S12 Construction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed land surveyor, who
shall be responsible for perpetuating all evidence of the location of
suvey monuments which may be disturbed during construction and who shall
furnish the County Engineer with "As Built" plans and a certificate in
writing that all improvements were installed to the lines and grades
shown on the approved construction plans and that all disturbed monuments
have been replaced.
CONNo construction work is to be performed with the Public Right of Way until
a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
S14 All construction within the Public Right of Way is to be completed prior
to filing the final plat or a bond in the amount estimated by the County
Engineer to cover the cost of construction of improvements, construction
certification, "As Built" plans, and monumenting the street centerlines,
shall be filed with the County Engineer.
S15 No direct acess from lots to Stub Road connections until such roads are
constructed to County Standards and established as County Roads.
S16 No direct access from lots to 1/2 right of ways until such time as
additional right of ways are dedicated and roads are established as County
Roads.
S17 Road design, construction, and drainage control for 1/2 rights of ways
and Stub Road connections are the responsibility of the developer.
S18 That the sponsor shall prepare and submit to the County Engineer a
&sign proposal acceptable to the State Highway Department of the proposed
State Highway-County Road intersection. State Highway Department
approval of the proposed design must be received prior to the filing of
the final plat. Improvements to the State Highway are to be the responsi-
bility of the sponsor and may either be constructed or a bond to cover the
cost of such improvements furnished to the County Engineer in the amount
as determined by the County Engineer and the State Highway Department.

S20 That the following statement be placed in the plat dedication:
WARNING: Spokane County has no responsibility to build, improve,
maintain, or otherwise service the private roads contained within or
providing service to the property described in this plat. By accepting
this plat or subsequently by allowing a building permit to be issued
on ptnperty on a private road, Spokane County assumes no obligation for
said private road and the owners hereby acknowledge that the County has
no obligation of any kind or nature whatsoever to establish, examine,
survey, construct, alter, repair, improve, maintain, provide drainage or
snow removal on a private road. This requirement is and shall run
with the land and shall be binding upon the owner, their heirs, successors
or assigns including the obligation to participate in the maintenance of
the private road as provided herein.
That each lot be authorized for the use of individual on-site sewage
disposal systems.
S22 The dedicatory language of the plat will state the sponsor will assume
no responsibility for provision of domestic water.
S23 That conditional approval be given subject to provisions in the plat for a
public sewer system. Approval of the design of said systems must be
given by County and State Health authorities and the County Utilities
Department prior to filing of the final plat. A suitable guarantee will
be required to cover the cost of providing said system in the amount as
determined by the Public Works Department.
S24 That a statement be placed in the dedication to the effect that a public
sewer system will be made available for the plat and individual service
will be provided to each lot prior to sale.
S25 Prior to filing of the final plat, the sponsor shall present evidence that
the plat lies within the recorded service area of the proposed water
district.
S26 That an on-site sewage management system be created and approved by the
Spokane County Health District prior to filing of the Final Plat.
dig That a plan for water facilities adquate for fire protection be approved
by the water supplier and fire protection district. Said water plan must
also have been approved by the appropriate health authorities. The
health authorities, water supplier (purveyor) , and fire protection district
will certify, prior to the filing of the final plat, on the face of said
water plan that the plan is in conformance with their requirements and
will adequately satisfy their respective needs. Said water plan and
certification will be drafted on a transparency suitable for reproduction.
S28 The purveyor will also certify prior to the filing of the final plat on a
copy of said water plan that appropriate contractual arrangeTllents have
been made with the plat sponsor for construction of the water system, in
accordance with the approved plan, and in accordance with a time
schedule. The time schedule will provide, in any case, for completion
of the water system and inspection by the appropriate health authorities
prior to application for building permits within the plat. The contractual
arrangements will include a provision holding Spokane County and the
purveyor harmless from claims by any lot puchaser refused a building per-
mit due to the failure of the plat sponsor to satisfactorily complete the
approved water system.
S29 The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities and
the local fire district and purveyor will be installed within this plat,
and the subdivider will provide for individual domestic water service as
well as fire protection to each lot prior to sale of each lot.
S30 That the provisions of SEPA's NOTICE OF ACTION pusuant to 43.21C 080
RCW and the Board of County Commissioners; Resolution No. 77-1392 be
accomplished by the project applicant within thirty (30) days of formal
action by the Short Plat Adminsitrator or before the filing of the final
plat; as instructed by the Planning Department.

THIS MATTER, an application for the approval of a short plat, pursuant
to Spokane County Resolution No. 78-291, came before the Spokane County Short

Having reviewed the records and files in this matter, the Spokane County
Short Plat Administrator makes the following:
FINDINGS OF FACT AND CONCLUSION
I
That appropriate provisions have been made for sewage disposal, water
supply, storm water control, circulation, fire protection, and other necessary public
facilities and utilides
II
That the uses and density proposed by the plat sponsor appear to be com-
patible with existing development in the immediate area as well as being compatible
with the Spokane County Comprehensive Plan.
III
That no significant adverse environmental impact will likely result from the
approval of this propr sal.
Therefore, the Spokane County Short Plat Administrator hereby issues this
DECISION
Short Plat Application as submitted by the applicant is hereby approved

1. References:
a. Plat map 'by., Clarence Simpson Engineers, dated July 11, 1978, scale
1"=501 , and received by Spokane County Health District ,July 31, 1970.
b. Soils are (Mcbl .Marble or,(CuH) Clayton sands and are listed as having
slight limitations for sewage disposal with possible contamination of
ground water as noted in Engineering Interpretations of the 'Soils of
Spokane County by the U.S. Department of Agriculture.
c. Washington Water Power has indicated on Part II, Short 'Plat Application,,
dated July 13., 1978, that they are able and willing to furnish water and
that satisfactory arrangements have been' made with the developer.
d. The plat sponsor has proposed 2 lots on 1.9 acres -as noted on plat map
dated July 11, 1978, prepared ,by Charles 'Simpson Engineers.
2. Discussion:
Field survey done by 'Gene 'Sharp, July 31, 1978', showed Tract "B" to be
a steep, hilly area with slopes ranging 'from 5% to 40%. On-site sewage'
disposal system can be installed when the slope is 15% or less. Tract "A"
has been filled and graded and is suitable for on-.site seWage disposal
system. No wells were located on or adjacent to the property.
3. Recommend that:
a. An on-site sewage management system be required if the number of
dwelling units authorized in plat exceeds 6'..
)< The dedicatory language of the Plat will state that each lot is
authorized the use of an individual on-site' sewage disposal system.
s/. A plan for water facilities adequate for domestic use, domestic irri-

Dear Steve:
Although I serve the same industry as Vince Seipp does, I am
opposed to the subdivision of Lot 5, Block 1, Myron Estates No. 8
for the following reasons:
1. First and foremost, if this request is approved, it will
establish a precedent for other owners in Myron Flats No. 1
through No. 8 to also divide their properties. At least
one other lot division is already in process.
2. The question most often asked me is: "What good are covenants
if they can be easily circumvented?" We purchased homes in
this area because of the size of the lots and lower density."
I wonder about the original intent of the Dedication of the
Plat as it concerns the subdivision of lots. When this was
written, the re-plat effort for one lot division would have
been prohibitive and therefore the likelihood of such
action was highly remote.
3. The County required the developer of Myron Estates to place
a buffer of one acre lots along the easterly side of Van
Marter. What has changed in the past two years to invalid-
ate this position?
4. In configuring Lot 5, it appears that the survey of the lot
in its original form revealed the area. bordering 48th Avenue
as being not too suitable for, a building site. The lot dropped
sharply to the rear a short distance from the road. Consequent-
ly, if a home were to be placed on this lot, it is quite likely
that it will be required to be placed much closed in proximity
to the street then the other homes in the immediate area.

Utility easements are hereby dedicated to the serving utility companies

A public water system shall be provided and individual services shall be
mad available by the developer to each lot prior to sale.
No more than one dwelling structure shall be placed on any lot, nor shall
any lot be subdivided for the purposes of creating additional lots or

The owners of all lots with drainage easements shall be held respon-
sible for not obstructing the natural drainage flow across or
