THIS h111TTER, An applicatinn requesting the change oF conditions to
allow duplexes on lots within Short Plats; SP-79-117 and SP-79-118, pursuant to
Spokane County Resolution Pdo. 78-291, came before the Spokane County Short Plat
Administrator on the 5th day of March, 1980.
' Havrng reviewed the records and files in this matter, the Spokane
Gvunty Short Plat'Administrator makes the following:
FINDI«GS OF FACT AND CONCLUSION
I
That appropriate provisions have been made for se4rage disposal,
"water supply, storm water control, circulation, fire protection, and other
necessary public facilities and utilities.
II
That the sponsor did create *two (2) parcels five (5) acres in size,
which is exe+npt for short platting-as provided for in Section 2.25Q of the Short
Plat Ordinance.

That the described pr-operty is zoned llgricultural Suburban, which
cloes allow duplex const►-uction. •

Tha.t after creating the two (2) parcels, the applicant did have the
right of establishiny one duplex on the vacant five (5) acre parcel.

That the sponsor did sub»>it the parcels of laiid for short platting;
which created eiglit (8) residential lots, one aiith an existing residence; and the
sponsor indicated on forms and oii mail iiig notices to adjacent property owners that
the "Land Use Aroposed by Applicant" - for• the seven (7) vacant lots was to be
"sinqle familv dwellings".

That tfie Short Plat Administrator's subsequent approval was for the
application as subrnitted, thercby precluding the use of duplexes.

That the proposed duplex lots would be along Sixth Avenue which is
a local access road and established single family housing area.

That the duplex uses were not advertised within the original
applica'tion, and although allowed within the Agricultural Suburban Zone, appear to

THEREFORE, The Spokane County Short Plat Administrator hereby issues

DECISION
The request to change conditions which would allow duplexes on lots
within Short Plats SP -79-117 and SP-79-118 is hereby DENIED.

The ~ic.posal Is locatcd approxtmately In the SE 1/4 of the NW 1/4 of S@ctlon
23, TownshEp 25 N., Range 44 EWM, north of and fconttng on Eighth Avenue
about 330 fcet west of Adams Road. The proponent has requested to subdivide
about 8.3 acres tnto 22 lots to be used for dupicxes cceating a gross denslty
of 5.3 unlts per acre. Tho site Is located on relatlvely flat tcrraln currently
covered by unmanaged grassland vegetation.
The staff ravlew has identtitcd three potcnttal areas of onvironmontal impacts.
Flrst, and common to all subdivisions !s the Increase In motor vehlcle traffic
and aIl the effc:cts associated therewith. These would lnclude such lmpacts
as 1ncreased air pollutton, speciflcally suspended parttculates from unlmproved
streets, lncreased notsc, and tncreased publlc safety hazards from trafftc.
The increased safety hazard from auto trafflc becomes [ncreasingiy maantnq-
fui when considc:ring Adamy Elementary Schoo! !s only OQO feet to the cast.
A sccond potentlal 4nvlronmuhtal lmpact area conslclc:red was the increased
demand on publ[c services and uttitles. Thi s would Include such factors as
lnc:ceased requlremc;nts for poltce and itre protectian, provision of additional
school, park, and recreatlonal facilietes, and addltiona[ maintenance
cequicernents on all county factlities and roads. This would also lnclude such
tmpacts as associated wtth extension of utility lines (power, natural qas,
telephone) and the provtsion of suttabte long terrtt sewerage, domestic water,
storm water runoff, and solld waste di sposal systems.
A thlrd ,,otcntial environmental lmpact revealed by the staff evaluation involves
the suh;;t;rtace tniectlon of sewage effluc:nt and storm watc;r runoff. Thls w►aste
watec A: aced at a depth will percolate downward toward the aqulfer rakher than
evaporatlray back into the atmosphere as under natucal conditlons. A portton
of the contarntnants will ltkely L•e filtered out of this waste water, but th`
resulting quallty has not been determined yet. Approxlmately 8.5 acre-feet
of waste water wlll be generated annually and Iniected lnto the subsurface,
6.5 acre-feet of whlch will bo sewage effluent.
The conciusion of thia envlcvnmental checkltst cevlew is that no stgnlftcant
environman tat impacts wtl I likely result from the proposal. Therzfore, it is
recommended that a Dc-:claration of Non-Stgntficance be tssued and an
environmentat impact statemant not be ruquired.

Dear Sir:
I t i s my understandi ng that Mr. Manos now' wants to re-zone
his property for duplexes. This change is not acceptable
to myself or my neighbors.
4Jhen h1r, Nlanos initially short-platted his property, there was
some question as to whether it was legally completed within
the Short Platt Ordinance. I have this question for the
following reasons:
1. t•1r. Nianos combi ned two f i ve acre parcel s to make one ten
acre parcel. He then split the ten acre parcel into two
parcels; one of 1.22 acres and one of 8.76 acres.
2. Next, he proceeded to short platt each of the two parcels
into four lots each. At the time th,is was done, Mr. Manos
assured us that he would only be requesting single family
lots. We had no objection to this since the neighborhoad
is a sirgle family, residential neighborhood.
The subdivision just South of Mr. Manos' property called Vera
Terrace First Addition was initially submitted for an R-2
use and the Spokane County Planning Commission decided at that
time that i-t was not suited for that use for a variety of
reasons. Enclosed is a copy of the facts and findings your
department issued. Since I was working~for the developer of
Vera Terrace at the time it was being platted, I am fully aware
of the facts surroundirig your decision. I also know full well
the neighorbhood opposition to duplexes at that time and the
fact that the Manos's objected to duplexes.

SP-79-117 and SP-79-118. Presently, the conditions of both plats
indicate single family residences only, the request is for a change
of conditions which would allow for both single family residences
and/or duplexes. This property is located east in the Spokane Valley,
niore specifieally, SP-79-117 is northeast of 6th Avenue and Rees Road,
containing 4 lots on 1.22 acres. While SP-79-118 is located between
4th and 6th Avenues, east of Rees Rnad and west of Calvin Road,

0~1 That the plat be designed as indicated on the preliminacy plat of recocd
and/or attached sheets as noted.
S2 That a statennent be placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shall any lot
be further subdivided for the purposes of creating additional lots or
building sites without filing a replat.

said private road and the awners hereby acknowledge that the County has
no obligation of any kind or nature whatsoever to establish, examine,

been made with the plat sponsor for construction of the wat-er system, in

schedule. The time schedule will provide, in any case, for vDmpletion

prior to application for building permits within the plat. The contractual
arrangements will include a provision holding Spokane County and ehe
purveyor harmless from claims by any iot puchaser refused a building per-
mit due to the failure of the plak sponsor to satisfactorily complete the

water system as approved by County and State Health authorities and
the local fire district and purveyor will be installed within this plat,
and the subdivider will provide for individual domestic water secvice as
well as fire protection to each lot prior to sale of each lot.

Spokane County Resolution No. 78-291, came before the Spokane County Short Plat

Having reviewed the records and files in this matter, the Spokane County
Short Plat Administrator makes the foilowing:
FINDINGS OF FACT ANO CONCLUSION
I
That appropriate provisions have been made for sewage disposal, water supply,
storm water control, circulation, fire protectiona and other necessary public facilities
and utilities.
II
That the uses and density proposed by the plat sponsor appear to be campatible
with existing development in the immediate area as well as being compatible with the
Spokane County Comprehensive Plan.
III
That Lot "D" of SP-79-118, has non-conforming use status for two (2) single
family residential structures.
IV
That no significant adverse environmental impact will likely result from the
approval of this proposal.
Therefore, the Spokane County Short Plat Administrator hereby issues this
DECISION
Short Plat Application as submitted by the applicant is hereby approved subject
to conditions which shall be complied with by the applicant and/or sponsor prior to
finalization of the short plat.

a. Basically flat tyith 0-5% slopes. Vegetation,appeared normal.
b. Soils are listed as Garrison gravel, noted as having slight limitation for
sewage disposal systemswith possible contamination of groundwater.
c. Vera Water and Power Company has indicated that they are willing and able
to furnish domestic use water -for-the plat and that adequate arrangements
have not been.macle with the developer .
d. -Field. sur-vey by, Gene Sharp, April 16, 1979, did no;t reveal any wells located
on or- adj,acent to the subj'ect plat.
3. Recofiiiierided-that:
a. The final plat shall be designed -as indicated on the preli.uninary plat of
recorri.and/or attached sheets as noted.
b. The dedicatory language,of the ,plat will state that each lot is authorized
the use of an individua.l on-site sewage disposal-system.
c. Prior to filing of the firial plat, the sponsor shall present evidence that
the pl'at lies within the recorded service area of the water system proposed
to serve the plat. The dedicator,y language on the plat,shall state : `.Use,of
private wells and water systems is prohibited."

d. The plan for water facilities adequate for domestic use; domestic irrigation
use and fire protection.,use shall be approved by, the.water supplier. Said
water plan must have been approved by the fire protection district and the-
appropriate health authorities. The health authorities, water supplier
'(purvey.or), and fire protection district will certify, prior to the filing
of the final plat, on the face of said~water plan that the plan is in con-
formance with-.their requirements and will adeq,uately satisfy their respective
needs. Said water plan and.certification will be drafted on a transparency
suitable for reproduction.
e-. The-purveyor wi-11 also certify prior to the filinq of the final plat on
a:copy of said water plan that'aPgropriate.contractual arrangements have
been made with the plat sponsor- for construc,tion of the water'system, in
accordarice with the approved,plan-, and in accordance with a time schedule.
The time schedule will provide, in any case, for completion of the water
system and-inspection by the.appropriate health authorities prior to applica-
tion for building permits within the plat. The contractual arrangements will
include a,provision holding Spokane'County,., Sgokane County Eiealth Distr-ict
and the ;purveyor harmless froin,claims by any 1'ot Purchaser refused a,building
permit due to the failure of the plat sponsor to satisfactorily complete the
approved water system.
f. The plat dedication will contain a statement to the effect,that: "The public
water system as approved by Coun'ty and State Health authorities and the local
fire district and purveyor will be.;installed within this plat, and the sub-
divider will provide -for individual domestic water service as well as fire
protection to each lot prior to,sale of each lo,t.
g. Drainage plans-and-design calculations sYiowing..the grades and aligninent of
c3rainage faci-lities shall be submi:tted to the County Erigineer and.Sgokane
County Health District for approval prior to construction and the filing
of the final_ plat.
