FINDINGS OF FACT, CONCLUSIONS AND ORDER
INTRODUCTION
This matter has come before the Hearing Examiner Committee on September 22,
1994. The members of the Committee present are: Verona Southern, Chair, Jane
Myers and Donald Moore.
PROPOSAL •
The sponsor, Bob Tomlinson requests approval of a Preliminary Plat, PE-1751-94,
Midilome East to subdivide approximately 44.69 acres into 1271ots for single
family dwellings and those uses allowed in the existing Urban Residendal-3.5
(UR-3.5) zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The propeny is generally located south of and adjacent to 32nd Avenue,
approximately 1/4 mile east of Pines Road in Secnon 34, Township 25 North,
Range 44 EWM, Spokane County, Washington.
2. The Committee adopts the Planning Deparoment Report as a part of this record.
3. The existing land uses in che area include single and mula-family residences on
urban size lots with large undeveloped lots direcdy adjacent to the subject propeny.
Chester Elementary and Horizon Jumor High schools aze located direcdy to the
west of the site. .
4. The proposed use is compatible with existing uses in the azea.
5. The Comprehensive Plan designates this site as Urban. The Urban Category is
intended to provide for a"city-lilce" environment with intensive residential
development. The Urban category encourages "fill-in" development, provided
public services are available to the site. Densides in this category will range from 1
to 17 units per acre. The proposed density of 2.86 units per acre is in accord with
the densiry guidelines of the Urban category. The Prelirrunary Plat and proposed
density are generally consistent with the Goals, Objectives and Decision Guidelines
of the Urban category.
6. The existing zoning does implement and conform to the Comprehensive Plan.
7. The Arterial Road Plan designates 32nd Avenue as a Principal Arterial, with a
recommended right of way width of 100 feet. In order to implement the Arterial
Road Plan, the County Engineer has requested dedication of a 10 foot wide strip
along 32nd Avenue to be set aside as a future acquisidon area.

11. The Spokane Counry Planning Department shall prepare and record with the
County Auditor a Tide Norice specifying a future land acquisition area for road
right-of-way and utiliries. The reserved future acquisition area Tide Notice shall be
released, in full or in part, by the Planning Department The norice should be
recorded within the same time frame as an appeal and shall provide the following.
a. At least 10 feet of reserved future acquisidon area for road right-of-way and
utiliries, in add.ition to the exisdng and/or newly dedicated right-of-way along
32nd Avenue. NOTE: The Counry Eng-ineer has required 10 feet of new
dedication.
b. Future building and other setbacks required hy the Spokane County Zoning
Code shall be measured from the reserved future acquisition axea.
c. No required landscaping, parldng, '208' areas, drainfield or allowed signs
should be lacated within the future acquisidon area for road right-of-way and
.utiliries. If any of the above unprovements are made within this area, they
shall be relocated at the applicant's expense when roadway unprovements are
made.
d. The future acquisiriorLarea, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shall be responsible for relocating such "interim"
unprovements at the time Spokane County malces madway improvements
after acquiring said future acquisiuon area.
12. The plat dedicarion shall contain the following statement for those lots located on a
temporary cul de sac/stub road:
"Lot(s) [ Block(s) [ ] are located on a temporary cul-de-sac/stub
road. This temporary cul-de-sac/stub road may be extended to provide access to -
adjacent propercy and/or connect ta existing roads or new roads as development
and/or circulauon needs dictate."
13. The final plat shall indicate yard setback arc lengths on cul-de-sac lots which meet
or exceed the minimum frontage of the underlying zone of the final plat.
14. A plan for water facilities adequate for domestic service and fire protecrion shall be
approved by the water purveyor, appropriate fire protection dismct, County
Building & Safety Department and County Health District. The agencies will
certify on the Water Plan, prior to the filing of a final plat, that the plan is in
conformance with their respecrive needs and regulations. The Water Plan and
cerdficarion shall be drafted on a transparency suitable for reproduction and be
signed by the plat sponsor.
15. The water purveyor shall certify that appzopriate contractual arrangements and
schedule of improvements have been made with the plat sponsor for construction of
the water system in accordance with the approved Water Plan. The time schedule
shall provide for completion of the water system and inspection by the appropriate

21. 'I'he Owner shall negatiate with che Central Valle}+ Schovt District No. 355 and
submit a recorded capy of a vvluntary agreernent making pravisions fvr public
schoals privr xv finalizacian and recording of this plat. 'Ihe agreernent shaIl provide
a written descripdon of the subject property to which the agreement applies and also
staze the dollar aznount and any other agreed to rnirigating rneasuses.
The Owmer shall nvtify any potential purchasers whra have made an agreernent ta
purchase property wathin said plat gursuant to the Reviseci Code of Washingtan
(58.17.205), that adequate prvaisions far s~hool facilities must be made
conditivned an a future agreement between the plattor and che schval district.
Voluntary agreements hetween the Owner and Schooi district shall ccanform to t9~e

23. To satisfy the requirernents of RCW 58.I7.11[] that a subtiivisivn ma]ce apprQpriiate
pravisions for public parks, recreatian and pPaygzounds, the vwner, at his vptian, shall
either dedicate land withun fhe subiiyision or enter mto a vflluntary agreement with
Spolcane County to mitigate the direct ampacts that the subdirrision has on public parks,
open spaces and recreatianal facilities withxn the tanincorparated areas of Spvkane
County.
If the owner vpts to enter into a voluntary agreement, the agreement shall be executed
prior to the finalia_ation and recordang of the plat and re,cvrded in conjunction therewith.
'I'he agreement shall be cQnsistent with RCW 82.02.020 and substantially che same as
the standardized agreement prepa.reci by the Spvkane County Parks, Recreation and Fair
