This aqreernent is entered into the day of 1996. Joesph R.
and KatFileen M. Ciarno being ttie owners of lot A and B of Spokane Caunty Short Piat
626-90, located in Section 14, Township 25 North, Range 44 East, W.M.
On January 30, 1996, the Board of County Commissioners of Spokane County created
Spokane County Road Improvement District No. 493 fiar the improvement and paving
of Adams Road. • Spokane County Short Pfat No. 626-90 lies within the boundary of
said Road Improvement District. The Clarnos, being the developers of Shon Ptat 626-
90 were required at the time tliat the short plat was approved by Spokane County, to
construct roadway improvements along the Adams Road frontage of the short plat.
The required improvements consisted of roadway paving and construction of curb and
drainage structures., Because the entire raad along the frontage of thP short plat was
unpaved, the developer was permitted to satisfy the roadway improvement
requirerrients by recording documents by which they agreed to join in and not oppose
formation of a Road Improvement District for the improvement and paving of the road.
Mr. and Mrs. Clarno requested that curb not be installed as part of roadway
improvemerit be+ng constructed by Road Improvement District No. 493. They hereby
agree that they are responsible for construction of the curb and assaciated drainage
structures as required at the time Spokane County approved Short Plat 626-90. In
exchange for deletion of curbing fram the road improvement project, Joseph Clarno
and Kathleen Clarno hereby agree to construct curb and associated drainage aiong the
Adams Road frontage of Spokane County Short Plat 626-90 rf Adams Raad is
improved ta a standard greater than that being constructed by the Road Improvement
District project or if the undeveloped proeprty on the east side of Adams Road is
developed.
This agreement is binding upon the owners of Spokane County Short Plat 626-94 their
heirs, successors and assigns. The agreement shall run with the land and may only
be extinpuished by Spokane County.

Transamerica Title Insurance Company, a California corporation, herein called the Company,
for a valuable consideration, hereby commiis to issue its poticy or policies of title insurance, as
identified in Schedule A. in favor of the proposed insured named in Schedule A, as owner or
mor#gagee of the estate or interest covered hereby in the land deseribed or referred to in
Scheduie A, upon payment of the premiums and charges therefor; all subject to the exceptions
and conditions and stipulations shown herein. the Exclusions from Coverage, the Schedule 6
exceptions, and the conditions and stipulations of the policy or policies requested. (See reverse
side of this cover and inside of back cover for printed Exclusions from Coverage and Schedule B
exceptions contained in various policy forms.)
This Corramitment shall be effective onty when the identity of the proposed Insured and the amount
of the policy or policies committed for have been inserted in Schedule A hereof by the Company,
either at the time of the issuance of this Commitment or by subsequent endorsements and is
subject to the Conditions and Stipulations on the back of this cover.
This Commitment is preliminary to the issuanCe o# sucb policy or policies of title insurance and all
liability and obligations hereunder shall cease and terminate six months after the effective date
hereof or when the policy or policies committed for shall issue, whichever first occurs, provided
that the failure to issue such policy or policies is not the fault of the Company.

and seal to be hereunto affixed by its duly authorized officers on the date shown in Schedule A.

COMMITMENT CONDITIONS AND STIPULATIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed insured has or acquires actual knowledge of any defect, (ien, encumbrance, adverse claim or other matter affecting
the estate or interest or mortgage thereon covered by ihis Commitment other than those shown in Schedule B hereof, and
shall fail to disclose such knowledge to the Company in writing. the Company shall be relieved from liability for any loss or
damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so disclose such know-
ledge. If the proposed insured shall disclose such knowledge to the Company, or if the Company otherwise acquires actual
knowledge of any such defect, lien, encumbrac►ce, adverse claim or other matter, the Company at its opfion may amend Schedule
B of this Commitment accordingly, but such amendment shall not relieve the Company from liability previously incurred pur-
suant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed insuned and such parties included under
the definition of insured in the form of policy or policies committed for and only for actual loss incurred in reliance hereon in
undertaking in good faith, (a) to comply with the requirements hereof, or (b) to eliminate exceptions shown in Schedule B, or
(c) to acquire or create the estate or interest or mortgage thereon covered by this Commitment. In no event shall such liability
exceed the amount stated in Schedule A for the policy or policies committed for and such Iiabllity is subjec# to the insuring
provisions, the Conditions and Stipulations, and the Exclus+ons from Coverage of the form of policy or policies cornmitted for in
favor of the proposed insured which are hereby incorporated by reference and are made a part of this Commitment except as
expressly modified herein.
4. Any action or actions or rights of action that the proposed insured may have or may bring against the Company arising out of
the status of the title to the estate or interest or the status of the mortgage thereon covered by this Commitment must be based
on and are subject to the provisions of this Commitment.
SCHEDULE OF EXCLUSIONS FROM COVERAGE
The matters listed below each policy form are expressly excluded from the coverage of that policy and the Company will not pay
loss or damage, costs, attorneys fees or expenses which arise by reason thereof:

DECISION

THIS MA'T'FER, an application for subdivision of land, from Joseph Clarno has been
receiyed and drcided upon, pursuant to Spokane County Subd.ivision negulations, on the
day of May, 1990
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 1.76 acres into 21ots for the development of
single family residences.
I 3. The proposal is located at the southwest corner of Adams Road and Cataldo Avenue in
, the NW 1/4 of Secdon 14, Township 25 N., Range 44 EWM.
4. The current zoning of the property is Agricultural. The proposed lot sizes, frontage and
~ intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
b. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and reconunendadons solicited.
7. No adjacent property owners commented on the proposed short plaL
~ K. The Spokane Counry Arterial Road Plan identifies Adams Road as a Minor Arterial with a
recommended right of way width of 80 feet and a 35 ft. structure setback to be measured
from the ultimate right of way. Existing Adams Road right of way width of 45 feet is
inadequate to implement the arterial road plan. Future right of way dedicadon and
acqisition areas will be required.
g. Recognizing the recommended conditions and Spokane County development standards,
the pmposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-626-90 is hereby APPROVED until June 1, 1993, subject to condirions noted
below. Most of the condidons of approval shall be accomplished by the applicant and/or
sponsor prior to finalizadon af the short subdivision. This decision is final unless
appcalr.d in writing, consistent with adnpted appeal proc;edures.
These Conditioos of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any surcessors-in-interest to property.
PLaNNING DEPARTMENT CUNDITIONS ~
1. The preliminary plat of record approval is for the properry legally described in the
application for this proposal.
2. The final plat shall be designed substantially in confonnance with the preliminary plat
of record as legally described and advertised. No increase of density or lot number
shall occur without a new application submittal and approval.

3. The Spokane County Planning Director/designee shall review any proposed final plac to
ensure compliance with these Findings and Conditions of Approval.
4. The preliminary plat is given conditional approval for three (3) years, specifcally to
May 1, 1993. The applicant may request an extension of time by subcrutting a written
request approximately forty-five (45) days prior to the above expiration date.
5. A'ppropriate road name(s) shall be indicated.
6. Appropriate utility easements shall be indicated on copies of the praposed final plat.
Wntten approval of udlity easements by appropriate utility compaaies must be received
with the submittal of the final plat.
7. Three (3) current certificates of tide shall be furnished the County Planning Department
prior to filing the final plaL
8. The following statement shall be placed in the final plat dedication: "No more than one
(1) dwelling structure shall be placed on any lot, nor shall any lot be further subdivided
for the purpose of creating addidonal lots, ownerships or building sites without first
filing and receiving approval of a replat."
9. The final plat map shall indicate by a clear dashed line the required yar+d setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement that: "Side yard and rear yard setbacks shall be deterniined at the time
building permits are requested. The setbacks indicated on this plat may be varied from
if proper zoning approvals are obtained."
10. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection disvict, Spokane County
Building & Safety Deparanent and Spokane County Health DistricL The agencies will
certify on the WATER PLAN, prior to the filing of the final plat or any phase of the
preliminary plat, that the plan is in conformance with their respective needs and
reguladons. The WATER PLAN and certification shall be dmfted on a transparency
suitable for reproduction and be signed by the plat sponsor.
11. The purveyor shall also certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construcdon of the water
system in accordance with the approved WATER PLAN. The time schedule shall
provide for completion of the water system and inspection by the appropriate health
authorities prior to application for building permits within the final plat. The
arrangements or agreements shall include a pmvision holding Spokane County and the
purveyor hanYiless from claims by any lot purchaser refused a building peffnit due to
the failure of the subdivision sponsor to satisfactorily complete the approved water
system.
12. The purveyor shall also certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construcdon of the water
system in accordance with the approved WATER PLAN. The time schedule shall
provide for completion of the water system and inspecdon by the appropriate health
authoriaes prior to application for building perrnits within the final plaL 1'he
ar,rangements or agreemencs shall include a provision holding Spokane County and the
purveyor harmless from claims by any lot purchaser refused a building pernlit due to
the failure of the subdivision sponsor to satisfactorily complete the approved water
system.
13. The fina] plat dedicadon shall contain the following st,atement: "The public water
system, pursuant che WATER PLAN approved by County and State Health authorities,
the local fire protecdon d.istrict, County Building & Safety Department, and water
purveyor, shall be installed within this subdivision, and che subdivider/sponsor shall
provide for individual domestic water service as well as fire protection to each lot prior
to sale of each lot and prior to issuance of a building permit for each IoL"
14. No building permit will be issued for any lot within the final plat until certified by a
Washington State-licensed engineer that "the water system has been installed pursuant
to the approved WATER PLAN for the final plat," signed and stamped by said
engineer. The certificadon may be in the form of a letter, but is preferred to be cemfied
on a copy of the WATER PLAN as a schematie map showing the "as-built" water
system.
15. The Water Plan and the above four (4) condidons of approval regarding the WATER
PLAN may be waived by the Planning Director/designee upon receipt of letters from
the appropriate water purveyor and fire protecdon district stating that simple
connecaons to an existing, approved water system, will provide adequate domestic and
fue protection water to ensure the public health, safety and general welfare.
16. A survey is required prior to the filing of a final plat.
17. Spokane County Planning Department is required to record witb the County Auditor a
"Title Notice," as prepared and signed by the applicant, for a future acquisidon area for
rMd right-of-way and utilities to run with the land, and the future acquisition area
resetvetion shall not be removed without prior approval by the Spokane County
Planning DeparcmenL Nodce shall be recorded prior to the issuance of a building
permit and shall provide the following:
a. 15 feet of future acquisition area for road right-of-way and utilities, in addition to
the exisdng right-of-way ded.ication required by the County Engineer, along Adams
Road.
b. Building and other setbacks required by the Spokane County Zoning Code shall be
measured 35 feet from the edge of the Future Acquisition Area that is reserved for
road right-of-way and utilities along Adams Road.
c. The following minimum unprovements necessary to support the use within the zone
classificadon as required by the Spokane Counry Zoning Code standards should not
be located within the Future Acquisition Area.
1. Landscaping
2. Surface drainage
3. Drai nfields
4. Parking
5. Other
d. The 15 ft. Future Acquisirion Area, until acquired by Spokane County, shall be
private praperty and may be used as allowed in che zone, except any improvements
(such as landscaping, parking, surface drainage, drainfields, sigas or others) shall
be considered "interim" uses.
The property ovmer shall be respansible for relocating such "interim"
improveme,nts at the time Spokane County makes roadway improvements after
acquiring said Future Acquisition Area.
e. This "Title Notice" shall be signed by the applicant to serve as official norice and
acknowledgement of said Future Acquisition Area for road right-of-way and
utilities.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The cond.itional approval of the plat is given by the County Engineer subject to
dedication of right-of-way.
2. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to [he county road system.
3. Dedication of 5 ft. of additional right-of-way along Adacns road and a 20 ft. radius at
Cataldo and Adams is required.
4. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
5. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the fonnadon of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewallc, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their beirs, grantees
and assigns.
6. As an alternative method of consavcting the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extenc of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
7. The following statement be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a pecition for the formation of a Road Inlprovement District (RID) by the
petition mechod pursuant to Chapter 36.88 RCW, wtucb petidon includes the owner(s)'
pivperty, and further not to object, by the signing of a ballot, to the formation of an
• RIDHy the resoludon method pursuant to Chapter 36.88 RCW, which resolution
includes the owner(s)' property. If an RID is formed by either the petition or resolution
method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agnee:
(a) that the irnprovement(s) or constvction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the formadon of the RID by the property
included therein, together with the amount of any Counry participation, exceed the
cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiendy developed.
Provided further that the owner(s) or successar(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of an RID by either perition
or resoluaon method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Conlanissioners affinning the final assessment roll.
It is furcher agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
dra.inage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained irl this agreement shall expire after ten (10) years firom the
date of execution below. However, the owoer(s) or successor(s) agree that if said RID
waiver expires without construction of the required impravements, the owner(s) or
successor(s) agree to conswct the required improvements at their own expense, pay to
Spokane County the chen estimated cost of the required improvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) providing
for or securing to the County the actual construction of the improvements.
All of che requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s).
1'he County Enginoer has designated Typical Roadway Section Number Two,
Second.ary Arterial Standard for the improvement of Adams Road, which is adjacent to
the proposed developmenL This will require the addition of approximately 12 to 14
feet of asphalt along the frontage of the deveiopmenL The construcdon of curbing and
sidewalk is also required.
9. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system wairants the
dedication of addidonal right-of-way and the roadway improvements herein specified.
10. The County Arcerial Road Plan identifies Adams Road as a Minor Arterial. The
existing righc-of-way wid:h of 45 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property 15 feet in width along the Adams Road frontage shall be
set aside in reserve. This property may be acquired by Spokane County at the time
when arterial improvements are made to Adams Road.
CUi1NTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utilicy easements shall be indicated on copies of the preliminary plat of
record for disaribudon by the Planning Department to the utility companies, Spokane
Counry Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as autharized by the Director of Utilides, Spokane
County.
4. Water senrice shall be coordinated through the Director of Utilities Spokane County.
5. lg''atcr service shall be by an existing public water supply when approved by the
~ Reglb~al Engineer (Spokane), State Department of Social & Health Services.
6. Prior to filing the fmal plat, the sponsor shall present evidence that the plat lies wichin
the recorded service area of the water system proposed to serve the plat.
Prior to filing the final plat, the sponsor shall demonstrate to the sadsfactioo of the
Spokane County Health District that a suitable site for an on-site sewage disposal
system is available on Tract 1.
8. Subject to specific application approval and issuance of permits by the health officer,
the use of individual on-site sewage disposal systems may be authorized.
9. The dedicatory language of the plat will state that: "Subject to specific application
approval and issuance of permits by the Health Officer, the use of ind.ividual on-site
sewage disposal systems may be authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
11. The plat dedicadon will contain a statement to the effect that: "The public water system,
as approved by Counry and state health authorides and the local fire d.istrict and
purveyor, will be installed within this plat, and the subd.ivider will provide for
individual domestic water service, as well as fire protectioo, to each lot/tract prior to
sale of each IoVtract."
COUNTY UTILITIES DEPART1ViENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resoludon No. 80-0418, the use of
on-site sewer d.isposal systems is hereby authorized. This authorizarion is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The dedication shall state: "The owaer(s) or successor(s) in interest agree to authorize
the County to place their name(s) on a petition for the formadon of ULID by petiaon
method pursuant to RCW 36.94, which the pedtion includes the owner(s)' property;
and further not to object by the signing of a protest peddon against the formarion of a
ULID by resotution method pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVIDED this condition shall not prohibit the owner(s) or
successor(s) from objecring to any assessment(s) on the property as a r+esult of
improvements called for in conjuncdon with the fomaation of a ULID by either petidon
or resolution method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for

As per the letter dated April 20, 1990, asking to submit
comments on the above referenced application, it is my
conce rn as a neighborhood homeowne r that the development
of these two subdivisions be upgraded in the form of
paving and curbing between Broadway and Cataldo on Adams.
In the summe r of August 1985, the homeowners on Adams,
between Cataldo and Mission, agreed to have the road
paved with asphalt and curbed with driveway approaches.
At this time, I was told by the Spokane County Road
Improvement District tha t only at the time of land
development on Adams Road would the developers or
property owners have to absorb the cost of road
improvements.
I feel at this time that the road improvement on Adams
would greatly benefit the neighborhood and all who frequent
this high traffic road between the major arterials of
Broadway and Mission.

The Following Conditions Apply to Plat Under Consideration:
E 1 That conditional approval of the plat by the County Engineer
is given subject to dedication of Right-of-Way.
E12 The applicant should be advised that individual driveway
access permits are requiied prior to issuance of a building
permit for driveway approaches to the County road system.
E13 Dedication of 5 ft. of additional Right-of-Way along Adams
Road and a 20 ft. radius at Cataldo and Adams..
E19 The word "applicant" shall include the owner or owners of
the property, his heirs, assigns and successors.
E20 To construct the road improvements stated herein, the
applicant may, with the approval of the County Engineer,
join in and be a willYng participant in any petition oz
resolution which purposes is the formation of a Road
Improvement District (RID) for 5aid improvements pursuant to
RCW 36.88, as amended. At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane
County, the improvements required (curb, sideWalk, drainaqe
control and paving to existing pavement) will be at the sole
expense of the undersigned oWner, their heirs, grantees and
assigns.
E21 As an alternative method of constructing the road
improvement stated herein, the applicant may, With the
approval of the County Engineer, accomplish the road
improvements stated herein by joining and participat3.ng in a

E22 That the following statement shall appear within the
dedicatory language of the final plat:
The owner(s) or successor(s) in interest agree to authorize
Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District (RID) by the
petition method pursuant to Chaptez 36.88 RCW, which
petition includes the owner(s) property, and further not to
object, by the signing of a ballot, the formation of a RID
by the resolution method pursuant to Chapter 36.88 RCW,
Which resolution includes the owner(s) property. If a RID
is formed by either the petition or resolution method, as
pZOVided for in Chapter 36.88 RCW, the owner(s) or
successor(s) further agree: (1) that the improvements or
construction cantPmplated within the proposed RID is
feasible, (2) That the benefits to be dezived from the
formation of the RID by the property included therein,
together with the amount of any County participation,
exceeds the cost and expense oi- formation of the RID, and
(3) that the property within the proposed RID is
sufficiently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized undet RCW
36.88.090, to object to any assessment(s) on the property as
a result of the improvements called for in conjunction With
the formation of a RID by either petition or resolution
method under Chapter 36.88 RCW, and to appeal to the
Superior Court the decision of the Board of County
Commissioners affirming the final assessment roll.
It is furL-her agreed fihat at such time as an RID is
created oz any Road Improvement Project is sanctioned by
Spokane County, the improvements required (curb, sidewalk,
drainaqe control and paving) Will be at the sole expense of
the undersigned owner, their heirs, grantees and assigns
without participation by Spokane County.
The RID waiver contained in this agreement shall expire
after ten (10) years from the date of execution beloW.
However, the owner(s) or sticcessoz(s) agree that if said RID
waiver explres without construction of the required
improvements, the oWner(s) or successor(s) agree to
construct the required improvements at their own expense;
pay to Spokane County the then estimated cost of the
zequired improvements ta enable the County to complete the
same; or furnish a bund or other secure method suitable to
the County (which may include the execution of another RID
