' Fla'v'rny reviewed the records and files in this matter, the Spokane Ctiunty Short P1at'Administrator makes the following: FINDINGS OF FACT AND CONCLUSION I That appropriate provisions have been made for sewage disposal, ' water supply, storm water control, circulation, fire protection, and other necessary public facilities and utilities. II That the sponsor d id crea te *two ( 2) parcel s f i ve (5) acres i n si ze, vrhich is exeilipt for short platting as provided for in Section 2.25Q of the Short Plat Ordinance. UJ That tlie Short Plat 1ldministrator's subsequent approval was for the application as submitted, thereby precluding the use of duplexes. VIII That the adjacent plat to the south, Vera Terrace First Addition (PE-1021-76), was allowed duplexes for only those lots alonq Eighth Avenue which . is a secondary arterial and specifically prohibited duplex uses within the interior of the plat which is adjacent to these Short Plats. IX That the area has deveioped in predominantly single family . residences. X That there are not a significant number of duplex units within this area. XI That the proposed duplex lots would be along Sixth Avenue which is a 1oca1 access road and established single family housing area. XII That the duplex uses were not advertised within the original applica'tion, and although allowed within the Agricultural Suburban Zone, appear to be incompatible with existing development in the immediate area. THEREFORE, The Spokane County Short Plat Administrator hereby issues this DECISION The request to change conditions which would allow duplexes on lots within Short Plats SP -79-117 and SP-79-118 is hereby DENIED. Seipp E. 14314 6th Veradale, WA 99037 RE: SP-79-117 and SP-79-118, Request for a Change of Conditions from Mike Manos Dear Sir: Thank you for your letter of concern regarding the above short plats. The letter raises several interesting points, one of which is the duplex issue. I am not able, at this time, to comment on that matter as the decision has not yet been made (any decision made regarding this application is appealable to the Hearing Examiner Committee which would require a public hearing). However, legal council has advised me that the proper procedures are being followed to request such a change in conditions. Also, that your letter along with your neighbors comments will be considered when this decision is to be made. In addressing your comments regarding the legality of the short plat applicat- ions and the manner in which they were completed; the following procedure was followed, as provided for within the Short Plat Ordinance: 1. The (10) ten acre parcel was divided into (2) two parcels (5) five acres each in siie ( rovided for in Section 2.25.B of the Short Plat Ordinance as an exemption~. 2. The the western (5) five acre parcel was divided into a parcel about an acre (1.22) in size and transferred to Sheri Manos (provided for by the Spouse, Son or Daughter exemption; Section 3.3.B.3 of the Short Plat Ordinance). 3. This "acre" (1.22) parcel of land was then submitted as a Short Plat Subdivision application to b.e divided into (4) four parcels (as provided for in Section 2.25A of the Short Plat Ordinance). 4. The remaining land (8.76 acres) t-las then also submitted as a Short Plat Sub- division application to be divided into (4) four parcels, one parcel containing the existing residence (as provided for in Section 2,25A of the Short Plat Ordinance).. 5. The resultinq approvals of these applications was for single family residences, however, the existing Zone classification is now and has been since 1963, Agricultural Suburban, which allows duplexes as an outright permitted use on 11,000 sq. ft. (as provided for in Section 4.05.050 (A) of the Spokane County Zoning Ordinance). w ~ James V. Seipp February 29, 1980 Page 2 .
