MINUTES OF THE SPOKANE COUNTY PLANNING COMMISSION HEARING OF SEPTEMBER 21, 1978,
WNEREAS, the Spokane County Planning Commission did hold a special public
meeting on September 21, 1978, to consider the testimony and requests of two plat
applicants and other interested parties concerning the following referenced sub-
divisions, aone reclassification upgradings, and a short plat appeal; and
WHEREAS, at said hearing opportunity was afforded those favoring and
those opposing all items of business; and
WHEREAS, Mr. McCoury, Chairman; Mrs. Byrne, Mrs. Myers, and Messrs. Culler,
Kennedy, Quigley and Thomas were in attendance for the entire proceedings, consti-
tuting a quorum at all times; and
WHEREAS, the Spokane County Planning Commission fully considered the
testimony given, the environmental review, and all other evidence presented, recom-
mends to the Board of County Comnissioners the following:
The Chairman announced the hearing would address itself to preliminary subdivision
applications and zone reclassifications, along with an Appeal, promptly at 1:30 PM,
of a Short Plat Subdivision, with those items presented by W. D. Nubbard, Plat
Administrator, as to preliminary plat applications; and John Stoeser as to the
short plat appeal; and 2ach sponsor or his representative; followed by favorable
and/or opposing testimony from the audience, with rebuttal allowed the sponsor.
A. PRELIMINARY SUBDIVISIONS ANO ZONE RECLASSIFICATIONS
1. PE-1179-78, NORTHCREST ADDITION by Wolfland, Inc.
ZE- 44-78, AGRICULTURAL to SINGLE FA14ILY RESIOENTIAL: That the preliminary
plat request be DENIED WITHOUT PREJUDICE. This request was heard throughout
the morning and a portion of the afternoon, following the short plat appeal.
W. D. Hubbard presented Findings of the Staff, with Bob Bethards presenting
information on behalf of the sponsor, Uince Seipp, wt;o also presented data
concerning Northcrest Addition. There was considerable testimony in oppo-
sition, with a petition bearing 150 signatures against the proposed plat,
along with severai letters related to various facts concerning the plat
being presented to the Corrgnission by the opposition. Discussion by the
Planning Commission and testimony by the sponsor, representatives of the
Health District, Engineer's office, Prosecuting Attorney's office; and
members of the opposition centered around the following topics: access
roads to the plat; traffic on Argonne Road; density of the proposed plat;
the requirement by the Health District for a sealed lagoon; uncertainty
regarding the location of the drainfield proposed by the sponsor; heavy
concentration of nitrates in the wells in the area; statistics on automo-
bile and train traffic; soii and water runoff; erosion that comes with
construction; the "208 Study;" and various factors in the E.I.S.
A motion to approve, providing all problems could be met and solved, was
lost for want of a second. A motion to continue until after the "208
Study" is published was also lost for want of a second. A motion to con-
tinue for ten working days to determine issues of water quality, sewage
and density, was also lost for want of a second. A motion to table the
matter indefinitely was,seconded, with two in favor to continue, and five
voting against a continuance.
(Motion to deny without prejudice by Byrne, seconded by Quigley. Vote was
six for the denial, with the Chair abstaining.)

plat be DENIED. 6ecause of a statement in the dedication of Myron Estates
that no more than one structure be placed on any one lot without filing a
replat, and also stated lots in this plat would remain one acre in size,
the question was raised as to whether or not a short plat is considered
a replat. The issue remained that the area was intended for one-acre
lots, which was a decision made with consideration of the neighboring
Ponderosa plat. '
(Motion to deny the short plat by Culler, seconded by Byrne. Voting was
five in favor of the denial, with two opposed.)
C. PRELIMINARY SUBDIVISIONS AND ZONE RECLASSIFICATIONS
2. PE-1168-78, MIDILOME FIRST ADOITION by Midilome, Inc.
ZE- 13-78, AGRICULTURAL to SItJGLE FAMILY RESIDENTIAL: That the preliminary
plat request be CONTINUED to September 28, 1978, at 10:00 A.M. Because
earlier items on the agenda had consumed a good portion of the day, the
motion was made by Byrne, seconded by Quigley, that the Commission hear
Midilome until 6:00 P.M., and to continue to another day if not concluded
by that hour. Vote was six in favor of that motion, with one opposed.
W. D. Hubbard presented Findings of the Staff with additional conditions
of the Engineering Department. Mr. Willard Sharp, representing the sponsor,
presented history of and request of approval for Mililome. The sponsor also
testified. Mr. William Powell, representing Mrs.Honnican, presented opposing
tzstimony. Testirrony was still in progress at 6:00 P.M.
(Motion to continue until September 28 at 10:00 AM by Thomas, seconded by
Quigley. Vote in favor of motion was unanimous.)

I. GENERAL INFORMATION
A. Location
-The proposed plat is located in the southern portion of the Spokane Valley
in the Chester Area. It is on the SW corner of 44th Avenue and Gillis Street,
which is Lot 4 in Block 4 of Myron Estates #2.
B. Proposal
-1.2 acres subdivided into 2 lots for single family use
-Typical lot frontage: #A = 190 feet
#B = 120 feet
-Typical lot size: #1 = 3/4 acre
#2 = 1/2 acre
C. Relationship to the Comprehensive Plan
-Approved amp of the Comprehensive Plan indicates residential usage of this
area with no density designations.
-Approved Comprehensive Plan map designates all nearby surrounding lands
as residential use.
D. Existing Land U ses
-Residential and the proposal is compatible with this use.
II. SPECIAL INFORMATION:
A. C irculation
-The County Engineer has examined the proposed plat and finds the roads to
be acceptable.
B. Sewage Disposal
-The Spokane County Health District has authorized the use of individual on-
site sewage systems for both lots within the proposed Plat.
C. Drainage
-The County Utilities Engineer did not require additfonal storm drainage
con s truction .
D. Water Supply
-Proposal is located within the recorded service area of the Washington Water
Power Company
-This District advises the staff that adequate system capacity, and a desire
on their part fio serve, exists for the provision of water for domestic, fire and
irrigation uses.
E. Fire Protection
-Proposal is situated within the recorded service area of Spokane County Fire
District #8.

-Mains and hydrants of sufficient size for fire protection now exist to serve
the proposed plat.
F. Schools
-Proposal lies within the boundaries of Central Valley School District #356.
III. ZOIVING ANALYSIS
The proposed plat is currently zoned single family residential and all lots within
the plat comply with the requirements af this zone. No zone change is being re-
quested.

An environmental checklist was not required for this plat under SEPA regulations,

I am writing in regards to the Short-Plat applica-
tion by John Bevan (#SP-78-059).
Our property is located across Gi11is, east of.
Bevan's property. We strenuously object to this
proposal for several reasons which I shall explain
in the itemized list below.
1. Past zoning decisions (namely the Basil
intent) have been to maintain lots of
nearly one acre each.
2. The slope, soil and woods situation on
Bevan's lot is not favorable for building
within close proximity.
3. Access to the back por-tion of his lot is
very steep.
These are m,y considerations concerning the Short-
Plat application. I would appreciate your considera-

A. Conditions
Sl That the plat be designed as indicated on the preliminary plat of record
and/or attached sheets as noted.
(!S2:) That a statement be placed in the declication to the effect that no more
than one dwelling s tructure be placed on any one lot, nor shall any lot
be further subdivided for the purposes of creating additional lots or
building sites without filing a replat.
(5D That the plat provide for right of way width for streets as indicated on the
preliminary plat of record.
C-V That appropriate provision be made that the following described property
be held in trust until the continuation of the streets be dedicated or
deeded: A 1' strip at the ends or edges of all streets that terminate or
border the plat boundary. (Temporary cul de sacs are requfred when
streets terminate at the plat boundaries.)

VIIARNING: Spokane County has no responsibility to build, impcove,
maintain, or otherwise service the prlvate roads contained within or

this plat or subsequently by allowing a building permit to be issued
on ptiperty on a private road, Spokane County assumes no obligation for
said private road and the owners hereby acknowledge that the County has
no obligation of any kind or nature whatsoever to establish, examine,
survey, construct, alter, repair, improve, maintain, provide drainage or
snow removal on a private road. This requirement is and shall run
with the land and shall be binding upon the owner, their heirs, successors
or assigns including the obliqation to participate in the maintenance of
the priva te road a s provided herein.
21 That each lot be authocized for the use of individual on-site sew3ge
dfsposal systems.
S22 The dedfcatory languaqe of the plat will state the sponsor will assume
no responsibility for provision of domestic water.
S23 That conditional approval be qfven subject to provisions in the plat for a
public sewer system. Approval of the design of said systems must be
given by County and State Health authocities and the County Utilities
Dzpartment prior to filing of the final plat. A suitable guarantee will
be required to cover the cost of providing said system in the amount as
determined by the Public Works Dzpartment.

sewer system will be made available for the plat and individual service
will be pravided to each lot prior to sale.
S25 Prior to filing of the final plat, the sponsor shall present evidence that

S26 That an on-site sewage management system be created and approved by the
Spokane County Health District prfor to filing of the Final Plat.

S27 That a plan for water facilfties adquate for fire protection be approved
by the water supplier and fire protection district. Said water plan must
also have been approved by the appropciate health authorities. The
health authoritfes, water supplier (purveyor) , and fire protection district
will certify, prior to the filing of the final plat, on the face of said
water plan that the plan is in conformance with their requirements and
wfll adequately satisfy their respective needs. Said water plan and
certification will be drafted on a transparency suitable for reproduction.
S28 The purveyor will also certify prior to the filing of the final plat on a
copy of said water plan that appropriate contractual arcangQ~:~P.nts have
been made with the plat sponsor for construction of the watsr system, in
accordance with the approved plan, and in accordance with a time
schedule. The time schedule will provide, in any case, for vorapletion
of the water system and inspection by the appropriate health authocities
prior to application for building pecmits within the plat, The contractual
arrangements will include a provision holdinq Spokane County and the
purveyor harmless from claims by any lot puchaser refused a bu#lding per-
mit due to the failure of the plat sponsor to satisfactorily complete the
approved water system.
S29 The plat dedication will contain a statement to the effect that the public
water systerri as approved by County and State Health authorities and
the local fire district and purveyor wfll be installed within this plat,
and the subdivider will provide for individual domestic water service as
well as fire protection to each lot prior to sale of each lot.
S30 That the provfsions of SEPA's NOTICE OF ACTION pusuant to 43.21C 080
RCW and the Board of County Commissfoners; Resolution No. 77-1392 be
accomplished by the project applicant within thirty (30) days of focmal
action by the Short Plat Adminsitrator or before the filing of the final
plat; as instructed by the Planning Department.
