Having reviewed the records and files in this matter, the Spokane County Short Plat Administrator makes the following: FINDINGS OF FACT AND CONCLUSION I That appropriate provisions have been made for sewage disposal, water supply, storm water control, circulation, fire protection, and other necessary public facilities and utili-ies . II That the uses and der.si:y proposed by the plat sponsor appear to be com- e patible with existing development in the immediate area as well as being compatible with the Spokane County Comprehensive Plan . III That no significant adverse environmental impact will likely result from the approval of this proprsal. Therefore, the Spokane County Short Plat Administrator hereby issues this DECISION Short Plat Application as submitted by the applicant is hereby approved subiect to conditians which shall be complied with by the applicant and/or sponsor prior to finalization of the short plat. Conditions ~ That the plat be designed as indicated on the preliminary plat of record and/or attached sheets as noted. ~ That a statement be placed in the dee-ication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes of creating additional lots or building sftes without filing a replat. S3 That the plat provide for riqht of way width for streets as indicated on the preliminary plat of record. G That appropriate provision be cnade that the following described propertp be held in trust until the continuation of the streets be dedicated or deeded: A 1' strtp at the ends or edges of all streets that terminate or bocder the plat boundary. (Temporary cul de sacs are required when streets terminate at the plat boundarles.) That appropriate street names be indicated. 6 That appropriate utility easements be indicated on copies of the approved preliminary plat for distrfbution on Ehe Planning Department and the utility companies. Written approval of the easements by the utility company must be received prior to the submittal of the final plat. S7 That a certificate of title be furnished the Planning Department prior to the filing of the final plat. SS That an avfgation easement satisfactory to the Spokane Airpork Board be provided for the benefit of Fairchfld Air Force Base and Spokane Inter- national Airport. That conditional approval of the plat is given subject to the dedication of right of way to the public and appr~-.•: al of the road system in the plat by the County Engineer. ~ That plans, profiles, and cross sections showing proposed street center- line and curb grades be submitted to the County Engineer for approval pclor to construction and the filinq of a final plat. 11 That drainage plans and design calculations showing the qrades and alignment of drainage facilities be submitted to the County Engineer for approval prior to construction and the filing of a final plat. I2 Construction within the proposed public streets and easements shall be performed under the direct supervision of a licensed land surveyor, who shall be responsible for perpetuating all evidence of the location of suvey monuments which may be disfi.irbed during construction and who shall furnish the County Engineer with "As Built" plans and a certificate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. (S13) No construction work is to be performed wiCh the Public Right of Way unt-fl a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. ik.14.) All construction within the Public Right of Way is to be completed prior to filing the final plat or a bond in the amount estimated by the County G Engineer to cover the cost of construction of improvements, construction certification, "As Built" plans, and monumenting the street centerlines, shall be filed with the County Engineer. S15 No direct acess from lots to Stub Road connections until such roads are constructed to County Standards and establfshed as County Roads. S16 No direct access from lots to 1/2 right of ways until such time as additional right of ways are dedicated and roads are established as County Roads. S17 Road design, construction, and drainage control for I/2 rights of ways and Stub Road connections are the responsfbilfty of the developer. S18 That the sponsor shall prepare and submit to the County Engineer a design proposal acceptable to the State Highway Department of the proposed State Highway-County Road intersection. State Highway Department approval of the proposed design must be received prior to the filing of the final plat. Improveinents to the State Highway are to be the -esponsi- bility of the sponsor and may either be cons tructed or a bond to cover the cost of such improvements furnished to the County Engineer in the amount as determined by the County Engineer and the State Hiqhway Department. S20 That the following statement be placed in the plat dedication: WARNING: Spokane County has no responsibility to build, imprave, maintain, or otherwise service the private roads contained withfn or providing service to the property described in this plat. By accepting this plat or subsequently by allowing a building permit to be issued on preperty on a private road, Spokane County assumes no obligation for said private road and the owners hereby acknowledge that the County has no obligation of any kind or nature wlhatsoever to establish, examine, survey, construct, alter, repair, improve, maintain, provide drainage or snow remaval on a private road. This requfrement is and shall run with the land and shall be binding upon the owner, their heirs, successors or assigns including the obligation to participate in the maintenance of the priva te road a s provid ed herein. S21 That each lot be authorized for the use of individual on-site sewage disposal systems. S22 The dedicatory language of the plat will state the sponsor will assume no responsibility for provision of domestic water. . S23 That conditional approval be given subject to provisions in the plat for a public sewer system. Approval of the design of said systems must be given by County and State Health authorlties and the County Utilities Dapartment prior to filing of the final plat. A suitable guarantee will be required to cover the cos t of providing said sys tem in the amount as determined by the Public Worjcs Department. S24 That a statement be placed in the dedication to the effect that a public sewer system will be made available for the plat and individual secvice will be prbvided to each lot prior to sale. Said water plan rniust also have been approved by the appropriate health authorities. The health authorities, water supplier (purveyor) , and fire protection district will cerrify, prior to the filinq of the final plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. 28 The pwrveyor will also certify prior to the filing of the final plat on a copy of said water plan that approprfate contractual arrange ~ents have been made with the plat sponsor for construction of the watsr system, in accordance with the approved plan, and in accordance with a time schedule. The time schedule will provide, in any case, for vompletion of the water system and inspection by the appropriate health authorities prior to application for building permits within the plat. The contractual atrangements wi11 include a provision holdinq Spokane County and the purveyor harmless from claims by any lot puchaser refused a building per- mit due to the failure of the plat sponsor to satisfactorily corriplete the approved water sys tem . S2 The plat dedication will contain a statement to the effect that the public water system as approved by County and State Health authorities and the local fire distrlct and purveyor will be installed within this plat, and the subdivfder will provide for indivfdual domestic water service as well as fire protection to each lot prior to sale of each Iot. S30 That the provisions of SEPA's NOTICE OF ACTION pusuant to 43.21C 080 RCW and the Board of County Commissioners; Resolution No. 77-1392 be accomplished by the project applicant within thirty (30) days of formal action by the Shoct Plat Adminsitrator or before the filfng of the final plat; as instructed by the Planninq Department.
