' Havrng reviewed the records and files in this matter, the Spokane Gvunty Short Plat'Administrator makes the following: FINDI«GS OF FACT AND CONCLUSION I That appropriate provisions have been made for se4rage disposal, "water supply, storm water control, circulation, fire protection, and other necessary public facilities and utilities. II That the sponsor did create *two (2) parcels five (5) acres in size, which is exe+npt for short platting-as provided for in Section 2.25Q of the Short Plat Ordinance. . • - III That the described pr-operty is zoned llgricultural Suburban, which cloes allow duplex const►-uction. • IV Tha.t after creating the two (2) parcels, the applicant did have the right of establishiny one duplex on the vacant five (5) acre parcel. V That the sponsor did sub»>it the parcels of laiid for short platting; which created eiglit (8) residential lots, one aiith an existing residence; and the sponsor indicated on forms and oii mail iiig notices to adjacent property owners that the "Land Use Aroposed by Applicant" - for• the seven (7) vacant lots was to be "sinqle familv dwellings". VI That tfie Short Plat Administrator's subsequent approval was for the application as subrnitted, thercby precluding the use of duplexes. VIII That the adjacent plat to the south, Vera Terrace First Addition (PE-1021-76), was allowed duplexes for only those lots along Eighth Avenue which . is a secondary arterial and specifically prohibited duplex uses within the interior of the plat which is adjacent to these Short Plats. IX That the area has developed in predominantly single family . ro+es i d ences . X That there are not a significant number of duplex units within this area. XI That the proposed duplex lots would be along Sixth Avenue which is a local access road and established single family housing area. XII That the duplex uses were not advertised within the original applica'tion, and although allowed within the Agricultural Suburban Zone, appear to , . be incompatible with existing development in the immediate area. THEREFORE, The Spokane County Short Plat Administrator hereby issues this DECISION The request to change conditions which would allow duplexes on lots within Short Plats SP -79-117 and SP-79-118 is hereby DENIED. Dear Sir: I t i s my understandi ng that Mr. Manos now' wants to re-zone his property for duplexes. This change is not acceptable to myself or my neighbors. 4Jhen h1r, Nlanos initially short-platted his property, there was some question as to whether it was legally completed within the Short Platt Ordinance. I have this question for the following reasons: 1. t•1r. Nianos combi ned two f i ve acre parcel s to make one ten acre parcel. He then split the ten acre parcel into two parcels; one of 1.22 acres and one of 8.76 acres. 2. Next, he proceeded to short platt each of the two parcels into four lots each. At the time th,is was done, Mr. Manos assured us that he would only be requesting single family lots. We had no objection to this since the neighborhoad is a sirgle family, residential neighborhood. The subdivision just South of Mr. Manos' property called Vera Terrace First Addition was initially submitted for an R-2 use and the Spokane County Planning Commission decided at that time that i-t was not suited for that use for a variety of reasons. Enclosed is a copy of the facts and findings your department issued. Since I was working~for the developer of Vera Terrace at the time it was being platted, I am fully aware of the facts surroundirig your decision.
