SiTMMARY OF PROPOSAL AND DECISION Proposal: Preliminary plat to subdivide approximately 2.2 acres into seven lots for single family residences and those uses allowed in the existing Urban Residential-3.5 (IJR-3.5) zone. Decision: Approved, subject to conditions. U. FINDINGS OF FACT AND CONCLUSIONS . The Hearing Examiner has reviewed the preliminary plat application and the evidence of record and hereby adopts the following findings of fact and conclusions: A. GENERAL INFORMATION: Applicant: Gerald and Margaret Becker, 2221 South Progress Road, Veradale, WA 99037 Agent: Trout Creek, Ltd., Tim Haener, 1928 East Thurston, Spokane, WA 99203 Address: Not known at this time. Location: Generally located at the northeast corner of Progress Road and 24t' Avenue in the NE '/4 of Section 26, Township 25 North, Range 44 EWM, Spokane County, Washington. Legal Description: As described on the preliminary plat of record. Zoning: Urban Residential-3.5 (LJR-3.5) Comprehensive Plan Category: The property is designated in the Urban category of the Spokane County Generalized Comprehensive Plan. The site is also within the Aquifer Sensitive Area, Priority Sewer Service Area and Urban Impact Area designated by the Plan. Environmental Review: A Deternunation of Nonsignificance was issued by the Division of Building and Planning on September 16, 1996. HE Findings, Conclusions and Decision PE-1800-96 Page 1=_~-- • ' y.' Site Description: The site is approximately 2.2 acres in size, and is currently vacant and undeveloped. The terrain of the site slopes to the southeast and is clear of vegetation. The site include..s Lo,ts "C" and "D" of Short Plat No. SP-762-91, and a drainage easement associated with the short plat bisects the site. The site is bounded by 240' Avenue on the south and Progress Road on the west. The Arterial Road Plan designates 24`hAvenue as a Collector Arterial. Progress Road in the vicinity is considered a local access road. Surrounding Conditions: Land uses in the vicinity of the proposed preliminary plat are predominately single-family residential on urban-sized lots consistent with the existing Urban , Residential-3.5 (LTR-3.5) zone. Located immediately north of the site are Lots "A" and "B" of . Short Plat SP-762-91, which are developed with single-family residences. The area southwest of the subject site consists of large, single-family parcels. Approximately 332 feet north of the proposal is the final plat of Autumn Crest Third Addition (PE-1570-89). Most of the single- family residences located in the Autumn Crest area are located on average lot sizes of approximately 13,700 square feet, at an overall density of 2.95 dwelling units per acre. , The adjoining land east of the site is a large lot single-family residence with large arumal-keeping. South of the proposal across 240' Avenue is the final plat of McLaughlin Addition (PE-676-68), comprised of single-family lots averaging 11,180 square feet in size at an overall density of 3.16 dwelling units per acre. Approximately 325 feet east of the proposal, north of 24th Avenue, lies Hart's Crosswind Addition (PE-1670-92). Hart's Crosswind Addition has a gross density of 3.15 dwelling units per acre, with single-family lots averaging 17,024 square feet in size. To the west of the site, west of Progress Road, is the Vera Crest subdivision (PE-1160-77) and Short Plat No. SP-902-93. Vera Crest subdivision consists of single-family lots averaging 17,202 square feet in size, with an overall density of 2.12 dwelling units per acre. Short Plat No. SP-902- 93 has a gross density of 3.48 dwelling units per acre, with an average single-family lot size of 12,000 square feet. Utilities and public services existing in the area include public sewer, overhead power transmission lines and paved roads without curbs and sidewalk. Terrace View Park is located approximately 3/4 mile south of the site. Project Description: The preliminary plat map illustrates division of 2.2 acres of land into seven lots for single-family residences, with access to 24hAvenue provided by a private road that cul-de-sacs. Lot sizes range from 11,958 to 16,233 square feet in size, and the net density of the proposal is approximately 3.2 units per acre. Lots 1, 2, 3 and 7 do not meet the minimum setbacks of the UR-3.5 zone, as indicated on page 9 of the Division of Building and Planning staff report. The proposed preliminary plat includes lots "C" and "D" of Short Plat No. SP-762-91, and the drainage easement associated with such short plat that bisects the site has been relocated on the site. The Central Valley School District has requested the applicant to enter into a voluntary fee agreement to mitigate the impact of the proposal on the housing of students. The Findings of Fact, Conclusions and Decision entered in Short Plat No. SP-726-91 on December 182 1991, and the final plat map for such short plat are incorporated by reference as part of the record. C. PRELIMINARY PLAT ANALYSIS: To be approved, the preliminary plat application must comply with the conditions and requirements set forth in the Spokane County Subdivision Ordinance, chapter 58.17 RCW, the Spokane County Zoning Code and other applicable land use regulations. The proposal must also comply with the requirements of the State Environmental Policy Act and Spokane County's Local Environmental Ordinance. The following findings of fact and conclusions are made: 1. The t)roposed nreliminarv nlat P-enerallv comnlies with the nolicies of the Snokane Countv Generalized Comnrehensive Plan. The proposal is designated in the Urban category of the Comprehensive Plan. The Urban category is intended to provide the opportunity for a"citylike" environment, which includes HE Findings, Conclusions and Decision PE-1800-96 Page 3-- various land uses, residential development and a high level of public facilities and urban services. The Urban category recommends a variety of densities and residential uses, including areas with varying densities, combinations, or mix of uses. The recommended range of residential densities in the Urban category is 1 to 17 units per acre, which the proposal is easily consistent with. The Urban category and the Urban Impact Area encourage "fill-in development", which is development at urban densities that facilitates the cost-effectiveness of utilities and other public facilities and services. The proposal will be served by public sewer and water, and other urban services. The proposal clearly implements the policies of the Urban category. . 2. The vronosed Dreliminarv iDlat comvlies with the Spokane Countv Zonine Code and all applicable land use reaulations. The proposal does not comply with the minimum setback standards specified in Zoning Code 14.616.325 (1), as discussed on page 9 of the Division of Building and Planning staff report. . Building and Planning Condition No. 8 requires the final plat to show the proper setbacks. The proposal as conditioned otherwise complies with the maximum density, minimum lot area and other development standards of the Urban Residential-3.5 (UR-3.5) zone; the County Subdivision Ordinance and other applicable land use regulations. 3. The vronosed preliminarv vlat will serve the vublic use and interest. The September 19, 1996 memorandum from the County Stormwater Utility in the project file states that drainage concerns relating to off-site flows crossing the property were identified during engineering analysis on the original short plat SP-726-91. The memorandum and final plat map for SP-726-91 further indicate that a 20 foot drainage easement was established across Parcels "C" and "D" to handle the runoff. The memorandum states that the environmental checklist for the proposal needed to address the identified drainage problems. The proposal deletes the 20 foot drainage easement shown for SP-726-91 but shows various new drainage easements on Lots 1, 2, 31 52 6 and 7, with a notation on the preliminary plat map that "proposed drainage easements are subject to change with drainage study". The environmental checklist for the proposal indicates that stormwater generated on-site and collected from certain off-site locations would be treated in "208" swales and discharged to the ground through drywells, and discusses other measures to treat stormwater and prevent erosion during construction. The environmental checklist was prepared before the September 19, 1996 memorandum from the County Stormwater Utility, and there was no further discussion of drainage issues at the public hearing or in the record after such memo was submitted. However, County Engineering Conditions No. 3 and 18 respectively require the submittal of drainage plans and compliance with County drainage regulations. These conditions appear adequate to address the concerns raised by the County Stormwater Utility. HE Findings, Conclusions and Decision PE-1800-96 Page 4- / 7 The Building and Planning staff report otherwise indicate that appropriate provision has been made in the design of the proposal and through the recommended conditions of;approval for roads, sanitary waste disposal, water supply, schools and the other servicss and factors referenced in RCW 58.17.110. No deficiencies were identified regarding any of the factors listed in RCW 58.17.110, and no testimony was offered in opposition to the project as conditioned. The conditions of approval are very similar to those attached to Short Plat SP-726-91, and the remainder of the short plat lying outside the site will not be negatively affected by approval of the proposal. The proposal generally complies with the Comprehensive Plan, and will provide housing to serve the growing population in the Spokane Valley. . 4. The nronosal will not have a sianificant vrobable adverse impact on the environment. No public agencies expressed opposition to the project, as conditioned. A trip distribution analysis performed by a civil engineer on behalf of the applicant indicated that the proposal would . not significantly impact or degrade the level of service at the Sullivan Road/Pines Road (SR-27) Interstate 90 interchanges or westbound I-90 turning movements. The proposal will not have more than a moderate effect on the quality of the environment, and the Hearing Examiner concurs with the Determination of Nonsignificance issued by the County Division of Building and Planning. The procedural requirements of the State Environmental Policy Act and the County's Local Environmental Ordinance have been met. - III. DECISION Based on the Findings -and Conclusion above, the above preliminary plat application is approved, subject to the conditions of approval of the various public agencies listed below. Failure to comply with the conditions of this approval may result in revocation of this approval by the Hearing Examiner. This approval does not waive the applicant's obligation to comply with all other requirements of other public agencies with jurisdiction over land development. SPOKANE COUNTY DTVISION OF BUII.,DING AND PLANNING 1. The proposal shall comply with the Urban Residential-3.5 (LTR-3.5) zone, as amended. 2. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 3. The Director of the Division of Building and Planning/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 4. A final plat name/number shall be indicated before the final plat is filed, such nameJnumber to be approved by the Director of the Division of Building and Planning/designee 5. Appropriate road name(s) sha11 be indicated. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies sha11 be received with the submittal of the final plat. _ 8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from a11 priv e and/or public roads. The dedication sha11 contain the following statement: "e yard and rear yard setbacks sha11 be determined at the time building permits are requested ess these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat 'y be varied from if proper zoning approvals are obtained." 9. Three (3) current certificates of title sha11 be furnished to the Division of Building and Planning prior to filing the final plat. 10. Prior to filing of a11 or a portion of the final plat the applicant's surveyor shall submit one or more maps outlined in red of the area being finalized. The scale sha11 match the appropriate assessor's map scale. . ,11. The Spokane County Division of Building and Planning shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Division of Building and Planning. The notice should be recorded within the same time frame. as an appeal and sha11 provide the following: a. At least five (5) feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing and/or newly dedicated right-of-way along 24th Avenue. b. Future building and other setbacks required by the Spokane County Zoning Code sha11 be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future - acquisition area. - - HE Findings, Conclusions and Decision PE-1800-96 Page 6 , 12. The final plat shall indicate yard setback arc lengths on cul-de-sac lots which meeE ortexc,eed the minimum frontage of the underlying zone of the final plat. 13. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Division of Building . and Planning and County Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat, that the plan is in conformance with their respective needs and regulations. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and . be signed by the plat sponsor. •14. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in ~--P- accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building . permits within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 15. T final plat dedication shall contain the following statement: "T ublic water system, pursuant to the Water Plan approved by county and state health a rities, the local fire protection district, County Division of Building and Planning and water eyor, shall be installed within this subdivision and the applicant shall provide for individual mestic water service as well as fire protection to each lot prior to sale of each lot and prior to ' issuance of a building pernut for each lot." 16. No building pernut will be issued for any lot within the final plat until certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat " including a signed license stamp. The certification may be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. 17. The Water Plan and the above four (4) conditions of approval regarding the Water Plan may be waived by the Director of the Division of Building and Planning/designee upon receipt of _ letters from the appropriate water purveyor and fire protection district stating that simple - connections to an existing, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 18. A survey is required prior to the filing of a final plat. 19. A copy of the homeowners/property owners' association articles of incorporation and/or bylaws andlor covenants and restrictions, together with any other provisions for maintenance of common areas and facilities, shall be submitted for review and approval to the Division of Building and Planning prior to finalizing. Prior to approval of road and drainage plans, you are required to coordinate with the United States Postal Service to deternune type and location of central mail delivery facilities which may include applicable easements for developments of three or more homes. 21. The owner shall negotiate with Central Valley School District and submit a recorded copy of a voluntary agreement making provisions for public schools prior to finalization and recording of the plat. The agreement shall provide a written description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mitigating measures. . The owner shall also notify any potential purchasers who have made an agreement to purchase property within said plat pursuant to the Revised Code of Washington (RCV) 58.17.205, that adequate provisions for school facilities must be made conditioned on a future agreement between the platter and school district. Voluntary agreements between the owner and school district shall conform to the requirements of RCW Chapter 82.02. SPOKANE COUNTY DTVISION OF ENGINEERING Prior to release of a building permit or use of property as proposed: ` 1. That conditional approval of the plat by the County Engineer is given subject to approval- of oad system as indicated in the preliminary plat of record. ~C2)et That plans, profiles and cross sections as designed to County standards showing proposed centerline and curb grades be submitted to the County Engineer for acceptance prior to - construction and/or the filing of a final plat; road plans to be prepared under the direction of a sed Professional Civil Engineer. 3. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purposes is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Progress Road. 11. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and;. ` assigns. This provision is applicable to Progress Road. 1 That the following statement shall appear within the dedicatory language of the final plat: ~That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves;1 r their heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane County to include the above described property in a Road Improvement District (RID) and to support the formation of a Road Improvement District for improvement of the road(s) described- below by requesting and authorizing Spokane County to place their name(s) on a petition for the formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being formed under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. If a RID is proposed for improvement of the road(s) described below, said owner(s) and successor(s)further agree: (1) that the improvements or construction contemplated within the proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s) HE Findings, Conclusions and Decision PE-1800-96 Page 9 ' shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the Board of County Commissioners confirming the final assessment rioll; provided further, it is recognized that actual assessments may vary from assessment estimate so,,;1. long as they do not exceed a figure equal to the increased true and fair value improvement(s) -add(s) to the property. It is further acknowledged and agreed that at such time as a RID is created or any County Road Improvement project is authorized by Spokane County, the improvements required sha11 be . at the sole expense of the owner(s) of property within the RID or served by the improvements without any monetary participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. This provision is applicable to Progress Road. 13. The County Engineer has designated a Collector Arterial Roadway Section for the improvement of 24" Avenue which is adjacent to the proposed development. This will require the addition of approximately 7-9 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 14. The County Engineer has designated a Loca1 Access Roadway Section for the improvement of Progress Road which is adjacent to the proposed development. This will require the addition of approximately 5-7 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. . 15. That the private road be improved to Spokane County standard for a private road standard serving 7-201ots. . # , 16. All vested owners shall sign and record private road documents as prescribed by the Spokane County Engineer. These documents shall be reviewed and approved by the Spokane County Engineer prior to recording with the Spokane County Auditor. Recording numbers shall be referenced in the dedicatory language of the plat. 17. That the following statement be placed in the plat dedication: WA,RNING: Spokane County has no responsibility to build, improve, maintain or other wise service the private roads contained within or providing service to the property described in this plat. By accepting this plat or subsequently by allowing a building permit to be issued on property on a private road, Spokane County assumes no obligation for said private road and the owners hereby acknowledge that the County has no obligation of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain, provide drainage or snow removal on a private road. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 19. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the roadway improvements herein specified. 20. That the following statement must be placed in the plat dedication: "The private road as shown hereon is an easement which provides a means of ingress and egress for those lots within . the plat having frontage thereon." ` 21. The County Arterial Road plan identifies 24`hAvenue as a 70 foot Collector Arterial. The existing right of way width of 60 feet is not consistent with that specified in The Plan. In order to implement the Arterial Road Plan it is recommended a strip of property 5 feet in width along the 240' Avenue frontage be set aside in reserve. This property may be acquired by Spokane Count'6 at the time when Arterial Improvements are made to 24`hAvenue. 22. II. SITE INFORMATION A. Site Size: Approximately 2.2 acres Gross Density: Approximately 3.2 dwelling units per acre B. Comprehensive Plan 1. Land Use: The property is located within the Urban category of the Comprehensive Plan and within the Priority Sewer Service Area (PSSA). The Urban category is intended to provide the opportunity for development of a"city-like" environment which includes various land uses, intensive residential development, and public facilities and services (water, sanitary and storm water lines, police and fire protection, and other features). The proposal is consistent with the Goals, Objectives and Decision Guidelines of the Urban category of the Comprehensive Plan. 2. Arterial Road Plan: The subject property is located north of and adjacent to 24th Avenue and east of and adjacent to Progress Road. Twenty-fourth Avenue is identified by the Spokane County Arterial Road Plan as a Collector Arterial. The Spokane County Division of Engineering has requested a five (5) foot wide strip of land along 24th Avenue to be reserved as Future Acquisition Area (FAA). Building/structure setbacks are recommended by the Comprehensive Plan to be 25 feet from the Future Acquisition Area (FAA). 3. County Parks Plan: The Spokane County Parks Plan identifies Terrace View Park as the County park facility located nearest to the proposal. This park is located approximately three-quarter (3/4) mile northwest of the subject site. - C. Site Characteristics: The subject property is currently vacant and undeveloped. The terrain of the site slopes to the southeast and is clear of vegetation. D. Neighborhood Characteristics: Land use in the vicinity of the proposed preliminary plat is predominately single family residential on urban sized lots consistent with the existing Urban Residential-3.5 (UR-3.5) zone. The area southwest of the subject site consists of large, single family parcels. Adjacent to and east of the site is a large lot single family residence with large animal raising. Utilities and public services existing in the area include public sewer, overhead power transmission lines and paved roads without curbs and sidewalk. E. Zoning Analysis: The existing zone of the site is Urban Residential-3.5 (UR-3.5). The purpose of the Urban Residential-3.5 (UR-3.5) zone is to implement the lower density range of the Urban category of the Comprehensive Plan. The intent of the zone is to promote areas of primarily single-family residential use in an urbanized neighborhood setting, having a high level of public services. Lots shall be served by a public water system and shall require connection to public central sewer system when available. Roadways shall be paved and curbed and may have sidewalks. This proposed preliminary plat does not include a zone reclassification request and demonstrates general compliance with the development standards for the Urban Residential-3.5 (UR-3.5) zone. Proposal: Urban Residential-3.5 (UR-3.5) established on January 1, 1991, previously classified as Agricultural (A); (ZE-60-42) North: Urban Residential-3.5 (UR-3.5) established on January 1, 1991, previously classified as Agricultural (A); (ZE-60-42) 10-9-96 HE Staff Report for PE-1800-96 Page 7 South: Urban Residential-3.5 (UR-3.5) established on January 1, 1991, previously classified as Single Family Residential (R-1); (ZE-4-69) East: Urban Residential-3.5 (UR-3.5) established on January 1, 1991, previously classified as Agricultural (A); (ZE-60-42) West: Urban Residential-3.5 (LTR-3.5) established on January 1, 1991, previously classified as Agricultural (A); (ZE-60-42) F. Land Use Analysis: The proposed preliminary plat includes lots "C" and "D" of Short Plat, File No. SP-762-91. Located immediately to the north of the proposal are remaining lots "A" and "B" which are developed as single family residences. Lots "A" and "B" exceed the minimum lot size of the existing Urban Residential-3.5 (UR-3.5) zoning and are 1.97 acres and 17, 846 square feet in size, respectively. Approximately 332 feet to the north of the proposal is Autumn Crest Third Addition (PE-1570-89). Most of the single family residences located in the Autumn Crest area are located on average lot sizes of approximately 13,700 square feet with an overall density of 2.95 dwelling units per acre. McLaughlin Addition (PE- 676-68), located south of the proposal, is comprised of lots averaging 11,180 square feet in size with an overal l density of 3.16 dwelling units per acre. Approximately 325 feet east of the proposal, north of 24th Avenue, lies Hart's Crosswind Addition (PE-1670-92). Hart's Crosswind Addition has a gross density of 3.15 dwelling units per acre with lots averaging 17,024 square feet in size. To the west of the property, west of Progress Road, is Vera Crest subdivision (PE-1160-77) and Short Plat, File No. SP-902-93. Vera Crest subdivision consists of lot averaging 17,202 square feet in size with an overall density of 2.12 dwelling units per acre. Short Plat, File No. SP-902-93 has a gross density of 3.48 dwelling units per acre with an average lot size of 12,000 square feet. The proposed preliminary plat of Valley Vista is consistent with subdivision approvals in the vicinity and consists of an overall density of 3.2 dwelling units per acre and an average lot size of 13, 690 square feet. Site: Vacant, undeveloped land. North: Single family residences. South: Single family residences. East: Large lot single family residences and large animal raising. West: Single family residences and vacant, undeveloped land. G. Circulation: Access to the lots within the proposed subdivision will be provided by a single private road easement/cul-de-sac extending north from 24th Avenue. H. Design: The preliminary plat illustrates subdivision of approximately 2.2 acres into seven (7) lots for single family development. Lots size ranges 10-9-96 HE Staff Report for PE-1800-96 Page 8 from 11,958 to 16,233 square feet in size and all the lots meet or exceed the minimum lot size and frontage requirements of the Urban Residential- 3.5 (UR-3.5) zone. Lots l, 2 and 3 do not meet the minimum setback standards specified by Section 14.616.325(1) of the Spokane County Zoning Code. These lots are considered double fronting lots and require front yard setbacks from the private road easement and Progress Road. The preliminary plat indicates the front yard setback adjacent to Progress Road as 20 feet from the property line whereas Section 14.616.325 (1) of the Spokane County Zoning Code requires a 25 foot setback from the property line adjacent to Progress Road. Twenty-fourth Avenue is located south of and adjacent to Lots 1 and 7. For Lots 1 and 7, the Spokane County Zoning Code defines 24th Avenue as a flanking street. The setbacks as illustrated on the preliminary plat . indicates a 15 foot setback from the Future Acquisition Area (FAA) whereas Section 14. 616.325 (3) of the Spokane County Zoning Code requires a 25 foot setback from the Future Acquisition Area (FAA) adj acent to 24th Avenue. The plat plan shall be revised to illustrate the required setback prior to finalizing the plat. 1. J. Drainage: A drainage plan has been submitted to and accepted for review by the Spokane County Division of Engineering. K. Power Transmission Lines/Other Known Easements: An existing drainage easement as required for approval of Short Plat (SP-726-91) currently bisects the subject property. The preliminary plat illustrates the relocation of the drainage easement and has been accepted for review by the Division of Engineering. All other required and recorded easements will be disclosed during the final plat process. L. Water Supply: The proposal is within the Vera Water and Power District. A water plan and provisions for water service shall be coordinated with the water purveyor prior to finalizing the plat. 10-9-96 HE Staff Report for PE-1800-96 Page 9 M. Sewage Disposal: The proposal will be served by a public sewer system as required by the Spokane County Health District. N. School: The proposal is located within the Central Valley School District, No. 356. The Central Valley School District has responded to the proposal and has indicated that existing facilities are inadequate to . accommodate additional students generated from new residential developments. The school distrrict has requested that the preliminary plat not be approved unless the developer and Central Valley School District agree to voluntary fees (which provide insufficient funding to support school construction needs) or other means of mitigation. This request is included as a recommended condition of approval. 0. Fire Protection: The proposal is within Fire District No. 1. The Fire District has responded and has indicated the water and road plans are adequate. . P. Critical Areas: None have been identified. Q. Cultural Resources: None have been identified. R. Transit: The proposal is located within the Public Transit Benefit Area (PTBA). The applicant indicates an existing bus stop is located within approximately 1/2 to 1 block of the proposal. III. ENVIRONMENTAL REVIEW An Environmental Checklist has been submitted by the sponsor and was reviewed by the Division of Building and Planning. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan and other County policies and guidelines. The Division of Building and Planning has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of nonsignificance ("DNS"). The "DNS" was circulated to 14 other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment. The "DNS" comment period ended October 7, 1996 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the subject site, and by notice on a sign posted on the subject site. The Hearing Examiner may consider additional environmental related testimony at the public hearing. IV. DIVISION OF BUILDING AND PLANIVING SUMMARY AND RECOMMENDATION The proposed preliminary plat is generally consistent with and implements the Goals, Objectives and Decision Guidelines of the Urban category of the Comprehensive Plan. The proposed density and lot sizes are consistent with recent subdivision approvals in the area. As conditioned, the proposal makes appropriate provisions for water, sewer, parks, roads and other services as 10-9-96 HE Staff Report for PE-1800-96 Page 10 required by the Revised Code of Washington (RCV) 58.17. The Division of Building and Planning recommends approval, as conditioned. V. CONDITIONS OF APPROVAL i. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. ii. The conditions of approval apply to the preliminary su6division of . record. SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING 1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, as amended. 2. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 3. The Director of the Division of Building and Planning/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 4. A final plat/ name/number shall be indicated before the final plat is filed, such name/number to be approved by the Director of the Division of Building and Planning/designee 5. Appropriate road name(s) shall be indicated. 6. The preliminary plat is given conditional approval for five (5) years, specifically to November 1, 2001. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above eYpiration date. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies shall be received with the submittal of the final plat. 8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private and/or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 9. Prior to filing of all or a portion of the final plat the applicant's surveyor shall submit one or more maps outlined in red of the area being finalized. The scale shall match the appropriate assessor's map scale. 11. The Spokane County Division of Building and Planning shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Division of Building and Planning. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least five (5) feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing andJor newly dedicated right-of-way along 24th Avenue. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. 12. The final plat shall indicate yard setback arc lengths on cul-de-sac lots which meet or exceed the minimum frontage of the underlying zone of the final plat. 13. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Division of Building and Planning and County Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat, that the plan is in conformance with their respective needs and regulations. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 14. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor hannless from claims by any lot purchaser 10-9-96 HE Staff Report for PE-1800-96 Page 12 refused a building permit due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 15. The final plat dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Division of Building and Planning and water purveyor, shall be installed within this subdivision and the applicant shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." 16. No building permit will be issued for any lot within the final plat until certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat " including a signed license stamp. The certification may be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. 17. The Water Plan and the above four (4) conditions of approval regarding the Water Plan may be waived by the Director of the Division of Building and Planning/designee upon receipt of letters from the appropriate water purveyor and fire protection district stating that simple connections to an e.cisting, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 18. A survey is required prior to the filing of a final plat. 19. A copy of the homeowners/property owners' association articles of incorporation andlor bylaws and/or covenants and restrictions, together with any other provisions for maintenance of common areas and facilities, shall be submitted for review and approval to the Division of Building and Planning prior to finalizing. 20. Prior to approval of road and drainage plans, you are required to coordinate with the United States Postal Service to determine type and location of central mail delivery facilities which may include applicable easements for developments of three or more homes. 21. The owner shall negotiate with Central Valley School District and subrnit a recorded copy of a voluntary agreement making provisions for public schools prior to finalization and recording of the plat. The agreement shall provide a written description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mitigating measures. The owner shall also notify any potential purchasers who have made an agreement to purchase property within said plat pursuant to the Revised Code of Washington (RCV) 58.17.205, that adequate provisions for school facilities must be made conditioned on a future agreement between the platter and school district.
