Short Plat. A street plan for Tract B is not required before
filing the final plat, but will be required at the time of a
building permit. Because no additional runoff is being created
from Tract B at this time and because the area is relatively flat
it is proposed that a detailed drainage plan is not necessary
until a building permit is issued and a street plan/profile is
required.

638-90. Mr. Cocking was concerned about the timinq of the
improvements to Montgomery Drive and University Road. ZE-61A-83
the zone change for the underlying parcel pzovided for the
improvements to be constructed at the time of issuance of
building pezmits. Per condition #23 of the Findinqs and Order
of SP 638-90, "The applicant shall comply With all conditions of
ZE-61A-83 prior to the issuance of any building pezmit." The
applicant has submitted a building permit for Tract "A" and is
in the process of making the improvements to Montgomery Drive
along the frontage of Tract "A". PZior to the issuance of a
building permit for Tract "B" the applicant shall make the
requiZed improvements along the frontage of Montgomery Drive and
University Road. The improvements along the frontage of Tract
"B" of SP-638-90 will not be required prior to finalization of

SHORT PLAT NU. SP-638-90 ) CONCLUSIQNS AND
DECISION
TH IS MATTER, arl applicadon for subdivision of land, from Duane Cocking has been
receivitd and decided upon, pursuant to Spokane County Subdivision regulations, on the
~ day of July, 1990.
FINDINGS QF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decisian by the Spokane County Director of Planning.
2. The proposal is to divide 1.9 acres into 21ots for the development of industrial use lots.
3. The proposal is located at the northeast corner of the intersection of University Road and
Montgomery Avenue.
4. The current zoning of the property is Restricted Industrial. The proposed lot sizes,
frontage and intended uses are allowed within this z4ne.
5. The Spokane County Comprehensive Plan desigaates this area as Indastrial. The
development and uses proposed are generally in accord with this category/designation.
6. The required public notice was provided for this proposal and agencies having a pocenti3l
in[erest in the project were notified and recommendations solicited.
7. No one in the area commented on the proposal.
8. This property is the subjecc of zone change ZE-61A-83.
9. Recognizing the recommended conditions and Spokane County development standards,
the proposed subd.ivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The project is exempt from environmental review under the State Environmental Policy
Acc pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-638-90 is hereby APPRUVED unal July 1, 1993, subject to conditions noted
below. Most of the conditions of approval shaU be accomplished by the applicant and/or
sponsor prior to finalizadon of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the

PLANNING DEPARTMENT CUNDITIONS
1. The specific development plan will be submitted for Planning Departrnent review and
approval prior to issuance of building pemuts.
2. The preliminary plat of record approval is for che property legally described in the
application for this proposal.
3. The final plat shall be designed substandally in conformance with the preliminary plat
of record as legally described and advertised. No inc:rease of density or lot number
shall occur without a new applicaaon submittal and approval.
4. The Spokane County Planning Director/designee shall review any pmposed final plat ta
ensure compliance w~th these Findings and Conditions of Approval.

5. The prelirrunary plat is given conditional approval for three (3) years, specifically to
July 1, 1993. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
6. A final plat number shall be indicated before the final plat is filed, such number to be
approved by the County Planning Director/designee.
7. Appropriate road name(s) shall be indicated.
8. Appropriace utility easements sball be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies must be received
with the submittal of the final plat.
9. Three (3) cuzrent eemficates of tide shall be fumished the County Planning Department
prior to filing the final plaL
10. The following statement shall be placed in the final plat dedication: "No more than one
primary use shall be placed on any lot, nor shall any lot be further subdivided for the
purpose of creaang add.itional lots, ownerships or building sites without first filing and
receiving approval of a replat."
11. The final plat map shall indicate by a clear dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedicadon shall contain the following
statement that: "Side yard and rear yard setbacks shall be detemzined at the dme
building permits aze requested. The setbacks indicated on this plat may be varied from
if proper zoning apprnvals are obtained."
12. A survey is required prior to the filing of a final p1aG
13. Spokane County Planning Department is required to r-ecord with the County Auditor a
"'I'idc Notice," as prepared and signed by the applicant, for a future acquisition area for
road right-of-way and utilities to run with the land, and the future acquisiaon area
reservadon shall not be removed without prior approval by the Spokane County
Planning Department. Noace shall be reccorded pnor to the issuance of a buildi.ng
perniit and shall provide the following:
a. 11 feet is to be set aside for futui-e acquisition area for road right of-way and
utilities, in addidon to the existing right-of-way dedication rre1quired by the County
Engineer, along University Road.
A strip of property along Montgomery Drive frontage that would provide a right of
way wndth equal to 40 feet from the centerline of Montgomery Drive is to be set
aside for future acquisition area for road right-of-way and utilities, in addition to the
existing right-of-way dedication required by the County Engineer, along
Montgomery Drive.
b. Building and other setbacks required by the Spokane County Zoning Code shall be
measured 35 ft. from the north edge of the Future Acquisition Area that is reserved
for road right-of-way and utilities along Montgomery Drive.
Building and other setbacks required by the Spokane Counry Zoning Code shall be
measured 20 fL from the east edge of the Future Acquisition Area that is reserved
for road right of way and utilides along University Road.
c. The following minimurn improvements necessary to support the use within the zone
elassificauon as rzquired by the Spokane County Zoning Code standards should not i
be located wichin the Future Acquisiaon Area.

4. Parking
5. Other
d. The 11 ft. Future Acquisition Area on University and a strip of property along
Montgomery Drive frontage that would provide a right of way width equal to 40
feet from the centerline of Montgomery Drive Future Aquisition Area on
Montgomery Drive, until acquired by Spokane County, shall be private property
and may be used as allowed in the zone, except any improvements (such as
landscaping, parking, surface drainage, drainfields, signs or others) shall be
considered "interim" uses.

The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said Future Acquisiaon Area.
e. This "Tide Notice" shall be signed by the applicant to serve as official notice and
acknowledgement of said Future Acquisition Area for road right-of-way and
utilities.
CvUNTY ENGINEER'S DEPARTMENT CONDITIUNS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to Counry standards showing proposed
street centerline and curb grades shaU be submitted ta the County Engineer for approval
prior to construction and/or the filing of each final plat; road plans to be prepared under
the direcdon of a licensetl Professional Civil Engineer.
3. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engineer for approval prior to construction and/or the
fil.ing of the final plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
4. Construction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed engineer/surveyor, who shall fumish the
County Engineer with "as-buiit" plans and a certificate in writing that all improvements
were installed to the lines and grades shown on the approved construcdon plans and
that all disturbed monuments have been replaced.
5. No construction work is to be performed within the existing or proposed public right-
of-way until a pernut has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
6. All construction within the existing or proposed public right-of-way is to be completed
prior to filing each final plat, or a bond in the amount estimated by the County Engineer
to cover the cost of construction of improvements, construceon cerrification, "as-built"
plans and monumentiag the street centerlines shall be filed with the County Engineer.
7. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
8. Dedication of additional right-of-way along Montgomery Drive to provide for a
minimum of 32 ft. from the centerline of Montgomery Drive along the frontage of the
project and applicable radius on Universiry Road and Montgomery Drive.
9. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane Counry standards.
10. Sidewalks are required along the arterial(s) on Montgomery Drive and University
Road.
11. The word "applicant" shall include the owner or owners of che property, his heirs,
assigns and successors.
12. The County Engineer has designated Typical Roadway Section Number One,
Secondary Arterial standard for the improvement of University Road, which is adjacent
to the proposed development. This will reyuire the addition of approximately 10-12
feet of aspbalt along the frontage of the development. The construcdon of curbing and
sidewalk is also required.
13. The County Engineer has designated Typical Roadway Section Number One,
Secondary Arterial standard for the improvement of Montgomery Drive, which is
adjacent to the proposed development. This will require the addition of asphalt along
the frontage of the development to meet the required 22 ft. of asphalt from the centerline
of Montgomery Drive.
14. The proposed private road as shown on the preliminary plat serving 21ots with no
extension possible is approved by the County Engineer provided that the easement
width is a minimum of 30 ft.

15. That private road be unproved to Spokane County standard for a private road
UrbanlSuburban standard serving 21ots, and are subject to approval under Section
10.207 of the Spokane Counry Fire Code.
16 All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokane County Engineer prior to recording with the Spokane County Auditor.
Recording nwnbers shall be referenced in the dedicatory language of the plat.
17. The following statement shall be placed in the plat dedication:
"WA►RNIIVG: Spokane County has no responsibility to build, improve, maintain or
otherwise service the private roads contained withi.a or provide service to the property
described in this plat. 8y accepting this plat or subsequently by allowing a building
pennit to be issued on property on a private road, Spokane County assumes no
obligation for said private toad, and the owners her+eby acknowledge that the County
has no obligation of any kind or nature whatsoever to establish, examine, survey,
construct, alter, repair, improve, maintain or provide drainage or snow removal on a
private road. This requirement is and shall run with the land and shall be binding upon
the owner(s), their heirs, successors or assigns, includiag thc obligation to participate
in the maintenance of the private road as provided herein."
18. The proposed plat shall be improved to the standards set forth in Spokane Counry
Board of Commissioners Resoluaon No. 80-1592, as anended, which establishes
regulations for roads, approaches, drainage and fees in new construction.
19. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedicaaon of additional right-of-way and the roadway impr+ovemen[s herein specified.
20. The following statement shall be placed in the final plat dedication: "The private road as
shown hereon is an easement which provides a means of ingress and egress for thase
lots wichin the plat having frontage thereon."
21. The Counry Arterial Road Plan identifies University Road as a Principle Arterial. The
existing right-of-way width of 69 feet is not consistent with that specified in the Plan.
In order to unplement the Arterial Road Plan, it is recommended that in adciidon to the
reyuired right of way ded.ication, a strip of property 11 feet in width along the
Universiry Road frontage be set aside in reserve. This property may be acquired by
Spokane County at the time when arterial improvements are made to University Road.
22 . The County Arterial Road Plan identifies Montgomery Drive as a Minor Arterial. The
exisdng right-of-way width of approximately 60 feet is not consistent with that
specified in the Plan. In order to implement the Arterial Road Plan, it is recommended
thac in addition to the required right of way dedicarion, a saip of property along
Montgomery Drive frontage that would provide a right of way width equal to 40 feet
from the centerline of Montgomery Drive be set aside in reserve. This property may be
acquired by Spokane County at the time when arterial improvements are made to
Montgomery Drive.
23. The applicant shall comply with all conditions of ZE-61A-83 prior to the issuante of
any building pemuts.
24. Applicant shall show all easements effecting Tract A and B of Short Plat 638-9(), these
easements include but are not limited to no build build easements, ingress and egress
and truck turn-around access.
C()UNTY IIEALTH DISTRICT CONDITIQNS
1. Appropriate utility easements shall be iadicated on copies of the preliminauy plat of
record for d.istribution by the Planning Department to the udlity companies, Spokane
County Engineer and the Spokane County Health DistricL Written approval of the
easements by the udlity companies must be received prior to the submittal of the final
plat.
2. A combined surface water and sewage disposal detailed plan shall be approved by the
County Engineer and the Spokane County Health District prior to the issuance of any
,I building pemut for this project.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.

4. Warer service shall be coordinated through the Director of Urilities Spokarie County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spolcane), State Department of Social & Health Services.
b. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service ar+ea of the water system proposed to serve the plat,
7. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
8. Prior to filing the final plat, the sponsor shall demonstrace to the satisfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems
are available on Tracts A&B.
9. Subject to specific application approval and issuance of permits by the hcalth officer,
the use of individual on-site sewage disposal systems may be authorized. Note: The
maximum sewage flow allowed shall be 2700-3600 gallons per acre of gross land area.
10. The dedicatory language of the plat will state that: "Subject to specific application
approval and issuance of permits by the Health Officer, che use of individual on-site
sewage systems may be authorized."
11. The dedicatory language on the plat shall stace: "Use of private wells and water
systems is prohibited."
12. The plat dedication will contain a statement to the effect thac: "The public: water system,
as approved by Counry and state health authorides and the local fire district and
purveyor, will be installed within this plat, and the subdivider will provide for
individual domestic water service, as well as fire protecdon, to each tract prior co sale of
each tract."
CqUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuanr to the Board of Counry Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific applicadon approval and issuanee of
permits by the Health District.
2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize
the County to place their name(s) on a petition for the formation of ULID by petition
method pursuant to RCW 36.94, which the petition includes the owner(s)' property;
and further not to object by the signing of a protest pedtion against the formation of a
ULID by resolution method pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVIDED this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a ULID by either petition
or resolution method under RCW Chapter 36.94."
3. Any watzr service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended..
4. T'he dedication sball state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."
BUILDING AND SAFETY I)EPARTMENT CONDITIONS
1. Tract A will need a fire access lane to the rear of the lot as per Fire District No. 1
requirements.
