TIIIS MATTER, An applicatifln requesting the change of conditions to
allow duplexes on lots within Sfiort Plats; SP-79-117 and SP-79-118, pursuant to
Spokane County Resolution PJo. 78-291, came before the Spokane County Short Plat
Administrator on the 5th day of rtarch, 1980.

FINDINGS OF FACT AND CONCLUSION
I
That appropriate provisions have been made for sewage disposal,
' water supply, storm water control, circulation, fire protection, and other
necessary public facilities and utilities.

That the sponsor d id crea te *two ( 2) parcel s f i ve (5) acres i n si ze,
vrhich is exeilipt for short platting as provided for in Section 2.25Q of the Short
Plat Ordinance.

of the plat which is adjacent to these Short Plats.

That the area has deveioped in predominantly single family

That there are not a significant number of duplex units within this
area.

That the proposed duplex lots would be along Sixth Avenue which is
a 1oca1 access road and established single family housing area.

That the duplex uses were not advertised within the original
applica'tion, and although allowed within the Agricultural Suburban Zone, appear to
be incompatible with existing development in the immediate area.
THEREFORE, The Spokane County Short Plat Administrator hereby issues
this
DECISION
The request to change conditions which would allow duplexes on lots
within Short Plats SP -79-117 and SP-79-118 is hereby DENIED.

Dear Sir:
Thank you for your letter of concern regarding the above short plats. The
letter raises several interesting points, one of which is the duplex issue. I
am not able, at this time, to comment on that matter as the decision has not
yet been made (any decision made regarding this application is appealable to the
Hearing Examiner Committee which would require a public hearing). However, legal
council has advised me that the proper procedures are being followed to request
such a change in conditions. Also, that your letter along with your neighbors
comments will be considered when this decision is to be made.
In addressing your comments regarding the legality of the short plat applicat-
ions and the manner in which they were completed; the following procedure was
followed, as provided for within the Short Plat Ordinance:
1. The (10) ten acre parcel was divided into (2) two parcels (5) five acres each
in siie ( rovided for in Section 2.25.B of the Short Plat Ordinance as an
exemption~.
2. The the western (5) five acre parcel was divided into a parcel about an acre
(1.22) in size and transferred to Sheri Manos (provided for by the Spouse, Son
or Daughter exemption; Section 3.3.B.3 of the Short Plat Ordinance).
3. This "acre" (1.22) parcel of land was then submitted as a Short Plat Subdivision
application to b.e divided into (4) four parcels (as provided for in Section
2.25A of the Short Plat Ordinance).
4. The remaining land (8.76 acres) t-las then also submitted as a Short Plat Sub-
division application to be divided into (4) four parcels, one parcel containing
the existing residence (as provided for in Section 2,25A of the Short Plat
Ordinance)..
5. The resultinq approvals of these applications was for single family residences,
however, the existing Zone classification is now and has been since 1963,
Agricultural Suburban, which allows duplexes as an outright permitted use on
11,000 sq. ft. (as provided for in Section 4.05.050 (A) of the Spokane County
Zoning Ordinance).

This brings up to the main issue at hand, being; the allowance of duplex '
development in a zone in which it is permitted and the request for a change in
conditions of the original approval. As an interested party, you will be con-

I t i s my understand i ng that Nir. . Manos i7ow wa+nts to re-zone
his property for duplexes. This change is nat acceptable
to myself or my neighbars. When Mr. Manos initially shart-platted his property, there was
some question as ta whether i t was 1 egal l,y compl eted withi n
the Short Platt Ordinance. I have this questian for the
fo114wing reasons:
1. Mr. Manos combined two five acre parcels to make one ten
acre parcel. He then split the ten acre parcel inta twa
parcels; one af 1.22 acres and one of 8.76 acres.
2. Nexta he praceeded to short p1att each af the two parcels
into four lats each. At the time th,is was done, Mr. Manos
assured us tInat he would anly be requesting single family
lats. We had nv objection to this sinee the neighborhood
1s a sir.gle family residential neighborhoad.
The subdivision just South af Mr. Manos` property called Vera
Terrace First Addi~ion was initially submitted for an R-2
use and the Spokane Caunty Planning Cammissivn decidedat that
time that it wa5 not su3ted for that use for a variety of
reasons. Enc7 osed is a cvpy of the facts and f i ndi ngs yaur
department i ssued. SZ nce I was work i ng •for the devel oper of
Vera Terrace at the time it was being platted, I am fully aware
of the facts surrounding your decision. i also know fu11 we1]
the neighorbhood opposition to duplexes at that time and the
fact that the Manos's objected to duplexes.

and all the effects associaked therewith. These would include such tmpacts
, as lncreased air polluttan, specifically suspended particulates from unimproved
streets, lncreased nolse, and lncreascd publlc safety hazards from trafflc.
The increased safc:ty hazard from auto trafflc becomes increasingly maantnq-
ful when consldCriny Fldams Elementary School is only 800 feet to the east.
A second potentlat environmuhtal impact area constdc;red was the lncreased
demand or► publlc servlces and utlltles. This would lnciude sueh factors as
tncreased requlrements for pollce and flre protictton, provEsion of additlonal
school, park, and recreattonal facilities, and addttional maintenance
requirements on all county facilittes and roads. Thiii would atso lnclude such
impacts as associated with extensfon of utitity ltnes (power, natural gas,
telephone) and the provlsion of sultabte long term sewQrage, domestic 4vater,
storm w3ter runoff, and solld waste dl sposal systems.
A third ;.otentEal environmental impact revealed by the staff evaluation tnvolves
the suh::urface lnjectlon of sewage offluent and storm water runoff. This waste
watec Giticed at a depth wili pQrcolate downward toward the aqulfer rather than
evaporating back into the atmosphet'e as under natural conditions. A portton
of the contarntnants will likely j•:e ftltere3 out of this waste water, but the
«sulting quallty has noC been datermined yet. Approxlmately 8.5 acre-feet
of aiaste water will be generatcad annually and lnjected lnto the subsurface,

THIS MATTER, an application for the approval of a short plat, pursuant to
Spokane County Resolution No. 78-291, came before the Spokane County Short Plat
Administrator on the JPW4ay of && . 1979.
Having reviewed the records and files in this matter, the Spokane County
Short Plat Adminfstrator makes the following:
FINDINGS OF FACT AND CONCLUSION

' That appropriate provisions have been made for sewage disposal, water supply,

and utilities.

That the uses and density proposed by the plat sponsor appear to be compatible
with existing development in the immediate area as well as being compatible with the
Spokane County Comprehensive Plan.

That no significant adverse environmental impact will likely result from the
approval of this proposal.

A. Conditions
1 That the plat be designed as indicated on the preliminary plat of recocd
and/or attached sheets as noted.
S2 That a statement be placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shall any lot
be further subdivided for the purposes of creating additlonal lots or
building sites withouE filing a replat.
03 That the plat provfde for right of way width for streets as indicated on the
preliminary plat of record.
S4 That appropriate provision be made that the following described property
be held in trust until the continuation of the streets be dedicated or
deeded: A 1' strip at the ends oc edges of all streets that terminate or

preliminacy plat for distribution on the Planning Department and the utility

17 That a certificate of title be furnished the Planning Department prior to
the filing of the final plat.
S8 That an avigatfon easement satfsfactory to the Spokane Airport Board be
provided for the benefit of Fairchild Air Force Base and Spokane Inter-
national Airport.
S9 That conditfonal approval of the plat is given subiect to the dedication of
cight of way to the public and appr^ : al of the road system in the plat by
the County Engineer.
S10 That plans, profiles, and cross sections showing proposed street center-
line and curb grades be submitted to the County Engineer for approval
pcior to construction and the filing of a final plat.
S11 That drainage plans and design calculations showing the grades and
alignment of drainage facilities be submitted to the County Engineer for
appraval prior to constructian and the filing of a final plat.
(*S*12 Construction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed land surveyor, who
shall be responsible for perpetuating all evidence of the location of
suvey monuments which may be dishsrbed during construction and who shall
furnish the County Engineer wfth "As Built" plans and a certificate in
writing that all fmprovernents were installed to the lines and grades
shown on the approved construction plans and that all disturbed monuments
have been replaced.
S13 Na construction work is to be performed with the Public Right of Way until
a permit has been issued by the County Engineer. All work is su biect to
inspection and approval by the County Engineer.
(&4 All construction within the Public Right of Way is to be completed prior
to filing the final plat or a bond in the amount estimated by the County

Engineer to cover the cost of construction of improvements, construction
certification, "As Built" plans, and monumenttng the street centerlines,
shall be filed with the County Engineer.
S15 No direct acess from lots to Stub Road connections until such roads are
constructed to County Standards and established as County Roads.
S16 No direct access from lots to 1/2 right of ways until such time as
additional right of ways are dedicated and roads are established as County
Road s .
S17 Road design, construction, and drainage control for 1/2 rights of ways
and Stub Road connections are the responsibility of the developer.
S18 That the sponsor shall prepare and submit to the County Engineer a
design proposal acceptable to the State Highway Department of the proposed
State Higrhway-County Road intersection. State Highway Department
approval of the proposed design must be received prior to the filing of
the final plat. ImprovemenCs to the State Highway are to be the responsi-
bility of the sponsor and may either be constructed or a bond to cover the
cost of such improvements furnished to the County Engineer in the amount
as determined by the County Engineer and the State Highway Department.

SZO That the following statement be placecl in the plat dedication:
WARIVING: Spokane County has no responsibility to build, improve, maintain, or otherwise service the private roads contained within or
providing service to the property described in this plat. By accepting
this plat or subsequently by allowing a building permit to be issued
on poperty on a private road, Spokane County as sumes no obligation for
said private road and the owners hereby acknowledge that the County has
no obliqation of any kind or nature whatsoever to establish, examine,
survey, construct, alter, repair, improve, maintain, provide drainage or
snow removal on a private road. This requirement is and shall run
with the land and shall be binding upon the owner, their heirs, successors
or assiqns including the obligation to participate in the maintenance of
the priva te road a s provided herein.
S21 That each lot be authorized for the use of individual on-site sewage
disposal systems.
S22 The dedicatory language of the plat will state the sponsor will assume
no responsibility for provision of domestic water.
S23 That conditi4nal approval be given subject to provisions in the plat for a
public sewer system. Approval of the design o# said systems must be
qiven by County and State Health authorities and the County Utilities
Department prior to filing of the final plat. A sultable guarantee will
be required to cover the cost of providing said system in the amount as
determined by the Public Wocks Department.
S24 That a statement be placed fn the dedication to the effect that a public
sewer system will be made available for the plat and individual service
will be provfcled to each lot prior to sale.
CS 205 Pcior to filing of the final plat, the sponsor shall present evidence that
the plat lies withfn the recorcled service area of the proposed water

S26 That an on-site sewage management system be created and approved by the
Spokane County Health District prior to filing of the Final Plat.

S27 That a plan for water facilitles adquate for fire protection be approved
by the water supplier and fire protection district. Said water plan must
also have been approved by the appropriate health authocities. The
health authorities, water supplier (purveyor) , and fire protection district
will certify, prior to the filing of the final plat, on the face of said
water plan that the plan is in conformance with their requireraents and
will adequately satisfy their respective needs. Said water plan and
certification will be drafCed on a transparency suitable for reproduction.
WB The purveyor will also certify prior to the filing of the final plat on a
copy of said water plan tha t appropriate contractual arrangeiDents have
been made with the plat sponsor for construction of the water system, in
accordance with the approved plan, and in accordance with a time
schedule. The time schedule will provide, in any case, for oompletion
of the water system and inspection by the appropriate health authorities
prior to application for building permits within the plat. The contractual
arrangements will include a provision holding Spokane County and the
purveyor harmless from claims by any lot puchaser refused a building per-
mit clue to the failure of the plat sponsor to satisfactorily complete the
approved wa ter sys tem .
S29 The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authortties and
the local fire distcict and purveyor will be installed within this plat,
and the subdfvider will provide for individual domestic water service as
well as fire protection to each lot prior to sale of each lot.
S30 That the provisions of SEPA's NOTICE OF ACTION pusuant to 43.21C 080
RCW and the Board af County Commissioners; Resolution No. 77-1392 be
accomplished by the project applicant wi[hin thirty (30) days of formal
action by the Short Plat Adminsitrator or before the filing of the final
plat; as insttucted by the Planning Department.
