use of on-site sewer disposal systems is hereby authorized. This authoriza-
tion is conditioned on compliance with all rules and regulations of the
Spokane County Health District and is further conditioned and subject to
specific application approval and issuance of permits by the Hea•lth District.

(7) A dry sewer connection to the future area-wide Sewerage System is to be con-
structed. Plans and specifications for the dry sewer connection are to be
reviewed and approved by the Utilities Department.
(8) Located within the Critical blater Supply Service Area but not within any
ourveyo r's district. May be serviced by an individual well owned and oper-
ated by lot owner.
(9) Any sewerage service for this project shall be provided in accordance with
the Comprehensive Wastewtaer Management Plan fo r Spokane County, as amended.

Permit No. CUE-46-78 SECOND NOTICE
The above Conditional Use Permit to allow location and use of a manufactured home to
temporarily house dependent relative, Della Conant, as associated with the above permit,
expired August 1, 1988. If the manufactured home and dependent relative situation still
exists, it is in violation of the Spokane County Zoning Ordinance.
On July 18, 1988 a notice was mailed to you stating the expiration date of this
permit. Accompanying that notice was an Affidavit of Dependent Relative Circumstances and
Statement of Attending Physician for Dependent Relative. These were to be returned to our
office along with the fifteen (15) dollar fee necessary to renew this Permit. We are
enclosing these forms again with this second notice in case they may have become lost or
misplaced. It is essential, in order to renew this permit, that we receive the completed
forms back in our office by September 18, 1988.
If you do not choose to renew the permit for the Conditional Use Permit by the above

A one year renewal/extension may be granted administratively and without a
public hearing if we can find that the circumstances leading to issuance of the

wish to renew the permit, please submit the following within approximately the next
thirty (30) days.

TEilPORARY RESIDENCE FOR DEPENDENT RELATIUE ) DECISION AND CONDITIONS
THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane
County, i n he ari ng the appl i cati on ( CUE-46-78) , for the purpose of mai ntai ni ng
a temporary mobi le home on the property for Del1 a Conant, a dependent rel ati ve, -
hereinafter referred to as the "Proposal", and the Zoning Ad,justor of Spokane
County having held a public hearing on July 11, 1984 and having fully considered
all testimony presented thereat, and further having visited the site and vicinity
in question, and havi.ng rendered a decision on the 18th day of July, 1984,
APPROVING said proposal, does hereby make the following:
FINDINGS OF FACT
l. That the proposal is generally located west and adjacent Progress Road
and approximately 120 feet north of 32nd Avenue in Section 26-25-44. Parcel #
26544-1555,
2. That the proposal consists of maintaining on a temporary basis a mobile
home for the above named party.
3. That the adopted Spokane County Generalized Comprehensive Land Use Plan
indicates Suburban usage of the area encompassed by the proposal.
4. That the site is zoned Agricultural.
5. That the existing 1 and uses in the area of proposal i ncl ude resi denti al
uses on parcels ranging generally from 1/2 to 10 acres, together with small grazing
fie1ds and farm animals.
6. That the mobile home has been established generally in accordance with the plot plan approved in 1978.
7. That th.e appl i cant has submi tted a 1 etter from a 1 ocal physi ci an i ndi cat-
ing the continued desirability of care for Mrs. Conant.
8. That opposi ti on to the proposal was presented by ad,j acent 1 and owners who presented photographs showing Mrs. Conant was not an inval i d and di d many
no rmal househol d acti vi ti es wi thout ass i stance.
9. Those opposed further i ndi cated that the mobi 1 e home di stracts from thei r
view and creates too high a density for the area.
10. That the Spokane County Zoning Ordinance does not require a relative to
be total ly dependent on others for thei r care or needs to request the dependent
rel ati ve pe rmi t.
11. That the testimony at the hearing generally indicated that relocation
of the tempol^ary residence would not cure the objections to thr requested renewal.
12. That the proper legal requirements for advertising of the hearing before
the Zoni ng Adj ustor of Spokane County have been met.
CONCLUSION
Fol lowing review of the P1 anning Department file, consi deration of the publ i c
testi mony, and circumstances i n the area of proposal, the Zoning Adjustor concl udes
that the proposal is not detrimental and is generally compatible to the public
health, safety and welfare. '
DECISION From the foregoing Findings, a review of the Planning Department file No.
CUE-46- 78, testi mony at the publ i c hearri ng and a si te vi si t, the Zoni ng Ad,j ustor
hereby in APPROVING the proposal establishes the following conditions:

tions of the Spokane County Heal:th District and is further conditioned
and subject to specific application approval and issuance of permits by
the Heal th Distri ct.
3) The Owne r(.s ) o r Successo r(.s ) i n i nterest ag ree to autho ri ze the County
to place their name(s) on a petition for the formation of a ULID by
petition rnethod pursuant to RCW 36.94 which the petition includes the
Owner(s) property and further not to object by the signing of a protest
petition against the formation of a ULID by resolution method pursuant
to RCW 36.94 which includes the Owner(s) property. PROVIDED, this
condition sh.all not prohibit the Owner(s) or Successor(s) from objection
to any assessment(s) on the property as a resul t of i mprovements cal 1 ed
for in conjunction with the formation of a ULID by either petition or

length. and at least eight (_8) feet in width, constructed in accordance
wi,th State of Washington or Federal manufactured home construction
standards as evi denced by the attachment of an insi gni a desi gned for

own chassis and whee1s, and arriving at the site where it is placed on

and fdmi ly, or by the rel ati ve and fami 1y provi di ng care to the dependent
relatlye owning and occupying the principal residence.
7) .Upon termination of the need for care or the sale or lease of the
property, the app1 icant shal 1 remove the manufactured home from the si te
wlth_ln farty--flye (45) days.
8) A statement shall be recorded i n the County Audi tors Offi ce stati ng that
the manufactured h.ome is temporary and for the use of the dependent
rel ati ve for wh_ich_ the condi tlonal use pe rmi t i s-approved and not con-
sl .dered a permdnent structure to be transferred with the property if
sol d or 1 eased, The statement shal 1 i ncl ude a 1 egal descri ption or
recording info.rmation from the deed or sale agreement.
9) The temporary residence shall be accessory only to a parcel or tract of
land under the ownership or lease by the applicant for the Conditional
Use Permi t.
10) The pl acement of the manufactured home shal 1 be i n compl i ance wi th al 1
pl at dedi cati ons.
11) The mobility gear shall not be removed, and the unit shall not be per-
manently affi xed to the 1 and, except for temporary connecti ons to
utilities.
12) Only one residence may be permitted on a lot, parcel or tract of land
under the wnership or lease by the applicant for the Conditional Use
Permi t.

We are opposing this permit for the following reasons: f

~ In 1978; the 2.pplicant spoke to us over the fence between our ~ properties stating that he' d like to put a srnall trailer in for
~ his mother who was elderly, ill and not able to care for herself. •

' did telz Mr. Conant that we had bought our house in 1976 after living in a mobile home for 6 years. One main reason we bought -
~ in thi s area tivas because our back yard faced other back yards and
~ open fields. Thi s appealed to us after hav.ing to look out our
~ windows right into our neighbors windows for 6 years. We would not ,
j have bought our house had there been a large mobile home already in. .
Mr. Conant assured us that he' d keep the trailer as far east as he
; could so aC not to block our view outside our dining room window. ~
Expecting a small trail.er, we were shocked when he moved in at least '
a 12 X 60 foot mobile home and parked it dirPCtly in front of our dining room window. '
When Mr. Conant' s mother moved in, she also had her own vehicle. We °
have' witnessed-her driving the ca'r by herself on numerous occasions. ~
She does her laundry and hangs it outside to dry, prepares her own +
meals, waters the lawn, plants and harvests vegetables in the garden,
pl2nts and cares for flowers, pulls weeds, ,nows the lawn around the
mobil~_- home and oaf-rys her garbage can out to the road. I-'ve attached '
pictures taken.in May' of this year showin; some of the activity. I t i s al so our unde r standing that bo th Mr. , and Mrs. Conant wo rk out si de
the home and at least during the surnmer of 1978 the elder Mrs. Cona.rit ~
cared for her grandkids during the day. We had also understood that
Mr. Conant' s wife had had open heart _surgery 'within the past year.
As recent as July 5, 1984, the.elder Mrs. Conant left in her car
by herself and later returned home with a large grocery bag of
groceries froln Warehouse IvIarket. July 9, 1984, she left in her car
by herself at 8:20 a.m, and was gone for a few hours. Again on
July 10, 1984, srle left in her car before noon returning home at
4:15 p.m, and carrying a large sack of groceries out of her car.

These activities have been the same for the past 6 years. Wz feel we
were purposely decieved by the size of the trailer and the stated
physical condition of Mr. Conant's mother. To us, she appears to
be very capable of caring for herself.

Della Conant is a 80-year old lady xhom I have seen on March 22, 19?89
complaining of discomfcrt in her chestg primarily associated with
exertion. This also gives her trouble xith her breathing when it
occurs. It ist however, relieved by rest. This has been a symptom
xhich has been present for about the pa.st year. Physica.l Exam in
the office shoxs a slightly elevated Blood Pressure. She has fairly
izregular hea.rtbeat and her EKG shows irregular beats, but also signs
of Ischemia.
In summarizing these findings, I Would say this lady has significant
heart disease xhich could present her with problems at any time. I
feel because of her age, and because of these findings, that locating
near a relative xould be extremely helpful in her future care, as she
will proba.bly need someone to check on her periodically, as fa.r as her
health status is concerned.

. This is to inform you that your temporary conditional use permit for
the manufactured home located on your property for a dependent relative has
expired. As the permit lapsed in June 1983, a public hearing will have to
be scheduled and testimony taken before the permit can be renewed.
In order for this office to schedule a public hearing a new temporary
pe rmi t appl i cati on must be s ubmi tted. At the ti me that you s ubmi t an
appl i cation and the requi red fee, a hearing before the Zoning Adjustor of
Spokane County will be scheduled. Also, at this time we will explain the
