SHORT PLAT NO. SP-643-90 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subd.ivision of land, from James Hollingsworth has been
reed and decided upon, pursuant to Spokane County Subdivision regulations, on the
daY of August, 1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide 4.7 acres into 21ots for the development of one additional single
family residence homesite.
3. The proposal is located west of and adjacent to Adams Road approximately 400 feet
south of 24th Avenue.
4. The current zoning of the property is Agricultural. The proposed lot sizes, frontage and
intended uses are aliowed within this zone.
5. The Spokane County Comprehensive Plan designates this ar+ea as Suburban The
development and uses proposed are generally in accord with this category/designation.
6. The r+equ'ved public norice was provided for this praposal and agencies having a potential
interest in the project were notified and recommendations solicited.
7. No one in the area commented on the proposal.
8. The Spokaae County Arterial Road Plan designates Adams Road as a Minor Arterial with
a planned roadway right of way width of 80 feet.
9. Recognizing the recommended conditions and Spokane County developmeot standards,
the proposed subdivision makes appropriate provisions for the public health, safery and
general welfare and that the public use and interest will be served by platting the
suUdivision.
10. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-643-90 is hereby A.PPROVED until September 1, 1993, subject to cond.irions noted
below. Mast of the condidons of approval shall be accomplished by the applicant andlor
sponsor prior to finalization of the short subd.ivision. This decision is final unless
appealed in wridng, consistent with adopted appeal procedures.
These Conditions of Approvat apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for tbe property legally described in the
application for this proposal.
2. The final plat shall be designed substantially in confonnance with the preliminary plat
of record as legally described and adverrised. No increase of density or lot number
shail occur without a new application submittal and approval.
3. The Spokane County Planning Director/designee shall review any proposed final plat to
ensure compliance with these Findings and Conditions of Approval.

4. The preliminary plat is given conditional approval for thr-ee (3) years, specifically tio
September 1, 1993. The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiration date.
5. A final piat nnmber shall be indicated before the final plat is filed, such number to be
appmved by the County Planning Director/designee.
6. Appropriate road name(s) shall be indicated.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies must be received
with the submittal of the final plat.
8. Three (3) curcent certificates of title shall be furnished the County Planning Departrnent
prior to filing the fnal plaL
9. The following statement shall be placed in the final plat dedication: "No more tban one
(1) dwelling structure shall be placed on any lot, nor shall any lot be further subdivided
for the puipose of creating add.itional lots, ownerships or building sites without first
filing and receiving approval of a repiaL "
10. The final plat map shall ind.icate by a clear dashed line the required yard setbacks Erom
all private, "Tract X" or public roads. The dedicatioa shall contain the followiag
statement that: "Side yard and rear yard setbacks shall be deteimined at the time
buildi.ng pertnits are requested. The setbacks indicated on this plat may be varied from
if proper zorung appmvals are obtained."
11. No water plan is required and a simple tap is needed at the time of building pemut
release.

13. Spokane County Planning Departrnent is nequired to recond with the County Auditor a
'"Iitle Notice," as prepam,ti and signed by the applicant, for a future acquisition area for
road right-of-way and udlities to run with the land, and the future acquisition area
reservaaon shall not be removed without prior approval by the Spokane Counry
Planning DepartmenL Notice shall be recorded prior to the recording of the fuial plat
and shall prnvide the following:
a. 8 fe,et of future acquisition area for road right-of-way and utilides, in addirion to the
exisdng right-of-way dedication requined by the County Engineer, along Adams
Road.
b. Building and other setbacks requined by the Spokane County Zoning Code shall be
measured 25 feet from the edge of the Future Acquisition Area that is reserved for
road right-of-way and utilities along west edge of Adams Road.
c. The 8 feet of Future Acquisition Area, until accquired by Spokane County, shall be
private property and may be used as allowed in the zone, except any improvements
(such as landscaping, parking, surface draioage, drainfields, signs or others) shall
be considered "interim" uses.
The property owner shall be responsible for relocaring such "interim"
improvements at the time Spokane County malces roadway improvements after
acquiring said Future Acquisition Area
d. This "Tide Notice" shall be signed by the applicant to seive as official notice and
acknowledgement of said Future Acquisition Area for road right-of-way and
udlides.
CUUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-vvay and approval of the road system as indicated in the
preliminary plat of rocord.
2. Individual driveway access peimits are required prior to issuance of a building permit
for driveway approaches to the county road system.

3. Dedicadon of 12 feet of additional right-of-way along Adams Road is required.
4. Existing county roads provid.ing direct access to the plat shall be paved and/or curbed to
Spokane Counry standards.
5. Sidewalks are required along the arterial on Adams Road.
6. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
7. To construct the road improvements stated herein, the applicant may, with the approval
of the Counry Engineer, join in and be a willing pardcipant in any petition or resolurion
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owoer(s), their heirs, grantees
and assigns.
8. As an alcernadve method of construccing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CR.P) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sancaoned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to exisring
pavement) will be at the sole expense of the undersigned owaer(s), their heirs, grantees
and assigns.
9. The following statement be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a pedtion for the formation of a Road Improvement District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petidon includes the owner(s)'
propeny, and further not to object, by the signing of a ballot, to the fornaauon of an
RID by the resoludon method pursuant to Chapter 36.88 RCW, which resolution
includes the owner(s)' propeny. If an RID is formed by either the petition or resolution
mechod as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agree:
(a) that the impr+ovement(s) or construction contemplated within the proposed RID is
feasible;
(b) that the benefits t4 be derived from the formation of the RID by the property included
therein, together with the amount of any Counry participation, exceed the cost and
expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formarion of an RID by either petition
or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without pamcipation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without conswction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the required improvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execudon of another RID waiver agreement) providing
for or securing to the County the actual construcrion of the improvements.
All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s).

10. The County Engineer has designated Typical Roadway Section Number Two,
Secondary Arterial standard for the improvement of Adams Road, which is adjacent to
the proposed developmenL This will require the addiaon of approximately 11 feet of
asphalt along the frontage of the deveIopment. The construction of curbing and
sidewalk is also required.
11. The proposed private road(s) as shown on the preliminary plat serving one lot with no
extension possible is approved by the County Engineer.
12. Private road(s) shall be unproved to Spokane County standard for a private road
Urban/Suburbaa standard serving one lot, and are subject to approval under Section
10.207 of the Spokane County Fire Code.
13. All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokane County Enginee,r prior to recording with the Spokane County Auditor.
Reconding numbers shall be referenced in the dedicatory language of the plat
14. The following statement shall be placed in the plat dedication:
"WARNING: Spokane County has no responsibility to build, improve, maintain or
otherwise service the private roads contained withi.n or provide service to the property
described in this plat. By acxepting this plat or subsequently by allowing a building
perinit to be issued on property on a private road, Spokane County assumes no
obligadon for said private road, and the owners hereby acknowleige that the County
has no obligation of any kind or nature whatscever to establish, examine, survey,
construct, alter, repair, irnprove, maintain or provide drainage or snow removal on a

15. The proposed plat shall be improved to the standands set forth in Spokane County
Board of Commissioners Resolution No. 80-1592, as amended, which resolution
establishes regulations for roads, approaches, drainage and fees in new construction.
16. The County Engineer has examined this development proposal and has deterrnined that
the impact of this proposal upon the existing county road system wairants the
dedication of additional right-of-way and tlle roadway improvements herein specified.
17. The following statement shall be placed in the final plat dedication: "The private road as
shown hereon is an easement which provides a means of ingress and egress for those
lots within the subd.ivision having frontage thereon."
18. The County Arterial Road Plan identifies Adarns Road as a Minor Arterial. The
existing right-of-way width of 40 feet is not consistent with that specified in the Plan.
In order to unplement the Arterial Road Plan, in addidon to the required right-of-way
dedication, a strip of property 8 feet in width along Adams Road frontage shall be set
aside in reserve. This property may be acquired by Spokane County at the dme when
arterial improvements are made to Adams Road.
COUNTY HEALTH DISTRICT CONDITIONS
1. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health DistricL Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
3. Water service shall be coordinated through the Director of Utilities, Spokane County.
4. Water service sball be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
5. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat
6. Prior to filing the final plat, the sponsor shall demonsorate to the satisfacrion of the
Spokane County Health District that the exisdng on-site sewage disposal system

7. A public sewer system will be made available for the plat/project, and individual service
will be provided to Tract B prior to sale. Use of individual on-site sewage disposal

8. A statement shall be placed in the dedication to the effect that: "A public sewer system
will be made available for the plat and individual service will be provided to Tract B
prior to sale. Use of an individual on-site sewage system shall be authorized only for
Tract A."
9. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
10. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by County and state health authorides and the local fire district and
purveyor, will be installed within this plat, and the subdivider will pr+ovide for
individual domestic water service, as well as fire protection, to each tract prior to sale of
each tracL"
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of Counry Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized for "Lot A". This auchorization is
conditioned on compliance with all niles and regulations of the Spokane County Heslth
District and is further condidoned and subject to specific application approval and
issuance of permits by the Health District.
2. 1'he dedication shall state: "The owner(s) or successor(s) in interest agree to authorize
the County to place their name(s) on a petition for tbe formation of ULID by petirion
method pursuant to RCW 36.94, which the petition includes the owner(s)' property;
and further not to object by the signing of a protest peadon against the fonnation of a
ULID by resolutioa method pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVIDED this condition shall not prohibit the owner(s) or
successor(s) from objecdng to any assessment(s) on the praperty as a result of
improvements called for in conjunction with the fonnation of a ULID by either pedcion
or resolution method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. Applicant will connect "Lot B" to the Public Sewer System. Sewer connection
agreement is requined. Sewer connecaon permit is required.
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. We have no requirements for this proposal - existing conditions.
