The above matters being.the consideration by the Zoning Adjustor for
Spokane County and pursuant to Chapter 4.25, Section 4.25.010 of the Spokane
County Zoning Ordinance granting the Zoning Adjustor the authority to hear
and decide such matters, and after conducting a public hearing on the above
matters to receive all public testimony, and in accordance with Chapter
36.70.810 Revised Code of Washington, and Section 4.25.030 of the zoning
ordinance, the Zoning Adjustor submits the following as the written record
of a class action findings for the above identified applications:
FINDINGS OF FACT
I.
That due to the heavy workload of the Planning Department staff during
this period of time, and due to staff resignations, written findings were
never completed.

That in each case, there is no public oppposition to the proposed pro-
ject, and the applicant was informed at the public. hearing and duly recorded ;
on tape that his application was approved with Findings of Fact stated and
the issuance of a building permit was authorized.

That these actions were found to be consistent with previous actions and
therefore will not be materially detrimental to-the public welfare or injurious
to adjacent properties and improvements.
IV.
That-all conditions of approval have been or can be met prior to the
issuance of a building permit, and specifically the requirements of the
Spokane County Health District and County Engineer's Office have been met.
CONCLUSION OF LAW
I.
That the Zoning Adjustor of Spokane County has jurisdiction over the
issuance of the building permit for the project to the applicant pursuant to
the provi.si,ons of Chapter 36.70.810 (2a) and (2b) RCW and Sect ion 4,25.030
(bl) and (.b2) of the Spokane County Zoning Ordinance.

That the applicant submitted an application to the Planning Department
requesting a public hearing before the Zoning Adjustor, and that pursuant to
Chapter 36..70.840. and Section 4.25.040 of the zoning ordinance, notice for a
public hearing was given through the United States mail to all property owners
within a radius of 300 feet from the subject property.
III.
That all citizens and public agencies having jurisdiction notified were
afforded the opportunity to testify or submit written comments on the proposed
project.
IV.
That pursuant to the above cited provision of law, Findings of Fact here-
inabove substantiates approval of the variance and issuance of a building permit
for the project.
V.
Any Finding of Fact hereinabove stated which is deemed to be a Conclusion of
Law i.s adopted as the same.
Therefore.be.it resolved that these files are complete with Findings of
Fact and can be closed,

ZONING ADJUSTOR DECI'SI'ON: After public testimony and review, the decision of the
Zoning Adjustor is to 4iED (deny) the applicant's request to allow a mobile
home as a residence within the Agricultural Zone.
A. FINDINGS FOR APPROVAL OR DENIAL: Pursuant to Section 4.24.010 (,b) of the
Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility of
determining that a use will not be detrimental to the surrounding properties.
In determining compatibility, the Zoning Adjustor based his decision on the testi-
mony presented at the CSC ' 1Q Zoning Adjustor Hearing as well
as criteria set forth in the Spokane County Zoning Ordinance for issuance of a
Conditional Use. The Zoning Adjustor hereby finds the following:
1. The proposed mobile home is compatible with the area as evidenced by
either other mobile homes and/or-mixed land uses in the immediate vicinity.
2. The described property meets the requirements as set forth in the Spokane
County Zoning Ordinance, for a Conditional Use Permit.
3. The applicant demonstrated to the satisfaction of the Zoning Adjustor that
sufficient screening can be provided so as not to conflict with adjacent
land uses.
4. It was substantiated by evidence from the staff presentation, the lot was
found to be a non-conforming lot of record by definition from the Spokane
County Zoning Ordinance.
5. The applicant was able to demonstrate to the satisfaction of the Zoning
Adjustor by means of a letter from a practicing physican, that there is,
in fact, a dependency which is medical in nature.

B. ORDER:
1. Before a building permit can be issued, the applicant shall submit-to the
Planning Department evidence that the proposed property is in compliance with
the Spokane County Short Plat Ordinance.
2. Subsequent to a building permit being issued, access permits must be
obtained from the County Engineers' Office.
3. The location of the trailer must be in such a fashion as to use ground
cover for sufficient screening.
4. The permit shall be subject to the conditions that existed in the previous
permit.
5. The trailer shall be located on the subject property in compliance with
yard (setback) requirements for a single-family dwelling as prescribed in
Section 4.05.110 (a) of the Zoning Ordinance of Spokane County.
6. The trailer shall be located on the subject property in substantial con-
formance with the "approved" plot plan on file with this application, and
in any case, shall observe the yard (setback) requirements for a single-
family dwelling as prescribed in Section 4.05.110 (a) of the Zoning
Ordinance of Spokane County.
7. This approval is granted to at which
time any permit issued pursuant to this approval shall become null and
void.
8. The trailer shall be skirted with a fire resistant material.
This approval is granted for the use of a trailer as a residence for a
caretaker of the subject property. This approval is granted for an
indefinite time period in connection with the previously described use.
10. The existing residence on the subject property shall be removed prior
to the occupancy of the trailer house.
11. The trailer can be mounted on a permanent foundation in such a manner as
to constitute a permanent residence, with or without a basement.
12. The trailer shall not be mounted on a permanent foundation in such a
manner as to constitute a permanent residence.

3. The trailer shall not be attached to other residential or accessory
structures. Metal canopies, tip outs and awnings may be attached to
the trailer, however, all wooden structures and accessory buildings,
except open porches, must be detached and placed at least three (3)
feet from the trailer. (If the mobile home is to be located in Fire
Zone II, this distance must be increased to forty (40) feet, or a one-
hour fire wall must be provided).
14. This approval is granted for the use of a trailer as a residence for a
dependent relative of the applicant, and shall immediately terminate
upon the dependent relative no longer residing in the trailer. Upon
this occurrence, the applicant shall remove the trailer from the site
within thirty (30) days.
15. The trailer shall have an ownership title and be listed as personal
property with the County Assessor.
