II. FINDINGS OF FACT AND CONCLUSIONS
The Hearing Examiner has reviewed the preliminary plat application and the evidence of
record and adopts the following findings of fact and conclusions:
A. GENERAL INFORMATION:

Avenue, approximately 200 feet east of Moore Road in the SW '/a of Section 13, Township 25
North, Range 44 EWM, Spokane County, Washington.
Legal Description: The east half of Tract 23, as per plat of Vera; EXCEPT the East 135.00
feet of the South 220.00 feet.
Zoning: Urban Residential-3.5 (LTR-3.5) Comprehensive Plan Category: The property is designated in the Urban category of the
Spokane County Generalized Comprehensive Plan. The subject property is also within the

Environmental Review: A Determination of Nonsignificance was issued by the Division
of Building and Planning on August 30, 1996.
Site Description: The site is approximately four (4) acres in size, and is relatively flat with
native grasses and weeds. There are no structures on the site. The site fronts along the north side
of Valley Way.
Surrounding Conditions: Valleyway Avenue is designated by the Arterial Road Plan as a
70-foot-wide Collector Arterial, while the existing right of way in the vicinity of the site is 40 feet.
Valleyway intersects Sullivan Road at some distance west of the site, and intersects Conklin Road
to the east. Moore Road to the west provides local access between Valleyway and Broadway
Avenue. The land north of the site is vacant and undeveloped, and the property to the south
across Valleyway contains single-family residences. The'property to the east contains single-
family residences and some vacant land, while the property to the west contains single-family
residences. Land uses in the vicinity of the proposal generally consist of single-family residences
on lots ranging from 10,000 square feet to five (5) acres in size. Residential development in the
area has generally occurred in strips along improved county roads, including Valleyway Avenue,
leaving relatively large areas of undeveloped property in the interior areas between roadways.
The nearest public sewer is approximately one-half mile south of the site, at the County's sewer
interceptor located south of Sprague Avenue.
Friske Addition, with frontage on Valleyway Avenue, lies immediately west of the site and was
approved in 1970 for 11 lots on 8.4 acres. Friske 1" Addition, which fronts on Broadway
Avenue, adjoins Friske Addition on the north, and was also approved in 1970 for 11 lots on 8.4
acres. Immediately west of Friske 1' Addirion lies Valleyview Estates, a final plat w!uch was
approved by the Spokane County Hearing Examiner Committee in December, 1993 for 13 single-
family lots on 4.8 acres. Valleyview Estates fronts on Valleyway and is approved for on-site
sewage disposal. To facilitate future connection to the County's general sewerage system, the
developer of Valleyview Estates was required as a condition of approval to install dry line sewers
in the streets of the subdivision, double-plumb all residences and execute a waiver to future
formation of a utility local improvement district (LJLID).
The preliminary plat of Childer's Subdivision (PE-1727-93) lies adjacent to the proposal on the
east, and fronts on Conlclin Road but not on Valleyway. The preliminary plat was approved by
the Board of County Commissioners in August, 1994, for 16 single-family lots on 7.66 acres. The
approval conta.ins a restriction that building pernuts can only be issued for one-half of the lots in
the plat until public sewer became available to the site; with dry lines, double plumbing and a
ULID waiver required for all lots served by on-site sewage disposal. Alki Avenue does not
currently exist east and west of the site, but is a partially or fully platted right of way in Valleyway
Estates, Friske Addition and Friske 1' Addition. Provision is also made in the preliminary plat of
Childer's Subdivision (PE-1727-93) to extend such right ofway all the way east to Conklin Road.
Business uses in the area include the Sullivan Road and the Sprague Avenue commercial
corridors, which offer a wide variety of services. Broadway Avenue and Sullivan Road are the
dividing lines in the area between the Urban and Commercial categories of the Comprehensive
Plan, and between residential and commercial zoning in the area. The land in Friske Addition and

Friske V Addition is zoned Urban Residential-7 (UR-7), while the balance of property in the
immediate vicinity is zoned Urban Residential-3.5 (LTR-3.5).
Project Description: Preliminary plat to subdivide approximately four acres into 11 single-
family lots of 12,500 square feet. The net density of the proposal is 3.3 units per acre. An
unnamed north/south public road would be constructed to serve the interior of the proposal.
County Engineering has requested a 25 foot dedication for Alki Avenue as a future east-west
extension from Friske Addition, and a temporary cul-de-sac is required at the north end of the site
until such time as Alki is improved as a public road. County Engineering has also requested the
applicant to dedicate land and make road improvements along the frontage of the site with
Valleyway Avenue. Individual on-site sewage systems are proposed for the site, with the use of
sand-lined pressure beds mandated by the County Health District. County Utilities has requested
provision for dry line sewers, double-plumbing and a ULID waiver to facilitate future connection
to the County's general sewerage system. Central Valley School District has requested the
applicant to enter into a voluntary impact fee to mitigate the impact of the proposal on the district.

Items Noticed: Spokane County Comprehensive Plan, Zoning Code, County Code,
Comprehensive Wastewater Management Plan 1996 Interim Update, Health District Rules and

C. PRELIMINARY PLAT ANALYSIS:
To be approved, the preliminary plat application must comply with the conditions and
requirements set forth in the Spokane County Subdivision Ordinance, chapter 58.17 RCW, the
Spokane County Zoning Code and other applicable land use regulations. The proposal must also
comply with the requirements of the State Environmental Policy Act and Spokane County's Local
Environmental Ordinance.
The following findings of fact and conclusions are made:
1. The vrovosed preliminarv nlat eenerallv comnlies with the nolicies of the Sookane Countv
Generalized Comprehensive Plan.
The proposal is designated in the Urban category of the Comprehensive Plan. The Urban
category is intended to provide the opportunity for a"citylike" environment, which includes
various land uses, residential development and a high level of public facilities and urban
services. The Urban category recommends a variety of densities and residential uses, including
areas with varying densities, combinations, or mix of uses. The recommended range of
residential densities in the Urban category is 1 to 17 units per acre, which the proposal is
clearly consistent with. The Urban category and the Urban Impact Area encourage "fill-in
development", which is development at urban densities that facilitates the cost-effectiveness of
utilities and other public facilities and services. The proposal clearly implements these policies
of the Urban category.
The Water Quality element of the Comprehensive Plan promotes development in the Urban
category and Priority Sewer Service Area which will create an urbanized environment, one that
most economically and practically supports connection to the regional public sewer system. -
The County Zoning Code, adopted by Spokane County in 1986, includes the Aquifer Sensitive
Area (ASA) Overlay zone at chapter 14.706. The ASA Overlay zone authorizes new
residential development within the PSSA to be served by on-site sewage disposal as long as
provisions are made for dry line sewers, double-plumbing and execution of a ULID waiver for
public sewer. Zoning Code 14.706.100.
On June 11, 1996, pursuant to County Resolution No. 96-0585, Spokane County adopted
the Comprehensive Wastewater Management Plan 1996 Interim Update ("CWMP Update"), as
the County's sewerage general plan required under chapter 36.94 RCW and as an element of
the County's Generalized Comprehensive Plan. The CWNII' Update, in subsection 2.3, adopts
new policies for development in the Priority Sewer Service Area (PSSA). The PSSA was
originally designated in the Comprehensive Plan (adopted in 1981) as an area of the county

which was urban or being urbanized and could feasibly be provided with interceptor sewers by
the early 1990s. CWNiP Update, p. 2-4. FuRher study in the 1990s indicated that the
County's plans for sewering the PSSA were overly optimistic and should be revised. CWMP,
p. 2-4.
The CVVMP Update promotes sewer construction or financial support of public sewering
by the County in the areas of the PSSA which are served by on-site sewage disposal and most
urbanized (i.e. the "goldenrod" and "blue" areas shown on the Capital Improvement Program
Spokane Valley, Exhibit 4-1, CWNT Update). In the remaining area of the PSSA (the "white
area" shown on Exhibit 4-11 CWNT Update), the CWNT Update recommends that the County
not initiate sewer construction but that any unused capacity in the regional treatment plant may
be allocated to projects in such area. CWNT Update, p. 2-8. The current proposal is located
in the "white" area.
The CWNiP Update recognizes that the County is in the process of planning under the
Growth Management Act, and establishing urban growth area boundaries under chapter
36.70A RCW. CWNT Update, p. 2-10. The CWNT Update indicates that the PSSA
boundary should be recognized as the limit for centralized wastewater facilities by Spokane
County, and that any adjustments to the PSSA should be coordinated with the GMA planning
efforts. CWNT Update, p. 2-10. The CWMP Update recommends preserving the existing
PSSA boundary and the on-going land use, sewer requirements and on-site provisions tied to
activities inside or outside the PSSA. CWMP Update, p. 2-8, 3-13 and 3-14. This policy takes .
into consideration the adoption of more stringent treatment and disposal processes for certain
highly porous soil conditions found in the Spokane Va11ey, under chapter 246-272 WAC and
under the 1995 Spokane County Health District Rules and Regulations for On-site Sewage
Systems for Spokane County ("Health District Regulations"). CWNT Update p. 3-12.
Further, under the policies of the CWMP Update, as well as under the ASA Overlay zone and
the Health District Regulations, new development projects within the PSSA must connect to
the County's general sewerage system if available to the site as determined by Spokane
County. CWNT Update, p. 3-13.
The County Health District has classified the soils on the site as Type II soils, which
mandates a minimum lot size of 12,500 square feet for on-site sewage disposal. Health District
Regulations 1.04.170, 1.04.195; Health District memo dated 8-28-96 for PE-1797-96. The -
Health District has required the use of sand-lined pressure beds in the desigi of the individual
on-site sewage systems for the proposal, which are more costly than a conventional gravity
system and provide a higher level of treatment of sewage effluent. See Health District
Regulations 1.04.200, Health District memo. County Utilities has conditioned the proposal for
dry lines, double-plumbing and execution of a ULID waiver.
While the sewer interceptor is about one-half mile south of the site, the area is developing
and there is potential for the County's general sewerage system to become available to the site
through developer extensions. The County Health District has authority to require the
applicant to connect to the County's system if public sewer becomes available to the site, as
determined by Spokane County. Health District Regulations 1.04.090. The Hearing Examiner
has added to the County Utilities conditions of approval a requirement that the site be

connected to public sewer, if public sewer becomes available to the site or as required by
Spokane County or the Health District under applicable regulations. As conditioned, the
proposal is generally consistent with the provisions of the Comprehensive Plan relating to
sanitary waste disposal, including the policies of the CWMP Update and the Water Quality ,
element of the Comprehensive Plan.
The Urban category indicates that new residential developments should be compatible with
nearby development and buffered from existing adjacent land uses where adverse effects may
develop. A number of protest letters regarding the proposal were submitted by residents in the
area, indica.ting concerns with on-site sewage disposal, increased traffic on Moore Road,
turning movements at the intersection of Valleyway and Sullivan Road, and impacts on
schools. Only one resident testified at the public hearing in opposition to the project, citing
inconsistency of the project with the County's GMA planning process and the need for the
project to be served with public sewer. The applicant for the Childer's Subdivision (PE-1727-
93) preliminary plat testified that he was not able to finally plat such proposal because of the
condition imposed by the County that one-half the lots be served by public sewer.
As indicated in the above analysis, there is no basis for the Hearing Examiner to deny the
proposal based on the lack of public sewer availability. The Board of County Commissioners'
decision on the Childer's Subdivision preliminary plat (PE-1727-93) was decided before
adoption of more stringent Health District regulations for on-site sewage disposal and before
adoption of the CWMP 1995 Update. Regarding traffic impacts, the applicant submitted a
Trip Distribution Analysis analyzing the impact of the proposal at the Sullivan Road
/westbound Interstate 90 interchange. The analysis indicated that the proposal would have
negligible impacts on the level of service at such location. County Engineering did not request
the applicant to mitigate traffic impacts at the intersection of Sullivan Road and Valleyway, or
deny access to Moore Road from the proposal via Alki Avenue. No expert testimony was
presented that the intersection of Valleyway and Sullivan was at a failing level of service or that
the capacity of Moore Road as a local access road would be exceeded. The extension of Alki
Avenue between Sullivan Road and Conklin Road, and access onto Moore Avenue from Alki
Avenue, is consistent with the past development approvals in the area.
RCW 36.70A.210 indicates that the county-wide planning policies adopted by Spokane
County under the GMA are to be used solely for establishing a county-wide framework from
which a new comprehensive land use plan is developed and adopted under GMA. RCW
36.70A.020 states that the planning goals set forth in such statute are to be used exclusively to
guide the development and adoption of the comprehensive plan and development regulations
adopted under the GMA. The policies have no regulatory effect until developed into a new
comprehensive plan. Spokane County has not adopted a new comprehensive plan under GMA
and no evidence was presented that the project would violate any regulation adopted by the
County under chapter 36.70A RCW.
Regarding schools, the applicant is required to negotiate and enter into a voluntary
agreement with the Central Valley School District to mitigate the impact of the proposal on
public schools in the area. The proposal is also consistent with other recent development
approved in the area and is generally compatible with adjacent land uses.

2. The provosed oreliminarv olat comolies with the Sookane Countv ZoninR Code and all
applicable land use re."lations.
The proposal as conditioned complies with the maximum density, minimum lot area and other
development standards of the Urban Residential-3.5 (UR-3.5) zone; the County Subdivision
Ordinance and other applicable land use regulations. While the UR-3.5 zone authorizes a
minimum lot area of 10,000 square feet, the County Health District has requued the proposal to
have a minimum lot size of 12,500 square feet under its regulations.
3. Pursuant to RCW 58.17.110. the oroQOSed oreliminarv vlat makes appropriate provision for
the public health. safetv and eeneral welfare. and for onen snaces and critical areas, oublic roads
and streets. water. sanitarv waste disoosal. surface water drainage and drainagewavs, parks and
recreation. schools and schoolarrounds. nlavgrounds. transit stovs and other relevant facts,
includinLy sidewalks and other olanning features that assure safe walking conditions for students
who oniv walk to and from school. The oronosed nreliminarv plat will serve the public use and
interest.
The above analysis indicates that appropriate provision has been made for on-site sewage
disposal, roads, sanitary waste disposal and schools. Appropriate provision has also been made
for drainage, water supplies, fire protection, parks and public transit, as indicated in the Division
of Building and Planning staff report and in the conditions of approval. No deficiencies were
identified regarding any of the factors listed in RCW 58.17.110. The proposal generally complies
with the Comprehensive Plan, and will provide housing to serve the growing population in the
Spokane Valley.
4. The vronosal will not have a sienificant orobable adverse imoact on the environment.
No public agencies opposed approval of the project, as conditioned. The proposal will not
have more than a moderate effect on the quality of the environment, and the Hearing Examiner
concurs with the Determination of Nonsignificance issued by the County Division of Building and
Planning. The procedural requirements of the State Environmental Policy Act and the County's
Loca1 Environmental Ordinance have been met.
M. DECISION
Based on the Findings and Conclusion above, the above preliminary plat application is
approved, subject to the conditions of approval of the various public agencies listed below.
Failure to comply with the conditions of this approval may result in revocation of this approval by
the Hearing Examiner. This approval does not waive the applicant's obligation to comply with all
other requirements of other public agencies with jurisdiction over land development.

SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
1. The proposal shall comply with the Urban Residential-3.5 (LJR-3.5) zone as amended.
2. The final plat shall be designed substantially in conformance with the preliminary plat of
record. No increase of density or number of lots sha11 occur without a change of condition
application submittal and approval.
3. The Director/designee shall review any proposed final plat to ensure compliance with these
Findings and Conditions of Approval.
4. A final plat name shall be indicated before the final plat is filed, such name to be approved
by the Director/designee.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for fivelffikyears, specifically to
Noverxi r 0►1; ~~~a'e-~applicant may request an extension of time b~y sub.mitting a written
request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposal final plat. Written
approval of utility easements by appropriate utility companies shall be received with the submittal
of the final plat.
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all
private or public roads. The dedication shall contain the following statement:
" ide yard and rear yard setbacks shall be determined at the time building pernuts are
rea4gsted unless these setbacks are specificaily drafted on this final plat. The setbacks indicated
Zn this plat may be varied from if proper zoning approvals are obtained."
9. Three (3) current certificates of title shall be furnished to the Division of Building and
Planning prior to filing the final plat.
10. Prior to filing of a11 or a portion of the final plat the applicant's surveyor shall submit one or
more maps outlined in red of the area being finalized. The scale sha11 match the appropriate
assessor's map scale.
11. The Division of Building and Planning shall prepare and record with the County Auditor a
Title Notice specifying a future land acquisition area for road right-of-way and utilities. The
reserved future acquisition area Title Notice shall be released, in full or in part, by the Division.
The notice should be recorded within the same time frame as an appeal and shall provide the
following:

a. At leastol eet of reserved future acquisition area for road right-of-way and utilities,
in addition to the existing and/or newly dedicated right-of-way along Valleyway.
NOTE: The County Engineerh4s rqujredA5.,~eet of new dedication.

b. Future building and other setbacks required by the Spokane County Zoning Code shall
be measured from the reserved future acquisition area.
c. No required landscaping, parking, `208' areas, drainfield or allowed signs should be
located within the future acquisition area for road right-of-way and utilities. If any of
the above improvements are made within this area, they shall be relocated at the
applicant's expense when roadway improvements are made.
d. The future acquisirion area, until acquired, shall be private property and may be used as
allowed in the zone, except that any improvements (such as landscaping, parking,
surface drainage, drainfield, signs or others) shall be considered interim uses.
e. The property owner shall be responsible for relocating such "interim" improvements at
the time Spokane County makes roadway improvements after acquiring said future
acquisition area.
12. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County Division of Building
and Planning and County Health District. The agencies will certify on the Water Plan, prior to the
filing of a final plat, that the plan is in conformance with their respective needs and regulations.
The Water Plan and certification shall be drafted on a transparency suitable for reproduction and
be signed by the plat sponsor.
13. The water purveyor shall certify that appropriate contractual arrangements and schedule of
improvements have been made with the plat sponsor for construction of the water system in
accordance with the approved Water Plan. The time schedule shall provide completion of the
- water system and inspection by the appropriate health authorities prior to application for building
pernuts within the final plat. The arrangements or agreements shall include a provision holding
Spokane County and the purveyor harniless from claims by any lot purchaser refused a building
permit due to the failure of the subdivision sponsor to satisfactorily complete the approved water
system.
14. The final plat dedication shall contain the following statement:
he public water system, pursuant to the Water Plan approved by county and state health
authorities, the local fire protection district, Division of Building and Planning and water
haance 'yor, shall be installed within this subdivision and the applicant shall provide for individual
tstic water service as well as fire protection to each lot prior to sale of each lot and prior to
of a building pernut for each lot."
15. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant to the

approved Water Plan for the final plat" including a signed license stamp. The certification may be
in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic
map showing the "as-built" water system.
16. A survey is required prior to the filing of a final plat.
17. The owner shall negotiate with Central Valley School District and submit a recorded copy
of a voluntary agreement making provisions for public schools prior to finalization and recording
of the plat. The agreement shall provide a written description of the subject property to which the
agreement applies and also state the dollar amount and any other agreed to mitigating measures.
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCV)
58.17.205, that adequate provisions for school facilities must be made conditioned on a future
agreement between the plat sponsor and the school district.
Voluntary agreements between the owner and school district shall conform to the
requirements of RCW Chapter 82.02.
SPOKANE COUNTY DIVISION OF ENGINEERING
1. That conditional approval of the plat by the County Engineer is given subject to dedication
of right-of-way and approval of the road system as indicated in the preliminary plat of record.
0 2. That plans, profiles and cross sections as designed to County standards showing proposed
str t centerline and curb grades be submitted to the County Engineer for acceptance prior to
construction andlor the filing of a final pIat; road plans to be prepared under the direction of a
licensed Professional Civil Engineer.
3. That drainage plans and design calculations showing the alignment of drainage facilities be
'tted to the County Engineer for acceptance prior to construction and/or the filing of the

4. Construction within the proposed public streets and easements shall be performed. under the
direct supervision of a licensed engineer/surveyor, who shall furnish the County Engineer with
"As Built" plans and a certificate in writing that all improvements were installed to the lines and
grades shown on the approved construction plans and that all disturbed monuments have been
replaced.
5. No construction work is to be performed within the existing or proposed Public right-of-
way until a pernut has been issued bythe County Engineer. All work is subject to inspection and
approval by the County Engineer.
6. All construction within the existing or proposed Public right-of-way is to be completed prior
to filing the final plat or a bond in the amount estimated by the County Engineer to cover the cost

of construction of improvements. construction certification, "As Built" plans and monumenting
the street centerlines shall be filed with the County Engineer.
10. No direct access from lots to 2 right-of-ways until such roads are constructed to County

streets terminate at the plat boundaries.)

19. The County Engineer has designated a Collector Arterial Roadway Section for the
improvement of Valley Way which is adjacent to the proposed development. This will require the
addition of approximately 5-7 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
20. The proposed plat sha11 be improved to the standards set forth in Spokane County Board of .
Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction. -

21. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants the dedication of
additional R.ight of Way and the roadway improvements herein specified.
22. The County Arterial Road plan identifies Valley Way as a 70 foot Collector Arterial. The
existing right of way width of 40 feet is not consistent with that specified in The Plan. In order to
implement the Arterial Road Plan it is recommended that in addition to the required right of way
dedication, a strip of property 12.5 feet in width along the Valley Way frontage be set aside in
reserve. This property may be ac,quired by Spokane County at the time when Arterial
Improvements are made to Valley Way.
23. The applicant should be advised that there may exist utilities either underground or overhead
affecting the applicants property, including property to be dedicated or set aside future
acquisition. Spokane County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the applicable utilities and Spokane
County Engineer to deternune whether the applicant or utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.

~25. The applicant sha11 design and construct a temporary cul de sac at the end of the internal

SPOKANE COUNTY DIVISION OF UTII..TrIES
1. Pursuant to the Board of County Commissioners Resolution No. 80-041 S, the use of on-site
sewer disposal systems is hereby authorized. This authorization is conditioned in compliance with
all rules and regulations of the Spokane County Health District and is further conditioned and
subject to specific application approval and issuance of permits by the Health District.
2. The Dedication sha11 state the Owner(s) or Successor(s) in interest agree to authorize the
Cffunty to place their name(s) on a petition for the formation of a ULID by petition method

4. A dry sewer connection to the future area-wide Sewerage System is to be constructed.
5. Applicant shall submit expressly to Spokane County Utilities Department "under separate
cover," only those plan sheets showing sewer plans and specifications for dry sewer connections
for review and approval prior to the finalization of the project and or the issuance of permit to
connect.
6. Security shall be deposited within the Utilities Department for construction of dry sewer
connections prior to the finalization of the project and or the issuance of the pernut to connect to
the Public Sewer System. 7. Any water service for this project shall be provided in accordance with the Coordinated Water
System Plan for Spokane County, as amended.
8. Connection shall be made to the area-wide Sewerage System should it become available, as
determined by Spokane County or as required pursuant to Spokane County or Spokane County
Health District regulations.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORTTY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction and
excavation projects be controlled. This may require the use of water sprays, tarps, sprinklers or
suspension of activity during certain weather conditions. Haul roads should be treated and
emissions from the transfer of earthen material must be controlled as well as emissions from all
other construction related activities.
3. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress, parking areas,
- access roads) be paved and kept clean to minimize dust emissions.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto
paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately
to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than burning
(i. e., vegetative materials, construction waste, etc.
6. Demolition and renovation projects must comply with the requirements of CFR 40, Part 61,
Subpart M and SCAPCA Regulation 1, Article IX, which address asbestos abatement issues.

SUBJECT: PE-1797-96, PRELIMINARY PLAT OF VALLEYWAY ADDITION WITH
EXISTING URBAN RESIDENTIAL-3.5 (UR-3.5) ZONING.
I. GENERAL INFORMATION

Location: Generally located north of and adjacent to Valleyway, south of Alki Avenue,
approximately 200 feet east of Moore Road in the SW '/4 of Section 13, Township 25 North,
Range 44 EWM, Spokane County, Washington.
Proposal: Preliminary plat to subdivide approacimately four acres into 11 lots for single
family residences and those uses allowed in the eYisting Urban Residential-3.5 (UR-3.5)
zone.
II. SITE INFORMATION
A. Site Size: Approacimately four (4) acres
B. Comprehensive Plaa
1. Land Use Plan: The Comprehensive Plan category of the subject property is
Urban and the subject property is within the Priority Sewer Service Area (PSSA)
and the Aquifer Sensitive Area (ASA) Overlay Zone. The Urban (L) Category
is intended to provide the opportunity for development of a"city-like"
environment which includes various land uses. Due to the variety and mix of
land uses and activities found in the Urban Catecrory, there are few land use
activities that would be inappropriate. Residential net densities are sugaested to
range from 1 to 17 dwelling units per acre in the Urban category. The net
density proposed in this application is 3.3 dwelling units per acre and is within
the sugoested range. The proposed zone reclassification implements the
majority of the Goals, Objectives and Decision Guidelines of the Urban
Category of the Comprehensive Plan.

2. Arterial Road Plan: The Spokane Arterial Road Plan identifies Valleyway as a
Collector Arterial with an existing right-of-way of 40 feet and a proposed right-of-
way of 70 feet. To implement the plan, ihe County Engineer is requesting the
dedication of an additional 2.5 feet of right of way on Valleyway as well as a 12.5
foot wide strip of property along Valleyway to be set aside as a future acquisition
area. 3. County Parks Plan: Sullivan Park, approximately 1 mile northwest, is the
nearest County park facility. Future expansion of Sullivan Park, including the
addition of hiking and riding trails, is contemplated within the County Parks Plan.
C. Site Characteristics: The site is relatively flat with native grasses and weeds. There
are no structures on site.
E. Zoniag Analysis:
Proposal: Urban Residential-3.5 (UR-3.5) (ZE-60-42) established in 1991.
North: Urban Residential-3.5 (UR-3.5) (ZE-60-42) established in 1991.
South: Urban Residential-3.5 (LJR-3.5) (ZE-60-42) established in 1991.
East: Urban Residential-3.5 (LTR-3.5) (ZE-60-42) established in 1991.
West: Urban Residential-7 (UR-7) (ZE-94-20) established in 1991.
Prior to the County-wide zone re-designation and implementation of the Spokane
County Zoning Code on January 1, 1991, the site and property to the north, south and
east were zoned Agicultural (A) (ZE-60-42). Property to the west was zoned Two
Family Residential (R-2 )(ZE-94-70). The proposal is within the Priority Sewer
Service Area (PSSA) and the Aquifer Sensitive Area (ASA) Overlay zone.
Within the project vicinity, the zoning is predominantly Urban Residential-3.5 (UR-
3.5). To the west of the proposal are two Urban Residential-7 (UR-7) associated with
the subdivision of Friske Addition (PE-730) and Friske First Addition (PE-730A). The
preliminary plat design is consistent with the development standards of the existing
Urban Residential-3.5 (UR-3.5) zone.
F. Land Use Analysis:
Site: Vacant, undeveloped.
North: Vacant, undeveloped.
South: Single family residences.
East: Single family residences and vacani.

West: Single family residences.
Land use in the vicinity of the proposal consists of single family residences on lots
ranging from 10,000 square feet to 5 acres in size. Residential development has
generally occurred in strips along improved County Roads, leaving relatively large
areas of undeveloped property in the interior areas between roadways. Business uses
in the area inc(ude the Sullivan Road and the Sprague Avenue commercia( corridors
which offer a wide variety of services.
G. Circulation: The site is adjacent to Valleyway which is designated as a Collector
Arterial by the Spokane County Arterial Road Plan. An unnamed north/south public
road will be constructed as a public road serving the interior of the proposal. A 25 foot
dedication for Alki Avenue, as a future east-west extension from the Friske Addition
adjacent to the north is requested by the County Engineer. A temporary cul-de-sac is
required at the north end of the site until such time as Alki is improved as a public
road.
H. Design: The preliminary plat design provides for residential lots of 12,500 square feet.
The plat design is consistent with the Urban Residential-3.5 (UR-3.5) standards for lot
size and frontage. Prior to plat finalization all lots will be reviewed to assure that
zoning standards are met.
1. Density: The net density (eYCluding roads) is 3.3 dwelling units per acre. The gross
density is 2.7 dwelling units per acre. The proposed density is not entirely consistent
with adjacent properties that include acreage residences and undeveloped property.
However, similar subdivisions have been approved in the area, including the Friske
development (PE-730) to the west, Childers Addition (PE-1727-93) and Valley View
Estates (PE-1731-93). Also, some of the eYisting segregated lots have lot sizes and
densities similar to the proposal.
J. Drainage: A drainage plan is required. This plan must be reviewed and approved by
the County Engineer prior to development. The proposal is inside the Aquifer
Sensitive Area, therefore "208" storm drainage requirements must be met.
K. Water Supply: The proposal is within the water service area of Vera Irrigation
District. The water district has indicated that a water plan and utility easements will be
required prior to plat finalization.
L. Sewage Disposal: Individual on-site septic systems are proposed for sewage disposal
subject to approval by the Spokane County Health District. All dwelling units will be
double plumbed and dry line sewers will be installed to facilitate connection to the
pub(ic sewer when it is available. Lot density is subject to Health District regulations
for on-site Septic tanks and drainfields. The Spokane Valley interceptor sewer line is
located approximately one half mile south of the proposal.
M. School: The proposal is in the Central Valley School District No. 356. The Central
Valley School District has submitted a letter indicating that schools are currently ovec-
crowded. The District sugoests that the plat should be denied unless approved with a

condition that the developer and the District agree to voluntary fees. The Division of
Building and Planning has included a condition of approval requiring the project
sponsor to negotiate a voluntary agreement with the School District to mitigate
impacts of the development on schools.
N. Fire Protection: The proposal is within Fire District No. l. All Fire District
requirements must be met prior to finalization of the piat.
0. Cultural Resources, Critical Areas: None have been identified.
P. Transit: The project is inside the Spokane Transit Authority Benefit Area. Transit
service is available to the north of the proposal on Broadway Avenue.
M. ENVIRONMENTAL REVIEW:
An Environmental Checklist was submitted by the sponsor and was reviewed by the
Division of Building and Planning. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines. The Division of Building and Planning has determined that "No
probable significant adverse impacts" would result from the proposal being developed and
has issued a Determination of Nonsienificance ("DNS").
The "DNS" was circulated to 14 other agencies of jurisdiction and other
agencies/departments affected by the future development for review and comment. The
"DNS" comment period ends September 23, 1996, and was advertised 15 calendar days
before said date in the newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner
may consider additional environmental related testimony at the public hearing.
IV. DIVISION OF BUILDING AND PLA►NNING RECOIVWiYDATION
The preliminary plat generally conforms to Spokane County Subdivision and Zoning Code
regulations, and the proposal is generally consistent with the Goals, Objectives, and Decision
Guidelines of the Urban category of the Comprehensive Plan. The net density of 3.3 units
per acre is also consistent with the density guidelines for the Urban category. The Division
of Building and Planning recommends approval of the preliminary plat, as conditioned.
V. C0iNDITIONS OF APPROVAL
i. All conditions imposed by the Hearing Examiner Committee shall be binding on
the "Applicant", which terms shall include tbe owner or ownecs of t6e
property, heirs, assigns and successors.
ii. The conditions of approval apply to the preliminary subdivision of record.

DIVISION OF BUILDP 1G AND PLANNIlNG
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended.
2. The final plat shall be designed substantially in conformance with the preliminary plat of
record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
3. The Director/designee shall review any proposed final plat to ensure compliance with
these Findings and Conditions of Approval.
4. A final plat name shall be indicated before the final plat is filed, such name to be
approved by the Director/designee.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for five (5) years, specifically to
November 1, 2001. The applicant may request an extension of time by submitting a
written request approximately forty-five (45).days prior to the above eYp'vation date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private or public roads. The dedication shall contain the following statement:
"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained."
9. Three (3) current certificates of title shall be furnished to the Division of Building and
Planning prior to filing the final plat.
10. Prior to fiiing of all or a portion of the final plat the applicant's surveyor shall submit one
or more maps outlined in red of the area being finalized. The scale shall match the
appropriate assessor's map scale.
11. The Division of Building and Planning shall prepare and record with the County Auditor
a Title Notice specifying a future land acquisition area for road right-of-way and
utilities. The reserved future acquisition area Title Notice shall be released, in full or in
part, by the Division. The notice should be recorded within the same time frame as an
appeal and shall provide the following:
a. At least 12.5 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Valleyway. NOTE: The County Engineer has required 2.5 feet of new
dedication.

b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilities. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, eYCept that any improvements (such as landscaping,
parking, surface drainage, drainfield, sians or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
12. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County Division of
Building and Planning and County Health District. The agencies will certify on the
Water Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
13. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide for
completion of the water system and inspection by the appropriate health authorities prior
to application for building permits within the final plat. The arrangements or agreements
shall include a provision holding Spokane County and the purveyor harmless from
claims by any lot purchaser refused a building permit due to the failure of the
subdivision sponsor to satisfactorily complete the approved water system.
14. The final plat dedication shall contain the following statement:
"The public water system, punuant to the Water Plan approved by county and state
health authorities, the local fire protection district, Division of Building and Planning
and water purveyor, shall be installed within this subdivision and the applicant shall
provide for individual domestic water service as well as fire protection to each lot prior
to sale of each lot and prior to issuance of a building permit for each lot."
15. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant to
the approved Water Plan for the final plat " including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.

17. The owner shall negotiate with Central Valley School District and submit a recorded
copy of a voluntary aareement making provisions for public schools prior to finalization
and recording of the plat. The ageement shall provide a written description of the
subject property to which the agreement applies and also state the dollar amount and any
other agreed to mitigating measures.
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCW)
58.17.205, that adequate provisions for schooi facilities must be made conditioned on a
future agreement between the plattor and school district.
Voluntary agreements between the owner and school district shall conform to the
requirements of RCW Chapter 82.02.

is a list of concerns/issues that, at a minimum, need to be addressed for this project. SCAPCA
encourages proponents to contact their offices at 1101 West College, Spokane, WA 99201 for
additional information.
* Al) air pollution regulations must be met.
* Air pollution regulations require that dust emissions during demolition, construction and
excavation projects be controlled. This may require the use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads should
be treated and emissions from the transfer of earthen material must be controlled as well
as emissions from all other construction related activities.
* SCAPCA strongly recommends that all travelled surfaces (i.e., ingress, egress, parking
areas, access roads) be paved and kept clean to minimize dust emissions.
* Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces
onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be
taken immediately to clean these surfaces.
~ Debris generated as a result of this project must be disposed of by means other than
burning (i.e., vegetative material, construction waste, etc...).
~ Demolition and renovation projects must comply with the requirements of CFR 40, Part
61, Subpart M and SCAPCA Regulation I, Article IX, which address asbestos abatement

This is in response to your request for comments regarding PE-1797-96. The development will
be located in the Spokane Valley and will produce eleven (11) lots for single family residences.
The Board of Directors of Central Valley School District has adopted a resolution which directs
the administration to take necessary action to mitigate impacts upon the School District created
by housing developments. The authority for this action is SEPA, RCW 82.02.020 and RCW
58.17.110. Under these statutes, the County, prior to approving a subdivision, must determine
whether adequate provisions exist for public school service.
The Central Valley School District has determined that added dwellings envisioned by this
proposal will adversely impact the District's ability to provide adequate student housing. We
ask that Spokane County not approve PE-1797-96 unless the developer and Central Valley
School District agree to voluntary means of mitigating its adverse impact on the Central Valley
School District. The School District seeks a fee or other measure which would mitigate the
impact by partially funding cost of space to adequately house students residing in the proposed
new housing. This determination is based on the following:
1. The District's elementary schools are overcrowded. We are currently using portable
facilities. We have need for additional classroom space.
2. Enrollment projections indicate that the capacity of our schools to house students will
continue to be exceeded. Enrollment projections are based on a cohort survival model
which predicts future enrollment based on the past three years' enrollment growth by
grade level.
3. A number of housing developments have been submitted for preliminary plat approval
within the Central Valley School District. Many of these approved developments have
not been completed. Students from these developments will contribute to the
overcrowding of our schools.

In summary, Central Valley School District asks that Spokane County either deny the presently
proposed PE-1797-96, or approve it with the condition that the developer and Central Valley
School District agree to voluntary fees or other means of mitigation. It should be noted,
however, that said fees provide insufficient funding to support school construction needs.
