SPOKANE COUNTY HEARING EXAMINER COMMITTEE FINDINGS OF FACT, CONCLUSIONS AND ORDER INTRODUCTION This matter has come before the Hearing Examiner Committee on January 25, 1996. The members of the Committee present are: Frank Yuse, Chair, Donald Moore and Brenda Bodenstein. PROPOSAL The sponsor, Jimmie Bates/Erwin Wiley, requests approval.of a Preliminary Plat, PE-1788-95 of Adams Court to subdivide approximately 2.1 acres into 71ots for single family residences aad those uses allowed in the existing Urban Residential-3.5 (UR-3.5) zone. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located north of and adjacent to 12th Avenue, between Warren Road and Adams Road in the SW 1/4 of Section 23, Township 25 North, Range 44 EWM, Spokane Counry, Washington. 2. The Committee adopts the Division of Building and Planning Report as a part of this record. 3. The existing land uses in the area include single family residences and duplexes: 4. The proposed use is compatible with existing uses in the area. 5. The Comprehensive Plan category of the subject property is Urban. The Urban (U) category is intended to provide the opportuniry for development of a"ciry-like" environment which includes various land uses, intensive residential development and public facilities and services (water, sanitary and storm sewer lines, police and fire protection and other features). Residential net densities are suggested to range from 1 to 17 dwelling units per acre in the Urban category. The proposed density of 3.3 dwelling units per acre is consistent with the density range suggested by the Urban Category of the Comprehensive Plan. The preliminary plat may be defined as "in-fill" development in an area served by public facilities. 6. The existing zoning does implement and conform to the Comprehensive Plan. 7. Adams Road is identified on the Spokane County Arterial Road Plan as a Minor Arterial with a future Right of Way (ROW) width of 80 feet. The -existing Adams Road ROW width is 50 feet. To implement the Arterial Road Plan, County Engineering has required that a strip of property 10 feet in width along Adams Road be set aside as a Future Acquisition Area (FAA). 8. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5) previously established as Agricultural (A) zoning in 1942 , and redesignated to Urban Residential-3.5 (UR-3.5) on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW . 58.17.195 the proposal does conform to the requirements of the existing zone. 9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance (DNS) was issued. The Committee, after independent review, hereby adopts the DNS. 10. The legal requirements for public notice have been fulfilled. 11. The owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 12. The proposed use will not be detrimental to the public health, safety, morals or welfare especially in light of the conditions recommended by the reviewing agencies. 13. The subd.ivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane Counry. The proposal as conditioned does provide adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces b. drainage ways c. public andlor private rights-of-way d . transit e. potable water f. sanitary waste disposal g. parks and recreation facilities h. playgrounds i. schools and schoolgrounds - j . sidewalks The above improvements are either elcisting facilities or wi11 be provided by the applicant upon finalizadon of this subdivision as conditioned by the Conunittee and implemented by the various County agencies. 14. The Committee additionally finds/concludes: a. The applicant agrees with and accepts all the recommended conditions of -approval. b. Applicant agrees to voluntary mitigation with the Central Va11ey School - District. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be bind.ing on . the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The conditions of approval apply to the preliminary subdivision of record. HEC Order for PE-1788-95 Page 2 SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING 1. The proposal shall comply with the Urban Residentia13.5 (UR-3.5) zone, as amended. 2. The final plat shall be designed substantially in conformance with the prelirninary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 3. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 4. A final plat name/number shall be indicated before the final plat is filed, such name/number to be approved by the Planning Director/designee. 5. Appropriate road name(s) shall be indicated. 6. The preliminary plat is given conditional approval for five (5) years, specifically to Febr,ua .ry..lo;M-OO 1~The applicant may request an extension of time by submitting a w0roMen request approximately forty-five (45) days prior to the above expiration date. 7. Appropriate utiliry easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility comparues shall be . received with the submittal of the final plat. . 8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, or public roads. The dedication shall contain the following statement: P "I~de yard and rear yard setbacks shall be determined at the time building permits . ~,e requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are ' tained." 9. Three (3) current certificates of title shall be furnished to the Spokane County Division of Building and Planning prior to filing the final plat. 10. Prior to filing of all or a portion of the final plat, the applicant's surveyor shall submit one or more maps outlined in red of the area-being finalized. The scale shall match the appropriate assessor's map scale. 11. The Spokane County Division of Building and Planning shall prepare and record with the County Auditor a Tiae Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Division of Building and Planning. The notice should be recorded within the same time frame as an appeal aad shall provide the following: a. At least 10 feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing and/or newly dedicated right-of-way along Adams Road. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. HEC Order for PE-1788-95 Page 3 c. No required landscaping, parking, 208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. 12. At the time of final plat submittal, the applicant shall demonstrate either on the face of the final plat or on an acceptable attachment that all lots located on a cul-de-sac or curvilinear street meet or exceed the minimum required frontage. 13. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate- fire protection d.istrict, Division of Building and Planning and Counry Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat/binding site plan, that the plan is in conformance with their respective needs and regulations. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 14. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate . health authorities prior to application for build.ing permits within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 15. The final plat dedication shall contain the following statement: "T~h~e public water system, pursuant to the Water Plan approved by counry and state d hMcealth authorities, the local fire protection district, Division of Build.ing an ~P''l~anrung and water purveyor, sha11 be installed within this subdivision or binding L'ite, plan, and the applicant shall provide for individual domestic water service as vell as fue protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." 0 16. No building permit will be issued for any lot within the final plat until certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat," including a signed license stamp. The certification may be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. The Water Plan and the above four (4) conditions of approval regarding the Water Plan may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protection district stating that simple connections to an existing, approved water system will provide adequate domestic = and fire protection water to ensure the public health, safety and general welfare. 18. A survey is required prior to the filing of a final plat. SPOKANE COUNTY DIVISION OF ENGINEERING 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. Plans, pro~les, and cross-sections as designed to County standards showing proposed street centerline and curb grades shall be submitted to the Counry Engineer for - acceptance prior to construction and/or the fiiing of each final plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. Drainage plans and design calculations showing the alignment of drainage facilities _ shall be submitted to the County Engineer for approval prior to construction and/or the filing of the final plat. *Drainage plans ta be prepared under the direction of a licensed Professional Civil Engineer. 4. Construction within the proposed public streets and easements shall be performed under the direct supervision of a licensed engineer/surveyor, who shall furnish the County Engineer with "as-built" plans and a certificate in writing that a11 improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed mohuments have been replaced. 5. No construction work is to be performed within the existing or proposed public . right-of-way until a pernut has been issued by the County Engineer. All work is . subject to inspection and approval by the County Engineer. 6. All construction within the existing or proposed public right-of-way is to be completed prior to filing each final plat, or a bond in the amount estimated by the County Engineer to cover the cost of construcdon of improvements, construction certification, "as-built" plans and monumenting the street centerlines shall be filed - with the County Engineer. . 7. Individual driveway access pernuts are required prior to issuance of a build.ing . pe 't for driveway approaches to the county road system. 8. A s atement shall be placed in plat dedication that no direct access be allowed from 1. ts to Adams Road and Warren Road. 9. Sidewalks are required along the arterial(s) on Adams Road. 10. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 11. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition HEC Order for PE-1788-95 Page 5 or resolution which purpose is the formation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane Counry, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Adams Road and Warren Road. 12. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the _ improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Adams Road and Warren Road. 13. The following statement shall be placed in the plat dedication: That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and successors in interest hereby request and authorize Spoken Counry to include the above described property in a Road Improvement District (RID) and to support the formation of a Road Improvement District (RID) for the improvement of the roads described below by requesting and authorizing Spokane County to place their names on a petition for the fonnation of a Road Improvement District (RID) pursuant to Chapter 36.88.050 RCW, or by requesting and authorizing Spokane County to cast their ballot in factor of a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being formed under the altemative r-esolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. If a RID is proposed for improvement of the roads described below, said owners and successors further agree: • (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any Counry participation, exceed the cost and expense of formation of the RID; and (c) that the properry within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property . as a result of the improvements called for in conjunction with the formation of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do not exceed a figure equal to the increased true and fair value improvements adds to the property. HEC Order for PE-1788-95 , Page 6 It is further agreed that at such time as an RID is created or any Road Improvement Project is authorized by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) shall be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns within the RID or served by the improvements without any monetary participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. This provision is applicable to Adams Road and Warren Road. 14. The County Engineer has designated a Minor Arterial Roadway Section for the improvement of Adams Road, which is adjacent to the proposed development. This will require the addition of approximately 12.5 - 14.5 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 15. The County Engineer has designated a Local Access Roadway Section for the improvement of 12th Avenue, which is adjacent to the proposed development. This will require the addition of approximately 5- 7 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 16. The County Engineer has designated a Local Access Roadway Section for the improvement of Warren Road, which is adjacent to the proposed development. This will require the addition of approximately 27 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk on one side is also required. 17. Private road(s) shall be improved to Spokane County standard for a private road . standard serving 7- 20 lots. 18. All vested owners shall sign and record private road documents as prescribed by the Spokane County Engineer. These documents shall be reviewed and approved by . the Spokane County Engineer prior to recording with the Spokane County Auditor. Recording numbers shall be referenced in the dedlcatory language of the plat. 19. The following statement shall be placed in the plat dedication: v "WARNING: Spokane County has no responsibility to build, improve, maintain - or otherwise service the private roads contained within or provide service to the property described in this plat. By accepting this plat or subsequently by allowing a - building pernut to be issued on property on a private road, Spokane County assumes no obligation for said private road, and the owners hereby acknowledge ~`t'gat the County has no obligation of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain or provide drainage or snow removal on a private road. This requirement is and shall run with the land and shall be binding upon the owner(s), their heirs, successors or assigns, includ.ing the obligation to participate in the maintenance of the private road as provided herein." 20. The proposed subdivision shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 95-0498, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway improvements herein specified. 22. ~~he following statement shall be placed in the final plat dedication: "The private .road as shown hereon is an easement which provides a means of ingress and egress 'for those lots within the subdivision having frontage thereon." 23. 4 The County Arterial Road Plan identifies Adams Road as a 80 foot Minor Arterial The existing right-of-way width of 50 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required - right-of-way dedication, a strip of property 10 feet in width along the Adams Road frontage shall be set aside in reserve. This property may be acquired by Spokane Counry at the time when arterial improvements are made to Adams Road. 24. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to determine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 25. The applicaat shall grant applicable border easements adjacent to Spokane County right of way per Spokane County Standards. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction-related activities. 3. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress, parking areas, access roads) be paved and kept clean to minimize dust enussions. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. Debris generated as a result of this project must be disposed of by means other than burning (i.e., construction waste, etc.). 6. All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with local, state, and federal rules and regulations. . HEC Order for PE-1788-95 Page 8 CENTRAL VALLEY SCHOOL DISTRICT NO. 356 1. The owner shall negotiate with Central Valley School District and submit a recorded copy of a voluntary agreement making provisions for public schools prior to finalization and recording of the plat. The agreement shall provide a wntten description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mitigating measures. The owner shall also notify any potential purchasers who have made an agreement to purchase property within said plat pursuant to the Revised Code of Washington (RCW) 58.17.205, that adequate provisions for school facilities must be made conditioned on a future agreement between the plattor and school district. Voluntary agreements between the owner and school district shall conform to the requirements of RCW Chapter 82.02. SPOKANE COUNTY HEALTH DISTRICT 1. The final plat shall be designed as indicated on the preliminary plat of record andlor any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Division of Building and Planning to the utility companies, Spokane Counry engineer and the Spokane Counry Health District. Written approval of the easements by the utiliry companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an e3cisting public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that an adequate and potable water supply is available to each tract of the plat. 7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 8. A plan for water facilities adequate for domestic use, domestic irrigation use and fire protection use shall be approved by the water purveyor. Said water plan must have been approved by the fire protection district and the appropriate health authorities. The health authorities, water supplier (purveyor) and the fire protection district will certify, prior to the filing of the final plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. HEC Order for PE-1788-95 Page 9 S 9. The purveyor will also certify prior to filing the final plat on a copy of said water plan that appropriate contractual arrangements have been made with the plat sponsor for construction of the water system, in accordance with the approved plan and time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the plat. The contractual arrangements will include a provision holding Spokane County, Spokane County Health District and the purveyor harmless from claims by any tract purchaser refused a building permit due to failure of the plat sponsor to satisfactorily complete the approved water system. 10. Prior to filing the final plat, the sponsor sha11 demonstrate to the satisfaccion of the Spokane County Health District that suitable sites for on-site sewage disposal systems are available on a111ots. 11. Priar to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that the existing system serving the residence located on lot 4 is wholly located within the boundaries of the lot or replaced within the boundaries of lot 4. 12. Subject to specific application approval and issuance of pernuts by the health officer, the use of individual on-site sewage disposal systems may be authorized. Alternative sewage disposal systems or connection to the public sewer system will be required. 13. The dedicatory language of the plat will state: "5ubject to specific application approval and issuance of permits by the Health Off'icer, the use of individual on-site sewage systems may be authorized." The dedicatory language on the plat shall state: "Use of private wells and water ~systems is prohibited." 15. GENERAL INFORMATION Applicant: Jimmie W. Proposal: Preliminary plat to subdivide approximately 2.1 acres into seven lots for single family residences and those uses allowed in the existing Urban Residential-3.5 (UR 3.5) zone. II. SITE INFORMATION A. Site Size: Approximately 2.1 acres Gross Density: 3.33 dwelling units per acre B. Comprehensive Plan 1. The Comprehensive Plan category of the subject property is Urban. The Urban (U) category is intended to provide the opportunity for development of a"city-like" environment which includes various land uses, intensive residential development and public facilities and services (water, sanitary and storm sewer lines, police and fue protecdon and other features). Residential net densities are suggested to range from 1 to 17 dwelling units per acre in the Urban category. The proposed density of 3.3 dwelling 1/96 HEC Staff Report for PE-1788-95 Page 20 t ~ units/acre is consistent with the density range suggested by the Urban Category of the Comprehensive Plan. The ,preliminary plat may be defined as "in-fill" development in an area served by public facilities. 2. Arterial Road Plan: The subject property is located on 12th Avenue, between Warren and Adams Roads. Adams Road is identified on the Spokane County Arterial Road Plan as a Minor Arterial with a future Right of Way (ROV) width of 80 feet. The existing Adams Road ROW width is 50 feet. To implement the Arterial Road Plan, County Engineering has required that a strip of property 10 feet in width along Adams Road be set aside as a Future Acquisition Area (FAA). 3. County Parks Plan: Terrace View Park is less than 2 miles southwest of the subject property and is the County Pazk closest to the subject property. The park offers a pool, play structures, shelters with barbecues, picnic tables, and restrooms and parking for 100 cars. C. Site Characteristics: The site is level and is developed with a single family residence and two accessory structures. Site vegetation includes numerous deciduous trees. D. Neighborhood Characteristics: The neighborhood in the vicinity of the subject property is made up of single family homes and duplexes and is on a slight rise that overlooks the valley below. All the surrounding property has been developed. The subject property is 1/4 mile south of Adams Elementary School and 3/4 of a mile west of Central Valley High School. E. Zoning Analysis: The subject property and adjoining areas to the north, south, east and west are all zoned Urban Residentia13.5 (UR 3.5). Prior to implementation of the Spokane Counry Zoning Code on January 1, 1991, the subject property and adjacent properties were zoned Agricultural and Agricultural Suburban. Proposal: Urban Residential-3.5 (UR-3.5) established in 1991, previously established as Agricultural (A) in 1942 (60-42). North: Urban Residential-3.5 (UR-3.5) established in 1991, previously established as Agricultural (A) in 1942 (60-42). South: Urban Residential-3.5 (UR-3.5) established in 1991, previously established as Agricultural (A) in 1942 (60-42). East: Urban Residential-3.5 (UR-3.5) established in 1991, previously established as Agricultural (A) in 1942 (60-42). West: Urban Residential-3.5 (UR-3.5) established in 1991, previously established as Agricultural Suburban (AS) in 1956 (293-56). F. Land Use Analysis: The subdivision proposal is surrounded by single family detached residences and duplexes. Lot sizes in the vicinity of the proposal range from 12,000 square feet to several acres. The proposed density is consistent with existing densities and the proposal is consistent with existing land uses in the area. Site: Single family residence and accessory structures. 1/96 HEC Staff Report for PE-1788-95 Page 21 r 7 North: Duplexes. South: Single family residences. East: Single family residences. West: Single family residences and duplexes. G. Circulation: The preliminary plat illustrates a 24 foot wide private road, which terminates in a cul-de-sac, to access all seven lots of the subdivision. Direct access to either Warren Road or Adams Road is not allowed. H. Design / Preliminary Plat: The preliminary plat shows seven lots and three existing buildings accessed by a private road terminating in a cul de sac. One building each will remain on Lots 3 and 4 and a second building on Lot 3 will be removed. The average net lot size (less the road) of the proposal is 11,444 square feet. The preliminary plat design meets the minimum frontage and lot size requirements of the existing Urban Residential-3.5 (UR-3.5) zone. Because access to the lots will be by private road easement, the actual building envelope of each lot will be generally smaller than existing lots in the area. I. Drainage: A drainage plan is required. This plan must be reviewed and approved by the Division of Engineering prior to development. J. Power Transmission Lines/Other Known Easements: None known. K. Water Supply: The proposal is served by Vera Water and Power. A water plan and specific provisions for water service shall be completed prior to finalization of the preliminary plat. L. Sewage Disposal: An on-site septic system is proposed for sewage disposal subject to approval by the Spokane County Health District. The project is located within the Priority Sewer Service Area (PSSA). Alternative sewage disposal systems or connection to the public sewer system will be required. M. School: The proposal is in the Central Va11ey School District No. 356. The Central Valley School District has responded to the proposal and has indicated " that existing facilities are inadequate to accommodate additional students. The school district has requested the applicant be required to negotiate a voluntary agreement to mitigate the impacts of the proposal on the school district and existing facilities. This request is included as a recommended condition of approval. . N. Fire Protection: The proposal is within Fire District No. 1. The Fire District and the Division of Building and Planning (Fire Marshall) are required to approve fire protection provisions prior to finalizing the preliminary plat. 0. CulturalResources: None have been identified. P. Parks and Recreation: No comments have been received. Q. Wetlands: No wetlands are shown on the Spokane County Wetlands Inventory Maps. 1/96 HEC Staff Report for PE-1788-95 Page 22 w III. ENVIRONMENTAL REVIEW: An Environmental Checklist was submitted by the sponsor and was reviewed by the Division of Building and Planning. The review considered t11e specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Division of Building and Planning has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of Nonsignificance ("DNS"). The "DNS" was circulated to 13 other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment. The "DNS" comment period ends January 23, 1996 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner may consider additional environmental related testimony at the public hearing. I V. DIVISION OF BUILDING AND PLANNING SUMMARY The preliminary plat is consistent with the existing Urban Residential-3.5 (UR-3.5) zoning of the property and will implement the Goals, Objectives and Decision Guidelines of the Urban Category of the Spokane County Comprehensive Plan. The proposal is also consistent with existing adjacent land uses and densities in the area. The Division of Building and Planning recommends approval of the preliminary plat, as conditioned. V . CONDITIONS OF APPROVAL i. All conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant", which terms shall include the owner or owners of the property, heirs, assigns and successors. i i. The conditions of approval apply to the preliminary subdivision of record. SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING 1. The proposal shall comply with the Urban Residentia13.5 (UR-3.5) zone, as amended. 2. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 3. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 4. A final plat name/number shall be indicated before the final plat is filed, such name/number to be approved by the Planning Director/designee. 1/96 HEC Staff Report for PE-1788-95 Page 23 . i 5. Appropriate road name(s) sha11 be indicated. 6. The preliminary plat is given conditional approval for five (5) years, specifically to February 1, 2001. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiration date. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utiliry easements by appropriate utility companies shall be received with the submittal of the final plat. 8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." . 9. Three (3) current certificates of title shall be furnished to the Spokane Counry Division of Building and Planning prior to filing the final plat. 10. Prior to filing of all or a portion of the final plat, the applicant's surveyor shall submit one or more maps outlined in red of the area being finalized. The scale shall match the appropriate assessor's map scale. 11. The Spokane County Planning Department shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Planning Department. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 10 feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing andJor newly dedicated right-of-way along Adams Road. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located withi.n the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acqui.red, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. 1/96 HEC Staff Report for PE-1788-95 Page 24 . e e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. 12. At the time of final plat submittal, the applicant shall demonstrate either on the face of the final plat or on an acceptable attachment that all lots located on a cul-de-sac or curvilinear street meet or exceed the minimum required frontage. 13. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Btulding & Safety Department and County Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat/binding site plan, that the plan is in conformance with their respective needs and regulations. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 14. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building pernut due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 15. The final plat dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Building & Safety Department and water purveyor, shall be installed within this subdivision or binding site plan, and the applicant shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." 16. No building permit will be issued for any lot within the final plat until certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat," including a signed license stamp. The certification may be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. 17. The Water Plan and the above four (4) conditions of approval regarding the Water Plan may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protection district stating that simple connections to an existing, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 18. A survey is required prior to the filing of a final plat. 1/96 HEC Staff Report for PE-1788-95 Page 25 ~ SPOKANE COUNTY DIVISIUN OF ENGINEERING 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. Plans, profiles, and cross-sections as designed to County standards showing proposed street centerline and curb grades shall be submitted to the County Engineer for acceptance prior to construction andlor the filing of each final plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. Drainage plans and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for approval prior to construction andlor the filing of the final plat. Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 4. Construction within the proposed public streets and easements shall be performed under the direct supervision of a licensed engineer/surveyor, who shall furnish the County Engineer with "as-built" plans and a certificate in writing that all -improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 5. No construction work is to be performed within the existing or proposed public right-of-way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 6. A11 construction within the e3cisting or proposed public right-of-way is to be completed prior to filing each final plat, or a bond in the amount estimated by the Counry Engineer to cover the cost of construction of improvements, construction certification, "as-built" plans and monumenting the street centerlines shall be filed with the County Engineer. 7. Individual driveway access pernuts are required prior to issuance of a building permit for driveway approaches to the county road system. 8. A statement shall be placed in plat dedication that no direct access be allowed from lots to Adams Road and Warren Road. 9. Sidewalks are required along the arterial(s) on Adams Road. 10. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 11. To construct the road improvements stated herein, the applicant may, with the approval of the Counry Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane Counry, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Adams Road and Warren Road. 1/96 HEC Staff Report for PE-1788-95 Page 26 ~ 12. As an alternative methad of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Adams Road and Warren Road. 13. The following statement shall be placed in the plat dedication: That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and successors in interest hereby request and authorize Spoken County to include the above described property in a Road Improvement District (RID) and to support the formation of a Road Improvement District (RID) for the improvement of the roads described below by requesting and authorizing Spokane County to place their names on a petition for the formation of a Road Improvement District (RID) pursuant to Chapter 36.88.050 RCW, or by requesting and authorizing Spokane County to cast their ballot in factor of a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being formed under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. If a RID is proposed for improvement of the roads described below, said owners and successors further agree: (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do not exceed a figure equal to the increased true and fair value improvements adds to the property. It is further agreed that at such time as an RID is created or any Road Improvement Project is authorized by Spokane County, the improvements required (curb, . sidewalk, drainage control and paving) shall be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns within the RID or served by the improvements without any monetary participation by Spokane County. 1/96 HEC Staff Report for PE-1788-95 Page 27 The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. This provision is applicable to Adams Road and Warren Road. 14. The Counry Engineer has designated a Minor Arterial Roadway Section for the improvement of Adams Road, which is adjacent to the proposed development. This will require the addition of approximately 12.5 - 14.5 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 15. The County Engineer has designated a Local Access Roadway Section for the improvement of 12th Avenue, which is adjacent to the proposed development. This will require the addition of approximately 5- 7 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 16. The County Engineer has designated a Local Access Roadway Section for the improvement of Warren Road, which is adjacent to the proposed development. This will require the addition of approximately 27 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk on one side is also required. 17. Private road(s) shall be improved to Spokane County standard for a private road standard serving 7 - 201ots. 18. All vested owners shall sign and record private road documents as prescribed by the Spokane County Engineer. These documents shall be reviewed and approved by the Spokane County Engineer prior to recording with the Spokane County Auditor. Recording numbers shall be referenced in the dedicatory language of the plat. 19. The following statement shall be placed in the plat ded.ication: "WARNING: Spokane County has no responsibility to build, improve, maintain or otherwise service the private roads contained within or provide service to the property described in this plat. By accepting this plat or subsequently by allowing a building pernut to be issued on property on a private road, Spokane County _ assumes no obligation for said private road, and the owners hereby acknowledge that the County has no obligation of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain or provide drainage or snow removal on a private road. This requirement is and shall run with the land and shall be bind.ing upon the owner(s), their heirs, successors or assigns, including the obligation to participate in the maintenance of the private road as provided herein." 20. The proposed subdivision shall be improved to the standards set forth in Spokane Counry Board of Commissioners Resolution No. 95-0498, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 21. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway improvements herein specified. 1/96 HEC Staff Report for PE-1788-95 Page 28 ~ . 22. The following statement shall be placed in the final plat dedication:. "The private road as shown hereon is an easement which provides a means of ingress and egress for those lots within the subdivision having frontage thereon." 23. The Counry Arterial Road Plan identifies Adams Road as a 80 foot Minor Arterial The existing right-of-way width of 50 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way dedication, a strip of property 10 feet in width along the Adams Road frontage shall be set aside in reserve. This property may be acquired by Spokane Counry at the time when arterial improvements are made to Adams Road. 24. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to deternune whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. 25. The applicant shall grant applicable border easements adjacent to Spokane County right of way per Spokane County Standards. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction-related activities. 3. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress, parking areas, access roads) be paved and kept clean to minimize dust emissions. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, . measures must be taken immediately to clean these surfaces. 5. Debris generated as a result of this project must be disposed of by means other than burning (i.e., construction waste, etc.). 6. All solid fuel buming devices (wood stoves, pellet stoves, etc...) must comply with local, state, and federal rules and regulations. CENTRAL VALLEY SCHOOL DISTRICT N4. 356 1.
