1. They request that priority review be given to their project.
2. They agree to reimburse Spokane County fot proiect review fees
as specified in Boazd of County Conunissioner's Resolution 80-
1592 attachment C, as amended. The fees will be based on

plus a ten pezcent administrative charge, and will be billed
monthly as accrued.

BEFORE THE SPOKANE CUUNTY PLANNIIVG DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-624-90 ) CONCLUSIONS AND
) DECISION
THIS MATTER, an applicadon for subdivision of land from Russ Cawen and Harry
Frazier, has been rece iv and decided upon, pursuant to Spokane County Subdivision
regulations, on thek ~ day of June, 1990.
FINDINGS UF FACT AND CONCLUSIQNS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide .54 acres into two lots for the development of single-family
home sites.
3. The proposal is located at the southwest corner of Ely Road and Kiernan Avenue in the
Spokane Valley, Spokane County Parcel No. 06543-2501.
4. The cu.rrent zoning of the properry is Agricultural-Suburban (AS). The proposed lot
sizes, frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category/designation.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the project were noafied and recommendations solicited.
7. No one in the area cornmented on the proposal.
8. Through the required right-of-way dedicadon of 7.75 feet along Kiernan Avenue a.nd Ely
Road, the exisung residence on Tract "A" has nonconforming setback status, as provided
for in Section 4.18.050 of the Zoning Ordinance of Spokane County. Any new
swctures on either tract will have to meet the proper setbacks required by the existing
zoning.
9. Recognizing the recornmended conditions and Spokane County development standards,
the proposed subd.ivision makes appropriate provisions for the public health, safety and
general welfare, and the public use and incerest will be served by platting the subdivision.
10. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800(6)(a).
DECISIUN
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-624-90 is hereby APPROVED until June 1, 1993, subject to condicions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalizadon of the short subdivision. This decision is final unless
appealed in wridng, consistent with adopted appeal procedures.
These Conditioas of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT C4NDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The final plat shall be designed substantially in conformance with the preliminary plat
of record as legally described and advertised. No increase of density or lot number
shall occur without a new applicadon submittal and approval.

3. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utiliry companies must be received
with the submittal of the final plat.
4. Three (3) current certificates of atle shall be furnished the County Planning Department
prior to filing the final plaL
5. The following statement shall be placed in the final plat dedication:
"No more than one (1) dwelling structure shall be placed on any lot, nor shall any lot be
funher subdivided for the purpose of creating additional lots, ownerships or building
sices without first filing and receiving approval of a replat."
6. A survey is required prior to the filing of a final plat.
7. Tract A shall have a non-conforming setbacks for the existing structure shown on the
preliminary plat of record. New structures will be required to meet proper setbacks.
8. The preliminary plat is given conditional approval for three (3) years, specifically to
July 1, 1993. 1fie applicant may request an extension of time by subnutting a written
request approximately forty-five (45) days prior to the above expiradon dgte.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedicadon of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
3. Dedication of 7.75 feet of additional right-of-way along Kiernan Avenue and Ely Road,
and a 20-foot radius at Kiernan and Ely, as depicted on the preliminary plat, is
required.
4. Existing county roads providing direct access to the plat shall be paved and curbed to
Spokane County standards.
5. The word "applicant" shall include the owner or owners of the property, heirs, assigns
and successors.
6. To construct the road improvements scated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such dme as an RID is
created or any Road Improvement Project is sancdoned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
7. As an altemative method of construcring the read improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and paracipadng in a County Road Project
(CR.P) ta the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
impruvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
8. The following statement be placed in the plat dedicaaon:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the fonnation of a Road Improvement District (RID)
by the petition method pursuant to Chapter 36.88 RCW, which petirion includes the
owner(s)' property, and further not to object, by the signing of a ballot, to the
formation of an RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s)' property. If an RID is formed by either the

petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formarion of the RID by the property
included therein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiendy developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the property
as a result•of the improvements called for in coajunction with the formation of an
RID by either pedtion or resolution method under Chapter 36.88 RCW, and to
appeal to the Snperior Court the decision of the Board of County Commissioners
affirming the final assessment roll.
It is further agr+eed that at such dme as an RID is created or any Road Improvement
Project is sancdoned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving) will be at the sole expense of the
undersigned owner(s), their heirs, grantees and assigns without participation by
Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) yeazs from
the date of execution below. However, the owner(s) or successor(s) agree that if
said RID waiver expires without construction of the required improvements, the
owner(s) or successor(s) agree to construct the required improvements at their own
expense, pay to Spokane County the then esdcnated cost of the required
improvements to enable the County to complete the same, or furnish a bond or
other secure n2ethod suitable to the County (which may include the execution of
another RID waiver agreement) provid.ing for or securing to the Count}r the actual
construction of the improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)."
9. The County Engineer has designated Typical Roadway Section No. 2 standard for the
improvement of Kiernan Road and Ely Avenue, which is adjacent to the proposed
deveiopmenL This will require the addition of approximately 10 to 12 feet of asphalt
along the frontage of the development. The construcaon of curbing and sidewalk is
also required.
10. The proposed subd.ivision shall be improved to the standards set forth in Spokane
County Board of Comnussioners Resolution No. 80-1592, as amended, which
resolunon establishes regulations for roads, approaches, drainage and fees in new
construction.
11. The County Engineer has examined this development proposal and has deternuned that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified.
12. This proposed subd.ivision or development proposal is located within a drainage basin
which has been identified by the Spokane County Engineef s office as having
stormwater runoff problems. Since this proposed subdivision or development proposal
is affected by or is a contributor to stormwater flows, property owners should
participate in the planning and implementation of a future basinwide stormwater
management system. The following statement shaIl be placed in the piat dedicacion:
"The owner(s) or successor(s) in interest agree to join in any County-approved
stormwacer management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
constructing, maintaining or operaaon of stormwater control facilities."

COUNTY HEALTH DISTRICT CONDI'TIONS
l. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for disrribution by the Planning Departnent to the utility companies, Spokane
Counry Engineer and Spokane County Health District. Written approval of the
easements by the utiliry companies must be received prior to the submittal of the final
plat.
2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
3. Water service shall be coordinated through the Director of Utilities, Spokane County.
4. Water service shall be by an existing public water supply when approved by the
Reg'onal Engineer (Spokane), State Department of Social & Health Services.

5. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the reconded service area of the water system proposed to serve the plat,
6. Prior to fili.ng the final plat, the sponsor shall demonstrate to tbe satisfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems
are available on Tract "B."
7. Prior to filing the final plat, the sponsar shall demonstrate to the satisfaction of the
Spokane County Health District that the euisting on-site sewage disposal system
serving the residence located on Tract "A" is wholly located within the boundaries of
the loVtra+cL
8. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of pernnits by the Health Officer, the use of (an) on-site sewage system(s)
may be authorized."
9. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
10. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by county and state health autharides, the local fue district and purveyor,
will be installed within this plat, and the subdivider will provide for individual domestic
water service as well as fire protecdon to each lot/tract pnor to sale of each lot/tract."
COUNTY UTILTTIES DEPARTIVIENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use af ~
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific applicaaon approval and issuance of
permits by the Health DistricG
2. The dedication shall state:
"The owner(s) or successor(s) in interest agnee to authorize the County to place
their name(s) on a pedtion for the fonnaaon of ULID by petition method pursuant
co RCW 36.94, which pedtion includes the owner(s)' property; and further not to
object by the signing of a protest petition against the fommtion of a ULm by
resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
propeny. PROVIDED, this condidan shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
improvements called for in conjunction with the formadon of a ULID by either
petition or resolution method under RCW Chapter 36.94."
3. Any water service for this project sha.U be provided in accordance with the Coordinatetl
Wacer System Plan for Spokane Counry, as amended.
4. The dedication shall state:
"Each new dwelling unit shall be double-plumbed for connecdon to fucure areawide
collection systems."
