SUBJECT: INTERIM DISPOSITION OF CONDITIONAL USE PERMIT
This Conditional Use Permit file has been examined and a field inspection of the site has
occurred. More than likely, there is an expired permit and an unauthorized manufactured
home on this piece of property. Due to the length of time which this situation has gone
without being investigated, the Planning Department has decided not to take Zoning
Enforcement action unless there is a complaint involving this property and any
unauthorized manufactured home on the property.

CUE-91-78, Trailer as a Residence
ZONING ADJUSTOR DECISION: After public testimony and review, the decision
of the Zoning Adjustor is to approve the applicant's request for a mobile home as a
residence within the Agricultural Zone.
A. FINDINGS FOR APPROVAL: Pursuant to Section 4.24.016 (b) of the
Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility of
determining that the granting of a Conditional Use Permit will not be detrimental
to the surrounding properties. In assuring compatibility, the Zoning Adjustor
based his decision on the testimony presented at the October 18, 1978 Zoning
Adjustor Hearing as well as criteria set forth in the Spokane County Zoning
Ordinance for issuance of a Conditional Use Permit. The Zoning Adjustor
hereby finds the following:
1. The proposed mobile home is compatible with the area as evidenced by either
other mobile homes and/or mixed land uses in the immediate vicinity.
2. The described property meets the requirements as set forth in the Spokane
County Zoning Ordinance, for a Conditional Use Permit.
3. The applicant was able to demonstrate to the satisfaction of the Zoning Adjustor
by means of a letter from a practicing physician, that there is, in fact, a
dependency which is medical in nature.
B. ORDER:
1. Before a building permit can be issued, the applicant shall submit to the
Planning Department, evidence that the proposed property is in compliance with
the Spokane County Short Plat Ordinance.
2. The location of the trailer must be in such a fashion as to use ground cover for
sufficient screening.
3. The trailer shall be located on the subject property in substantial conformance
with the "approved" plot plan on file with this application, and in any case,
shall observe the yard (setback) requirements for a single-family dwelling as
prescribed in Section 4.05.110 (a) of the Zoning Ordinance of Spokane County.
4. The trailer shall be skirted with a fire resistant material.
5. The trailer shall not be mounted on a permanent foundation in such a manner as
to constitute a permanent residence.
6. The trailer shall not be attached to other residential or accessory structures.
Metal canopies, tip outs and awnings may be attached to the trailer, however, all
wooden structures and accessory buildings, except open porches, must be
detached and placed at least three (3) feet from the trailer. (If the mobile home
is to be located in Fire Zone II, this distance must be increased to forty (40)
feet, or a one-hour fire wall must be provided.)
7. This approval is granted for the use of a trailer as a residence for a dependent
relative of the applicant, and shall immediately terminate upon the dependent
relative no longer residing in the trailer. Upon this occurrence, the applicant
shall remove the trailer from the site within thirty (30) days.
8. The trailer shall have an ownership title and be listed as personal property with
the County Assessor.
