THIS MATTER, a request for an extension of time from Michele Cole has been received and
decided upon, pursuant to Spokane County Subdivision regularion (Chapter III, Section G) and
RCW 58.17.140.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering this
decision by the Spokane Counry Director of Planning.
2. The proposal was to divide approximately 1.6 acres into 21ots for commercial use and those
uses permitted in the Regional Business (B-3) zone.
3. The preliminary short plat was given conditional a roval onAuigusta1,611`9.9i1sby the

4. The proposal is generally located at the northeast corner of Sprague Avenue and Evergreen
Road in the SW 1/4 of Section 14, Township 25 North, Range 44 E.W.M. Spokane County,
Washington.
5. The existing zoning of the property described in the application is Regional Business (B-3),
which remains the same since the original preliminary plat approval and conrinues to conform.
6. The Comprehensive Plan designates this area of the preliminary plat as Major Commercial
(C), and the location is within the Prioriry Sewer Service Area (PSSA) and the Aquifer
Sensitive Area (ASA) Overlay Zone. The Comprehensive Plan designation remains the same
since the original preliminary plat approval and continues to conform.
7. Due to personal hardship resuldng from the death of both the applicant's land surveyor and the
co-owner of the proposed plat, the criteria in Chapter III, Section G of the Spokane County
Subdivision Ordinance used for considering a request for an extension of time of an approved
preliminary plat has been waived in this case by the Planning Director. The applicant has
indicated that a new land surveyor and real estate agent has been obtained and will assist her in
expediting the finalizing of this plat.
8. The purpose of granting an extension of rime is not only to ensure the applicable provisions of
Chapter III, Section G of the Spokane County Subdivision Ordinance have been satisfied, but
to ensure that the proposal complies with any changes in land use policies and regularions that
were adopted after the preliminary plat was appmved, and that any newly recommended
conditions be included in upgrading the original preliminary plat's Condidons of Approval.
9. Additional conditions have been recommended by the various reviewing agencies and
departments, including the County Planning Department, the County Division of Engineering
and Roads, and the Counry Division of Buildings.
10. This is the first request for a time extension. The total life of the preliminary plat has been
approxunately 3 years.
11. The applicant/owner should show substantially greater progress toward complying with
Chapter III, Section G, of the Subdivision Ordinance before requesting an additional
extension of time.
12. A final plat was received by the Planning Department prior to this request for an extension of
time. Moreover, the proposed plat still confoims to the existing zoning and comprehensive
plan designation. Therefore, this request for an extension of time, as conditioned, represents
no significant change in the approved original preliminary plat and will not be adverse to the
public health, safety and general welfare.
13. The Spokane County Arterial Road Plan identifies Evergreen Road as a Principal Arterial with '
a future right of way width of 100 feet. The exisdng right of way width is 40 feet. In order to
implement the Arterial Road Plan, the County Engineer had previously requested a dedication
of 14 feet of additional right of way and a strip of property 16 feet in width along the
Evergreen Road frontage be set aside as a Future Acquisition Area. Due to changed in
conditions, the County Engineer has amended that request and now requires a dedicarion of 25
