Thank you for your cooperation with our office. I have received a copy of the caretaker agreement between James E. Sellers, owner, and Alison Clark, caretaker, dated August 25, 1986. I have also received a letter dated January 21, 1987, from Don A. Sellers, wherein he again states the need for a care- taker due to the 11:00 a.m. to 10 p.m., seven days per week, hours of the family business, Topcat Video located at 13905 E. Trent. Mr. Don Sel.l.ers also refers to additional hours which he spends at a part time job selling auto- mobiles. As far as our office is concerned Mr, Don Sellers has adequately established a caretaker arrangement with Ms. Clark. It is our understanding that the property, the dwelling unit and the-manufactured home are owned by James Sellers, who with his wife Mary occupies the dwelling unit with Don Sellers when they are not traveling. Ms. Clark, the caretaker, occupies the manufactured home. From the information you have submitted to us it appears that nearly the same conditions exist as existed when the permit was granted. It-was granted in perpetuity, as long as the applicant.James Sellers owned the property and occupied the primary residence. The records show that he is still the owner and that, with the exception of traveling, he does live in the residence. The caretaker has changed from Wayne Joy to Alison Clark, which is not of concern to us. As long as the relationships and occupants remain the same, with the excep- tion of the caretaker, the arrangement is substantially in conformance with the conditional use permit. At such time as the property is no longer owned by James Sellers and he is not one of the regular occupants of the house, the permit may either become void or need to be reestablished with a different owner; if the ircum f need remain substantially the same. Thank you for your letters of December 16, 1986. In order to settle this issue, we must have a clarification of the responsibility which your caretaker assumes in occupying the manufactured home on the property. As you may know, the complaintant has stated that if the caretaker is truly a caretaker, there is little evidence that the outside premises is receiving any substantial care in so far as it does not appear to be irrigated, seeded or generally cared for. The comp 1 a i ntant feels that you are presently misrepresenting the caretaker situation and are simply renting out the manufactured home as an additional source of income. This is exactly the kind of abuse which we vigorously seek to prevent. That is also the reason why I have addressed a letter to Ms. Clark asking her to clarify her role as a caretaker. I would encourage you to assist in that clarification. We believe one of the most obvious clarifications would be a written agreement for custodial or caretaking services expected from-Ms. Clark. If reduced rent is involved in an exchange for her services as a caretaker, this should be reflected in the rental contract and would go a long way to laying this complaint to rest. Webster's definition of "caretaker" is one who takes care of the house or land of an owner who may be absent. Therefore, it is conceivable that the care given to the primary residence might well be housekeeping services. I don't know; we are asking that you clarify this issue for us, preferably with copies of previously signed documents describing the relationship. One reason we feel there may be a legitimate complaint is the actual wording of your most recent letters. As we understand it, Don Sellers lives in the house owned by James Sellers. James Sellers is the owner of the underlying property also. James Sellers is apparently involved in travel, thus creating his frequent absence. We are also assuming that James and Mary Sellers live in the house with Don when they are not traveling. "Caretaker" or "Custodial Employee" was defined in the Zoning Ordinance in 1978 as "one who takes care of the property in the absence of the owner." In that respect, Don Sellers is the true caretaker of the property, as he takes care of it in the absence of James Sellers, the true owner. If you were applying for a permit for a custodian at the present time and it was apparent that Don Sellers has a job or jobs in the local area and resides in the house owned by his parents and that the parents occasionally reside with Don in the house, there would be absolutely no grounds for a caretakers residence. If Don Sellers chooses not to do the chores and maintain the property, he can hire somebody on a daily help basis for that purpose and does not need a resident caretaker. However again, as I say, if you can establish by separate documents that Ms. Clark is a caretaker who has some assigned responsibilities and duties and possibly pays less rent because of the trade-off for work which she undertakes, we are within the bounds of the definition of caretaker. My alternative is to call a public hearing to consider revoking the Conditional Use Permit if the purpose for which it was originally issued is no longer valid or needed. At this time, I do not feel the need to do that. Since we are responding to a complaint alleging abuse of the Conditional Use Permit, it is necessary that you provide clarification along the lines as I have outlined above and to do so within fifteen (15) days of the above date. If after 15 days, I have not received sufficient information clarifying the caretakers responsibilities and possibly a rental trade-off for these responsibilities, I will have to call a public hearing to consider whether or no oke the Conditional Use Permit for a caretaker. Rich. Both James and Don Sellers have stated to us in writing as well as over the phone that you are residing in the manufactured home northwest of the rest of the primary residence at E. 13513 Rich. They have stated that you are a "caretaker". However, we have a complaint which challenges whether or not caretaker functions are being performed. Rather, the complaintant speculates you are simply renting the manufactured home. If the later is the case, than a zoning violation exists. Would you please describe to me your responsibilities as a caretaker and whether or not you occupy the dwelling unit rent free or at a reduced rent in light of any caretaker responsibilities you perform. If you have a rental P* contract or an employee agreement which clarifies your relationship with the Sellers, it would be most useful for our file to contain a copy. I Just wanted to recap the conversations which you and I had during the past few days. You have made an inquiry as to whether an interpretation of my December 229 1985 letter to James E. Sellers, your father, may allow some continuance of the *caretaker's residence" if you were to assume ownership of the property. I believe in the third and fifth paragraph of that letter, the door was left oopen for an interpretation to continue the caretaker's residence. I advised you to submit a request for such an interpretation, clearly establish- ing in that letter the need for the continuance of the manufactured home as a caretaker's residence. One of the reasons that the concept of a caretaker's residence was dropped from many of the zones was because the abuse to which it was subjected by persons who would purchase the property and continue the second dwelling unit as income property when there was no need for a caretaker. Hence, we can only handle the situation of a transfer of this concept to a new property owner if we work this on an annual renewable basis. If your case is sound enough for me to establish the caretaker's residence use for your proposed situation, it would be granted only for a one year's period of time and would become renewable upon review and approval at the end of that period. In each case, a renewal would have to justify the same degree of need or cause as may be applicable in the current ordinances of the time. A prospective purchaser contacted us to determine the status of the subject mobile home on your property. This person was inquiring as to whether this unit would remain as a lawful, permitted use in the event the property was sold. I felt it aright be useful and helpful for us to share our answer with you. Your application stated that the permit was requested for an indefinite period as long as you were the owner of the ro e--t . The permit which was granted was or the use o a trailer as a res ence (for a caretaker) on the property and the permit was granted for an indefinite time period "...in connection with the previously described use" (emphasis added). Consequently at such point in time as you are no longer the owner of the erty, the subsequent owner will minimally be required to substantiate to Spokane County Zoning Adjustor that the second residence is for a a •a 1 1 a neea Tor a caretaker on the property. This can be done without the necessity of a public hearing if the information is submitted in writing and can be substantiated by a zoning enforcement investigator. If it cannot be substantiated that there is a need for a caretaker, the Zoning Adjustor may call for a public hearing, take testimony and render a decision with regard to whether or not the Conditional Use Permit should be revoked. This is provided for in the Zoning Ordinance in force at the time the Conditional Use Permit was issued and is presently in the Zoning Ordinance. If any person is aggrieved of such a decision of the Zoning Adjustor, that decision can be appealed to and reviewed by the Spokane County Board of Adjustment and upon the submission of the appropriate $75.00 appeal fee and paperwork.
