BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-634-90 ) CONCLUSIONS AND
DECISION
THIS MATTER, an applicatioa for subdivision of land, from Frank Madden has been
recved and decided upon, pursuant to Spokane County Subdivision regnlations, on the
~ ~ day of June, 1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately .61 acres into 21ots for the development of
single family dwellings.
3. The proposal is located at the northeast corner of Lily Road and Fairview Road in the NE
1/4 of Section 12, Townsbip 25 N., Range 43 EWM.
4. The current zoning of the property is Agricultural Suburban. The proposed lot sizes,
frontage and intended uses ane allowed within this zone.
5. The Spokane Counry Comprehensive Plan designates this area as Urba.n. The
development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this pnoposal and agencies having a potential
interest in the project were notifieri and recomraendadons solicited.
7. No property owners in the area commented on the proposed short plat.
8. Division of subject property into proposed Tracts "A" and "B" may result in existing
dwelling located on proposed Tract "B" having non-confomling front and side yard
setbacks. Any subsequent additions to existing dwelling must meet minimum setback
requirements of the Spokane County Zoning Ordinance.
9. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-634-90 is hereby APPROVED until July 1, 1993, subject to conditions noted
betow. Most of the conditions of approval shall be accomplished by the applicant andlor
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writinng, consistent with adopted appeal procedures.
These Conditions of Approvat apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIUNS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The final plat shall be designed substantiaUy in conformance with the prelinunary plat
of record as legally described and advertised. No increase of densicy or lot number
shall occur without a new application submittal and approval.

3. The Spokane County Planning Director/designee shall review any proposed final plat to
ensure compliance with these Fuidings and Condidons of Approval.
4. The preliminary plat is given cond.itional appmval for three (3) years, specifically to
July 1, 1993. The applicant may request an exteasion of time by subnutting a written
request approximately forty-five (45) days prior to the above expiration date.
5. Appropriate utility easements shall be indicaied on copies of the proposed final plat.
Written approval of urility easements by appropriate utility comparues must be received
with the submittal of the final plat.
6. Three (3) cuaent certificates of dtle shall be furnished the County Planning Deparnnent
prior tio filing the fiaal plat
7. The following statement shall be placed in the final plat dedication: "No more than one
(1) dwelling structure shall be placed on any Iot, nor shall any lot be further subdivided
for the purpose of creadng addiuonal lots, ownerships or building sites without first
filing and receiving approval of a replat."
8. The final plat map shall indicate by a clear dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement that: "Side yard and rear yard setbacks shall be determined at the time
building permits are requested. The setbaCks indicated on this plat may be varied from
if proper zoning approvals are obtained."
9. A survey is required prior to the filing of a final plaL
10. A plan for water facilities adequate for domesac service and fire proteceon shall be
approved by the water purveyor, appropriate fire protecdon district, Spokane County
Building & Safety Department and Spokane Counry Health District The agencies will
cerrtify on the WATER PLAN, prior to the filing of the final plat or any phase of the
preliminary plat, that the plan is in conforniance with their respecdve needs and
regulations. The WATER PLAN and certification shall be drafted on a transparency
suitable for reproduction and be signed by the plat sponsor.
11. The purveyor shall also certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved WATER PLAN. The time schedule shall
provide for completion of the water system and inspecaon by the appropriate health
authorities prior to application for build.ing permits within the final plat. The
anangements or agreements shall include a provision holding Spokane Counry and the
purveyor harniless from claims by any lot purchaser refused a building pernut due to
the failune of the subdivision sponsor to satisfactorily complete the approved water
system.
12. The final plat dedication shall contain the following statement: "The public water
system, pursuant the WATER PLAN approved by County and State Hettlth authoriries,
the local fire protection district, County Building & Safety Department, and water
putveyor, shall be installed within this subdivisioa, and the subdivider/sponsor shall
prnvide for individual domestic water service as well as fire protection to each lot prior
to sale of each lot and prior to issuance of a building permit for each lot."
13. No building permit will be issued for any lot within the final plat until certified by a
Washington State-licensed engineer that "the water system has been installed pursuant
to che approved WATER PLAN for the final plat," signed and stamped by said
engineer. The certification may be in the form of a letter, but is preferred to be certified
on a copy of the WATER PLAN as a schematic map showing the "as-built" wacer
system.
14. The Water Plan and the above four (4) cond.icions of approval regard.ing the WATER
PLAN may be waived by the Planning Director/designee upon receipt of letters from
the appropriate water purveyor and fire protection district staang that simple
connections to an existing, approveti water system, wiU provide adequate domestic and
fire protecaon water to ensure the public health, safety and general welfare.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedicadon of right-of-way and approval of the road system as indicated in the
preliminary plat of record.

2. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
3. Dedication of 7.75 ft. of additional right-of-way along Fairview Avenue, and 7.75 of
additional right-of-way along Lily Road is required.
4. Existing county rQads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
5. 1he word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
6. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
wluch purpose is the fonnation of a Road Improvement District (R.ID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This applies to Fairview Avenue and Lily Road.
7. As an alternative method of construcdng the road improvements stated herein, the
applicant may, witb the approval of the County Engineer, accomplish the road
impmvements stated herein by joining and participating in a County Road Project
(CRP) co the extent of the required road improvements. At such time as an RID is
created or any Road Improveraent Project is sanctioned by Spokane Counry, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), thcir heirs, grantees
and assigns. This applies to Fairview Avenue and Lily Road.
8. Tbe following statement be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to auchorize the County to place their
name(s) on a pedtion for the fonnaeon of a Road Improvement District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the formation of an
RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution
includes the owner(s)' property. If an RID is formed by either the petition or resolution
method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agree•
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation, exceed the
cost and expense of formadon of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the forrnation of an RID by eicher petition
or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the impmvements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participstion by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construction of the required improvements, che owner(s) or
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the required improvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) providing
for or securing to the County the actual construction of the unprovements.

All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s). This applies to Fairview Avenue
and Lily Road.
9. The County Engineer has designated Typical Roadway Secdon Number Two, Local
Access standard for the unprovement of Fairview Avenue and Lily Road, which are
adjacent to the proposed development. This will require the addition of approximately
10 feet of asphalt along the frontage of the developmenL The construction of curbing is
also required.
10. The proposed subdivision shall be irnproved to the standards set fortli in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
consrrucdon.
11. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing counry road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified..
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribudon by the Planning Deparanent to the ucility companies, Spokane
County Engineer and the Spokane Counry Health DistricL Wntten approval of the
easements by the utility companies must be received prior tQ the submittal of the final
plat.
3. Sewage d.isposal method shall be as authorized by the Dircctor of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilides, Spokane County.
5. Water service shall be by an exisdng public water supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Services.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Counry Health District that a suitable sites for on-site sewage disposal system
is available on Tract B.
8. Prior to filing the final plat, the sponsor shall dernonstrate to the sadsfacdon of the
Spokane County Health District that the existing on-site sewage disposal system
serving the residence located on Tract A is wholly located within the boundaries of the
tract.
9. Subject to specific application approval and issuance of permits by the health officer,
the use of individual on-site sewage disposal systems may be authorized.
10. The ded.icatory language of the plat will state that: "Subject to specific applicadon
approval and issuance of permits by the Health Officer, the use of individual on-site
sewage systems may be authorized."
11. The dedicatory language on the plat shall state: "Use of private wells And water
systems is prohibited."
12. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by County and state health authorides and the local fire district and
purveyor, will be installed within this plat, and the subdivider will provide for
individual domestic water service, as well as fue protection, to each tract prior to sale of
each tracL"
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of Counry Conunissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned

2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize
the County to place their name(s) on a petition for the fomnation of ULID by petition
method pursuant to RCW 36.94, which the petidon includes the owner(s)' property;
and further not to object by the signing of a protest petition against the foanation of a
ULID by resolution method pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVIDED this condidon shall not prohibit the owner(s) or
successor(s) fram objecting to any assessment(s) on the property as a result of
imprnvements called for in conjuncdon with the formation of a ULID by either petition
or resolution method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collecdon systems."
BUILDING AND SAFETY DEPART1ViENT CONDITIONS
1. The issuance of a building pennit by the Department of Building and Safcty is required.
2. Requircments of Fire District No. 1 need to be sadsfied during the building permit
process.

1. All requirements are met to satisfy Fire District #1 for short plat 634-90.
