for project zeviews and / or inspections plus a ten percent

BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-629-90 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land, from Rose Bagby has been received
and decided upon, pursuant to Spokane County Subdivision regulations, on the kday of
May, 1990.
FINDINGS OF FACT AND CONCLUSIONS
1. T'he individual signing below has further been properly delegated the respoosibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 1.72 acres into 21ots for the development of
residential uses.
3. The proposal is located east of and adjacent to Mamer Road, approximately 300 ft. south
of Mission Avenue, in the NE 1/4 of Section 15, Township 25 N., Range 44 EWM.
4. The current zoning of the propeny is Agricultural. The proposed lot sizes, frontage and
intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a poteotial
interest in the project were notified and recommendacions solicited.
7. No adjacent property owners commented on the proposed short plat.
8. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions far the public health, sarery and
general welfare and that the public use and interest will be served by platting the
subdivision.
9. The project is exempt from environmental review under the State Envinonmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-629-90 is hereby APPROVED undl June 1, 1993 subject to conditions noted
below. Most of the condidons of approval shall be accomplished by che applicant and/or
sponsor prior to finaiization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, 6eirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The final plat shall be designed substantially in conforniance with the preliminary plat
of record as legally described and advertised. No increase of density or lot number
shall occur without a new applicadon submittal and approval.
3. The Spokane County Planning Director/designee shall review any pmposed final plat to
ensure compliance with these Findings and Conditions of Approval.

4. The preliminary plat is given condirional approval for three (3) years, specifically to
3une 1, 1993. The applicant may request an extension of time by submitdng a wntten
request approximately forty-five (45) d.ays prior to the above expiration date.
S Appropriate road name(s) shall be ind.icated.
6. Appropriate utility easements shall be indicated on copies of the praposed final plat.
Written approval of utiliry easements by appropriate utility companies must be received
with the submittal of the final plat.
7. Ttvee (3) current certificates of title shall be furnished the County Planning Department
prior to filing the final plat.
8. The following statement shall be placed in the final plat dedication: 'No more than one
(1) dwelling structure shall be placed on any lot, nor shall any lot be fuzther subdivided
for the pu.rpose of creating additional lots, ownerships or building sites withoui first
filing and receiving approval of a replat."
9. The final plat map shall indicate by a clear dashed line the requined yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement that: "Srde yard and rear yard setbacks shall be detennined at the time
building permits are requested. The setbacks indicated on this plat may be varied firom
if proper zoning approvals are obtained."
10. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, Spokane County
Building & Safety Deparanent and Spokane County Health DistricG The agencies will
certify on the WATER PLAN, prior to the filing of the final plat or any phase of the
preliminary plat, that the plan is in conformance with their respective needs and
regulatioas. The WATER PLAN and cerdficadon shall be drafted on a transparency
suitable for repr+oducdon and be signed by the plat sponsor.
11. Tbe purveyor shall also certify that appropriate contractual arrangements and schedule
of unprovements have been made with the plat sponsor for construcdon of the water
system in accordence with the approved WATER PLAN. The time schedulc shall
provide for completion of the water sysoem and inspection by the appropriate health
authorities prior to applicadon for buildina pPrmits within the final plaL The
arrangements or agreements shall include a provision holding Spokane County and the
purveyor harmless from claims by any lot purchaser refused a building pesinit due to
the failure of the subdivision sponsor to satisfactorily complete the approved water
system.
12. The final plat dedicatioa shall concaiin the following statement: "The public water
system, pursuant the WATER PLAN approved by County and State Health authorities,
the local fire protecdon d.istrict, County Building & Safety Deparnnent, and water
purveyor, shall be installed within this subdivision, and the subdivider/sponsor shall
provide for individual domestic water service as well as fire protection to each lot prior
to sale of each lot and prior to issuance of a building pemut for each loL"
13. No building perinit will be issued for any 1ot within the final plat undl certified by a
Washington State-licensed engineer that "the water system has been installed pursuant
to the approved WATER PLAN far the final plat," signed and staznped by said
engineer. The certification may be in the fonn of a letter, but is prefened to be certified
on a capy of the WA1'ER PLAN as a schematic map showing the "as-built" water
system. .
14. The Water Plan and the above four (4) conditions of approval regarding the WATER
PLAN may be waived by the Planning Director/designee upon receipt of letters from
the appropriate water purveyor and fire protection district stadng that simple
connections to an euisting, appraved water system, will pmvide adequate domestic and
fire protecdon water to ensure the public health, safety and general welfare.
15. A survey is required prior to the filing of a final plaL
CvUNTY ENGINEER'S DEPARTMENT CONDITIQNS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.

2. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
3. Dedicadon of S feet of additional right-of-way along Mamer Roa,d is requ.ired.
4. The word "applicant" shall include the owner or owners of the property, tus heirs,
assigns and successors.
5. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a wiUing participant in any petidon or resolution
which purpose is the fonnation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
6. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvernents stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sancrioned by Spokane Counry, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
7. The following statement be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for che fomnation of a Road Improvement District (RID) by the
petidon method pursua►nt to Chapter 36.88 RCW, which pedtion includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the fonnation of an
RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution
includes the owner(s)' property. If an RID is formed by either the petition or resolution
method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agnee:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the fonnadon of the RID by the properry
included therein, together with the amount of any County participation, exceed the
cost and expense of forroation of the RID; and
(c) that the property within the proposed RID is sufficiendy developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the farcnatian of an RID by either petition
or resoludon method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners affirm.ing the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage conmal and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from tbe
date of execudon below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the required improvements to enable the
Counry to complece the same, or fumish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) provid.ing
for or securing to the County the actual construcdon of the improvements.
AU of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s).
8. The County Engineer has designated Typical Roadway Secdon Number Two, Access
Sveet standard for the improvement of Mamer Road, which is adjacent to the proposed
development This wiU r+equire the addition of approximately 8 to 10 feet of asphalt

along the frontage of the developcnent. The construction of curbing and sidewalk is
also required.
9. The proposed subdivision shall be i.cnproved to the standards set forth in Spokane
County Board of Commissioners Resoluuon No. 80-1592, as amended, which
resoludon establishes regulations for roads, approaches, drainage and fees in new
construcaon.
10. The County Engineer has examined this development pnoposal and has deterniined that
the impact of this proposal upon the existing county road system warrants the
dedicadon of additional right-of-way and the roadway unprovements herein specified.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the pneliminary plat of record and/or any
attached sheets as noted.
2. Appropriau udlity easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District Written appmval of the
easements by the utility companies must be received prior to the subnuttal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Services.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plaL
7. Prior to filing the final plat, the sponsor shall demonstrate to the saasfaction of the
Spokane County Health District that suitable sices for on-site sewage disposal systems
are available on Tracts A& B.
Subject to specific application approval and issuance of permits by the health officer,
the use of individual on-site sewage disposal systems may be authorized
9. The dedicatory language of the plat will state that: "Subject to specific application
approval and issuance of permits by the Health Off'icer, the use of (an) on-site sewage
system(s) may be authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
11. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by County and state health authorities and the local fire district and

COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuanc to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is bereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific applicadon approval and issuance of
permits by the Health District.
2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize
the Counry to place their narue(s) on a petition for the formation of ULID by peation
method pursuant to RCW 36.94, which the petition includes the owner(s)' property;
and further not to object by the signing of a protest petition against the fonnation of a
ULID by resoluaon methai pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVIDED this condidon shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
improvements called for in conjuncdon with the fomnation of a ULID by either petition
or resolution method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The ded.ication shall state: "Each new dwelling unit shall be double-plucnbed for
connecdon to future areawide collection systems."
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. The issuance of a build.ing permit by the Department of Building and Safety is required.
2. Requirements of Fire District No. 1 need to be satisfied during the building permit
process.
3. The required fire flow for any building or subdivision is determined by building size,
type of construction and proximiry of exposures. Based on information presented to
this office regarding this subdivision, the minimum fire flow established by code of
500 gallons per minute for 30 minutes is being required.

1. SP-629-90 is going to require the insta.Uation of one new fire hydranL The fire hydrant
