SP-636•90 ) CONCLUSIONS AND DECISION THIS MATTER, an applicarion for subdivision of land, from Robert Payne has been rece med and decided upon, pursuant to Spokane Counry Subdivision regulations, on the ZO~'k day of July,1990. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has fiirther been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide .9 acres into 31ots for the development of one additional single family residence. 3. The proposal is located south of and adjacent to 3rd Avenue and north of and adjacent to 4th Avenue approximately 500 fL east of University Road. 4. The current zoning of the property is Multiple Family Suburban. The proposed Iot sizes, frontage and intended uses are allowed within this zone. 5. 1'he Spokane County Compr+ehensive Plan designates this area as Urban. The development and uses propased are generally in accord with this category/designation. f. The Spokane Counry Arterial Road Plan designates 4th Avenue as a CoUector Arterial with a planned right of way width'of 70 feeL The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 8. N0 one in the area commented on the proposal. 9. The width of improved roadway along the frontage of 3rd Avenue is 40 fG of asphalt from curb to curb and a sidewalk is constructed. The funcdonal classification of 3rd Avenue is Local Access, and is improved beyond local access requirements. 10. Recognizing the recommended conditions and Spokane County development standards, the pr+oposed subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by plauing the subdivision. 11. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-636-90 is hereby APPROVED undl August 1,1990, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant andlor sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. PLANNING DEPARTMENT CONDITIONS 1. The preliminary plat of record approval is for the property legally described in the application for this proposal. 1 ..1 . SP-636-90 2 2. The final plat shall be designed substantially ia c:onformance with the preliminary plat of record as legally described and advertised. No increase of density or lot number shall occur without a new application submittal and approval. 3. The Spokane County Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Cond.itions of Approval. 4. The preliminary plat is given conditional approval for three (3) years, specifically to August 1, 1993. The applicant may request an extension of time by submitting a wntten request approxunately forty-five (45) days prior to the above expiradon date. 5. A final plat number shall be indicated before the final plat is filed, such number to be approved by the County Planning Director/designee. 6. Appropriate road name(s) shall be indicated. 7. Appropriate utility easements shall be indicated on copies of the praposed final plat. Wntten approval of utiliry easements by appropriate uality companies must be received with the submittal of the final plat. 8. Tlvee (3) current cerdficates of title shall be furnished the County Planning Deparnneoc prior to filing the final plat. 9. The following statement shall be placed in the final plat dedication: "No more than one (1) dwelling structure shall be placed on any lot, nor shall any lot be furtber subdivided for the purpose of creating additional lots, ownerships or building sites without first filing and receiving approval of a replat." 10. The fiaal plat map shall indicate by a clear dashed line the required yard setbacks from all private, "Tract X" or public roa►ds. Tbe dedicarion shall contain the following statement that: "Side yard and near yard setbacks shall be determined at the time building perrmits are mquested. 3'he setbacks indicated on this plat may be varied from if pmper zoning appmvals are obtained." 11. No water plan is requir+ed and a simple tap is needed at the time of building pennit release. 12. A survey is required prior to the filing of a final plaL 13. Spokane Caunty Planning Department is required to r+ecand with the County Auditor a "Tide Notice," as prepared and signed by the applicant, for a future acquisidon area for road right-of-way and utiliries to run with the land, and the future acquisiuon area reservadon shall not be removed without prior approvat by the Spokane County Planning DepartmenL Notice shall be recorded prior to the issuance of a building pernut and shall provide the following: a. 5 feet of future acquisition area for road right-of-way and utilities, in addition to the existing right-of-way dedication required by the County Engineer, along 4th Avenue. b. Building and other setbacks required by the Spokane County Zoning Code shall be measurEd 25 fL from the northem edge of the Future Acquisition Area that is res,grv,.,eId for road right-of-way and ualides along 4th Avenue. Y~ c. Thex'S ft. Future Acquisition Area, until acquir+ed by Spokane County, shall be private property and may be used as atlowed in the zone, except any improvements . (such as landscaping, parking, surface drainage, drainfields, signs or others) shall be considered "interim" uses. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after ~ acquiring said Future Acquisiaan Anea. d. This "Title Norice" shall be sigQed by the applicant to serve as offieial notice and ~ acknowledgement of said Future Acquisition Area for road right-of-way and utilities. The condidonal approval of the plat is given by the County Engineer subject to dedication of rigbt-of-way and approval of the road system as indicated in the preliminary plat of record. 2. Iadividual driveway access pernuts are required prior to issuance of a buitding pemnit for driveway approaches to the county road system. 3. Dedication of 10 fL of additional right-of-way alon ?Ath Avenue is required 4. Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standazds. 5. Sidewalks are required along the arterial on Ath Avenue. fi. The word "applicant" shall include the owner or owners of the property, his heirs, assi,gns and successors. 7. To construct the mad improvements stated her+ein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) far said ~ improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Impmvement Project is sanctioned by Spokane County, the ~ improvements required (curb, sidewalk, drainage control and paving to existing ~ pavement) wiU be at the sole expense of the undersigned owner(s), their heirs, gantees and assigns. This is applicable to 4th Avenue. 8. As an altemative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accompush the road impmovements stated herein by joining arid participating in a County Road Pmject (CRP) to the exteat of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heus, grantees and assigns. This is applicable to 4th Avenue. 9. The following statement be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the peation method pursuant to Chapter 36.88 RCW, which perition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the fonriation of an RID by the resoludon method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by either the petition or resoluaon method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the unprovement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived frorn the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the R1D; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as autharized under RCW 36.8$.090, to object to any assessment(s) on the property as a resuZt of the improvements called for in conjunction with the formation of an RID by either petidon or resoludon method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners aff'uming the final assessment roll. It is further agreed that at such time as an RID is created or any Road ImpTOVement Project is sanctioned by Spokane County, the improvements requirr,d (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without parrticipation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required impravements at their own expense, pay to I , SP-636-90 4 Spokane County the then esdmated cost of the required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execudoa of another RID waiver agreeraent) prvviding for or se,curing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be bind.ing upon the owner(s), their successor(s) or assign(s). 1'his is applicable to 4th Avenue. 10. The County Eagineer has designated Typical Roadway Section Numbff Two, Collector Arterial standard for the improvement of 4th Avenue, which is adjacent to the proposed development. This will require the addition of approximately 10 feet of asphalt along the frontage of the development The construction of curbing and sidewallc is also required. 11. The proposed plat shall be improved to the standards set forth in Spokane County Board of Conunissioners Resolution No. 80-1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 12. The County Engineer has examined this development proposal and has deterrrrined that the impact of this proposal upon the existing county road system wamants the dedication of addidonal right-of-way and the roadway improvements her1ein specified. 13. The County Arterial Road Plan identifies 4th Avenue as a Collector arterial. The existing right-of-way width of 40 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way dedication, a strip of property 5 feet in width along the 4th Avenue frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to 4th Avenue 14. Applicant must demonstrate, per short.plat 63 90, that 60 fL of dedicated right-of-way exists on the 3nd Avenue frontage of the plaL There appears to be a 20 fL discrepancy between the Counry Engineers map and the designed short plat which would leave lot 1 of the short plat without frontage on 3rd Avenue. Applicant shall dedicate the additional ZO ft, of pmperty to provide for a 60 ft right of way atong the frontage of 3r+d Avenue. COUNTY HEALTH DISTRICT CONDITIONS 1. Appropriate utility easements shall be ind.icated on copies of the preiiminary plat of record for distribution by the Planning Department to the utiliry oompanies, Spokane County Engineer and the Spokane County Health DistricL Written approval of the easements by the utility companies must be received prior to the submittal of the final plat. 2. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Spokane Counry Health District prior to the issuance of any building pemut for this projecG 3. Sewage disposal method shall be as authorized by (the Director of Udlities, Spokane Counry. 4. Water service shall be coordinated throug6 the Director of Utilides Spokane County. 5. Water seivice shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsor shaU present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that a suitable site for on-site sewage disposal system are available on tract 1. 9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of dhe Spokane County Health District that the existing on-site sewage disposal system serving the residence located on tracts 2& 3 are wholly located within the boundaries of the tract. ~ i • \ SP-636-90 5 10. Subject to specific application approval and issuance of pernuts by the health officer, the use of i.adividual on-site sewage disposal systems may be authorized Note: There may not be adequate area ava.ilable oa tract 1 for the development of 4-5 multiple faanily residences. 11. The dedicatory language of the plat will state that: "Subject to specific applicadan approval and issuance of permits by the Health Officer, the use of individual on-site sewage systems may be authorized." 12. The dedicatory language on the plat shall sta.te: "Use of private wells and water systems is prohibited." 13. The plat dedication will contain a statement to the effect that: "The public water system, as approved by County aad state health authorities and the local fire di.strict and purveyor, will be installed within this plat, and the subd.ivider will provide for individual domesdc water service, a.s well as fire protection, to each tract prior to sale of each tracL" COUNTY UTILITIES DEPARTIVIENT CONDITIONS 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific applicadon approval and issuance of permits by the Health District. 2. The dedicadon shall state: "The owner(s) or successor(s) in interest agree to authorize the County to place their aame(s) on a petiaon for the formadon of ULID by petition rnethod pursuant to RCW 36.94, which the petition includes the owner(s)' property; and further not to object by the signing of a protest peridon against the foraaatioo of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED this condidon shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of improvements called for in conjunction with the fonnation of a ULID by either petirion or resolution method under RCW Chapter 36.94." 3. Any water service for this project shal.l be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. The preliminary plat is given conditional approval for tbree (3) years, specifically to August 1, 1993. The applicant may request an extension of ame by submitting a written request approximately forty-five (45) days prior to the above expiradon date. 5. A final plat number shall be indicated before the final plat is filed, such number to be approved by the County Planning Director/designee. 6. Appropriate road name(s) shall be ind.icated. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. The County Engineer has designated Typical Roadway Section Number Two, Collector Arterial standard for the improvement of 4th Avenue, which is adjacent to the proposed development This will require the addition of approximately 10 feet of asphalt along the frontage of the developmenL The construction of curbing and sidewallc is also required. 11. The proposed plat shall be improved to the standanis set forth in Spokane County Board of Comamissioners Resoludon No. 80-1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 12. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the exisdng county road system warrants the dedicacion of additional right-of-way and the roadway improvemenLs herein specified. 13. The County Arterial Road Plan identifies 4th Avenue as a Collector arterial. The existing right-of-way width of 40 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addiaon to the required right-of-way dedicadon, a strip of properry 5 feet in width along the 4th Avenue frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to 4th Avenue. 14. Applicant must demonstrate, per short plat =90, that 60 ft. of dedicated right-of-way exists on the 3rd Avenue frontage of the plat. There appears to be a 20 ft. discrepancy between the County Engineers map and the designed short plat which would leave lot 1 of the short plat without frontage on 3rti Avenue. Applicant shall dedicate the add.idona120 fL of property to provide for a 60 fL right of way along the frontage of 3rd Avenue. COUNTY HEALTH DISTRICT CONDTTIONS 1. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribuaon by the Planning Department to the utility companies, Spokane County Eng-ineer and the Spokane County Health DistricL Written approval of the easements by the utillity companies must be received prior to the submittal of the final plat. 2. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Spokane County Health District prior to the issuance of any building permit for this pro,ject. 3. Sewage disposal method shall be as authorized by (the Director of Utilities, Spokane County. 4. Water service shall be coord.inated through the Director of Utilides Spokane Counry. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plaL 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 8. Prior to filing the final plat, the sponsor shall demonstrate to the sadsfacdon of the Spokane County Health District that a suitable site for on-site sewage disposal system are available on tract 1. 9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaccion of the Spokane County Health District that the existing on-site sewage disposal system serving the residence located on tracts 2& 3 are wholly located within the boundaries of the tract. _ • ' - SP-636-90 5 10. Subject to specific applicarion approval and issuance of permits by the health officer, the use of individual on-site sewage disposal systems may be authorized. Note: There may not be adequate area available on tract 1 for the development of 45 muldple family residences. 11. The dedicatory language of the plat will state that: "Sabject to specific application approval and issuance of pennits by the Health Officer, the use of individual on-site sewage systems may be authorized." 12. The dedicatory language oa the plat shall state: "Use of private wells and water systems is prohibited." 13. The plat dedication will contain a statement to the effect that: "The public water system, as approved by County and state health authorides and the local fire district and purveyor, will be installed within this plat, and the subdivider will provide for individual domestic water service, as well as fire protection, to each tract prior to sale of each =L" COUNTY UTILITIES DEPARTMENT CONDITIONS 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is condidoned on compliance with all rules and reguladons of the Spokane County Health District and is further conditioned and subject to specific applicadon approval and issuance of permits by the Health District. 2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petidon for the formation of ULID by peddon method pursuant to RCW 36.94, which the petition includes the owner(s)' property; and further not to object by the signing of a protest petidon against the fonnation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' pmperty.
