FINDINGS OF FACT AND CONCLUSIONS COMPLIANCE WITH THE STATE ENVIRONMENTAL POLICY ACT(SEPA): Findings: Ordinance No. 48 (effective March 31, 2003) adopted on an interim basis by reference the Spokane Environmental Ordinance (Spokane County) thereby implementing the State Environmental Policy Act (SEPA) and Chapter 197-11 of the Washington Administrative Code (WAC) within the jurisdictional limits of the City of Spokane Valley. The Current Planning Division determined that the request is categorically exempt pursuant to WAC 197-11-800-6.b (Minor Land Use Decisions). Staff Report and Notice of Decision for ADV-06-04 April 5,2004 2 of 5 • Conclusion(s): Staff conclude that compliance with the State Environmental Policy Act(SEPA) is not required. ZONING CODE CONFORMITY: Findings: Section 14.404.090 (Administrative Variance) Section 14.404.09.0 (Conditions for Granting an Administrative Variance) specifies the approval criteria for the granting of an administrative variance, all of which must be complied with, if applicable. The following are staffs findings and conclusion (s)for each of the'criterion: 1. The administrative variance does not detract from the desired character and nature of the vicinity in which it is proposed. Finding (s): The subject property is zoned Urban Residential-3.5 and is currently occupied by a duplex. Surrounding, abutting and adjacent properties are also zoned UR-3.5 and are residential in nature. The purpose of the administrative variance request is to facilitatethe approval of a building permit for a previously constructed deck cover to the duplex structure for only one (1) unit addressed as 1102 North Woodward Road, within the required front yard setback. Pursuant to Section 14.616.325.A.1 of the Spokane Valley Interim Zoning Code, the minimum front yard setback of a structure without an administrative variance authorization is twenty-five (25) feet from centerline from'the property line. The applicant's request seeks authorization to encroach into the required front yard setback by 4.83 feet. No other modifications to the UR-3.5 zoning standards are proposed by the applicant. The administrative variance request will not by itself change the existing residential character of the subject property as the proposed setback reduction to the previously constructed deck cover is an acceptable and reasonable land use for the existing duplex purposes of the subject property. Conclusion (s): Criterion 1 is satisfied. The administrative variance request will not by itself change the existing residential character of the subject property or surrounding properties. 2. The administrative variance enhances or protects the character of the neighborhood or vicinity by protecting natural features, historic sites, open space, or other resources. Finding (s): The subject property is currently developed with a single duplex structure. Staff has reviewed applicable adopted plans and maps including the City of Spokane Valley Interim Critical Areas Maps, the City of Spokane Valley Interim Shorelines Management Program and the Federal Emergency Management Agency's Flood Insurance Rate Maps (Community Panel No. 530174 0300 C dated September 30, 1992)and has determined that there are no natural features, historic sites, open space or other such resources at or near the site Conclusion (s): Criteria 2 is not applicable. 3. The administrative variance does not interfere with or negatively impact the operations of existing land uses and all legally permitted uses within the zoning district it occupies. Finding (s): The operations of existing land uses surrounding the property are varied between single- family residential, multi-family residential and duplexes. The existing property contains a duplex such as what is located further to the north and east of the subject property. The adjacent property owners may, at some time in the future, choose to build closer to the street, but the previously constructed addition is Staff Report and Notice of Decision for ADV-06-04 April 5,2004 3 of 5 proposed to be constructed on the west side (Woodward Road) of the subject property and conform to all applicable building setback requirements of the Spokane Valley Interim Zoning Code per approval of this administrative variance request. Conclusion (s): Criterion 3 is satisfied because the administrative variance does not interfere with or negatively impact the operations of existing land uses and all legally permitted uses within the zoning district it occupies. 4. Granting the administrative variance does not constitute a threat to the public health, safety and welfare within the City. Finding (s): Staff find that the existing deck cover does not currently impact emergency personnel's ability to access the lot or surrounding lots because there will remain 20.17 of front yard setback upon any approval of the administrative variance request and there is currently a twenty-one (21) feet side yard setback on the south side of the property. Conclusion (s): Staff conclude that the front yard setback authorized by the administrative variance request would not interfere with requirements for emergency access, that there is adequate emergency access ability in the front yard and side yard setbacks and that the existing deck cover is not constructed at or in close proximity to the subject property lines. Staff therefore conclude that Criterion 4 is satisfied because the granting of the administrative variance does not constitute a threat to the public health, safety or welfare to the public within the City. 5. In addition to theabove conditions a variance may be issued when the following specific conditions exist: a. A parcel prior to the adoption of this zoning ordinance did not meet the buildable square footage requirements for a parcel in a particular zoning district. b. A dwelling has been rendered legal non-conforming due to setback, height and size and thus cannot be expanded or otherwise reconstructed in a particular zoning district; or c. Where duplexes are permitted, but due to dwelling (s) having been built prior to the adoption of this zoning ordinance, the minimum size parcel cannot be met, an administrative variance may allow the existing building or buildings to be reconstructed as a duplex.. Finding (s): The subject property meets current buildable square footage requirements as specified in Section 14.616 (Urban Residential-3.5) of the Spokane Valley Interim Zoning Code. The City has not classified the existing on-site dwelling as a legal non-conforming dwelling. The existing on-site dwelling is currently intended for duplex use only, and is not proposed for reconstruction or reclassification to a single-family structure. Conclusion (s): Criteria 5. a-c are not applicable. III. DECISION Based on the preceding analysis, the Current Planning Division staff concludes that the administrative variance request meets the required criteria and therefore APPROVES ADV-06-04 subject to conformance with the following conditions of approval: 1. The allowable front yard setback for the previously constructed deck cover shall be a minimum of 20.17 feet from the front property line. Conditional . approval of the administrative variance request shall` not be construed as an authorization for any additional new construction at the subject property. Any additional future construction shall not occur without first obtaining required City and/or other agency approvals. 3. In order for the administrative variance approval to be effective, the applicant shall obtain an approved building permit from the City of Spokane Valley Building Division for the previously constructed deck cover. IV. APPEAL OF DECISION Pursuant to Section 13.900 (Appeals) of the City's adopted "Application Review Procedures for Project Permits", a written appeal of the Staff Report and Notice of Decision shall be filed with the City of Spokane Valley Community Development Department within fourteen (14) calendar days after the date the notice of the decision is mailed. Pursuant to Section 13.900.110 (Contents), an appeal shall contain all of the following information: 1. The file number designated by the review authority and the name of the applicant. 2. The name, address and signature of the appellant and a statement regarding the legal standing of the appellant to appeal. If multiple parties file a single appeal, they shall designate one part as the representative for all contact with the review authority. 3. The specific aspect (s) of the permit decision and/or SEPA issue being appealed, the reasons why each aspect is in error as a matter of fact or law, and the evidence relied upon to support allegations of error. 4. All statutory requirements for appeals of land use decisions of land use decisions, including land use petitions filed in superior court pursuant to RCW 36.70C shall be complied with. 5. Any required appeal fees. Pursuant to the currently adopted Fee Schedule, the current fee for an appeal of an administrative decision is $250.00. Please note that that this fee may be changed by City Council adoption of an ordinance updating the Fee Schedule. Pursuant to Section 7 of Ordinance No.57, the Hearings Examiner shall conduct a public hearing on appeals ofadministrative decisions made by the Current Planning Division. Pursuant to Section 11 of Ordinance 03-081, the Hearings Examiner's decision on the appeal shall be final and conclusive and shall have the effect of a final decision of the City Council. Standing to appeal a decision shall be determined in accordance with the provisions of Section 13.900.102 (General). Requesting an"ADMINISTRATIVE VARIANCE" Dear Karen Kendall, This letter is in regards to Linda Olsen and the deck cover issue. You have asked me to write "why"we are asking for a variance. For the following reasons, please understand Mrs. Olsen's requests. The following structure is already built and built with a 5.0 Los Angeles earthquake in mind. Even though, through not intentionally thinking anything was being built out of place or of the such, Linda Olsen had this deck cover built over an"existing"front deck. Keeping to a thought that building this deck may help keep the water from getting on the deck, we at this time would like to keep the existing structure were it is, and just simply add to what is yet needed to comply with the building codes per Barry Husfloen's stop notice document, his concerns, and any other building codes that may need to be identified. At this time regarding this deck, we see no detracting from what is in the neighborhood nor at this property, in fact, it is an improvement to the character in a cosmetic way from a "curb and gutter approach." This porch cover"does not"in any way shape or form, interfere with or have a negative impact on any existing land uses. As stated above, it is an improvement to the city and to the neighborhood. Granting this variance "would not" constitute a threat to the public health, safety and welfare within the.city. We would ask that you please except this deck cover due to all that we have mentioned in the above writings and statements.
