of counsel,
and that he understands and agrees to the provisions herein
stated. The undersigned further declares that this release
shall be binding upon his heirs , personal representatives
and assigns , and all subsequent purchasers of the above
described properties .
