SUBJECT: Assessor's Parcel Number 13544-1801; Expired Conditional Use Permit
#CUE-61-78, Trailer as residence for Dependent Relative.
On August 14, 1978, the Spokane County Zoning Adjustor granted a
conditional use permit to allow you to house a dependent relative (at that time
listed as Ada L. Cronk). The permit was granted subject to several conditions (see
attached). Condition #4 said that the approval was granted for an indefinite
period of time, but that five (5) years after its being granted, the permit would be
reviewed administratively to determine if the -mobile home was a "compatible land
use." Such an inspection should have occurred on August 14, 1983, but there is no
evidence in the file that such an inspection occurred.
On August 15, 1988, John Harrington, Spokane County Zoning Enforcement
Officer, inspected the property and reported that a creme colored manufactured
home with brown trim is present on the south Y2 of the property. We need
verification that the present situation is an authorized situation and not a
violation of the Zoning Ordinance. In effect, I need to begin the process of
administrative review which should have occurred on August 14, 1983.
Condition #1 stated that before a building permit for the manufactured
home could be issued, the applicant was to submit information to the Planning
Department proving that the proposed property is in compliance with the
Spokane County Short Plat Ordinance. I don't believe the file contains the
requested information, although there is a copy of a Certificate of Survey from
August 13, 1968. The situation will be reevaluated by our Subdivision section. I
will respond later to you.
Finally, Condition #8 stated that the approval was granted for the use of the
manufactured home as a residence for a dependent relative of the applicant
(specifically), and the approval shall terminate upon the dependent relative no
longer residing in the manufactured home. Condition #8 continued to say that in
the event that the dependent relative no longer resided in home, the applicant
shall remove the manufactured home from the site within thirty (30) days. We
need to verify that the situation is still consistent with the Zoning Ordinance. I
have enclosed two (2) forms which are routinely used in annual reviews of
dependent relative conditional use permits. The 14" long green form is to be filled
out and notarized by yourself with regard to the dependent relative living in one
of the two buildings on the property. The second form needs to be filled out by
the dependent relative's physician, signed by the physician, and returned to our
office. The administrative fee for a renewal of dependent relative conditional use
permit is $15.00. This review and verification occurs annually.
If the situation is one of the dependent relative living in the dwelling unit,
please fill out the required forms and return them to our office with the $15.00
administrative fee. Specifically, what we are seeking is that Ada Cronk still
resides in the manufactured home or the other dwelling unit, that she is mentally
or physically dependent upon others for care of her person or property, and that
you and a physician verify that dependent circumstance.
In the event that a dependent relative situation no longer exists, you may
wish to explore with John Pederson of our office the possibility of dividing the
one (1) acre parcel into two (2) smaller parcels, each parcel containing one
residence.
I set the end of the business day on September 28, 1988 as the time in which
you should have begun the work in our office of clarifying the situation. That is,
either clarifying that we have an on-going dependent relative situation
consistent with the original permit, or that you are alternatively investigating
the dividing of the land into two (2) parcels to accommodate the two (2) dwelling
units which presently exist on the same parcel of land. Additionally, it may be
necessary verify to the Subdivision section of our office that the property is in
compli a with the Spokane County Short Plat Ordinance.

Zoning Adjustor is to approve- (d I the appli'cant's request to allow a mobile
home as a residence wi thi'n he A ri~cul tural Zone.
A. FINDINGS FOR APPROVAL OR DENTAL: Pursuant to Section 4.24.010 (b) of the
Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility of
determining that a use will not be detri'mental to the surrounding properties.
In determi.ni'ng compatibility, the Zoning Adjustor based his decision on the testi-
mony presented at the' I Zoning Adjustor Hearing as well
as criteria set forth. i.n the SAatpkane County Zoning Ordinance for issuance of a
Conditional Use. The Zoning Adjustor hereby finds the following:
J1. The proposed mobile home is compatible with the area as evidenced by
either other mobile homes and/or-mixed land uses in the immediate vicinity.
J 2. The descri=bed property meets the requirements as set forth in the Spokane
County Zoning Ordinance, for a Conditional Use Permit.
3. The-applicant demonstrated to the satisfaction of the Zoning Adjustor that
sufficient screeni=ng can be provided so as not to conflict with adjacent
land uses.
4. It was substantiated by evidence from the staff presentation, the lot was
found to be a non-.conformi.ng lot of record by definition from the Spokane
County Zoning Ordinance.
J 5. The applicant was able to demonstrate to the satisfaction of the Zoning
Adjustor by means of a letter from a practicing physican, that there is,
i'n fact, a dependency which is medical i.n nature.

1 Before a building permit can be issued, the applicant shall submit to the.
Planning Department evidence that the proposed property is in compliance with
the Spokane County Short Plat Ordinance.

2. Subsequent to a building permit being issued, access.permits must be
obtained from the County Engineers' Office.
The location of the trailer must be in such a fashion as to use ground
cover for sufficient screening.
4. The permit shall be subject to the conditions that existed in the previous
permi t.
5. The trailer shall be located on the subject property in compliance with

yard (setback) requirements for a single-family dwelling as prescribed in
a
Section 4.05.110 (a) of the Zoning Ordinance of Spokane County.
The trailer shall be located on the subject property in substantial con-
formance with the "approved" plot plan on-file with this application, and '

8. The trailer shall be skirted with a fire resistant material.
9. This approval is granted.for the use of a trailer as a residence for a
caretaker of the subject property. This approval is granted for an
indefinite time period in connection with the previously described use.
10. The existing residence on the subject property shall be removed prior
to the occupancy of the trailer hbuse.
11. The trailer can be mounted on a permanent foundation in such a manner as
to constitute a permanent residence, with or without a basement.

The trailer shall not be attached to other residential or accessory
structures. Metal canopies, tip outs and awnings may be attached to
the trailer, however, all wooden structures and accessory buildings,
except open porches, must be detached and placed at least three ,(3)
feet from the trailer. (If the mobile home is to be located in Fire
Zone II, this distance must be increased to forty (40) feet, or a one-
hour fire wall must be provided). -
This approval is granted for the use of a trailer as a residence for a
dependent relative of the applicant, and shall immediately terminate
upon the dependent relative no longer residing in the trailer. Upon
this occurrence, the applicant shall remove the trailer from the site
within thirty (30) days.
The trailer shall have an ownership title and be listed as personal,
property with the County Assessor.
