~ S2 That a statement be placed in the dec,ication to the effect that no more

WARNING: Spokane County has no responsibility to build, improve,
maintain, or otherwise service the private roads contained within or
providing service to the property described in this plat. By accepting
this plat or subsequenrly by aliowing a building permit to be issued
on prnperty on a private road, Spokane County assumes no obligation for
said private road and the owners hereby acknowledge that the County has
no obligation of any kind or nature whatsoever to establish, examine,
survey, construct, alter, repair, improve, maintain, provide drainage or
snow removal on a private road. This requirement is and shall run
with the land and shall be binding upon the owner, their heirs, successors
or assigns including the obligation to participate in the maintenance of
the private road as provided herein.
S21 That each lot be authorized for the use of individual on-site sewage
disposal systems.
S22 The dedicatory language of the plat will state the sponsor will assume
no responsibility for provision of domestic water.
S23 That conditional approval be given subject to provisions in the plat for a
public sewer system. Approval of the design of said systems must be
given by County and State Health authorities and the County Utilities
Department prior to filing of the final plat. A suitable guarantee will
be required to cover the cost of providing said system in the amount as
determined by the Public Worics Department.
S24 That a statement be placed in the dedication to the effect that a public
sewer system will be made available for the plat and individual service
will be provided to each lot prior to sale.
S25 Prior to filing of the final plat, the sponsor shall present evidence that
the plat lies within the recorded service area of the proposed water
dis trict .
S26 That an on-site sewage managemznt system be created and approved by the
Spokane County Health Dis trict prior to filing of the Final Plat.

S27 That a plan for water facilities adquate for fire protection be approved
by the water supplier and fire protection district. Said water plan must
also have been approved by the appropriate health authorities. The
health authorities, water supplier (purveyor) , and fire protection district
will cerrify, prior ro the filing of the final plat, on the face of said
water plan that the plan is in conformance with their requirements and
will adequately satisfy their respective needs. Said water plan and
certification will be drafted on a transparency suitable for reproduction,

ARTICLE 1
l. Purpose of the Association: The Association's primary func-
tion is the maintenance and oversight of the management and the operation
of the on-site sewage disposal system. The system is defined and composed
of: A. The collective on-site building sewers, treatment systems and
disposal systems.
ARTICLE 2
l. On-Site Sewage disposal system Rules: The Association shall:
A. Contract with a licensed agent who shall not less than once every three
years, or if required, more often, pumpout, inspect each on-site disposal
system and service the treatment facilities and system in accordance with
accepted standards and procedures, and, B. Cause to be inspected and repaired
components of the system when required by the Spokane County Health District.
The Spokane County Health District may from time to time inspect the system
for satisfactory function and compliance. Users of the system shall intro-
duce into it no materials such as paints, oils, solvents, and chemicals other
than those and in quantities normally used in the home.

ARTICLE 3
l. Limited Easement: A. Ingress and egress to each lot in the
North Warren Road Lots for se rvicing the on-site sewage disposal system.
B. Limited easement: The easement is for limited purposes only. The
respecti ve 1 ot owners shal 1 en joy ful 1 use and pri vacy from trespasses i n
every way except as required for the periodic, or emergency inspection and
repair of the system. This paragraph does not preclude the erection of
fences such as chain link, wood, or other matierals that can be temporarily
removed for service or repair of the system components.
ARTICLE 4
l. Assessments and Liens: Each homeowner whose dwelling is
connected to the sewage disposal system shall be assessed by the association
for his equal share of the cost and maintenance and repair of their system.
Such costs shall be defined and determined by the association according to
its rules and regulations so adopted. If any homeowner shall fail to pay
the required assessment in the amount and time prescribed, the association
may decla re the amount delinquent and place a lien aqainst the respective
homeowner's respective property.
ARTICLE 5
l. Dissolution of the Association: The association may by a
majority vote of the homeowners be dissolved, provided that: A. All

connected to a municipal sewer line servicing same when and if built by
Spokane County or other Municipal Corp. B. At such time as the treatment
and disposal system and its components are abandoned, the limited easement
providing for said system shall be vacated to or in part, such parts being
retai ned for conti nued and future use i f requi red and each parcel of sai d
easement or portions thereof shall revert with clear title and without
charge to the respective owners. Easements or parts thereof shall not
revert to the owners of the 1 ots unti 1 the Spokane County Heal th Distri ct
shall have determined and agreed in writing that the easements or portions
thereof are no 1 onger requi red for the operati on of any communi ty or
municipal sewage system serving North Warren Road Shortplat. (78-017)

ARTI CLE 6
l. Annual hleeting: The annual meeting of the lot owners of
the association for the election of officers to succeed those whose terms
expire, and for the transaction of such other business as may properly
come before the meeting, shall be held each year at the home of the
current Fresident of the Association on the date and at the time herein-
afte r specified, if not a legal holiday, and if a legal holiday, then
on the next day at the same time of day. The day and time for said
annual meeting shall be: lst Tuesday of May, 7:30 P.M.
2. Special Meetings: Special meetings of the association
for any purpose or purposes may be called at any time by the association
to be held at such time and place as the association my prescribe.
3. Notice of Meeting: No notice of the annual homeowners
meeting shall be required.
4. Method of Breaking Tie-Vote: In the event of a tie vote,
a fl i p of a coi n saTI set-t-l et-he matter.
5. Voting Privileges: Each homeowner has the power of one
vote.
ARTICLE 7
l. Officers Enumerated--Election: The officers of the
association shall be a Nresident and a 5ecretary/Treasurer, all of whom
shall be elected by the majority vote of all homeowners at the annual
meeting thereof, to hold office for the te rm of one (1) year, and until
thei r s uccessors are el ected and qual i fied.
2. Qualifications: All of the officers of the association
need to be homeowners. Excluding the office of President, any two
of the other associ ati on offi ces may be combi ned i n one person.
3. The President: Shall exercise the usual executive powers
pertaining to the office of President. He shall preside at meetings
of the officers and of the homeowners and perform such other duties
as the homeowners may from time to time designate.
4. The Secretary/Treasurer: It shall be the duty of the
Secretary/Treasurer to keep records of the proceedings of the home-
owners and when requested by the President to do so, to sign and execute
with the President all contracts and other obligations or instruments
in the name of the association and to perform such othe r duties as the
homeowners may from time to time designate. Also as Secretary/Treasurer,
he/she, shall have the care and custody, and be responsible for all funds
of the association, and shall cause to be kept regular books of account.
He/she shall cause all such funds to be kept in such depositories as

may be desi gnated by the homeowners. In general ; he shal 1 perform al 1
of the duties incident to the office of Secretary/Treasurer, and such
other duties as from time to time may be assigned to him/her by the
homeowners.
5. Uacancies: Vacancies in any office arising from any
cause may be fi-T1e~Tc by the majori ty vote of al1 homeowners.
6. Compensation: Officers shall serve without compensation.
ARTICLE 8
BOOKS AND RECORDS
l. Records of Homeowners Meetinqs: The association shall
keep at its office, complete records of all the proceedings of the
homeowners' association.
2. Copies of Resolutions: Any person dealing with the asso-
ciation may rely upon a copy of any of the records of the proceedings,
resolutions, or votes of the homeowners, when certified by the President
or Secretary/Treasurer.
3. Qooks of Account: The association shall keep appropriate
and complete books of account.
ARTI CLE 9
l. By the Lot Owners: These Bylaws may be amended, altered,
or repealed at any regular or special meeting of the homeowners if
notice of the proposed alteration or amendment is contained in the notice
of the meetings by majority vote, except articles 2 and 5 may not be
amended or altered or repealed without prior aqreement from the Spokane
County Heal th Department.
